Abstract

Dalam Peraturan Menteri Kesehatan Nomor 24 Tahun 2022 tentang Rekam Medis Elektronik mewajibkan semua fasilitas pelayanan kesehatan menjalankan sistem Rekam Medis Elektronik (RME). Terdapat kendala – kendala seperti kesulitan dalam mengumpulkan data dari berbagai sumber yang tersebar di departemen-departemen berbeda dan potensi bocornya data rekam medis elektronik. Permasalahan dalam penelitian ini yaitu Bagaimana pengaturan kerahasiaan medik dalam Permenkes No. 24 Tahun 2022, dan Bagaimana tanggung jawab hukum Pemerintah dalam perlindungan rekam medis elektronik yang bocor dan merugikan hak-hak pasien? Jenis penelitian yang akan digunakan dalam tulisan ini yaitu yuridis normatif, mengacu kepada norma-norma hukum yang ada dalam Perundang-Undangan. Pendekatan yang digunakan yaitu Pendekatan Undang-Undang dan Pendekatan Konseptual serta data yang diperoleh yaitu data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian ini menunjukan bahwa Pemerintah bertanggungjawab dalam hal pengaturan kerahasiaan medis dan kebocoran data pasien di rekam medis elektronik dengan cara Regulasi dan Pengawasan, Pencegahan dan Deteksi Keamanan Data, Penegakan Hukum, Bantuan dan Pemulihan, serta Evaluasi dan Perbaikan Sistem.

Abstract

The Unitary State of the Republic of Indonesia (NKRI) as a legal state based on the Almighty God has an obligation to protect the rights of its citizens, including press freedom. Press freedom, as the fourth pillar of democracy, is guaranteed by the 1945 Constitution and Law of the Republic of Indonesia Number 40 of 1999 on the Press, which guarantees the right to obtain and disseminate information. However, recent laws such as Law No. 19 of 2016 on Electronic Information and Transactions (ITE Law) and its revision in Law No. 1 of 2024, along with provisions in the Criminal Code, pose potential norm conflicts with press freedom. Articles in the ITE Law are often used to curb press freedom, contrary to the Press Law which provides legal protection for journalistic activities. This research uses a normative legal method to analyze the conflict of norms between the ITE Law, the Criminal Code, and the Press Law. Through this approach, the research examines how legal principles such as Lex Superior Derogat Legi Inferiori and Lex Specialis Derogat Legi Generalis can be applied to resolve conflicts and ensure effective protection of press freedom within the Indonesian legal framework

Abstract

The fundamental issue in every general election, for instance the Indonesia’s 2024 election, is the existence of stipulated principle of neutrality of the State Civil Apparatus (SCA) in election laws. The principle has been in conflict with the highest values which should govern it. The purpose of this research is to describe and discuss the idea or effective legal theory for solving the conflict of SCA with the highest values that should govern it. The research applied the Indonesian legal theory known as Dignified Justice to navigate the finding. The methods used is pure legal research or the normative legal research. It has found that the root problem of violations of the principle of SCA in, for instance the 2024 is that election laws is in conflict with the Pancasila, which has long been understood as not as the highest law, but an ideology, while an ideology has been argued as a manipulative tool of a ruling elite to control its subject. In order to solve the problem, this study proposes that Pancasila should be treated as containing the highest values or the inner morality of law to govern the principle of SCA stated in the country’s election laws.

Abstract

Penelitian ini bertujaun untuk untuk meneliti peraturan hukum, tenaga medis atau tenaga kesehatan yang melakukan kelalaian menurut hukum pidana di Indonesia; (2) Mempelajari pertanggungjawaban pidana tenaga medis atau tenaga kesehatan sesuai pasal 440 Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Penelitian ini termasuk penelitian normative yuridis dan menggunakan analisis data deduktif dengan bahan-bahan hukum primer, sekunder dan tersier. Berdasarkan hasil pembahasan, berikut ini dapat disimpulkan. 1) Hubungan hukum antara pasien dengan rumah sakit dan tenaga kesehatan berdasarkan perspektif hukum dijelaskan dalam Undang-Undang Nomor 44 Tahun 2009 tentang Rumah Sakit dijelaskan bahwa kelalaian tenaga medis merupakan tanggung jawab rumah sakit. 2) Peraturan mengenai Kelalaian Tenaga Kesehatan dalam Peraturan Perundang-undangan dijelaskan pengaturan malpraktik kedokteran dalam Pasal 440 UUK yang mengatur sanksi pidana atas kelalaian (layigensi) tenaga medis dan kesehatan tidak sesuai dengan paradigma UU Kesehatan. 3) Rumah sakit dan tenaga Kesehatan bertanggung jawab atas kekalalaian sesuai dengan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan diatur dalam Pasal 447 ayat (1), ayat (2), ayat (3), ayat (4) Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan.

Abstract

Orang Dengan Gangguan Jiwa (ODGJ) adalah individu yang memiliki hak untuk hidup merdeka, dan termasuk dalam golongan seseorang dilindungi oleh hukum. Meskipun telah banyak regulasi mengenai larangan pemasungan, bahkan hingga ancaman pidana bagi seseorang yang melakukan tindakan pemasungan, perilaku ini masih terus terjadi. Penelitian ini memiliki tujuan untuk menganalisis perlindungan hukum terhadap pemasungan ODGJ perspektif keadilan bermartabat. Keadilan bermartabat adalah bentuk teori menggabungkan hukum positif dengan dasar hukum Indonesia (Pancasila) yang mengedepankan nilai kemanusiaan, untuk menjaga martabat manusia. Jenis penelitian ini adalah yuridis-empiris dengan teknik statute approach dan case study. Peneliti mengumpulkan data melalui wawancara yang kemudian hasil wawancara tersebut diolah dengan pendekatan Undang-Undang dan analisis dengan teori keadilan bermartabat. Hasil penelitian ini menunjukkan bahwa faktor-faktor yang mempengaruhi pemasungan terhadap ODGJ disebabkan rasa trauma dan pencegahan akan stigma buruk masyarakat kepada ODGJ, namun hal demikian tetap pelanggaran HAM yang tidak memenuhi unsur keadilan bermartabat. UU Nomor 17 Tahun 2023 tentang Kesehatan, Permenkes Nomor 54 Tahun 2017, dan PP Nomor 28 Tahun 2024 tentang Pelaksanaan UU No. 54 Tahun 2017 tentang Kesehatan adalah bentuk upaya preventif dan implementasi terhadap penanggulanagan tindakan pemasungan ODGJ secara nyata. Regulasi ini memuat hal-hal yang menjadi dasar terlaksananya dukungan antar sektoral melakukan penanggulangan atas kejahatan ini.

Abstract

The authority of the DPD is regulated in Article 22 D of the 1945 Republic of Indonesia Constitution which states that there are three functions of the DPD, namely the functions of legislation, consideration and supervision. However, these three functions are carried out by the DPD in a very limited manner. The existence of the DPR and the Supreme Audit Agency (BPK) as one of the state institutions is an implementation of the horizontal division of powers. The House of Representatives is an institution that has legislative, budgetary and supervisory functions, while the Supreme Audit Agency is an institution with the main function of auditing state finances. However, the supervisory function in regional budget matters carried out by the DPD is still part of the financial audit by the BPK. The principle that applies in state administrative law is that if an institution, including the DPD RI can measure performance, it means that the institution can know many things, such as being able to reward those who succeed, as well as being able to provide sanctions or recommend sanctions for those who fail; be able to know the actual cost; can link between costs and results; can determine whether it is better to do it yourself or need to outsource (outsourcing); can improve performance; can choose the best alternative

Abstract

Children are individuals who are not yet adults and have a fundamental right to education. A child's education starts at the family level and continues at an educational institution like a school. Teachers play a crucial role in education and are responsible for instructing their students. In addition to this responsibility, teachers must uphold laws, regulations, and ethical codes as specified in Article 20 of Law No. 14/2005. This includes adhering to child protection laws outlined in Law No. 35/2014. Everyone needs to protect children from violence, as Article 76C of Law No. 35/2014 explicitly prohibits any person from committing or allowing violence against children. The law also mandates teachers to protect their students from violence, as stated in Article 9(1a) and Articles 54(1) and (2) of Law No. 35/2014. Issues arise when teachers allow bullying to occur among their students. This neglect constitutes a violation of Article 76C of Law No. 35/2014. This study uses a normative legal methodology to apply child protection rules to teachers who ignore bullying among their students. The study concludes that teachers who tolerate bullying violate Article 76C of Law No. 35/2014, as this neglect causes suffering to children. Such teachers could face criminal sanctions as outlined in Article 80 of Law No. 35/2014. The research team suggests increased criminal penalties for teachers who allow such neglect should be imposed.

Abstract

The people want to understand the concept of law renewal, the general impression is that the meaning or ontology of the concept of law renewal is something like this: "The law is what you change and what you change." Legislative renewal is instead interpreted as the function of law as a tool or instrument (tool) for bringing about change, especially social change. On the other hand, in legal reform, law actually becomes a tool, a parameter, to guide the goals of society. The research method used to create this article is legal research. In general, the intended method of legal research is understood as prescriptive legal research. The theory used to analyze the importance of legal reform is the theory of dignified justice. This research clarified that legal renewal means efforts to bring about change in society using law as a tool (law as a tool for social engineering). In an engineering society, the law does not change, but the direction of change is determined according to the purpose of the law.
