Abstract

The main problem that will be discussed in this wrinting is what is the concept of jihad in the Quran. The problem is discussed using tafsir approach by Maudhu’iy method. The result of this research shows that: a) Jihad is way of struggle to do anything we can do to achieve a specific goal, whether by spoken or real actions. It also means to spread the Islamic teachings and values. Jihad, as it is mentioned in Quran, does not only mean a way to face against the enemy, hardship, or struggle for it, but also an act to eradicate stupidity, poverty and illness, self-control, wisdom and patience to confront all the miserableness; b) Jihad consisted of kinds of jihad, form of jihad, and way to do jihad. Jihad has two kinds. First, fighting the enemies (kafir and munafiq). Second, fighting against the carnality and fighting against the musyrikin opression. There are two forms of jihad, a jihad in the name of Allah and jihad for Allah. Jihad can be committed by Quran, weapon, wealthiness, and life; and c) Jihad is crucial that remind us again of who we are before God, and to estabilish a civilization under the preferences of Allah. Jihad is a pathway to the order. And to do so, struggle is a must. In Quran, jihad will be rewarded jannah (heaven), given a good grade from Allah, and will be fortunate.

Abstract

This paper elaborated on the Substance of the Prohibition of Alcoholic Beverages in the Provincial Regulation of Papua Number 15 of 2013 concerning the Prohibition of the Production, Distribution, and Sales of Alcoholic Beverages in the Manifestation of Maqasid al-Shari’a in Papua. This type of research was qualitative empirical legal research with a normative theological approach, statute approach, and sociological approach. The results showed that the substance of the prohibition of alcoholic beverages in the Provincial Regulation of Papua Number 15/2013 which totally prohibited the production, distribution, sales, and consumption of alcoholic beverages was legally contrary to Presidential Decree Number 74 of 2013. Based on the principle of “Lex Superiori Derogad Lege Inferiori”, the Provincial Regulation of Papua Number 15 of 2013 could be ruled out by the Presidential Decree Number 74 of 2013. Therefore, the Ministry of Home Affairs canceled the Provincial Regulation Number 15 of 2013 because it violated the principle of the hierarchy of laws and regulations. Based on the perspective of maqasid al-shari’a, the regulation of alcoholic beverages in the Provincial Regulation of Papua was a necessity of daruriyyat. Thus, everything to make it happen was also daruriyyat.

Abstract

This research is aimed to discover the meaning of the hijrah hadith; and the implementation of hijrah in the Sahabat Hijrah Makassar Community (the fellow hijrah community Makassar). This is a field-reference research in which the data is obtained from takhrij hadith, observations and interviews. The researcher then reviews and concludes the result. The hadith used in this research are sahih (valid) and contain versatile contents such as the intentions of hijrah, religious practices equals to hijrah, and the the fail of hijrah. The meaning of hijrah according to the Sahabat Hijrah Makassar Community is divided into two aspects. Those are the understanding of hijrah hadith and the understanding of hijrah out of the hadith context, for example, repentance and identity. The living sunnah is a brand new kind of research that is openly acceptable to the hadith research. The absence of model and analysis for this method is expected to florish the living sunnah studies and discourses in Indonesia. The hijrah movement in Indonesia begins with dakwah by the millennials. Therefore, the government is expected to be aware of this communities.

Abstract

This paper elaborates on the Papuan People's Assembly Electing Non-Muslim Leaders in Non-Muslim Majority Areas in the Perspective of Mashid Syari'ah in Jayapura City, Papua Province. The results of this study indicate that the Papuan People's Council (MRP) elects leaders in non-Muslim majority areas in the perspective of maqasid syari'ah in Papua, in its role in the process of organizing the selection of prospective leaders in Papua, has taken away the rights of citizens in general. it is decided by the competent authority of the Papuan People's Assembly (MRP) following what has been decided by formal institutions, such as the General Election Commission (KPU) and traditional institutions that have been given authority according to law. In the provisions of Law No. 21 of 2001 on Papua Special Autonomy, there is no room or space for immigrants. As for the recruitment process for prospective leaders such as Governors and Deputy Governors based on Law No. 21 of 2001 The basic matters that constitute the contents of this Law include the arrangement of authority between the Government and the Provincial Government of Papua and the application of this authority in Papua Province which is carried out with specificity. This law places indigenous Papuans and the population of Papua in general as the main subjects. The existence of the Government, Provincial Government, Regency / City Government, as well as the apparatus under them, are all directed at providing the best service and empowering the people.

Abstract

Allah reveals the Quran as a guidance to those who are pious and those who are not. In Quran, there are some verses that can be easily comprehended, also known as muhkam verses. There are also quite cryptic verses known as mutasyabih. The interpretation of the Quran often be divise, and divided into two groups. The first group derives and uses the mutasyabih verses of the Quran as a reason to spread deception and finding its takwil (original meaning) due to their heart prefers to the misguidance. The second group is them, whom they are the experts and is known as al-Rasikhuna fi al-‘ilm. They interpret the verses of the Quran, bith muhkam and mutasyabih, based on the opinion that all is coming from Allah. Understanding of the Quran making them more faithful, and therefore called as ulul albab. The term al-Rasikhuna fi al-‘ilm in Quran and hadith does not refer to a certain group or person. Hence, the interpretation of al-Rasikhuna fi al-‘ilm by the ulama depends on their mahzab.

Abstract

Zakat is one of the pillars of Islam that is required of all Muslims whose wealth has reached Nisab. The collection of BAZNAS zakat funds in Papua province through several stages, namely through socialization to several institutions both public and private and initially originated from UPZ funds in the Jayapura region. Based on the recapitulation of zakat funds in Papua province through BAZNAS in 2018 amounting to Rp. 963,858,000. The distribution of zakat funds carried out by BAZNAS in Papua province is not only a consumptive way but also in a productive way, this is an effective way for community economic empowerment such as assistance distributed to 5 Papuan Muslims, assistance through BKMT, zakat fostered villages (Ambon and Dobonsolo villages) and empowerment of spinach farmers in Mappi district. In addition to the economic empowerment of the people through zakat there is also the provision of scholarship assistance ranging from elementary, junior high, high school and university, in 2018 a number of 23 people have received scholarship assistance through zakat funds. According to the analysis of researchers that the recapitulation of zakat funds shows that between the receipt of Rp. 963,858,000 and expenditure or distribution of Rp. 438,811,500 were unbalanced, so the discovery by the audit team occurred because the distribution was less than 70%.

Abstract

This paper elaborates in depth on the position of maqasid al-syari'ah towards minority fiqh. This research is a library research, descriptive in nature. This research uses normative (syar'i) and sociological theological approaches. Primary data sources are data obtained through literature studies with primary data taken from the Koran, hadith, jurisprudence books, books that study minority fiqh or others that are related to this research. The results showed that the position of maqasid al-syari ah is the foundation and foundation for the concept of minority fiqh. The format of the rules of maqasid al-syari'ah contained in minority jurisprudence, namely: First: al-taysir waraf' al-haraj (eases and raises difficulties). Second: tagayyur al-fatwa is a change in fatwa. Third: tanzil al-hajah manzilah aL-darurat (Needs occupy an emergency). Fourth: 'Urf or customs in society. Fifth: Annazru ila al-Ma'alat (seeing the legal consequences). Sixth: The congregation as a judge.

Abstract

This article will try to see how the correlation between Human Rights Obligations and Human Rights when viewed in the perspective of Islamic Criminal Law. The theme of Human Rights Obligations, by scientists and the world community, is not an issue that is considered as important as the issue of Human Rights. Even though the Human Rights Obligation is an important point of whether human rights are upright or not. The description of the relationship is in the concept of Islamic criminal law as summarized in al-Daruriyyat al-khamzah (religious preservation obligations, life obligations, obligations to preserve reason, obligations to preserve offspring and obligations to preserve property.

Abstract

Pondok Pesantren Al Mawaddah Warrahmah Kolaka since its inception in 1998. Aims to form a generation of Qurani. During its development, efforts were made to achieve this goal, one of which was to form a tradition of reciting the chosen surah of the Koran after performing obligatory prayers and sunnah, including recitation of surah al-waqiah after performing the Fajr prayer. By using the theory of social construction of reality offered by Peter L. Berger and Thomas Luckmaan in the form of externalization, objectification and internalization phases. The research shows that the reading of the communal pesantren towards surah al-waqiah emits several social meanings, namely: obedience to the Kiai and the rules of the boarding school, expecting blessings from reading the Koran, getting fadhilah from the recited surah, and as mediation in tahsin and tahfiz. on the surah of the Koran that is read.

Abstract

This paper elaborates on the life of the inhabitants of hell in the Koran. This type of research is a descriptive qualitative library research. The approaches used in this research are interpretive, theological, philosophical and semantic approaches. Data were collected using the method of exegesis, namely the maudu'i method, both primary data in the form of Qur'anic expressions starting from the form of verses, clauses, phrases, to vocabulary related to problem studies, as well as secondary data in the form of data. The decline of the Koran, linguistic data, and data relating to the theory of knowledge. The collected data interpreted with textual, linguistic, systemic, and socio-historical interpretations. The results of the research show that the life of the hereafter becomes the belief of every human being that there is life after this world life, which symbolized by the life of heaven and life of hell. The life of the inhabitants of hell depicted in terms of neither living nor dying. This is because their lives filled with torments due to the bad things they do while living in this world and that torture has a bad result in the form of death.
