Abstract

The development of information technology has transformed conventional crimes into more sophisticated forms of cybercrime, creating new challenges in law enforcement. One of the emerging issues is the circulation of pornographic images through social media platforms. Therefore, professionalism and expertise of law enforcement officers, particularly investigators from the Indonesian National Police, are required to effectively handle such cases. This research aims to analyze the legal regulation of criminal sanctions against cybercrime involving the distribution of pornographic images on social media and to determine the elements of fault and criminal sanctions as the basis for criminal liability. The study employs a normative juridical research method, focusing on the analysis of statutory regulations, legal principles, court decisions, and legal doctrines related to cybercrime and pornography offenses. The results show that although Indonesia guarantees freedom in accessing information and technology, the state also imposes legal restrictions on activities conducted in cyberspace to prevent criminal acts. The distribution of pornographic content through social media constitutes a violation of decency norms and is subject to criminal sanctions under several legal instruments, particularly the Law on Information and Electronic Transactions (ITE Law) and the Pornography Law. Criminal liability can be imposed when the elements of unlawful acts, fault, and the capability of the offender to be held responsible are fulfilled. Thus, law enforcement against cybercrime involving pornographic content requires strict application of legal provisions to ensure legal certainty, protect public morality, and maintain social order.

Abstract

The increasing number of palm oil theft cases in the jurisdiction of the Kotawaringin Timur Police Resort from January to October 2025 has become the background of this study. This research aims to analyze the law enforcement process against suspects involved in palm oil theft and to identify the factors influencing its implementation based on Decision Number: 286/Pid.Sus/2025/PN Spt. This study employs normative legal research with a case study approach. The analysis is conducted using descriptive qualitative methods based on primary legal materials, including Law Number 1 of 1946 concerning the Indonesian Criminal Code and Law Number 39 of 2014 concerning Plantations, supported by secondary and tertiary legal materials. The results show that law enforcement against palm oil theft suspects in Kotawaringin Timur Regency has been implemented through the application of Article 362 of the Criminal Code and Article 107 letter (d) of Law Number 39 of 2014 concerning Plantations, where the legal elements of the offense have been fulfilled. Several factors influence the effectiveness of law enforcement, including legal regulations, the capacity of law enforcement officers, limitations in facilities and infrastructure, the level of community legal awareness, and cultural perceptions that sometimes consider palm oil harvesting acceptable under customary beliefs.

Abstract

This study examines the concept of restorative justice as an alternative approach to addressing cyberbullying crimes within the Indonesian criminal justice system. The rapid development of information technology has significantly transformed social interactions, while simultaneously giving rise to cyberbullying as a form of psychological violence conducted through digital media. Conventional criminal justice mechanisms that emphasize retributive punishment are often considered insufficient to address the complex social and psychological impacts experienced by victims. This research employs a normative legal research method using statutory and conceptual approaches by analyzing relevant laws, legal doctrines, and scholarly literature. The findings indicate that restorative justice has obtained normative recognition within the Indonesian legal framework through several regulations, including the Juvenile Criminal Justice System Law (Law No. 11 of 2012), National Police Regulation No. 6 of 2019, and Prosecutor Regulation No. 15 of 2020 concerning termination of prosecution based on restorative justice. Therefore, restorative justice offers a more holistic and constructive approach that emphasizes victim recovery, offender accountability, and the restoration of social harmony. This study recommends the development of specific legal regulations governing restorative justice in cybercrime cases and strengthening the capacity of law enforcement officials in digital technology and restorative mediation.

Abstract

This study aims to analyze law enforcement against police officers who abuse narcotics and the application of criminal sanctions and professional code of ethics for such violations. The research method used is normative juridical legal research with a statutory approach and literature study. The results show that police officers proven to have abused narcotics can be subject to criminal sanctions under Law Number 35 of 2009 concerning Narcotics as well as sanctions based on the Police Professional Code of Ethics. However, in practice, the enforcement of the code of ethics has not been fully effective due to several obstacles in the implementation of sanctions and internal supervision mechanisms. Therefore, stricter and more transparent law enforcement is required to maintain professionalism and public trust in the police institution.

Abstract

The rapid development of Artificial Intelligence (AI) technology has created a new paradigm in the spectrum of crime that challenges the existing criminal law framework. This study examines the concept of criminal liability in crimes involving Artificial Intelligence within the Indonesian criminal law system and explores the harmonization of criminal liability doctrines with the juridical complexities arising from AI technology. This research employs normative legal research using statutory and conceptual approaches by analyzing relevant primary, secondary, and tertiary legal materials. The analysis is grounded in the theories of criminal liability and progressive law. The findings indicate that the Indonesian criminal law system faces significant paradigmatic challenges in constructing criminal liability for AI-related crimes. Traditional criminal liability principles based on the doctrine of geen straf zonder schuld (no punishment without fault) encounter difficulties when applied to AI systems characterized by autonomous learning, autonomous decision-making, and the black-box problem. Therefore, an effective legal response requires a paradigmatic transformation from a positivist-legalistic approach toward a progressive legal framework. Such transformation includes the reconstruction of the concept of mens rea, adaptation of causality theories, and the development of negligence doctrines specifically tailored to AI technologies. Furthermore, the proposed harmonization model should incorporate cascading liability, the principle of meaningful human control, restorative justice, and proportional criminal sanctions while maintaining the fundamental principles of Indonesian criminal law.

Abstract

Kepala desa memiliki kewenangan strategis dalam penyelenggaraan pemerintahan desa, termasuk kewenangan mengangkat dan memberhentikan perangkat desa sebagaimana diatur dalam Undang-Undang Nomor 6 Tahun2014 tentang Desa yang telah diubah dengan Undang-Undang Nomor 3Tahun2024. Namun, dalam praktiknya kewenangan tersebut sering dijalankan secara diskriminatif dan tidak objektif. Artikel ini bertujuan untuk menganalisis tugas dan kewenangan kepala desa yang bersifat diskriminatif terhadap perangkat desa berdasarkan Pasal 26 huruf b, Pasal 49 ayat (2), dan Pasal 53 UU Desa, ditinjau dari perspektif hukum tata negara dan fiqih siyasah. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil kajian menunjukkan bahwa tindakan diskriminatif kepala desa merupakan bentuk penyalahgunaan kewenangan yang bertentangan dengan prinsip negara hukum berdasarkan demokrasi Pancasila serta nilai keadilan dan amanah dalam fiqih siyasah.

Abstract

This research aims to analyze and describe the competencies of leading teachers as an effort to improve the quality of education in the implementation of the Merdeka Curriculum at SD Negeri 04 Menanga. The study was conducted at SD Negeri 04 Menanga, located in Menanga Sari Village, Menanga Besar Sub-District, Semendawai Barat District, East Ogan Komering Ulu Regency. The research object focuses on the competencies of leading teachers as a strategic instrument to strengthen educational quality through the application of the Merdeka Curriculum. This research adopts a qualitative approach with a descriptive qualitative method. Primary data sources were obtained from in-depth interviews with the school principal, teachers, and other school community members at SD Negeri 04 Menanga. Meanwhile, secondary data include school documents such as institutional profiles, organizational structures, lists of educators and education personnel, number of students, teacher performance assessments, learning supervision, facilities and infrastructure, as well as teaching schedules. Data collection techniques encompass participatory observation, semi-structured interviews, and document analysis. Data validity is ensured through source and method triangulation. Data analysis is performed qualitatively using typological approaches and SWOT analysis to identify strengths, weaknesses, opportunities, and threats. The research findings indicate that leading teachers at SD Negeri 04 Menanga have successfully implemented the Merdeka Curriculum through student-centered learning, such as differentiated instruction, outdoor activities, and project-based learning. The main supporting factors include support from the government and school stakeholders, while the inhibiting factors encompass resistance from fellow teachers to change and limited digitalization facilities. These findings imply the need for strengthened ongoing training for leading teachers and more adequate resource allocation to optimize educational quality at the elementary school level.

Abstract

Project-based learning at SD Negeri 1 Sukarami is implemented through planning activities, group work, and the creation of tangible products that encourage student creativity. However, its implementation still faces limitations in facilities, time, and teacher readiness, which necessitates various collaborative efforts between the school and parents. This study employed a qualitative approach with a descriptive method. The research subjects included the principal, school supervisors, classroom teachers, students, and the school committee. Data were collected through in-depth interviews, observations, and documentation. Data analysis was conducted through the stages of data reduction, data display, and conclusion drawing. The results indicate that the implementation of the Project-Based Learning (PjBL) method at SD Negeri 1 Sukarami has been carried out in accordance with the main principles of Project-Based Learning, namely student-centered learning through project planning, group-based implementation, the creation of tangible products, and the presentation of learning outcomes. The application of this method has a positive impact on student creativity, as evidenced by increased student confidence in expressing ideas, the emergence of diverse ideas and creative products, the development of divergent thinking skills (fluency, flexibility, originality, and elaboration), as well as increased student motivation and enthusiasm in participating in learning activities.Nevertheless, this study also identified several obstacles, including limited facilities and infrastructure, limited instructional time, differences in teachers’ readiness to implement PjBL, variations in students’ abilities and confidence in group work, and uneven parental support. To address these challenges, the school has implemented various collaborative solutions, including making PjBL a school priority program, providing flexibility in learning time, conducting teacher supervision and mentoring, utilizing simple and locally available materials, and strengthening cooperation with parents and the school committee.

Abstract

This study aims to analyze strategies to enhance the role of Murhum Port as a maritime hub in the Buton Archipelago region. The method used is a mixed-method approach with a sequential exploratory design, in which the research begins with qualitative methods and is subsequently complemented by quantitative methods. The analytical approach employed is SWOT analysis through the identification of internal factors (strengths and weaknesses) as well as external factors (opportunities and threats) that influence port development. The results of the study indicate that Murhum Port has several strengths, including its strategic geographical position on the regional sea distribution route, the support of local commodities, the involvement of third parties, and supportive government policies. However, there are still several weaknesses, particularly in bureaucratic processes, limited modern infrastructure, the need for improved logistics digitalization, and the integration of hinterland access. From the external perspective, opportunities such as strengthening national maritime connectivity, increasing inter-island trade, and the availability of alternative financing schemes serve as key driving factors. Nevertheless, these opportunities are accompanied by challenges, including budget efficiency constraints and dependence on central government policies. The SWOT analysis results show an S–W value of 0.04 and an O–T value of 0.21, placing the port in Quadrant I (progressive growth strategy). Therefore, the development strategy should focus on optimizing external opportunities through the simultaneous and sustainable strengthening of internal capacities to realize Murhum Port as a competitive regional maritime hub.

Abstract

The urgency of this study lies in the need for an empirical understanding of the extent to which parenting styles are related to children's cognitive development, particularly in the environment of TKN Beiposo. This study employed a quantitative approach with a correlational research design. The population consisted of all children aged 4-5 years and their parents. The sampling technique used was saturated sampling, chosen because the population size was relatively small. In quantitative research, the instruments must meet the requirements of validity and reliability. The reliability test obtained a Cronbach’s alpha value of 0.709, indicating that the instrument used in this study is reliable. Therefore, the research instrument has fulfilled the requirements of validity and reliability and is appropriate to be used to test the research hypothesis.
