AbstrakHubungan Industrial Pancasila mengacu pada konsep hukum ketenagakerjaan Indonesia yang sarat dengan nilai-nilai Pancasila. Redundansi berarti PHK antara pegawai atau karyawan dengan perusahaan atau kontraktor. Uraian singkat kasus yang penulis lakukan yaitu pemecatan karyawan Garden Palace Hotel Surabaya karena perusahaan dinyatakan pailit oleh Pengadilan Niaga Surabaya, karena buruknya keadaan keuangan perusahaan sehingga tercapai efisiensi. Karyawan yang terkena PHK berhak mendapatkan uang pesangon secara mencicil. Disepakati pada 29 Maret 2021. Namun hasilnya tidak sesuai dengan kesepakatan berdasarkan asas Pancasila bahwa pelaksanaan hak-hak agregat diatur dengan undang-undang. peraturan pemerintah dan kontrak kerja. Dalam putusan tersebut, penulis berkesimpulan bahwa dalam hal ini majelis hakim telah mematuhi Pasal 165 UU No 13/2003 , dimana hak pemberhentian pegawai apabila perusahaan bangkrut adalah: 2x PHK + 1x panjang. biaya layanan + hak pesangon.AbstractPancasila Industrial Relations refers to the concept of Indonesian labor law which is full of Pancasila values. Redundancy means termination of employment between an employee or employees and the company or contractor. A brief description of the case that the author did, namely the dismissal of Garden Palace Hotel Surabaya employees because the company was declared bankrupt by the Surabaya Commercial Court, due to the poor financial condition of the company so that efficiency was achieved. Employees who are dismissed are entitled to severance pay in installments. It was agreed on March 29, 2021. However, the result is not in accordance with the agreement based on the principle of Pancasila that the implementation of aggregate rights is regulated by law. government regulations and employment contracts. In this decision, the author concludes that in this case the panel of judges has complied with Article 165 of Law Number 13 Year 2003, where the right to dismiss employees if the company goes bankrupt is: 2x layoff + 1x long. service fee + severance pay rights.

AbstrakCovernote biasanya diminta oleh para pihak, dalam hal ini adalah bank selaku kreditur serta debitur untuk proses pencairan kredit. Pencairan kredit yang menjaminankan tanah dan memerlukan sertifikat hak tanggungan, umumnya lebih lama prosesnya disebabkan masih adanya proses pengecekan dari Badan Pertanahan Indonesia. Keberadaan covernote diibaratkan sebagai jaminan dari pihak notaris bahwa sertifikat hak tanggungan akan dipastikan selesai selagi bank mencairan dana kredit tersebut. Namun keberadaan covernote hanya sebatas surat keterangan dan bukan termasuk ke dalam akta autentik yang dibuat oleh Notaris, sehingga jika notaris gagal memenuhi apa yang tertera di covernote maka akan sangat merugikan bank selaku kreditur. Tulisan ini didasarkan pada penelitian yuridis normatif, yang mengacu pada literatur hukum menggunakan bahan hukum primer dan bahan hukum sekunder dengan pendekatan konseptual dan pendekatan perundang-undangan. AbstractCovernote are usually requested by the parties, in this case the bank as the creditor and debtor for the credit disbursement proses. Disbursement of credit that guarantees land and requires a mortgage certificate generally takes longer because there is still a checking process from the Indonesian Land Agency. The existence of a covernote is seen as a guarantee from the notary that the mortgage certificate will be guaranteed to be completed while the bank disburses the credit funds. However, the existence of the covernote is only limited to a statement and is not included in the authentic deed made by the notary, so that if the notary fails to fulfil what is stated on the covernote it will be very detrimental to the bank as the creditor. This paper is based on normative juridical research, which refers to legal literature using primary legal materials and secondary legal materials with a context approach and a statutory-regulatory approach.

AbstrakPeran hakim dalam memperkokoh integritas peradilan sebagai benteng penegakan hukum dan keadaban publik di Indonesia. Sistem hukum Indonesia yang mengadopsi elemen dari sistem Eropa Kontinental dan Anglo-Saxon menuntut hakim untuk tidak hanya menegakkan hukum tertulis tetapi juga menyesuaikan dengan dinamika masyarakat dan rasa keadilan yang berkembang. Penelitian ini menggunakan pendekatan kualitatif dengan analisis studi kasus terhadap peran hakim dalam sistem peradilan Indonesia. Hasil penelitian menunjukkan bahwa hakim memiliki tanggung jawab untuk menggali, mengikuti, dan memahami nilai-nilai hukum serta rasa keadilan yang hidup dalam masyarakat. Melalui perannya, hakim dapat meningkatkan integritas pengadilan dan mendapatkan kepercayaan masyarakat. Namun, integritas peradilan seringkali terganggu oleh kasus-kasus korupsi, seperti yang diungkap oleh Komisi Pemberantasan Korupsi (KPK). Oleh karena itu, diperlukan upaya luar biasa untuk membersihkan praktik korupsi di sektor peradilan dan mengembalikan citra lembaga kehakiman. AbstractThe role of judges in strengthening judicial integrity as a bastion of law enforcement and public civility in Indonesia. The Indonesian legal system, which adopts elements from the Continental European and Anglo-Saxon systems, requires judges to not only enforce the written law but also adjust to the dynamics of society and the growing sense of justice. This research uses a qualitative approach with a case study analysis of the role of judges in the Indonesian judicial system. The results show that judges have the responsibility to explore, follow, and understand the legal values and sense of justice that live in society. Through their role, judges can improve the integrity of the court and gain public trust. However, judicial integrity is often compromised by corruption cases, as revealed by the Corruption Eradication Commission (KPK). Therefore, extraordinary efforts are needed to clean up corrupt practices in the judicial sector and restore the image of the judiciary.

AbstrakPenelitian ini mengevaluasi perlindungan hukum yang dapat diakses oleh konsumen dalam transaksi perdagangan elektronik dan metode penyelesaian sengketa yang diterapkan dalam kasus pelanggaran kontrak. Metode yang digunakan adalah pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis, menggunakan data sekunder yang mencakup hukum primer, sekunder, dan tersier sebagai sumber informasi. Analisis data dilakukan secara kualitatif. Temuan penelitian menunjukkan bahwa regulasi hukum terkait perlindungan konsumen E-commerce diatur dalam Undang-Undang No. 8/1999 tentang Perlindungan Konsumen, khususnya pada pasal 19, 20, 21, 24, dan 26. Pelaksanaan perlindungan ini melibatkan kerja sama antara pemerintah, Badan Perlindungan Konsumen Nasional, dan Lembaga Perlindungan Konsumen Swadaya Masyarakat. Untuk menyelesaikan sengketa terkait wanprestasi, hukum menyediakan dua jalur, yaitu litigasi dan non-litigasi, sebagai solusi yang dapat ditempuh. AbstractThis research evaluates the legal protection accessible to consumers in electronic commerce transactions and the dispute resolution methods applied in cases of breach of contract. The method used is a normative juridical approach with analytical descriptive research specifications, using secondary data that includes primary, secondary, and tertiary laws as sources of information. Data analysis was conducted qualitatively. The research findings show that legal regulations related to E-commerce consumer protection are regulated in Law No. 8/1999 on Consumer Protection, specifically in articles 19, 20, 21, 24, and 26. The implementation of this protection involves cooperation between the government, the National Consumer Protection Agency, and the Non-Governmental Consumer Protection Agency. To resolve disputes related to default, the law provides two paths, namely litigation and non-litigation, as solutions that can be pursued.

AbstrakPenelitian ini mengkaji tentang tindakan antidumping pemerintah Indonesia kepada eksportir dari negara lain yang melakukan praktik dumping berdasarkan ketentuan GATT dan bagaimana upaya penyelesaian sengketanya. Tujuan penelitian ini adalah untuk menganalisis akibat hukum dari praktik dumping dan bagaimana penyelesaian sengketa jika negara pengekspor tidak mendapatkan sanksi antidumping. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian menyimpulkan bahwa praktik dumping harus dipelajari terlebih dahulu untuk menentukan apakah kriteria praktik dumping terpenuhi atau tidak. Oleh karena itu, investigasi akan dilakukan oleh instansi terkait dalam hal ini Komite Anti-Dumping Indonesia (KADI). Kemudian KADI akan memutuskan apakah eksportir dari negara lain tersebut terbukti melakukan dumping berbahaya dengan bukti-bukti yang ada. Selanjutnya KADI memberikan sanksi berupa Bea Masuk Anti-Dumping (BMAD). Jika negara tidak menerima sanksi yang dijatuhkan, WTO telah memberikan fasilitas untuk menyelesaikan sengketa perdagangan internasional, termasuk dumping. AbstractThis study examines the Indonesian government's anti-dumping actions against exporters from other countries who practice dumping under GATT provisions and how to resolve the dispute. This study analyzes the legal consequences of dumping practices and how to resolve conflicts if the exporting country does not receive anti-dumping sanctions. The research method used is normative juridical. The study results concluded that dumping practices must be studied first to determine whether the criteria for dumping practices are met. Therefore, the relevant agency, in this case, the Indonesian Anti-Dumping Committee (KADI), will conduct an investigation. Then KADI will decide whether the exporter from another country is proven to have committed dangerous dumping based on the available evidence. They then gave sanctions in the form of Anti Dumping Import Duty (BMAD). If countries do not accept the sanctions imposed, the WTO has provided facilities to resolve international trade disputes, including dumping.

AbstrakPraktik prostitusi di Kabupaten Cianjur menimbulkan dampak penilaian yang kurang baik. Modus yang dilakukan adalah tempat panti-panti pijat, tempat penginapan, vila-vila, dan bungalau, yang terselubung. Permasalahan yang ada faktor-faktor yang mempengaruhi adanya praktik prostitusi di wilayah Cianjur. Upaya-upaya dalam penanggulangan praktik prostitusi di wilayah kabupaten Cianjur dalam konsep budaya hukum. Metode penelitian menggunakan pendekatan yuridis normatif. Hasil penelitian menyatakan faktor terjadinya prostitusi adalah faktor internal seperti rendahnya standar moral dan keimanan, kurangnya keterampilan, keahlian dan pendidikan yang dimiliki, gaya hidup yang konsumtif. Faktor eksternal berupa kesulitan ekonomi, adanya kerjasama dengan masyarakat dan aparat setempat dimana praktik prostitusi tersebut sudah menjadi budaya dan bersifat masip karena semua sektor memiliki asas manfaat bahkan menjadi ladang mata pencaharian bagi masyarakat sekitar (seperti jadi guide, penarik ojeg, sopir mobil rental, menyewakan vila-vila) ataupun bagi aparat penegak hukumnya adanya bakking atau kerjasama dalam pelaksanaan praktik prostitusi, sehingga praktik prostitusi tersebut merupakan suatu jaringan yang terorganisir.AbstractThe practice of prostitution in Cianjur Regency has an unfavorable assessment impact. prostitution is still found in Cianjur. They operate by massaging parlors, lodging places, villas, and bungalau, which are used as locations for covert prostitution. The normative juridical approach are used as a research method. Prostitution still occurred due to several factors such as internal factors and external factors in the form of economic difficulties, cooperation with the community and local officials where the practice of prostitution has become a culture and is masip because all sectors have the principle of benefit and even become a livelihood field for the surrounding community (such as being a guide, ojeg puller, rental car driver, renting out villas) or for law enforcement officials there is bakking or cooperation in the implementation of prostitution practices, so that the practice of prostitution is an organized network in it. The countermeasures use the main legal data assisted by non-legal data such as social / socilogical data, culture, economy, politics, education, religion.

AbstrakTanggung jawab pemerintah daerah tidak hanya untuk memberikan layanan tertentu dengan baik, tetapi untuk mengarahkan masyarakati dalam memenuhi berbagai kebutuhannya. Hal tersebut sejalan dengan sistem pemerintahan daerah atas keuntungan pemberian sistem desentralisasi terutama dalam aspek relasi pusatIdan pertanian adalah kearifan lokal dan keaneka ragaman hayati yang mampu dikelola dengan memberdayakan masyarakat. Metode yang digunakan dalam penulisan ini adalah metode jenis penelitian kualitatif dengan pendekatan yuridis normatif. Hasil penelitian ini imenunjukkan bahwa, kebijakan perlindungan lahan pertanian pangan berkelanjutan merupakan tujuan dari negara dalam rangka memastikan hak atas pangan sebagai hak asasi setiap warga negara dan dalam rangka mewujudkan kemandirian, ketahanan, dan kedaulatan pangan sekaligus mewujudkan kesejahteraan para petani. Tantangan besar bidang pertanian hingga saat ini yang paling utama adalah bagiamana upaya mempercepatikualitas produksi pertanian (tanaman pangan, hortikultura, dan perkebunan). AbstractThe responsibility of local government is not only to provide certain services well but to direct the community to meet its various needs. This is in line with the regional government system on the advantages of providing a decentralised system, especially in the aspect of central and regional relations. One element that can ensure the sustainability of food and agriculture is local wisdom and biodiversity which can be managed by empowering the community.; The methodised in this writing is a qualitative research type method with a normative juridical approach. The results of this study show that the policy of protecting sustainable food agricultural land is the goal of the state in order to ensure the right to food is a human right of every citizen and in order to realize food independence, Resilience, and sovereignty while prospering farmers. The main challenge in agriculture to date is how to accelerate the quality of agricultural production (food crops, horticulture, and plantations).

AbstrakPenelitian ini bertujuan mengkaji urgensi perubahan status Badan Hukum bagi Perusahaan Daerah pasca berlakunya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah dan Peraturan Pemerintah Nomor 54 Tahun 2017 tentang BUMD. Persoalan utama adalah keterlambatan Pemerintah Daerah dan DPRD dalam membahas dan mengubah bentuk hukum melalui perda. Penelitian ini menggunakan metode hukum normatif dengan pendekatan peraturan perundang-undangan dan konseptual. Hasil penelitian menunjukkan banyak BUMD belum menyesuaikan bentuk hukum menjadi Perumda atau Perseroda, yang harus dilakukan melalui perda. Meski Undang-Undang memberi tenggat waktu 3 tahun hingga 2017, banyak DPRD dan Kepala Daerah belum melakukan analisis dan pembahasan. Tidak adanya sanksi dan baru disahkannya Peraturan Pelaksana pada 2017 menjadi kendala. Sebagai contoh, dari 416 BUMD penyedia air minum di Indonesia, hanya 166 yang telah mengubah bentuk hukum pada 2021. Abstract This research aims to examine the urgency of changing the status of Legal Entity for Regional Companies after the enactment of Law Number 23 Year 2014 on Regional Government and Government Regulation Number 54 Year 2017 on BUMD. The main issue is the delay of the Regional Government and DPRD in discussing and changing the legal form through local regulations. This research uses normative legal methods with statutory and conceptual approaches. The results show that many BUMDs have not adjusted their legal form to Perumda or Perseroda, which must be done through local regulations. Although the law gives a 3-year deadline until 2017, many DPRDs and Regional Heads have not conducted analyses and discussions. The absence of sanctions and the enactment of the Implementing Regulations in 2017 are obstacles. For example, of the 416 BUMDs providing drinking water in Indonesia, only 166 had changed their legal form by 2021.

AbstrakPenelitian ini mengevaluasi pentingnya Kesenian yang dapat menjadi kekayaan milik daerah khususnya di Cirebon, seperti Tari Topeng, Sintren, Sandiwara Cirebonan dan wayang Cirebon. Melalui penggunaan metode penelitian yuridis normatif serta perkembangan teori desentralisasi, Temuan penelitian menunjukkan Administrasi daerah diketahui belum mengeluarkan kebijakan urgensi terhadap pendaftaran hak cipta atas kesenian lokal, Peran pemerintah daerah dibutuhkan sebagai aparatur dan media yang memfasilitasi bukan hanya untuk pengembangan namun mengatur kebijakan normatif agar banyak masyarakat yang mengetahui pentingnya pengakuan hukum terhadap kesenian sebagai warisan dan kekayaan daerah yang memiliki nilai ekonomi tinggi. AbstractThis research evaluates the importance of arts in Cirebon City, such as Mask Dance, Sintren, Cirebonan Theater and Cirebon puppetry. AbstrakPenelitian ini bertujuan untuk menganalisa aturan dan kebijakan mengenai Dana Bagi Hasil Cukai Tembakau, yakni sebagai bagian dari pelaksanaan kebijakan desentralisasi sistem pemerintahan atau otonomi daerah, Untuk menjawab isu hukum yang dikaji digunakan metode penelitian hukum normatif dengan pendekatan per Undang-Undangan dan pendekatan konseptual. Data yang digunakan adalah data skunder yang diperoleh melalui penelusuran literatur. Analisa menggunakan metode kualitatif. Hasil penelitian menegaskan bahwa kewenangan pengelolaan Dana Bagi Hasil Cukai Tembakau dilimpahkan kepada para gubernur dari provinsi penerima dan disinyalir menimbulkan persoalan tersendiri di bidang hukum administrasi negara. AbstractThis study aims to analyze the rules and policies regarding the Tobacco Excise Revenue Sharing Fund, which is part of the implementation of the decentralization policy of the government system or regional autonomy, to answer the legal issues studied, a normative legal research method is used with a statutory approach and a conceptual approach. The data used is secondary data obtained through literature searches. Analysis using qualitative methods. The results of the study confirm that the authority to manage the Tobacco Excise Revenue Sharing Fund is delegated to the governors of the recipient provinces and allegedly raises its own problems in the field of state administrative law.
