Abstract

There have been an existing problem in Indonesia. We have been told that Indonesia’s social security system, particularly its national health social insurance (JKN) is not equipped to deal with the health and economic shocks associated with a pandemic such as Covid-19. In this article we look at how Indonesia must prepare to face a possible chalanges, post Covid-19 Pandemic. We argue that the government need to focus on a clear legal strategy to address the medium-and longer-term implications of a pandemic such as Covid-19. Since the pandemic has ended, appart from technicals efforts such as continuing reducing the rate endemic of infection through effective testing and tracing and enforcing social distancing and mobility restrictions, the government need to reform the JKN in order to be able to support all the populations particularly the poor and near-poor. A legal philosophy for the reform scheme is needed to reducing long-term poverty and preventing structural changes in unemployment that undermining the JKN. As a report of a legal research, this paper used normative methodology to examine primary legal material such as legislations pertaining to the JKN. It has been found that the Covid-19 pandemic undermines the JKN in the form of legislations regulating this particular field, and it is needed to be reformed.Keywords: Indonesia, Social Health Insurance, Dignified Justice Jurisprudence.

Abstract

The regulations about general elections in Indonesia are Act No. 7 of 2017, it was created to address issues in the conduct of elections which are binding on all elements involved in the conduct of elections with the provision of sanctions that can be given to the violators. The application of sanctions includes criminal sanctions (election crime). This regulation does not have any rules regarding criminal liability of political parties which implement money politics and due to the absence of such regulations, the implementation of elections is not based on the concept of elections with integrity and not yet fair and dignified.

Abstract

Since the promulgation of Act No. 14 of 2005, teachers are given the authority to sanction their students who violate norms, both religious norms, moral norms and school rules, whether written or not. However, teachers who provide sanctions in the form of violence are often faced with legal problems, because they are considered to have violated under the provisions of Article 54 of Act No. 35 of 2014 concerning Child Protection. Act No. 14 of 2005, precisely Article 39 has regulated Legal Protection for teachers, however the regulation only provides protection for teachers from acts of violence from other parties, explicitly teachers as victims not as perpetrators, so the teachers are often faced with law enforcement officers and even upfront of the court, as perpetrators of crimes in general. So teachers who commit violent acts intended to discipline their students often lose their glory and nobility. Which results in the teacher becoming indifferent to the development of the personality of his students. The glory and nobleness of the teacher as a lamp of character-forming life collapses when faced with law enforcement officers. Thus, the regulation of legal protection for teachers who commit acts of violence in the educational environment has not been based on the value of justice and dignity

Abstract

This article was writting to describe government policies in upholding educational rights, especially during a pandemic with its implementation in the field of education according to the theory of dignified justice. Qualitative descriptive method was used in reviewing the problems described, using content analysis method, namely examining the contents of the document. The theoretical basis is used as a guide to adapt the research approach to reality. For the sake of simplicity, qualitative method sources are used in reference studies from various existing research results. The data analysis method uses deductive analysis techniques that use logic to draw one or more conclusions based on a particular field. The role of the state and citizens in dealing with the covid-19 pandemic, especially in the field of education, needs to be synchronized so that citizens, especially middle and lower education, SMA to SD and Kindergarten, the role of parents is very important in the continuity of the online learning process because the teacher's role has changed completely from the beginning. dominated by schools when learning is online, the role of teachers and schools is reduced. This raises its own problems so that the responsibility for education is a shared responsibility in terms of supervision in using online learning media, because this is a disaster category so that human rights violations do not occur, it is necessary to change the view of education that is handed over to schools now it is a shared responsibility so that create a dignified education. The government's policy to protect people's education is always implemented by making education a priority work program of the government, among other programs. This means that the education budget is in accordance with the 1945 Constitution of the Republic of Indonesia Article 31 paragraph (4), "The state prioritizes the education budget at least twenty percent of the state revenue and expenditure budget as well as from the regional revenue and expenditure budget to meet the needs of national education administration.

Abstract

Sexual offense is a serious crime which could pose significant negative impacts on personal level and community. When committed by minors, sexual offense becomes a much more complicated problem and raises many different intricacies. Despite being a popular topic within the legal sphere, restorative justice in Indonesia still has research gap, particularly on the focus of applying restorative justice measures for juvenile sexual offenders. The purpose of this research is to address this research gap and analyze the potentials of using the restorative justice approach to deal with sexual offense cases committed by minors, with the focus of impacts, recovery, and preventing future recidivism. Using the normative legal research method his research dives into the Indonesian legal system to uncover the legal problems that may hinder or discourage people from using this approach, despite the potentials benefits it possesses. Through the statutory approach, this research finds the links within the relevant laws and regulations that may or may not support the use of restorative justice approach to deal with juvenile sexual offenders. The analysis of this finds that the restorative justice approach is indeed beneficial and can help Indonesia in dealing with this issue by not only focusing on delivering justice and recovery the victims, but also holding offenders responsible without sacrificing their youth development and their future.

Abstract

The purpose of this study is to examine how artists’ exclusive rights are protected by law. The empirical legal method was used for the research. The study found that if a law or regulation regulates the protection of a creation’s exclusive rights, it is certain that there will also be legal remedies for violations of the problem of using other people’s creations without permission. These legal remedies can be taken in either litigation or non-litigation. If the effort is made through litigation, namely by filing a lawsuit to the commercial court or can be prosecuted criminally, this is already included in the Copyright Law, or by a resolving. In light of the conversation above with respect to legitimate security of the select privileges of makers of compositions, the public authority ought to have the option to make sense of additional explicitly in the items in the Intellectual property Regulation in regards to canvases that poor person has been made sense of top to bottom, and there ought to be more effort to the public so that individuals are all the more endlessly figure out the presence of lawful security for work or creation. Perlindungan Hukum Hak Eksklusif Karya Lukis. Tujuan dari penelitian ini adalah untuk mengkaji bagaimana hak eksklusif seniman dilindungi oleh hukum. Metode hukum empiris digunakan untuk penelitian ini. Kajian ini menemukan bahwa jika suatu peraturan perundang-undangan mengatur tentang perlindungan terhadap hak eksklusif suatu ciptaan, maka dapat dipastikan juga akan ada upaya hukum atas pelanggaran terhadap masalah penggunaan ciptaan orang lain tanpa izin. Upaya hukum ini dapat ditempuh baik secara litigasi maupun non litigasi. Apabila upaya tersebut dilakukan melalui litigasi, yaitu dengan mengajukan gugatan ke pengadilan niaga atau dapat dituntut secara pidana, hal tersebut sudah termasuk dalam Undang-Undang Hak Cipta, atau dengan cara penyelesaian. Sehubungan dengan percakapan di atas sehubungan dengan keamanan yang sah dari hak pilih pembuat komposisi, otoritas publik harus memiliki pilihan untuk menjelaskan secara lebih eksplisit dalam item dalam Peraturan Kekayaan Intelektual tentang kanvas yang dibuat oleh orang miskin. dimaklumi dari atas ke bawah, dan harus ada upaya yang lebih kepada masyarakat agar setiap individu semakin mengetahui adanya jaminan hukum atas suatu karya atau ciptaan.

Abstract

Wewenang dan tugas DPD-RI yang baru itu diatur dalam Pasal 249 ayat (1) UU tentang Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, dan Dewan Perwakilan Rakyat Daerah (UU MD3). Kewenangan dan tugas DPD-RI dimaksud adalah melakukan pemantauan dan evaluasi terhadap Rancangan Peraturan Daerah (Ranperda) dan Peraturan Daerah (Perda), yang dilaksanakan dalam kerangka harmonisasi legislasi antara Pusat dan Daerah. Penelitian ini dilakukan dengan metode penelitian hukum normatif (legal research) merupakan studi dokumen yang menggunakan sumber bahan hukum berupa peraturan perundang-undangan, keputusan/ketetapan pengadilan, kontrak/perjanjian, teori hukum, dan pendapat para sarjana. Wewenang dan tugas baru DPD-RI sebagai rezim hukum lembaga perwakilan dalam Pasal 249 ayat (1) huruf (j) UU MD3 adalah tugas pengawasan atas Ranperda dan Perda, yang sudah urgen untuk segera direalisasikan. Seperti telah dipahami oleh Pimpinan DPD-RI, adanya kewenangan dan tugas yang baru dari DPD-RI tersebut adalah adanya tuntutan untuk memperbaiki mekanisme pemantauan dan evaluasi rancangan Perda dan Perda yang selama ini telah diatur dalam berbagai peraturan perundang-undangan dengan adanya keterlibatan DPD-RI. Sudah tepat, bahwa keterlibatan DPD-RI sebagai lembaga perwakilan daerah, termasuk dalam ruang lingkup lembaga perwakilan di Indonesia, dengan fokus pada integrasi dan ekspresi kepentingan masyarakat dan daerah. DPD -RI melalui wewenang dan tugas yang baru harus terus memposisikan konteks pemantauan dan evaluasi (melakukan pengawasan atas Ranperda dan Perda dalam kerangka representasi daerah).

Abstract

Settlement of gross violations of human rights might be pursued by choosing two “paths” provided. The first “path” is via the Human Rights Court. This route is also called litigation settlement. The second path is an alternative “path”, and has been coined as the out of the Human Rights Court settlement. The problem is the Constitutional Court states that the alternative “path” as referred to in the Explanation of Article 47 of the Law on Human Rights Courts is contrary to the Constitution. As a result of the issuance of the Constitutional Court decision, the alternative “path” seems to be in a state of limbo, and this presupposes a legal issue of the lack of clarity on the meaning of a formulation of the applicable statutory provisions. In this paper, it is argued that Article 47 of the Law on Human Rights Courts still recognizes two “paths” for solving or settling cases of gross violations of human rights in the Pancasila legal system. The research method used in this paper is normative legal research, often known as the pure legal research method. It examined the primary legal materials. The theory used for understanding and explaining the problem is the Dignified Justice theory, the Indonesian Jurisprudence.

Abstract

Akses terhadap obat-obat esensial yang aman, efektif, dan terjangkau telah menjadi salah satu masalah utama dalam sistem kesehatan global, di mana terjadi ketidakadilan struktural yang mendalam antara negara maju dan berkembang. Tantangan ini tidak hanya menyangkut aspek ekonomi dan distribusi, namun juga berkaitan erat dengan nilai-nilai etika, moral, dan martabat manusia. Artikel ini mengeksplorasi perumusan kebijakan akses obat global dapat diperbaiki dengan menggunakan pendekatan teori keadilan bermartabat.1,2 Analisis teoretis dan praktis tentang bagaimana keadilan bermartabat dapat membantu mengatasi ketimpangan akses terhadap obat akan dibahas secara komprehensif, di mana nilai utama konsep ini adalah kepastian bahwa martabat manusia ditinggikan.. Artikel ini pada akhirnya akan mengusulkan model kebijakan yang responsif terhadap tantangan etika dan sosial, di samping memberikan rekomendasi strategis bagi pemangku kebijakan untuk menciptakan sistem kesehatan yang lebih berkeadilan dan manusiawi.

Abstract

This study aims to analyze the provisions in Law of the Republic of Indonesia Number 17 of 2023 concerning Catastrophic Disease Control, especially related to the financing of the National Health Insurance (JKN) based on the principle of dignified justice. This study uses a normative legal method with a legislative and comparative approach, as well as descriptive-analytical specifications. The analysis was carried out by examining related regulations, government responsibilities, and comparative studies with other countries such as the United States, England, Canada, and Australia. The results of the study indicate several challenges in the implementation of catastrophic disease control in Indonesia, especially in financing through JKN. Although Law Number 17 of 2023 has provided a comprehensive legal framework, there are gaps in the efficient use of JKN funds and disparities in access to health services between urban and rural areas. In addition, this study also found that the role of the government as a regulator and service provider creates potential conflicts of interest. Based on the legal analysis conducted, policy recommendations are proposed to improve the regulation and implementation of catastrophic disease control through improving institutional structures, increasing financing transparency, and strengthening the role of government in ensuring fair and quality access.
