Abstract

Saat ini, perkembangan hukum Islam semakin baik. Dalam Undang-Undang No. 25 Tahun 2000 tentang Program Pembangunan Nasional Tahun 2000-2004 dikemukakan bahwa arah kebijakan hukum yaitu menata kembali sistem hukum nasional yang menyeluruh dan terpadu dengan mengakui dan menghormati hukum agama yang dianut masyarakat. Kesempatan ini belum bisa dipergunakan oleh ummat Islam secara maksimal, sebab masih ada faktor penghambat yang mesti harus diselesaikan oleh ummat Islam sendiri. Apabila faktor-faktor penghambat hukum Islam itu dapat dihilangkan, maka eksistensi hukum Islam dalam pluralisme bangsa akan tetap eksis.

Abstract

This article discusses zakat for business associations, which requires refinement of the concept and regulations if it is to be implemented in Indonesia. Although it has been discussed by scholars, how it becomes obligatory, what criteria must be met, and how the provisions of nisab,  ḥaul, the obligatory rate, and its implementation are still not receiving significant attention. Furthermore, the lack of clear and comprehensive regulations on zakat for business associations in Indonesia makes this discussion important. Focusing on zakat for business associations, this article will outline the Islamic legal review of zakat for business associations, the provisions of nisab,  ḥaul, the obligatory rate, and its implementation. This article is a literature study whose data is processed qualitatively using a normative-comparative approach. After reviewing relevant literature sources, this paper shows that assets in a business association are subject to zakat if they meet the nisab and haul requirements and are paid on behalf of the owners of the associated assets, not on behalf of the business association. Scholars differ in their opinions regarding the nisab requirements for zakat on business partnerships. Some argue that the nisab and haul should be determined based on the business partnership, while others argue that the nisab should be calculated based on the assets of each participant in the business partnership, not the partnership itself. Artikel ini mendiskusikan zakat untuk serikat usaha yang memerlukan penyempurnaan konsep dan regulasi jika diterapkan di Indonesia. Meskipun sudah dibahas oleh para ulama, namun bagaimana ia menjadi wajib, apa kriteria yang harus dipenuhi, serta bagaimana ketentuan nisab,  ḥaul, kadar wajib, dan pelaksanaannya, belum mendapatkan perhatian yang berarti. Ditambahkan lagi belum jelas dan tegasnya regulasi zakat serikat usaha di Indonesia yang komprehensif, menjadikan diskusi ini penting untuk dilakukan. Berfokus pada zakat untuk serikat usaha, artikel ini akan menguraikan tinjauan hukum Islam terhadap zakat serikat usaha, ketentuan nisab,  ḥaul, kadar wajib, dan pelaksanaannya. Artikel ini merupakan penelitian pustaka yang datanya diolah secara kualitatif menggunakan pendekatan normatif-komparatif. Setelah menelaah sumber-sumber pustaka yang relevan, tulisan ini menunjukkan bahwa harta yang terdapat dalam serikat usaha wajib dikeluarkan zakatnya bila telah memenuhi ketentuan nisab dan hawl dan ditunaikan atas nama pemilik harta yang berserikat, bukan atas nama serikat usaha. Para ulama berbeda pendapat tentang ketentuan nisab zakat serikat usaha. Mereka berpandangan bahwa nisab dan haul dilihat dari serikat usaha dan sebagian berpandangan bahwa perhitungan nisab atas harta masing-masing peserta serikat usaha, bukan pada serikat usaha.

Abstract

The Covid-19 pandemic has been declared over in recent years; however, economic activity—particularly among Micro, Small, and Medium Enterprises (MSMEs)—has yet to stabilize, leading to challenges for some enterprises in fulfilling their credit obligations. Utilizing the maṣlaḥah (beneficial interest) framework, this study aims to evaluate the bad credit restructuring policy for MSME entrepreneurs in Yogyakarta. This research employs a normative juridical approach, incorporating observation, interviews, and document analysis to examine the implementation of Financial Services Authority Regulations No. 17/POJK.03/2020, which addresses bad credit restructuring for MSME entrepreneurs. The findings reveal that the restructuring and relaxation of bad credit measures following the Covid-19 pandemic function as policies intended to facilitate compromise between creditors and debtors amid ongoing economic instability. The study underscores that this policy yields significant benefits for all stakeholders involved and asserts that these benefits align with the concept of maṣlaḥah mu’tabarah (significant beneficial interest), indicating their endorsement and obligation within the Islamic legal framework.

Abstract

The integration between Tasyri's Philosophy and Sharia Philosophy in the context of Islamic law reform in Indonesia is the main focus of this study, especially in understanding how Islamic legal values can be applied effectively in the modern legislation system. The urgency of reforming Islamic law to answer the challenges of the times and the importance of understanding the relationship between the principles of tasyri' – as the basis for the formation of law – and sharia as the entire Islamic legal system that governs the lives of Muslims, are emphasized in the introduction. This research uses a qualitative approach with normative analysis, combining literature studies, the study of classical legal texts, and the interpretation of the views of contemporary scholars in Indonesia. The data obtained were critically analyzed to identify how Tasyri and Sharia Philosophy principles can be adapted into legislation responsive to social changes and the Indonesian context. The study results show that integrating Tasyri' and Sharia Philosophy in the reform of Islamic law in Indonesia allows the application of Islamic law that is more relevant to the needs of the times and enriches the legislation process with a strong ethical and moral basis. The main challenge in this integration is ensuring harmony between classical texts and modern social realities in Indonesia so that Islamic law continues to function as a dynamic and adaptive system, as a representation of religious law. Integrasi antara Filsafat Tasyri' dan Filsafat Syariah dalam konteks reformasi hukum Islam di Indonesia menjadi fokus utama penelitian ini, terutama dalam memahami bagaimana nilai-nilai hukum Islam dapat diterapkan secara efektif dalam sistem legislasi modern. Urgensi reformasi hukum Islam untuk menjawab tantangan zaman dan pentingnya memahami hubungan antara prinsip-prinsip tasyri' – sebagai dasar pembentukan hukum – dan syariah sebagai sistem hukum Islam secara keseluruhan yang mengatur kehidupan umat Muslim, ditekankan dalam pengantar. Penelitian ini menggunakan pendekatan kualitatif dengan analisis normatif, menggabungkan studi literatur, studi teks hukum klasik, dan interpretasi pandangan ulama kontemporer di Indonesia. Data yang diperoleh dianalisis secara kritis untuk mengidentifikasi bagaimana prinsip-prinsip Tasyri' dan Filsafat Syariah dapat diadaptasi ke dalam legislasi yang responsif terhadap perubahan sosial dan konteks Indonesia. Hasil studi menunjukkan bahwa integrasi Tasyri' dan Filsafat Syariah dalam reformasi hukum Islam di Indonesia memungkinkan penerapan hukum Islam yang lebih relevan dengan kebutuhan zaman dan memperkaya proses legislasi dengan dasar etika dan moral yang kuat. Tantangan utama dalam integrasi ini adalah memastikan keselarasan antara teks-teks klasik dan realitas sosial modern di Indonesia sehingga hukum Islam tetap berfungsi sebagai sistem yang dinamis dan adaptif, sebagai representasi dari hukum agama.

Abstract

This study explores traders’ understanding of mamatuik—the traditional skill of estimating the meat weight of live cattle—in buying and selling transactions at the Palangki livestock market. Using a qualitative phenomenological approach with in-depth interviews and observation, the research reveals three levels of trader competence: al-yaqīn, those certain and accurate in estimation (appraisers); al-syak, those partially knowledgeable but doubtful (amateurs); and wahm, those lacking the skill entirely (non-appraisers). This categorization reflects the fiqh maxim اليقين لا يزال بالشك (“certainty is not removed by doubt”), emphasizing that conviction determines trading confidence and continuity. In practice, mamatuik assesses potential meat weight and anchors price bargaining to that estimate, directly influencing a trader’s decision to purchase and the final cattle price. While mutual understanding between buyer and seller supports fair transactions, it cannot fully eliminate defects such as gharar (uncertainty) stemming from ignorance of the goods. External factors also shape the process: the Livestock Service Office provides official weighing facilities that limit reliance on mamatuik, enabling buyers without this skill to use objective measurements instead. Overall, mamatuik represents both a localized non-verbal knowledge system and a practical economic strategy, where the interplay of skill, belief, and regulatory oversight determines market dynamics and the distribution of risk. Penelitian ini mengkaji pemahaman para pedagang terhadap mamatuik—keahlian tradisional dalam memperkirakan berat daging sapi hidup—dalam transaksi jual beli di Pasar Ternak Palangki. Menggunakan pendekatan fenomenologis kualitatif dengan wawancara mendalam dan observasi, penelitian ini mengidentifikasi tiga tingkatan kompetensi pedagang: al-yaqīn, yaitu mereka yang yakin dan akurat dalam perkiraan (penilai); al-syak, yaitu mereka yang memiliki pengetahuan sebagian tetapi ragu-ragu (pemula); dan wahm, yaitu mereka yang sama sekali tidak memiliki keterampilan tersebut (bukan penilai). Klasifikasi ini mencerminkan prinsip fiqh اليقين لا يزال بالشك (“keyakinan tidak hilang karena keraguan”), menekankan bahwa keyakinan menentukan kepercayaan dan kelangsungan transaksi. Dalam praktiknya, mamatuik menilai berat daging potensial dan menetapkan tawar-menawar harga berdasarkan perkiraan tersebut, yang secara langsung mempengaruhi keputusan pedagang untuk membeli dan harga akhir ternak. Meskipun pemahaman mutual antara pembeli dan penjual mendukung transaksi yang adil, hal ini tidak dapat sepenuhnya menghilangkan cacat seperti gharar (ketidakpastian) yang berasal dari ketidaktahuan tentang barang. Faktor eksternal juga memengaruhi proses ini: Kantor Layanan Peternakan menyediakan fasilitas penimbangan resmi yang membatasi ketergantungan pada mamatuik, sehingga pembeli yang tidak memiliki keterampilan ini dapat menggunakan pengukuran objektif sebagai gantinya. Secara keseluruhan, mamatuik mewakili sistem pengetahuan non-verbal yang lokal dan strategi ekonomi praktis, di mana interaksi antara keterampilan, keyakinan, dan pengawasan regulasi menentukan dinamika pasar dan distribusi risiko.

Abstract

The development of neuromarketing as an interdisciplinary approach that integrates neuroscience, psychology, and marketing has created new opportunities for a more precise understanding of consumer behavior. However, from the perspective of Islamic business ethics, an academic problem arises regarding the boundary between legitimate innovation and manipulative practices that harm consumers. Techniques such as scarcity and dark patterns raise serious concerns because they risk undermining the principles of justice, contractual clarity, and consumer consent, which are fundamental in Islamic commercial jurisprudence. This study seeks to examine the position of neuromarketing by referring to the framework of maqāṣid al-sharī‘ah, particularly the dimensions of  ḥifẓ al-‘aql (protection of intellect), ḥifẓ al-māl (protection of wealth), and ḥifẓal-nafs (protection of self), alongside relevant fiqh principles. The research employs a library-based method with a critical analytical approach. Data were collected from contemporary neuromarketing literature, consumer ethics studies, and classical sources in Islamic jurisprudence. The analysis was carried out through a dialectical engagement between modern research findings and Islamic normative principles, resulting in an evaluative synthesis. The findings indicate that neuromarketing can be categorized as a halal by design practice when it is directed towards clarifying information, enhancing consumer literacy, and strengthening transparency. Conversely, it becomes manipulative when it exploits consumer cognitive biases. The primary contribution of this research is the formulation of the Shariah Neuromarketing Ethics Index (SNEI) as an ethical audit instrument applicable to the development of the halal marketing industry in the digital era.

Abstract

This study investigates the academic challenge of reconciling economic development with ecological sustainability in the context of coastal reclamation in Tapakerbau, Sumenep, Indonesia—a process that has generated social conflict, environmental degradation, and distributive injustice. Utilizing the maqāṣid framework, the research employs a qualitative socio-legal methodology, incorporating in-depth interviews, field observations, and analysis of legal documents alongside a review of literature on Islamic environmental jurisprudence (fiqh al-bī'ah). The findings reveal that, despite the brief duration of the reclamation project, it resulted in initial ecological damage, restricted fishermen’s access to coastal resources, and reinforced the dominance of local political and economic elites. This study emphasizes the significance of environmental preservation (ḥifẓ al-bī'ah) as a fundamental objective within the framework of maqāṣid discourse, particularly in the context of contemporary ecological challenges. It highlights the imperative for coastal development models that are inclusive, participatory, and ecologically equitable. Practically, the Tapakerbau case provides a crucial lesson for environmental conservation in Indonesia, emphasizing the importance of addressing sustainable development and environmental justice issues.

Abstract

This paper critically reevaluates the concept of taʿzīr—a discretionary category of punishment within Islamic criminal law—by examining its interplay with capital punishment for drug crimes in Indonesia. While taʿzīr is traditionally regarded as less severe than divinely mandated punishments such as ḥudūd and qiṣāṣ, its contemporary implementation reveals a more intricate and expansive nature. Employing Indonesia’s regulation of narcotics trafficking under Law No. 35 of 2009 (Articles 114 and 119) as a case study, the analysis contextualizes the legal framework within broader social and religious dimensions. The study demonstrates that considerations of maṣlaḥah (public interest), deterrence, and the classification of narcotics offenses as extraordinary crimes serve to legitimize the application of capital punishment. Several indicators suggest that taʿzīr may extend beyond its classical boundaries: the authorization of the death penalty for offenses not explicitly addressed in textual sources, quantitative criteria triggering maximum sanctions, reliance on state sovereignty in defining punishments, and the absence of traditional fiqh-based mitigation mechanisms. By integrating legal, societal, and religious perspectives, this study reveals that taʿzīr in the Indonesian context potentially surpass the severity of ḥudūd and qiṣāṣ punishments, thereby raising critical questions regarding the flexibility and limits of Islamic criminal justice within modern nation-states.

Abstract

Homosexuality, defined as same-sex relationships among men, is not explicitly recognized as a legal ground for divorce under Indonesian marriage law. This study examines how judges interpret homosexuality in divorce proceedings, focusing on a khulʿ case filed by a wife in the Religious Court of Singkawang, West Kalimantan, Indonesia. The case exposes a normative gap between formal legal provisions and the socio-religious realities encountered by Muslim women seeking legal protection. Employing a socio-legal approach and qualitative content analysis of Decision No. 134/Pdt.G/2025/PA.Skw as primary data, the research explores judicial reasoning within the frameworks of discretion and interpretive practice that connect statutory law, Islamic legal principles, and social context. The findings reveal that the judges intentionally characterized homosexuality as “deviant behavior” constituting ongoing marital discord (shiqāq). This reasoning integrates juridical references to statutory law and judicial precedents, theological arguments derived from Sūrat al-Rūm verse 21, and several qawāʿid fiqhiyyah (Islamic legal maxims) emphasizing harm elimination, alongside moral and social considerations that underscore divorce as a means to prevent greater harm. This study advances a theoretical framework of interpretive strategies that bridge normative gaps and illuminate how Islamic family law is adjudicated within the evolving socio-legal landscape of contemporary nation-states.
