Taushiah: Jurnal Hukum, Pendidikan dan Kemasyarakatan, aims to promote scientific publications on Law, Education, and Society in its broadest sense covering textual, Historical, and Empirical. Abstract

This study aims to describe and analyze the strategies employed by Islamic Religious Education teachers in instilling the value of hifzh al-lisan (guarding one’s speech) as an effort to anticipate verbal bullying among students at SMP Pancasila Tanjung Beringin. The research was motivated by the tendency of students to normalize ridicule, inappropriate nicknames, and harsh language as part of everyday joking, which may negatively affect students’ character development and psychological well-being. This study employed a descriptive qualitative approach. Data were collected through participatory observation, in-depth interviews with key informants, including the principal, Islamic Religious Education teachers, subject teachers, homeroom teachers, and students, as well as documentation studies. Data were analyzed through data reduction, data display, and conclusion drawing. The findings revealed that verbal bullying commonly occurred in the form of mocking, labeling, and the use of offensive language among peers. Islamic Religious Education teachers addressed this issue through the integration of ethical communication values in classroom instruction, role modeling (uswatun hasanah), personal counseling, and collaborative supervision involving school stakeholders. Supporting factors included strong school leadership and teacher collaboration, while obstacles arose from peer culture, social media influences, and limited parental supervision. Overall, the strategy contributed positively to students’ communication ethics and awareness of respectful interaction.

Abstract

Trademark violations in Indonesia, including counterfeiting, imitation, and unauthorized registration, continue to occur and indicate weaknesses in legal awareness and intellectual property rights enforcement. Such practices cause economic losses to legitimate trademark owners and create unfair business competition. This study aims to analyze the legal protection afforded to registered trademark owners against bad-faith trademark registration and to compare its regulation under Law Number 20 of 2016 concerning Trademarks and Geographical Indications and the Fatwa of the Indonesian Ulema Council Number 1/MUNAS VII/MUI/5/2005 concerning the Protection of Intellectual Property Rights. This research employs a normative legal method using statutory and comparative approaches. The findings reveal that Indonesian positive law provides both preventive and repressive protection through exclusive trademark rights, cancellation mechanisms, compensation claims, and legal sanctions against infringers. Meanwhile, Islamic law recognizes trademarks as a form of property right that must be protected based on the principles of justice, public benefit, and the prohibition of unlawfully appropriating the rights of others. Both legal systems acknowledge the importance of trademark protection, although they differ in their philosophical foundations. The study concludes that positive law and Islamic law complement each other in promoting legal certainty, justice, and fair business practices.

Abstract

This study was motivated by the importance of innovative learning media in improving students’ learning outcomes in Islamic Religious Education. Learning processes that are still predominantly based on conventional methods often limit students’ active engagement, resulting in suboptimal learning achievement. Therefore, this study aimed to analyze the effect of Canva-based learning media on the learning outcomes of eleventh-grade students at Broadcasting Bina Creative (BBC) Vocational High School, Medan. The study employed a quantitative approach with a correlational research design. The population consisted of all eleventh-grade students, while the sample comprised 30 students selected using a predetermined sampling technique. Data were collected through questionnaires and documentation and were analyzed using validity, reliability, classical assumption, t-test, and coefficient of determination analyses with the assistance of IBM SPSS Statistics 25. The findings revealed that Canva-based learning media had a positive and significant effect on students’ learning outcomes, as indicated by a t-test significance value of 0.008 (< 0.05). Furthermore, the coefficient of determination (R Square) value of 0.585 indicated that Canva contributed 58.5% to the improvement of students’ learning outcomes, while the remaining 41.5% was influenced by other factors. These findings confirm that Canva is an effective digital learning medium for enhancing the quality of Islamic Religious Education learning.

Abstract

This study aims to examine the impact of Islamic bank financing on the growth of three key economic sectors in Aceh Province, namely agriculture, forestry, and fisheries; wholesale and retail trade; and manufacturing. These sectors play a strategic role in regional economic development, particularly following the implementation of the Islamic Financial Institutions (LKS) Qanun in 2018. Despite the continuous growth of Islamic financing, questions remain regarding its effectiveness in stimulating sectoral economic growth. This study employs a quantitative approach using quarterly time-series data obtained from the Financial Services Authority and Statistics Indonesia for the period 2016–2023. The Autoregressive Distributed Lag (ARDL) model is applied to analyze both short-run and long-run relationships between Islamic financing and sectoral growth. The findings reveal that Islamic financing has a positive and significant long-run effect on the wholesale and retail trade sector. In contrast, no significant impact is found on the agriculture, forestry, and fisheries sector or the manufacturing sector. These results suggest that the effectiveness of Islamic financing varies across sectors. Therefore, more targeted and sector-specific financing strategies are required to enhance the contribution of Islamic banking to sustainable and inclusive economic growth in Aceh Province.

Abstract

This study aims to analyze and classify the practice of the merariq tradition in Sasak marriages in Kalijaga Village, Aikmel District, East Lombok Regency, West Nusa Tenggara, from the perspective of the legal maxim al-‘ādah muḥakkamah. This research employed a qualitative approach using a field study design. Data were collected through online in-depth interviews, non-participant observation, and open-ended questionnaires administered to individuals who had participated in the merariq tradition as well as community members familiar with its implementation, selected through purposive sampling. The data were analyzed using the interactive model of Miles and Huberman, consisting of data reduction, data display, and conclusion drawing. The findings reveal that the merariq tradition in Kalijaga Village exhibits various forms of practice that continue to be recognized as part of the Sasak community’s cultural tradition. In general, the tradition fulfills the criteria of al-‘ādah muḥakkamah because it is practiced continuously and repeatedly, has been maintained across generations, and is carried out based on mutual community agreement. However, certain variations of the practice involve elements of khalwah, ikhtilāṭ, and excessive premarital interaction that are inconsistent with Islamic law. Consequently, the application of the maxim al-‘ādah muḥakkamah to the merariq tradition is partial and selective. This study contributes to the development of Islamic legal scholarship by proposing a classification of merariq practices based on the perspective of al-‘ādah muḥakkamah, thereby distinguishing between practices that should be preserved, those that require modification, and those that should be abandoned due to their inconsistency with Islamic legal principles.

Abstract

This study examines the revitalization of Islamic Religious Education in the digital era, particularly in addressing the learning characteristics and religious challenges faced by Generation Z. The rapid development of digital technology has transformed patterns of religious learning, information access, and educational interaction, creating challenges related to digital literacy, religious authority, and contextual learning relevance. This research employed a qualitative approach using a library research design by analyzing recent academic literature, official reports, and scholarly publications related to Islamic education, digital literacy, and Generation Z. The findings reveal several major gaps in Islamic Religious Education, including conventional teacher-centered learning methods, limited integration of contemporary issues, low digital literacy among students, and weak collaboration between schools, families, and communities. In response to these challenges, the study formulates a revitalization model consisting of interactive digital learning, integration of contemporary social issues, strengthening of digital literacy, digital andragogical approaches, and multi-stakeholder collaboration. The novelty of this study lies in its integrative framework combining digital literacy, contextual pedagogy, and religious moderation. This model is expected to support adaptive, relevant, and transformative Islamic Religious Education in the digital era.

Abstract

This study aims to analyze the practice of child-rearing wills (wasiat tarbiyah) from the perspective of maqashid al-shariah and its conformity with Article 156(a) of the Compilation of Islamic Law. Children are subjects of legal protection whose continuity of care must be planned by parents, including through testamentary arrangements. However, the practice of wasiat tarbiyah often creates tension with the custodial order (hadhanah) regulated in the Compilation of Islamic Law. This study employs a normative legal method with statutory and conceptual approaches. Primary legal sources include the Qur’an, Hadith, the Compilation of Islamic Law, and classical Islamic jurisprudence texts, while secondary sources consist of scholarly journals and relevant academic books. Data collection is conducted through library research using descriptive-analytical analysis based on maqashid al-shariah. The findings indicate that wasiat tarbiyah has a strong legal foundation in Islamic jurisprudence, although differences exist compared to the formal custodial order in the Compilation of Islamic Law. The principle of the child’s best interest (maslahah) becomes the main consideration, allowing deviations from the prescribed order when it better serves the child’s welfare. From the perspective of maqashid al-shariah, this practice aligns with hifz al-nafs, hifz al-aql, and hifz al-nasl. The study concludes that wasiat tarbiyah is a child protection instrument that should be formally documented in writing to prevent conflicts and ensure the realization of the child’s welfare.

Abstract

The morning Qur’an recitation program is a form of religious habituation aimed at improving students’ ability to read the Qur’an through regular and continuous activities. However, in practice, some students still experience difficulties in reading the Qur’an fluently and correctly, so more targeted efforts are needed to address this issue. This study aims to analyze the implementation of the morning Qur’an recitation program in improving students’ Qur’anic reading abilities at SMP IT Al-Ma’arif NU Pekanbaru. This research employs a qualitative descriptive approach conducted at SMP IT Al-Ma’arif NU Pekanbaru. The research informants consisted of Islamic Education teachers as the main informants, as well as the school principal and students as supporting informants. Data were collected through observation, interviews, and documentation, and analyzed using an interactive model involving data reduction, data display, and conclusion drawing, with validity tested through source and method triangulation.The findings show that the program is implemented regularly with teacher guidance and has a positive impact on improving students’ Qur’anic reading abilities. Supporting factors include program consistency, active teacher involvement, and a religious school environment, while inhibiting factors include differences in students’ abilities, limited instructional time, and low learning motivation. It can be concluded that the morning Qur’an recitation program contributes to improving students’ Qur’anic reading skills and forming their religious habits.

Abstract

The jujuran tradition is a pre-marital practice among the Banjar community that carries social, cultural, and economic values in community life. This study aims to analyze the practice of the jujuran tradition in Banjar marriages in Kapuas Regency from social and cultural perspectives, its impact on marriage intention, and its assessment within Islamic legal thought. This research employs a qualitative approach using field research methods. Data were collected through in-depth interviews, observation, and literature review, and analyzed using the interactive model of Miles and Huberman, consisting of data reduction, data display, and conclusion drawing. The findings show that jujuran serves economic, social, and symbolic functions within the Banjar community. Socially, it strengthens relationships between families, while economically it reflects financial readiness for marriage. However, the practice of jujuran also has an ambivalent impact on marriage intention, as it can function both as motivation and as a barrier. At a proportional level, jujuran encourages marital readiness, but when the amount is excessively high, it may delay or even hinder marriage due to economic limitations. From the perspective of Islamic law, jujuran can be classified as ‘urf shahih as long as it does not contradict Sharia principles, particularly in promoting public welfare and avoiding hardship for those intending to marry. Therefore, the continuity of the jujuran tradition should be managed proportionally to ensure that it remains in harmony with customary values and Islamic legal principles.
