Abstract

Hukum selalu hadir untuk mengatasi kejahatan dan menghadirkan kembali keadilan. Urgensi kehadiran hukum mengatasi kejahatan atau ketidakadilan pertambangan terlihat dalam rumusan UUD 1945 Pasal 33 ayat (3). Bahwa bumi, air, dan kekayaan alam yang terkandung didalamnya dikuasai oleh negara dan dipergunakan untuk sebesar-besar kemakmuran rakyat. Keadilan Bermartabat memotret, menggambarkan dan terutama menjelaskan bagaimana eksistensi hukum mengatasi kejahatan maupun pelanggaran atau ketidakadilan yang selalu mengancam eksistensi dunia pertambangan. Suatu contoh dari gambaran Keadilan Bermartabat tentang kejahatan dan kehadiran hukum untuk mencegah dan mengatasi kejahatan dalam bidang pertambangan dalam sistem hukum Pancasila itu antara lain dapat terlihat manifestasinya dalam rumusan ketentuan dalam UU No. 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara. Gambaran Keadilan Bermartabat tentang kejahatan atau ketidakadilan serta upaya untuk mengatasi kejahatan dan ketidakadilan pertambangan antara lain dapat ditemukan dalam rumusan pasal-pasal mulai Pasal 158 sampai dengan Pasal 165 UU No. 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara.The law has always been around to overcome evil and restore justice. The urgency of the ever presence of law in handling mining crime activities could be seen in the 1945 Constitution of the Republic of Indonesia, Article 33 Section 3. It is stipulated that land, water and wealth of it’s natural resources are in the possession of the State and used for the utmost welfare of the people. The Dignified Justice has potrayed, described and particularly explained how the law exists to overcome crimes and offences or injustices which always threaten the mining industries. Among other things, one of the examples ofthe Dignified Justice Theory describes how the law plays it’s role to prevent and solve crimes in the Pancasila Legal System which is in the Law number 4/2009 on Minerals and Coals Mining. The details on the types of crimes and offences on the mining field and all the legal efforts to overcome those injustices might be found in the Articles of 158 to 165 of the Law number 4/2009 on Minerals and Coals Mining.

Abstract

An advocate is a person whose profession is providing legal services both inside and outside the court that meets the requirements based on legislations. In child cases, the role of advocates is needed to provide legal protection for children in order to create a child generation which is free from discrimination, violence and exploitation. The purpose of this research is to analyze various regulations regarding advocate policy in legal assistance on criminal cases, especially on child cases and how the policy is implemented in assisting child cases at the level of investigations in police, prosecutors office and court in Kuningan District. The method used in this research was the Evaluative Analysis method, which is a method of collecting and presenting the obtained data to analyze actual situation and subsequently carry out rational analysis based on juridical references through library and field research. As results, this research found that the regulations applied in providing legal assistance on child cases include; Article 23 paragraph (1) of Law Number 11 of 2012 concerning System of Child Criminal Justice, and Kuningan District Regulation Article 17 Point (b) Number 15 of 2003 concerning Implementation of Child Protection. Moreover, the implementation of advocate policy in assisting child cases in Indonesia has not been carried out optimally both in police, prosecutor's office and court due to the following factors, namely legislation factors, legal apparatus factors, and society awareness factors (legal culture). Therefore, there is a need for reconstruction of legal awareness through education, training and socialization, especially for the law enforcement of child cases. Besides, the societys legal culture regarding the obligation of advocate assistance needs to be improved so that the objectives to provide child protection can be achieved.Advokat adalah orang yang berprofesi memberi jasa hukum baik didalam maupun di luar pengadilan yang memenuhi persyaratan berdasarkan peraturan per Undang Undang. Dalam perkara anak peran advokat sangat di perlukan dalam perlindungan hukum bagi anak yang merupakan bagian terpenting dalam menjaga generasi anak yang bebas dari diskriminasi, kekerasan dan eksploitasi sehingga mampu membangun generasi anak bahagia dan sejahtera. Tujuan penelitian ini adalah untuk mengetahui perbagai peraturan mengenai kebijakan advokat dalam pendampingan hukum dalam perkara pidana khususnya terhadap terhadap perkara anak serta bagaimana implementasi kebijakan peran advokat dalam pendampingan perkara anak di tingkat penyelidikan dan penyidikan di kepolisisan, kejaksaan dan pengadilan Negeri Kuningan. Methode penelitian yang digunakan oleh penyusun dalam pembahasan penelitian ini adalah methode Evaluatif Analisis, yaitu suatu methode mengumpulkan dan menyajikan data yang diperoleh untuk menganalisis keadaan yang sebenarnya dan selanjutnya dilakukan analisis rasional berdasarkan acuan yuridis melalui penelitian kepustakaan dan penelitian lapangan. Hasil Penelitian ini yaitu Pertama,.Pasal 23 ayat (1) Undang Undang nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak, Perda Kabupaten Kuningan Pasal 17 hurp (b) No.15 Tahun 2003 Tentang Penyelenggaraan Perlindungan Anak .Kedua, Implementasi peran advokat dalam pendampingan perkara anak di Indonesia belum dilaksanakan dengan maksimal baik di kepolisian, kejaksaan maupun pengadilan hal ini karena faktor faktor sebagai berikut yaitu Faktor Peratuan Perundang Undangan, Faktor Aparat Hukum dan Faktor Kesadaran Masyarakat (Budaya Hukum). Oleh sebab itu perlu adanya rekontruksi peningkatan kesadaran melalui pendidikan, pelatihan dan sosialisasi terhadap penegak hukum perkara anak maupun terhadap budaya hukum masyarakat tentang kewajiban pendampingan advokat sehinga tujuan keadilan perlindungan anak dapat terpenuhi.

Abstract

The rise of sexual and non-verbal sexual harassment against women by men makes women not have bargaining in criminal law as a victim, this has implications for the psychology of women feeling humiliated, lacking confidence, trauma and fear, due to the above women who are victims of sexual harassment who are unable to carry out their work or even have mental illness, stress or some who commit suicide. The purpose of this study was to determine the legal arrangements for the protection of women due to acts of sexual harassment by men today and how the legal efforts of victims of sexual harassment against women. The methodology used in this study is normative legal research with primary, secondary and tertiary materials such as laws, journals and books. The researcher concludes:  First; There is a need for regulations governing the protection of women, especially regarding acts of sexual harassment. Second; Preventive and repressive efforts are needed to prevent acts of sexual harassment against women in order to protect women so that women are able to rise up, advance, prosperous, happy, independent and contribute to the Family, Nation and State. Preventive efforts can be carried out through socialization, workshops and training on legal awareness of women's protection while repressive efforts include taking action by the police.Keywords: Women, Sexual Harassment, Legal Protection Perlindungan Hukum terhadap Perempuan Korban Pelecehan Seksual di Indonesia Abstrak : Maraknya tindakan pelecehan seksual baik verbal maupun non verbal terhadap perempuan yang dilakukan oleh laki laki menjadikan perempuan tidak memliki bergaining dalam hukum pidana sebagai korban, hal demikian berimplikasi pada pisikologi perempuan merasa direndahkan, kurang percaya diri, trauma dan takut, akibat hal di atas perempuan yang menjadi korban pelecehan seksual yang tidak bisa menjalankan pekerjaanya atau pun ada juga sakit jiwa, stress atau ada juga yang bunuh diri. Tujuan penelitian ini untuk mengetahui pengaturan hukum perlindungan perempuan akibat tindakan pelecehan seksual oleh laki-laki saat ini serta bagaimana upaya hukum korban pelecehan seksual terhadap perempuan. Metodelogi yang dipakai dalam penelitian ini adalah penelitian hukum yuridis normatif dengan bahan primer, sekunder dan tersier seperti peraturan perundang undangan, jurnal dan buku. Hasil penelitian  Pertama; Perlu adanya peraturan yang mengatur mengenai perlindungan perempuan khusunya mengenai tindakan pelecehan seksual. Kedua; Perlu adanya upaya preventif dan represif dalam mencegah tindakan pelecehan seksual terhadap perempuan dalam rangka melindungi para perempuan agar perempuan mampu bangkit, maju, sejahtera, bahagia, mandiri dan berkontribusi bagi Keluarga, Bangsa dan Negara . Upaya preventif dapat dilakukan dengan sosialisasi, workshop dan pelatihan-pelatihan kesadaran hukum perlidungan perempuan sedangkan upaya refresif berupa penindakan oleh aparat kepolisian.Kata Kunci :  Perempuan, Pelecehan Sekual, Perlindungan Hukum

Abstract

AbstractThis article discusses the application of the crime diversion to children in juvenile criminal justice system. So far in the criminal justice system, punishment for perpetrators of children not create justice the perpertrators and victims. On the other hand also still leaves another problem that was not solved even though the perpetrators have been punished. See the principle of the protection of children especially the principle that the best interest of the child. The cild process is required for settling disputes outside the criminal mecanism or commonly referred to as diversion. Settlement through this diversion is expected to provide a win-win solution tho the cases encountered so as to create fairness both in terms of perpertrators as well as for the victim.AbstractThis article discusses the application of diversion in juvenile criminal justice system. So far in the criminal justice system, punishment of juvenile perpetrators of crimes did not create justice for the perpertrators and victims. On the other hand, the system also leaves another problem that has not been solved eventhough the perpetrators have been unished. Noting one of the principles in the protection of children, which is the best interests of the child, criminal cases with children as perpetrators should be settled outside the criminal mechanism generally referred to as diversion. Settlement by way of diversion is expected to create a solution that is balanced so as to create justice for both perpetrators and victims. Nevertheless, the diversion can not be applied to all of the criminal act. Diversion can only be applied in offenses committed by children which are sanctioned by penalty of no more than seven years imprisonment and the offence is not a repetition of crime (recidive).

Abstract

AbstrakSebagai negara yang sudah merdeka selama 68 tahun, Indonesia seharusnya sudah mempunyai sistem hukumnya sendiri yang sesuai dengan kepribadian bangsa Indonesia. Sistem hukum Indonesia tersebut harus dibangun berdasarkan Pancasila yang menampilkan karakteristik ke-Indonesia-an di tengah-tengah sistem hukum lain di dunia. Sistem hukum Pancasila merupakan suatu sistem hukum yang bermoral dan bermartabat. Bermoral berarti bahwa sistem hukum di Indonesia sistem hukum yang merdeka dari korupsi. Sedangkan sistem hukum yang bermartabat adalah sistem hukum yang menjunjung nilai-nilai kemanusiaan terutama di bidang HAM.AbstractHaving been independent for 68 years, Indonesia should have had its own legal system that suits the character of the Indonesian nation. Indonesias legal system have to be constructed based on Pancasila which reflects all the characteristics of Indonesia particularity in the midst of other legal systems in the world. The legal system based on Pancasila is a legal system that emphasizes moral and human dignity. Legal morality means that the legal system in Indonesia is free from corruption. While the legal system with dignity is a legal system that upholds the values of humanity, especially in the field of human rights.

Abstract

Problematika Pemberlakuan Pembatasan Kegiatan Masyarakat Dalam Perspektif Teori Hukum Keadilan Bermartabat. Adanya pembatasan kegiatan masyarkat selama pandemi covid-19 telah menimbulkan berbagai permasalahan yang rumit. Kepatuhan terhadap regulasi dan kebijakan pemerintah dalam mencegah penyebaran virus telah banyak diabaikan, sehingga diperlukan kebijakan dengan pendekatan teori keadilan sosial bermartabat yang mampu menarik simpati warga negara dan masyarakat Indonesia. Sehingga mereka mau melaksanakan peraturan-peraturan yang diberlakukan pemerintah dan menyadari kepentingan peraturan itu sendiri dalam mencegah wabah lebih jauh serta bersedia menaati aturan-aturan dengan tersebut dengan penuh kesadaran dan demi kepentngan bersama karena sesungguhnya pembatasan kegiatan masyarakat dalam masa pandemi saat ini, dilakukan untuk memanusiakan manusia agar selalu sehat, sehingga upaya pemerintah dalam mencegah penyebaran virus covid-19 mendapat dukungan dari warga negara masyarakat Indonesia dengan penuh kesadaran untuk mematuhi segala bentuk protokol kesehatan yang telah ditentukan.

Abstract

The regulation of termination of prosecution based on efforts to stop prosecution based on Perja Number 15 of 2020 is an embodiment of the concept of restorative justice as an effort to peacefully settle criminal cases outside the trial. Termination of prosecution with the condition that compensation to victims is included as a form of restorative justice because the restoration of conditions resulting from criminal acts that occurred is the main focus of case settlement and the result of the second study is an effort to stop prosecution based on Perja Number 15 of 2020 in terms of the perspective of the Dignified Justice Theory that in justice what Pancasila wants is dignified justice. As initiated by Teguh Prasetyo, justice refers to divine values and places humans as creatures of God who have basic rights and obligations that must be upheld. One of them that puts forward a dignified theory of justice is restorative justice in the termination of prosecution as stated in Perja Number 15 of 2020. In the author's opinion, the termination of prosecution with the concept of restorative justice needs to be prioritized considering that a case must also be seen from the side of justice and in this case the Prosecutor's Office can give an example that the prosecution is not carried out unilaterally, but sees it from the other side, namely by using one's conscience.

Abstract

This study aims to answer three main problems, namely: (1) How the provisions of the deadline for execution on the death row prisoners in the Indonesian justice system?; (2) What method of execution on death row prisoners in the Indonesian justice system?; and (3) How is the policy of capital punishment in Indonesia in the future?. This research uses the primary, secondary and tertiary legal materials. The research methods being used in this research is normative method with the application of the statute approach, the case approach and the comparative approach. The results of this study shows the following conclusions: (1) the criminal law system in Indonesia is not set the deadline for execution on death row prisoner who had obtained a court decision that is legally binding and or the clemency petition has been rejected signal by the president; (2) The method of execution that has been implemented in Indonesia is a method of firing squad the u.s. stipulated in Law No. 2/Pnps/1964; (3) The policy the SE for the death penalty law in Indonesia in the future will not be shifted away from the current state.

Abstract

Trial proving in Indonesia has always been limited to Criminal Procedural Law and other regulations. Following the recent development of electronic criminal case trials, there has not been any precise regulation aside from Supreme Court Regulation 4 of 2020. The contradiction between KUHAP and Supreme Court Regulation causes problems, especially regarding trial proving. The purpose of the paper is to provide a legal solution to the problem of the legal emptiness regarding the regulation of trial proving in electronic criminal case trials from the perspective of Dignified Justice that will provide advantageous, responsive, and adaptive justice towards the needs of the community. The methodology of this research is based on normative research. The normative research methods used in this research are the statute approach, normative approach, and comparative approach. The result showed there shouldn't be a conflict between the effect of KUHAP and Supreme Court Regulation. Yet, the regulation of trial proving in an electronic criminal trial should be regulated at a statute level.

Abstract

Illicit used of intellectual property protection of indigenous peoples which are increasingly exploitative and leaving the existing values, and it’s happen over the world. Paradox government need it for raw material in creative economic but there’s no law to protect. The aim of this study is to describe dilemma of law patronage for Intellectual property of Indigenous People. Method for this study used library research. The values of justice in the use of traditional cultural expressions are carried out proportionally and balanced by harmonizing the values of individuals with communal values. Based on it ought to palladium with legal system that preserve behalf indigenous peoples in order to achieve legal objectives (Justice, certainty and expediency).
