Abstract

Disputes in the construction services sector are inevitable due to the complexity of contracts, project delays, cost overruns, and quality issues. Law No. 2 of 2017 on Construction Services seeks to reform dispute resolution mechanisms by emphasizing alternative dispute resolution (ADR), mediation, and arbitration while ensuring legal certainty and fairness. This study analyzes these reforms using a quantitative survey approach to assess their effectiveness and identify existing gaps. The Construction Services Acts of 1999 and 2017 marked significant philosophical and procedural shifts, with the latter focusing on non-litigious settlements through a win-win approach. However, challenges remain, particularly regarding the interpretation of the term "court" and the enforcement of decisions. Findings indicate that while Law No. 2 of 2017 promotes ADR mechanisms, enforcement issues, contractual inconsistencies, and power imbalances between large developers and smaller contractors hinder its effectiveness. The Act also establishes a team formed by mutual agreement to oversee construction services and mediate disputes, yet concerns persist over defects, nonconformities, weaknesses, and perceived biases in its implementation. Despite these challenges, Indonesia is progressing toward more effective construction dispute resolution. To enhance future regulatory frameworks, this study recommends stricter sanctions for violations of construction agreements and improved procedural clarity. Comparative insights from international legal frameworks suggest that Indonesia could benefit from integrating global best practices, such as adjudication boards and expedited arbitration. These findings are crucial for legal practitioners and policymakers in refining dispute resolution mechanisms and raising public awareness of regulatory gaps that hinder sustainable development.

Abstract

This research aims to examine the role of employment law in overcoming the challenges of abuse of power by employers to build a legal framework that is socially just. This challenge is in focus because of its impact on imbalances in employment and labour relations. In this context, labour law has an important role in protecting workers' rights and preventing abuse of power by employers in the corridor of legal reform that provides social justice. The research method used is a normative legal approach. Through analysis of various legal regulations, court decisions, and related literature, this research seeks a comprehensive understanding of the concept of employment law and its relevance in overcoming the challenges faced. The novelty of this research lies in its holistic approach, integrating social justice, proactive prevention, technology use, and worker participation in employment law reforms to prevent employer abuse, ensuring comprehensive and fair protection for all workers. The research results show that labour law plays a crucial role in ensuring social justice in the work environment and in carrying out legal reforms. Clear regulations and effective law enforcement are key to preventing abuse of power by employers and protecting workers' rights. Thus, labour law is not only an instrument of protection but also a foundation for building a legal framework that is socially just. In conclusion, comprehensive labor law implementation and collaboration among government, employers, and workers are essential for creating a fairer and more socially just work environment.

Abstract

The sea and its resources, especially fishery resources, are a gift from God Almighty for the welfare of all Indonesian people. Based on the state's right to control the earth and the natural resources contained therein, which originates from Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia, the government must regulate fishery resources for the greatest prosperity of all people. The use of fishery resources is carried out with various legal products ranging from laws, government regulations, and presidential decrees to ministerial rules. Regulations on using fishery resources include prohibiting using trawl nets to catch fish in certain waters. This prohibition aims to prevent damage to the marine environment, ensure the sustainability of fishery resources, and protect small fishermen. However, in its implementation, it is still hampered by the problem of law enforcement, which is hindered by disharmony of regulations, the availability of professional law enforcement officers, and the lack of support for facilities and infrastructure considering the vast area of law enforcement. One thing that is no less important in enforcing the law on the prohibition of the use of trawl nets is the low legal awareness of fishing communities, especially industrial fishermen who only care about themselves without paying attention to the preservation of marine ecosystems, the sustainability of fishery resources, and the protection of small fishermen or traditional fishermen.

Abstract

The seller offers goods with online media by relying on the description of the goods in the form of videos or photos so that consumers cannot directly check the goods to be purchased. This article analyzes the seller's liability due to hidden defects in online buying and selling transactions. This study uses a normative juridical approach. Results of the study show that hidden defective products sold by sellers in online transactions are the absolute responsibility of the seller as regulated in Article 19 of the UUPK, as well as the provisions of Articles 1365 and 1865 of the Civil Code, namely the seller is responsible for the goods sold. However, this responsibility must be proven that the seller did make a mistake, and the result of the mistake has been detrimental to the consumer. Besides the obligation of consumers to be careful, consumers also need to get protection.

Abstract

Penelitian ini mengkaji akibat hukum dari ketidakjelasan frasa “merugikan perekonomian negara” dalam Pasal 2 ayat (1) dan Pasal 3 Undang-Undang Pemberantasan Tindak Pidana Korupsi. Frasa tersebut tidak memiliki batas konseptual yang pasti, sehingga menimbulkan multitafsir dan mengurangi kepastian hukum dalam konstruksi delik korupsi. Kajian menunjukkan bahwa istilah perekonomian negara tidak dilengkapi dengan parameter yang dapat diuji secara empiris. Akibatnya, unsur ini tidak operasional dalam proses pembuktian, karena kerugian yang dimaksud bersifat abstrak, makroekonomis, dan tidak dapat diverifikasi melalui alat bukti yang tersedia dalam hukum acara pidana. Kondisi tersebut menyebabkan penilaian atas terpenuhinya unsur delik bergeser menjadi sangat subjektif, membuka ruang interpretasi yang luas, dan meningkatkan potensi ketidakkonsistenan putusan maupun penyalahgunaan kewenangan oleh aparat penegak hukum. Ketidakjelasan itu juga menunjukkan adanya pertentangan dengan asas legalitas, khususnya prinsip lex certa, yang menghendaki kejelasan, ketegasan, serta batasan yang terukur dalam perumusan tindak pidana. Tanpa pemaknaan yang jelas, penerapan unsur ini berisiko menimbulkan ketidakadilan bagi terdakwa maupun pihak lain yang berhadapan dengan proses penegakan hukum. Penelitian ini menegaskan urgensi reformulasi unsur perekonomian negara dalam undang-undang tindak pidana korupsi. Reformulasi diperlukan untuk memberikan kepastian hukum, menyusun parameter kerugian yang dapat diuji secara objektif, serta memastikan bahwa penegakan hukum berjalan konsisten dan sejalan dengan prinsip dasar hukum pidana. Dengan demikian, norma hukum dapat dioperasionalkan secara lebih akuntabel dan mengurangi ruang penyimpangan dalam praktik peradilan.
