Abstract

This study aims to analyze the relationship between banking and employment regulations in protecting labor rights in Indonesia. Using a literature study method, this study examines legal documents such as Law Number 13 of 2003 concerning Employment, the Banking Law, Financial Services Authority Regulations (POJK), and Bank Indonesia Regulations (PBI), as well as relevant academic literature. Descriptive-analytical analysis was conducted to evaluate the suitability of regulations with banking operational practices and identify potential synergies between regulations to strengthen the protection of labor rights. The results of the study indicate that there are regulatory gaps that require harmonization to ensure banking compliance in supporting workers' rights, especially related to the management of welfare funds and the fulfillment of labor obligations. This study recommends strengthening coordination between banking and labor regulators to create a more integrated and effective legal framework.

Abstract

Artikel ini membahas isu keadilan dalam pemberian upah buruh dari dua perspektif utama: hukum ketenagakerjaan Indonesia dan etika ekonomi Islam. Latar belakang penelitian ini adalah masih maraknya praktik eksploitasi tenaga kerja dan ketimpangan dalam sistem pengupahan di Indonesia. Penelitian ini menelaah kesesuaian antara Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan dengan prinsip keadilan yang terdapat dalam Al-Qur’an, khususnya QS. Al-Muthaffifin ayat 1–3. Pendekatan yang digunakan adalah kualitatif dengan metode normatif dan analisis isi terhadap teks hukum serta ayat Al-Qur’an. Hasil penelitian menunjukkan bahwa praktik seperti upah murah, sistem outsourcing, dan pengabaian hak buruh bertentangan baik dengan nilai-nilai moral Islam maupun semangat keadilan yang dijunjung dalam hukum positif. Perspektif Islam memberikan dimensi spiritual dan etik yang memperkuat perlindungan terhadap buruh, sementara hukum positif menyediakan kerangka legal formal. Penelitian ini mendorong integrasi antara nilai religius dan regulasi hukum dalam reformasi sistem ketenagakerjaan. Dengan demikian, keadilan upah dapat diwujudkan secara lebih menyeluruh, adil, dan berkelanjutan.
