Abstract

This study aims to identify the moderation of Huzaemah Tahido Yanggo's fiqh of the law of purity over homosexual acts. This is a qualitative research in the form of heirloom studies which uses a normative-philosophical approach. The paradigm of moderate fiqh conceptualized by M. Quraish Shihab becomes the theory of analysis. The results show that there is a paradigm basis for moderate fiqh in the construction of Huzaemah's fiqh on the law of purity over homosexual acts. This great conclusion can be seen from the following various aspects. The first aspect is the dimensions of the paradigm of fiqh al-maqashid and fiqh al-awlawiyat in the use of theological foundations that emphasize the realization of the benefit orientation of Islamic sharia, namely the regeneration of offspring (hifz al-nasl) and the protection of honor (hifz al-'ird). The second aspect is the paradigm pattern of fiqh al-muwazanat, and fiqh al-ma'alat in the basis of consideration of the impact of disease from a medical perspective, and violations of national legal norms in Indonesia. The pattern of the fiqh al-ma'alat paradigm can also be seen from Huzaemah's advice to the community and the government to realize preventive efforts, healing as well as rehabilitation and empowerment of homosexual actors to positive things. The theoretical implications of this study show that a holistic fiqh paradigm is needed in prohibiting homosexual acts, namely by involving multiple perspectives, such as medical, state norms, psychology and socio-cultural norms.

Abstract

Purpose - The rampant da’wah content in social media that triggers social and national disintegration is a problem and a big task for the government and Muslims in Indonesia to prevent it. This study seeks to identify the values of moderation in the fatwa of the Majelis Ulama Indonesia of East Java Province Number—06 of 2022 concerning da’wah Ethics in the Digital Era.Method - This qualitative study uses a philosophical normative approach. The study's primary data used the fatwa document of the Majelis Ulama Indonesia, East Java Province Number—06 of 2022 concerning da’wah Ethics in the Digital Era. Indicators of religious moderation conceptualized by the Ministry of Religious Affairs of the Republic of Indonesia as the primary analysis theory. The documentation techniques used in collecting data in this study and the data analysis techniques used were data reduction, presentation, and verification.Results - This study concludes that there is a dimension of religious moderation in the fatwa of Majelis Ulama Indonesia of East Java Province Number—06 of 2022 concerning da’wah Ethics in the Digital Era, among others, the value of anti-radicalism in the prohibition of the delivery of provocative da’wah content, the value of tolerance in the recommendation of delivering pluralist da’wah content, the value of national commitment in the recommendation of delivering da’wah content that leads to compliance with the country's constitution, and the accommodating value of local wisdom in the recommendation of delivering da’wah content that maintains public conduciveness. Implications – This study shows that mainstreaming religious moderation in Indonesia can be internalized in religious social fatwas.Originality - This study shows that the four indicators of religious moderation in Indonesia (tolerance, anti-radicalism, national commitment, and accommodating to local wisdom) can be internalized in the digital media space's code of ethics for da’wah activities.***Tujuan - Maraknya konten dakwah di media sosial yang memicu disintegrasi sosial dan bangsa merupakan masalah dan tugas besar bagi pemerintah dan umat Islam di Indonesia untuk mencegahnya. Kajian ini berupaya mengidentifikasi nilai-nilai moderasi dalam fatwa Majelis Ulama Indonesia Provinsi Jawa Timur Nomor—06 Tahun 2022 tentang Etika Dakwah di Era Digital.Metode – Penelitian kualitatif ini menggunakan pendekatan filosofis normatif. Data primer penelitian ini menggunakan dokumen fatwa Majelis Ulama Indonesia Provinsi Jawa Timur Nomor—06 Tahun 2022 tentang Etika Dakwah di Era Digital. Indikator moderasi beragama dikonseptualisasikan oleh Kementerian Agama Republik Indonesia sebagai teori analisis utama. Teknik dokumentasi yang digunakan dalam mengumpulkan data dalam penelitian ini dan teknik analisis data yang digunakan adalah reduksi data, penyajian, dan verifikasi.Hasil - Penelitian ini menyimpulkan bahwa terdapat dimensi moderasi beragama dalam fatwa Majelis Ulama Indonesia Provinsi Jawa Timur Nomor—06 Tahun 2022 tentang Etika Dakwah di Era Digital antara lain nilai anti radikalisme dalam larangan penyampaian konten dakwah yang provokatif, nilai toleransi dalam rekomendasi penyampaian konten dakwah pluralis, nilai komitmen nasional dalam rekomendasi penyampaian konten dakwah yang mengarah pada kepatuhan terhadap konstitusi negara, dan akomodatif nilai kearifan lokal dalam rekomendasi penyampaian konten dakwah yang menjaga kondusifitas publik.Implikasi – Kajian ini menunjukkan bahwa pengarusutamaan moderasi beragama di Indonesia dapat terinternalisasi dalam fatwa-fatwa sosial keagamaan.Orisinalitas - Studi ini menunjukkan bahwa empat indikator moderasi beragama di Indonesia (toleransi, anti radikalisme, komitmen kebangsaan, dan akomodatif terhadap kearifan lokal) dapat diinternalisasikan dalam kode etik ruang media digital untuk kegiatan dakwah.

Abstract

This study compares Zakat and tax relations in three countries in the Southeast Asian region, where most of the population is Muslim (Indonesia, Malaysia, and Brunei Darussalam). This type of research is normative, empirical legal analysis with a comparative approach. The results showed relational and functional distinctions in Zakat and tax positions in Indonesia, Malaysia, and Brunei Darussalam. In Indonesia, paying Zakat can reduce taxable income. Meanwhile, Malaysia uses Zakat as a deduction for individual taxes, even up to 100%. Meanwhile, in Brunei Darussalam, the Zakat and tax relationship are not interrelated.

Abstract

Sungguh disayangkan masih ditemukan sebagian pandangan umat Islam di Indonesia yang menilai moderasi beragama sebagai liberalisasi atau skulerisasi beragama dalam kehidupan bernegara. Hal tersebut sungguh disayangkan, karena pengarustamaan moderasi beragama tersebut sesungguhnya memiliki tujuan positif untuk membangun peradaban umat beragama di tengah kemajemukan masyarakat Indonesia.Studi kualitatif dalam bentuk kajian pustaka inimemiliki tujuan untukmengidentifikasi dan mengeksplorasi muatan universalisme Islam dalam empat indikator moderasi beragama di Indonesia yang dirumuskan Kementrian Agama Republik Indonesia. Pendekatan normatif-filosofis digunakan dalam studi ini.Sementara itu,data dikumpulkan menggunakan dokumentasi, dan analisa data melalui tahap reduksi, penyajian, dan verifikasi. Hasil studi ini menemukan dimensi nilai-nilai Islam universal dalam indikator moderasi beragama di Indonesia, antara lain, nilai tasammuh padaindikator toleransi, nilai amar makruf nahi munkar pada indikator anti radikalisme,nilai tafahum pada indikator akomodatif terhadap kearifan budaya lokal, dan nilai takaful pada indikator komitmen kebangsaan. Implikasi teoritis studi ini menegaskan nilai-nilai Islam universal dapat didesiminasikan dalam kebijakan publik untuk membangun peradaban umat beragama yang moderat di tengah kemajemukan sosial masyarakat Indonesia   It is unfortunate that there are still some views of Muslims in Indonesia who consider religious moderation as liberalization or religious scullerization in state life This is unfortunate, because the mainstreaming of religious moderation actually has a positive goal to build religious civilization in the midst of the plurality of Indonesian society. This qualitative study in the form of a literature review aims to identify and explore the content of Islamic universalism in four indicators of religious moderation in Indonesia formulated by the Ministry of Religious Affairs of the Republic of Indonesia. A normative-philosophical approach was used in this study. Meanwhile, data is collected using documentation, and data analysis goes through the stages of reduction, presentation, and verification.The results of this study found dimensions of universal Islamic values in indicators of religious moderation in Indonesia, among others, the value of tasammuh on indicators of tolerance, the value of amar makruf nahi munkar on indicators of anti-radicalism, the value of tafahum on indicators accommodating to local cultural wisdom, and the value of takaful on indicators of national commitment. The theoretical implications of this study affirm that universal Islamic values can be disseminated in public policy to build a moderate religious civilization in the midst of social pluralism of Indonesian society
