Abstract

This research focused on performing a comprehensive needs analysis to guide the creation of an e-module aimed at bolstering pedagogical skills within the Microteaching course. The study particularly explored the educational hurdles faced by students, their preferred learning materials, and their expectations for digital learning within the Educational Technology program at Universitas Negeri Makassar. Data collection was facilitated through multiple methodologies, including questionnaires, interviews, and observations, involving a cohort of 20 undergraduate students. The questionnaire was meticulously designed with ten key indicators focusing on various aspects such as learning content, accessibility, interactive elements, and visual attractiveness. Findings indicated that a significant majority of students perceived existing instructional materials as inadequate and unengaging, signifying a critical need for improvements. The highest needs were related to the inclusion of clear learning objectives (93%) and offline usability (92%). These findings indicate that an e-module for the Microteaching course is needed to support flexible, independent, and engaging learning. The results of this analysis serve as a foundation for the subsequent development phase using the 4D model to improve the quality of pedagogical learning.

Abstract

Increasingly progressive digital technology is driving significant changes in business transaction practices, particularly through marketplace platforms. This has led to new innovations widely used by consumers, such as paylater services, which allow payments to be routed through third parties, such as fintech companies. This scheme raises questions regarding the legal standing of the parties in an agreement. This paper discusses the legal standing of the parties by focusing on the concept of passive subjective novation, namely the replacement of the debtor's position in an agreement, as regulated in the Civil Code (KUHPerdata). The research method used is normative law with a qualitative descriptive analysis approach referring to statutory regulations, conceptual frameworks, and actual practices in Indonesia. The results show that in paylater transactions, passive subjective novation occurs, where the consumer, who was originally indebted to the seller, is replaced by the paylater service party as the new debtor, while the consumer shifts into a new obligation to the paylater service. This practice is in accordance with the principle of freedom of contract and is legally valid according to the Civil Code, POJK and the ITE Law.

Abstract

The copyright infringement case involving the singer Vidi Aldiano has drawn significant attention within the study of intellectual property law in Indonesia, particularly regarding conflicts of interest between creators, rights holders, and actors in the music industry. This study aims to analyze the legal dynamics that arise in the context of copyright disputes and conflicts of interest based on the prevailing laws and regulations in Indonesia. The research employs a doctrinal or normative legal approach with qualitative analysis of secondary data, including legislation, legal documents, news reports, and relevant public statements. The findings indicate that weaknesses in collective management systems and the lack of transparency in royalty administration constitute major triggers of conflict. Moreover, the blurred boundaries between personal, professional, and institutional interests within the music industry further complicate dispute resolution. This study recommends strengthening regulatory frameworks, enhancing legal protection for copyright holders, and increasing transparency within collective management organizations in the collection and distribution of royalties. These insights are expected to serve as a reference for policymaking and for future reform of Indonesia’s intellectual property law.

Abstract

This study examines the dynamics of ASEAN as a regional organization in the context of the shifting security paradigm from traditional state-centric security to non-traditional human security, with a specific focus on natural disaster management. Southeast Asia is highly vulnerable to massive, cross-border natural disasters that often overwhelm national capacities. However, the prevailing "ASEAN Way," which emphasizes the principles of absolute state sovereignty and non-intervention, creates significant obstacles to effective humanitarian response, particularly when member states are unable or unwilling to accept aid due to internal conflict or lack of capacity. Using normative legal research methods based on secondary legal materials, this article argues that the principle of state sovereignty must be reinterpreted as a responsibility to protect human rights rather than a barrier to international aid. The study concludes that to resolve human security issues effectively, ASEAN must strengthen the principle of international cooperation and ASEAN centrality. This includes empowering the ASEAN Coordinating Centre for Humanitarian Assistance (AHA Centre) and the ASEAN Secretary-General to play a more active, independent role in decision-making during humanitarian emergencies.

Abstract

This study aimed to assess the critical thinking abilities of 12th grade students on the topic of atomic structure using a complex multiple-choice test instrument based on the Rasch Model. The research found that the instrument was valid and reliable in measuring students' critical thinking skills. The majority of students (75%) demonstrated adequate critical thinking abilities, while 25% faced difficulties, particularly with items measuring inference and explanation. Students performed better on questions related to interpretation and evaluation but struggled with questions that required them to draw conclusions and explain more complex scientific phenomena. These results indicated that while students had a solid understanding of the basic concepts of atomic structure, they needed more practice to improve their higher-order critical thinking skills. Small gender differences were observed, with male students performing slightly better on analysis and inference items, although these differences were not significant. Overall, the findings suggest that while students had a strong foundational knowledge, there is a need for reinforcement through more challenging questions and deeper critical thinking exercises to further develop their critical thinking abilities.

Abstract

This study investigates the emerging phenomenon of AI-dependent learning among university students, focusing on how reliance on generative artificial intelligence tools shapes their academic behaviors, learning motivation, and engagement with course tasks. The rapid advancement of AI applications, such as ChatGPT, has transformed students’ study habits, yet concerns arise regarding excessive reliance that may weaken independent cognitive processes. Using a qualitative descriptive method, this research involved 30 accounting students from State University of Makassar. Participants were selected through purposive sampling to ensure they had substantial exposure to AI-assisted academic work. The findings indicate that AI dependence is commonly driven by academic workload, tight deadlines, a desire for efficiency, and the perception that AI provides faster and higher-quality output. However, overreliance leads to diminished critical thinking, reduced confidence in completing tasks independently, and concerns related to academic integrity. This study highlights the urgent need for universities to establish AI literacy guidelines, promote responsible use, and design learning activities that balance technological assistance with genuine cognitive engagement.

Abstract

This study examines the existence and role of Customary Law in the recognition and protection of collective rights of Betawi Batik motifs as Traditional Cultural Expressions (TCE) and Traditional Knowledge (PK). Betawi Batik motifs have communal values that are vulnerable to exploitation, and literature analysis shows that the formal Intellectual Property Rights (IPR) regime (Copyright and Industrial Design) is inadequate due to its individualistic nature and time constraints. This creates a protection gap against the collective rights of the Betawi community. This normative legal research uses a literature review, focusing on the synchronization of Customary Law norms and positive IPR. The results indicate that the principle of communal ownership and control functions through the Betawi Cultural Institution (LKB) still exist and are relevant. Therefore, this study constructs an integrative sui generis legal protection model. This model rests on three pillars: Communal Registration in the TCE database, Customary Control Mechanisms through BCIapproval, and Strengthening Ex-Officio Protection by the government. This model is expected to realize cultural justice and provide legal certainty for the preservation and commercialization of Betawi Batik in a sustainable manner. Keywords: Betawi Batik, Customary Law, Collective Rights, Traditional Cultural Expressions (TCE), Sui Generis Protection.
