Abstract

This study explores the vulnerability of persons with disabilities to sexual violence and the critical role of government intervention in providing psychological and legal support for victims. The Women Empowerment and Child Protection Agency (DP3A) of Bandung City is tasked with addressing such cases. This research aims to analyze DP3A's role in handling sexual violence against persons with disabilities, as well as the challenges and efforts in its implementation. Using a descriptive-analytical method with an empirical juridical approach, the study reveals that DP3A plays a pivotal role through preventive and repressive measures. Preventive efforts are carried out via socialization programs, while repressive efforts include legal and psychological assistance to ensure victims’ rights are upheld. However, challenges such as the limited number of counselors remain, prompting DP3A to collaborate with disability communities and related organizations. Based on Lawrence Meir Friedman’s legal system theory, the handling of sexual violence against persons with disabilities has yet to be fully effective. DP3A’s role is hindered by a lack of disability counselors and persistent societal stigma viewing persons with disabilities as weak. To enhance DP3A’s role, it is recommended to increase the number of counselors specializing in disabilities, intensify public outreach about DP3A’s functions, and provide education to reduce stigma against persons with disabilities. These efforts aim to create a more inclusive and supportive environment for addressing cases of sexual violence involving persons with disabilities

Abstract

This study aims to analyze the causes of delivery delays at PT XYZ. Delivery delays have become a critical issue as they can affect customer trust and result in potential losses for the company. The study identifies two main causes of delivery delays: shipping schedules and the aging (storage time) of goods in the warehouse. The method used in this research is Statistical Process Control, which involves several analytical tools such as P-chart, Pareto diagram, fishbone diagram, histogram, and scatter plot. The analysis results show that shipping schedules have a significant impact on delivery delays, with several delivery periods falling outside the upper control limit and lower control limit. Additionally, goods aging exceeding seven days also contribute to delays. Other influencing factors include human aspects (data entry errors), environmental factors (bad weather and changes in shipping schedules), methods (schedule mismatches), and measurements (inaccurate stock data). The study recommends several improvements to enhance delivery efficiency, including optimizing stock recording processes, strengthening work discipline, and improving human resource quality through operational training.

Abstract

The current technological developments have provided convenience for society in accessing the internet, which can be utilized in various fields, one of which is the economy. In economic activities through digital media, the term "digital economy" is used. Digital economic activities cannot be separated from copyright objects that are traded as goods. Considering that examining copyright issues ultimately leads to the concept of law itself, especially regarding efforts to protect the results of two-dimensional art in the form of Non-Fungible Tokens (NFTs), it is important to address this matter. The buying and selling of NFT art in digital media brings fresh opportunities for artists. However, it also creates problems for some parties in protecting their creations from harmful actions. Therefore, this research aims to understand the legal protection for creators of two-dimensional digital artworks, to facilitate economic activities, and to identify the appropriate legal actions for creators in the event of copyright infringement in digital media. In this research, the author employs a normative research method, focusing on literature and secondary data through a juridical-normative approach that is descriptive and analytical in nature. The study reviews and analyzes regulations related to the core issues at hand. The findings of this research clearly show that, in fact, Indonesian Law Number 28 of 2014 on Copyright and Law Number 19 of 2016 on Amendments to Law Number 11 of 2008 on Electronic Information and Transactions do not comprehensively regulate two-dimensional digital artworks. To address emerging issues, creators can take legal action in the form of filing a compensation lawsuit in commercial courts, submitting criminal reports, or filing a report to the Directorate General of Intellectual Property to request the removal of content and/or access rights if copyright infringement is suspected in digital media.

Abstract

The purpose of this research is to analyze the Legal Challenges in E-commerce Dispute Resolution: Arbitration and Litigation Approaches. This type of research is a literature review, with data collection through documentation. Data analysis is conducted using SLR (Systematic Literature Review). The research findings indicate that the legal challenges in resolving e-commerce disputes involve regulatory complexities that are rapidly evolving amidst the dynamics of online transactions. Arbitration and litigation approaches are the two primary options that parties involved in e-commerce disputes must consider. Arbitration offers speed and confidentiality, while litigation provides a more structured process with public disclosure of information. However, the biggest challenge remains the adaptation of the existing legal system to the dynamics of technological advancements and the continuously growing e-commerce business.

Abstract

This study examines the patterns and norms of negotiation communication that occur in the merariq tradition in the Sasak community of Genggelang village, North Lombok. Merariq is a traditional wedding tradition with a series of complex communication stages, involving a negotiation process between the family of the prospective bride and groom mediated by a pembayun (traditional spokesperson). Using a communication ethnographic approach, this study aims to uncover and analyze in depth the communication components, interaction patterns, and norms that govern the negotiation process in the merariq tradition. The research method used is qualitative with an ethnographic approach of communication. Data collection was carried out through participant observations, in-depth interviews with the participants, traditional leaders, and families involved in the merariq process, as well as documentation of various stages of negotiations. The results of the study show that the communication norms in merariq negotiations have a hierarchical structure and are bound by strict customary rules. Pembayun as a mediator must master the base alus (subtle language) and understand the social stratification of the Genggelang community to be able to carry out their role effectively. The negotiation process includes the stages of selabar (notification), the discussion of ajikrama (traditional values), the determination of pisuke (a gift for the bride's family), and the determination of the time of the wedding procession. Each stage has specific verbal and non-verbal communication norms, including the use of figurative language, sitting positions, gestures, and proper timing in conveying messages. The study also revealed that the success of negotiations is highly dependent on the ability of the participants to manage intercultural communication, given the differences in social and economic backgrounds between the two families. The communication strategies used include a persuasive approach, the use of cultural symbols, and the application of consensus deliberation principles that are deeply rooted in the Sasak tradition. Other findings show a transformation in the practice of negotiation communication, where some aspects have been adapted to the modern context while still maintaining the core values of the tradition

Abstract

The performance measurement system influences the behavior of managers towards the improvement of their performance through performance appraisal in the performance evaluation process. To be an effective control mechanism, a performance measurement system must have the ability to influence managers' behavior towards desired organizational goals, which is in line with the main principles of a management control system. However, the performance measures used in the performance evaluation process must be considered fair by the manager to achieve the manager's intended behavior. The purpose of this study is to examine the effect of controlling objective performance measures on distributive and procedural justice. The proposed framework suggests that controlling objective performance measures is positively related to managers' perceptions of distributive fairness and procedural fairness. The data used is a type of secondary data sourced from the results of previous research that has been published in the form of scientific articles, literature books and official websites related to research related to performance measurement systems, managerial performance, and fairness. The results of this study reinforce the acceptance of the principle of control and its relevance in increasing managers' perceptions of fairness and in turn managerial performance with managers' cognitive perceptions of fairness further showing a positive effect on managerial performance. The results of the study also strengthen the basic premise of social exchange theory by illustrating how managers' perceptions of the fairness of their treatment, in this study, the fairness of the performance appraisal system, are reciprocated with a fairer performance appraisal system so as to produce better performance
