Abstract

The diversity of Indonesia's fauna and flora is quite enormous. Its strategic geographical location makes Indonesia a suitable place for breeding, and creates a good ecosystem for the wildlife species that live in it. However, the diversity and uniqueness of nature and animals are not well supported and protected, especially by irresponsible humans and weak regulations. Environmental conservation and sustainable management of natural resources can be used as the purpose of the juridical foundation to strengthen and clarify the legislation itself, so that there is no legal vacuum or “elastic law” that has no clear benchmark. Therefore, in this research, the community and regulators need to see the internal and external challenges in facing the problems faced by Mother Nature and the ecosystems and animals in it. In this article, the method used is a qualitative descriptive approach and a literature study that becomes the author's reference.

Abstract

Desertion is a military crime involving members of the Indonesian National Armed Forces (TNI) leaving their duties or military obligations without proper authorization from their superiors. Desertion has serious implications for military discipline, cohesion, and operational efficiency, and it can threaten national defense. The legal enforcement of desertion offenses is regulated under the Military Penal Code (KUHPM), particularly Articles 87 and 88. The process of handling desertion cases involves investigation by the Military Police (POM), investigation by military investigators, and trial by military courts that issue rulings according to the applicable laws. The penalties imposed vary, ranging from imprisonment, demotion, dishonorable discharge, and even the death penalty during wartime. This study aims to explore in-depth the implementation of military law on individuals who commit desertion and to analyze the factors causing desertion. These factors include personal issues, psychological pressure, and unfavorable working environments. The study employs a normative juridical method, with an approach focused on relevant regulations and military court case studies concerning desertion offenses. The findings show that the application of military law to desertion is a crucial effort in maintaining the stability, discipline, and integrity of the TNI. However, there are several challenges in enforcing the law, such as internal and external factors affecting military personnel. In the relationship between the Military Penal Code (KUHPM) and the Criminal Code (KUHP), both are complementary, where general crimes are regulated by the Criminal Code (KUHP), while offenses related to military duties are governed by the Military Penal Code (KUHPM). This study recommends strengthening law enforcement and discipline training to minimize desertion within the military.

Abstract

The environment is a very important aspect of human life, which functions as the main source for fulfilling various needs. The environmental problems that occur frequently and are commonly encountered today are water pollution. One of the water sources that is currently very polluted is rivers. This study aims to analyze the factors and impacts of the pollution in the Ciliwung River, and determine the regulations that have been implemented to reduce this pollution. The research method used in writing this paper is the normative legal research method. In this study, the authors used primary legal materials and secondary legal materials. Primary legal materials, namely statutory regulations and official documents containing legal provisions, while secondary legal materials are materials that provide explanations related to primary legal materials. The results obtained in this study indicate that a few factors causing pollution of the river is the lack of awareness of local residents who still throw garbage into the river, as it has an impact on the water quality, public health, damage to the ecosystem around the river and impact on social and economic losses. The regulations that have been issued and implemented by the government to reduce pollution in the Ciliwung River, one of which is the Undang-Undang (UU) Nomor 18 Tahun 2008 tentang Pengelolaan Sampah regulating the waste management in Indonesia. So, the water pollution that occurs cannot be separated from irresponsible human actions or activities and to deal with this, the role of the government is needed to increase public awareness in dealing with this pollution.

Abstract

Gedangsari District is one of the sub-districts in Gunungkidul Regency, Yogyakarta which is classified as underdeveloped. This sub-district has potential but has not developed optimally because its human resource capabilities have many limitations. The livelihood of the people in Mertelu Village is farming. The Mertelu region has a field area of 101.68 hectares which is mostly used by the community to grow bananas. Steep topographic conditions cause people's access to mobility to be hampered. This affects the economic conditions of the community, especially in expanding sales targets for agricultural products. So selling to the public is still within a narrow scope. Most of the banana harvest is only consumed for personal use and sold raw if the harvest is large enough. It is hoped that the development of food products can provide variations in finished products so that they have a high selling value and can cover the shortage of terrain in the Mertelu area. Therefore, an innovative approach is needed in solving socio-economic problems in the village. One of the proposed approaches is community empowerment through increasing skills in banana processing production. It is hoped that this method can make a positive contribution in improving the quality of life of the people in Mertelu Village by empowering women, especially the Batur Indah Women Farming Group (KWT).

Abstract

Bankruptcy is a legal solution that aims to resolve the debtor's inability to fulfill his obligations to creditors, as well as creating fairness in the distribution of assets. However, in practice, the implementation of guarantee execution often faces obstacles in the form of a Niet Ontvankelijke Verklaard (Formal Defect) decision, namely a lawsuit that is declared inadmissible due to non-fulfillment of formal requirements such as a lack of relevant parties (Plurium Litis Consortium), unclear object of the lawsuit (obscuur libel). ), or other administrative errors. This obstacle not only slows down the dispute resolution process, but also disrupts legal certainty, especially for separatist creditors who have special rights over the debtor's collateral. This research aims to analyze the causes of claims being declared Niet Ontvankelijke Verklaard (Formally Disabled) in the bankruptcy process, their impact on the effectiveness of collateral execution, and offer recommendations to improve the efficiency of the legal system. Using normative juridical research methods, this article examines relevant legislation, legal documents and jurisprudence. This analysis shows that these legal obstacles are often caused by a lack of understanding of civil procedural legal procedures, completeness of documents, and inaccuracies in preparing lawsuits. This article recommends improving regulations to clarify formal lawsuit requirements, education and training for legal practitioners, as well as digitizing court administration processes to minimize procedural errors. The implementation of these steps is expected to reduce legal obstacles resulting from Niet Ontvankelijke Verklaard (Formal Defects) and ensure legal certainty in the execution of guarantees in bankruptcy, so that the dispute resolution process can run more fairly and efficiently.

Abstract

In facing national problems such as intolerance and ethnic and social conflicts, Indonesia needs to re-actualize the values of Pancasila, which have been proven as a unifying solution for the nation. Pancasila, as the foundation of the state and the nation's outlook on life, plays an important role in uniting the ethnic, religious, and cultural differences in Indonesia. However, in daily practice, the values of Pancasila tend to be eroded and are more present as formal symbols than behavioral guidelines, thus triggering various disputes between residents. Therefore, the purpose of this community service activity Pancasila is intended to (1) instill Pancasila values in the Pacet Village community; (2) mentor the Pacet Village youth organization as a facilitator of harmony by utilizing social media to campaign for harmony in society. This community service activity is a collaboration between the Pancasila and Citizenship Education Study Program, Surabaya State University with the Pacet Village Government, Pacet District, Mojokerto Regency, and the Mojokerto Regency Interfaith Harmony Forum. This community service activity is a Pancasila Discussion and Creative Content Creation Training for Karang Taruna Pacet Village. The method used is socialization, which provides material about Pancasila as a unifier of the nation, ending with digital content training. Through socialization activities, national insight training, discussions with religious leaders, and training for village officials, efforts to strengthen Pancasila encourage a harmonious life amidst diversity.
