Taushiah: Jurnal Hukum, Pendidikan dan Kemasyarakatan, aims to promote scientific publications on Law, Education, and Society in its broadest sense covering textual, Historical, and Empirical. Abstract

The expansion of the digital economy has given rise to content creators as a new form of employment characterized by fluctuating and unpredictable income patterns. This development presents challenges for the application of a husband’s maintenance obligation (nafaqah) in Islamic jurisprudence, particularly regarding the determination of kifāyah standards, which were traditionally formulated within relatively stable economic contexts. This study aims to examine the concept of maintenance and kifāyah in classical Islamic legal literature and to reconstruct its application within the context of digital content creation. Employing a qualitative normative-conceptual approach, the study relies on a systematic review of classical fiqh sources, contemporary fatwas, and scholarly works on the digital economy. Data were analyzed through the frameworks of maqāṣid al-sharī‘ah, qawā‘id fiqhiyyah, and Islamic legal reasoning (istinbāṭ). The findings indicate that kifāyah is inherently flexible and contextual, emphasizing the fulfillment of essential family needs according to prevailing customs (‘urf) and the husband’s actual financial capacity. In the context of fluctuating digital income, kifāyah is assessed through three interconnected parameters: the lawfulness of income sources, sustainable material adequacy, and income stability supported by prudent financial management and risk mitigation. The study concludes that content creation can constitute a legitimate source of family maintenance when these criteria are fulfilled, thereby offering a contextual framework for contemporary Islamic family jurisprudence in the digital era.

Abstract

This study aims to analyze and classify the practice of the merariq tradition in Sasak marriages in Kalijaga Village, Aikmel District, East Lombok Regency, West Nusa Tenggara, from the perspective of the legal maxim al-‘ādah muḥakkamah. This research employed a qualitative approach using a field study design. Data were collected through online in-depth interviews, non-participant observation, and open-ended questionnaires administered to individuals who had participated in the merariq tradition as well as community members familiar with its implementation, selected through purposive sampling. The data were analyzed using the interactive model of Miles and Huberman, consisting of data reduction, data display, and conclusion drawing. The findings reveal that the merariq tradition in Kalijaga Village exhibits various forms of practice that continue to be recognized as part of the Sasak community’s cultural tradition. In general, the tradition fulfills the criteria of al-‘ādah muḥakkamah because it is practiced continuously and repeatedly, has been maintained across generations, and is carried out based on mutual community agreement. However, certain variations of the practice involve elements of khalwah, ikhtilāṭ, and excessive premarital interaction that are inconsistent with Islamic law. Consequently, the application of the maxim al-‘ādah muḥakkamah to the merariq tradition is partial and selective. This study contributes to the development of Islamic legal scholarship by proposing a classification of merariq practices based on the perspective of al-‘ādah muḥakkamah, thereby distinguishing between practices that should be preserved, those that require modification, and those that should be abandoned due to their inconsistency with Islamic legal principles.

Abstract

This study aims to analyze the influence of self-efficacy on the learning outcomes of Islamic Religious Education (PAI) among eighth-grade students at SMP IT Ar-Rasyid STM Hilir. The research background arises from the phenomenon of varying levels of students’ self-confidence, which impacts their engagement and academic achievement. A quantitative approach with a survey method was employed to measure self-efficacy using a Likert-scale questionnaire, supported by interviews, observations, and documentation of learning outcomes. The population consisted of 94 students, all included as the research sample through saturated sampling. The instrument was tested for validity and reliability using SPSS, yielding a Cronbach’s Alpha of 0.896. Data were analyzed using descriptive and inferential statistics with Spearman’s rho correlation test. Findings revealed that most students had moderate to high self-efficacy, with an average score of 67.73. The average PAI learning outcome was 82.79, categorized as good. The correlation test produced a significance value of 0.044 and a correlation coefficient of 0.208, indicating a positive but low significant relationship between self-efficacy and learning outcomes. These results highlight self-efficacy as an important psychological factor supporting PAI learning success, though outcomes are also influenced by motivation, environment, and teaching methods.

Abstract

Human organ trafficking is a form of crime that contradicts humanitarian principles, positive law, and Islamic values. As an evolving criminal phenomenon, this offense requires a comprehensive legal analysis, including from the perspective of Islamic criminal law. This study aims to analyze the constituent elements of the crime of human organ trafficking and examine the classification of sanctions applicable under Islamic criminal law. The research employs a normative juridical method using both statutory and conceptual approaches. Data were collected through a library research method encompassing legislation, legal literature, scholarly journals, and other relevant sources, which were subsequently analyzed using a descriptive-analytical technique. The findings indicate that human organ trafficking fulfills the elements of criminal liability and, from the perspective of Islamic criminal law, is classified as jarimah taʿzir because no specific sanction for this offense is explicitly prescribed in the Qur’an or Hadith. Furthermore, the study finds that sanctions imposed on offenders may be classified according to the consequences arising from the offense, namely taʿzir, qisās-diyāt, or hudūd, when the crime is accompanied by other offenses that satisfy the legal elements of each respective jarimah. These findings demonstrate the flexibility of Islamic criminal law in responding to the development of contemporary forms of crime.

Abstract

This study examines the revitalization of Islamic Religious Education in the digital era, particularly in addressing the learning characteristics and religious challenges faced by Generation Z. The rapid development of digital technology has transformed patterns of religious learning, information access, and educational interaction, creating challenges related to digital literacy, religious authority, and contextual learning relevance. This research employed a qualitative approach using a library research design by analyzing recent academic literature, official reports, and scholarly publications related to Islamic education, digital literacy, and Generation Z. The findings reveal several major gaps in Islamic Religious Education, including conventional teacher-centered learning methods, limited integration of contemporary issues, low digital literacy among students, and weak collaboration between schools, families, and communities. In response to these challenges, the study formulates a revitalization model consisting of interactive digital learning, integration of contemporary social issues, strengthening of digital literacy, digital andragogical approaches, and multi-stakeholder collaboration. The novelty of this study lies in its integrative framework combining digital literacy, contextual pedagogy, and religious moderation. This model is expected to support adaptive, relevant, and transformative Islamic Religious Education in the digital era.

Abstract

This study examines the hermeneutical elements employed by Imam Ahmad bin Muhammad Ash-Shawi in interpreting Surah Al-Fatihah in Tafsir Ash-Shawi. The research is motivated by the importance of understanding the interpretive methodology of classical Muslim exegetes, which extends beyond literal textual analysis to encompass linguistic, contextual, historical, and spiritual dimensions. The study aims to identify and analyze the hermeneutical elements underlying Ash-Shawi's interpretation of Surah Al-Fatihah. A qualitative approach with a library research design was adopted. The primary data source was Tafsir Ash-Shawi, while secondary data were obtained from classical and contemporary works on Qur'anic exegesis, hermeneutics, and related scholarly literature. The findings reveal that Ash-Shawi's exegetical method integrates several hermeneutical elements, including linguistic analysis, transmitted traditions (tafsīr bi al-ma'thūr), rational argumentation, contextual interpretation, and isyārī (spiritual) as well as Sufi perspectives. These elements are harmoniously synthesized to produce a comprehensive interpretation while remaining grounded in the authority of the Qur'an, the Sunnah, and the opinions of classical scholars. The study concludes that Ash-Shawi's hermeneutical framework is integrative, combining textual, contextual, and spiritual approaches in interpreting Surah Al-Fatihah, thereby demonstrating its enduring relevance for the advancement of contemporary Qur'anic exegesis and hermeneutical studies.

Abstract

This study aims to analyze the practice of child-rearing wills (wasiat tarbiyah) from the perspective of maqashid al-shariah and its conformity with Article 156(a) of the Compilation of Islamic Law. Children are subjects of legal protection whose continuity of care must be planned by parents, including through testamentary arrangements. However, the practice of wasiat tarbiyah often creates tension with the custodial order (hadhanah) regulated in the Compilation of Islamic Law. This study employs a normative legal method with statutory and conceptual approaches. Primary legal sources include the Qur’an, Hadith, the Compilation of Islamic Law, and classical Islamic jurisprudence texts, while secondary sources consist of scholarly journals and relevant academic books. Data collection is conducted through library research using descriptive-analytical analysis based on maqashid al-shariah. The findings indicate that wasiat tarbiyah has a strong legal foundation in Islamic jurisprudence, although differences exist compared to the formal custodial order in the Compilation of Islamic Law. The principle of the child’s best interest (maslahah) becomes the main consideration, allowing deviations from the prescribed order when it better serves the child’s welfare. From the perspective of maqashid al-shariah, this practice aligns with hifz al-nafs, hifz al-aql, and hifz al-nasl. The study concludes that wasiat tarbiyah is a child protection instrument that should be formally documented in writing to prevent conflicts and ensure the realization of the child’s welfare.

Abstract

The integration of religious values into the higher education curriculum has become a critical issue in the development of higher education in the modern era, particularly amid rising moral degradation, intolerant attitudes, and the dominance of an educational orientation that tends toward materialism. Higher education institutions are expected not only to produce academically outstanding graduates but also to foster religious character, moral integrity, and the ability to maintain social harmony within a multicultural society. This study aims to analyse the integration of religious values in higher education curriculum design, its implementation in teaching and academic culture, and its contribution to character formation and religious moderation among students. The research employs a qualitative approach using a literature review (library research). Data were obtained from scientific journals, academic books, and relevant educational policy documents, then analysed using descriptive-analytical content analysis techniques. The results indicate that the integration of religious values is achieved through the development of interdisciplinary curricula, the strengthening of a religious academic culture, and the internalization of religious moderation values within the learning process. This integration has proven effective in shaping students’ character to be disciplined, tolerant, and socially responsible. This study implies the importance of developing a holistic and integrative higher education curriculum to produce graduates who are not only intellectually competent but also morally and spiritually mature.

Abstract

This study develops a conceptual framework for managing teacher psychological well-being within educational institutions. Using a qualitative literature review methodology, the research synthesizes existing knowledge on four key components: professional counseling services, peer support communities, mental health leave policies, and early detection mechanisms for work-related stress. The findings indicate that effective management of teacher psychological well-being requires an integrated system supported by leadership commitment, adequate resource allocation, an organizational culture that encourages openness, and active teacher participation. A preventive approach focused on sustained psychological maintenance proves more effective than reactive strategies that only address problems after they emerge. The study contributes a structured framework that can guide educational institutions in designing and implementing comprehensive support programs. Teacher psychological well-being is not merely an individual concern but a collective institutional responsibility requiring systematic and sustained attention within educational management practices.

Abstract

The morning Qur’an recitation program is a form of religious habituation aimed at improving students’ ability to read the Qur’an through regular and continuous activities. However, in practice, some students still experience difficulties in reading the Qur’an fluently and correctly, so more targeted efforts are needed to address this issue. This study aims to analyze the implementation of the morning Qur’an recitation program in improving students’ Qur’anic reading abilities at SMP IT Al-Ma’arif NU Pekanbaru. This research employs a qualitative descriptive approach conducted at SMP IT Al-Ma’arif NU Pekanbaru. The research informants consisted of Islamic Education teachers as the main informants, as well as the school principal and students as supporting informants. Data were collected through observation, interviews, and documentation, and analyzed using an interactive model involving data reduction, data display, and conclusion drawing, with validity tested through source and method triangulation.The findings show that the program is implemented regularly with teacher guidance and has a positive impact on improving students’ Qur’anic reading abilities. Supporting factors include program consistency, active teacher involvement, and a religious school environment, while inhibiting factors include differences in students’ abilities, limited instructional time, and low learning motivation. It can be concluded that the morning Qur’an recitation program contributes to improving students’ Qur’anic reading skills and forming their religious habits.
