Abstract

Disputes usually occur due to differences in ideas, beliefs, values, needs, and goals, until finally people with different backgrounds cannot work together and cannot avoid disputes. Litigation is the most traditional dispute resolution which is a process in court using applicable law. Alternative Dispute Resolution is a concept of dispute resolution outside the court that prioritizes a win-win solution which is now integrated into the adjudication process as part of CDR or CADR. With a normative research method, which is sourced from secondary legal data, with primary legal materials, secondary legal materials, and tertiary legal materials, using qualitative data analysis methods by interpreting and describing questions contained in documents and laws and regulations. The results of this study indicate that the traditional dispute resolution method is a slow, protracted, and relatively expensive dispute resolution process, while the digital dispute resolution method in an approach to optimizing ADR has advantages in economic factors, scope factors and good relationship building factors.

Abstract

Arbitrase dan Alternatif Penyelesaian Sengketa (ADR) merupakan mekanisme penting dalam menyelesaikan konflik hukum di luar pengadilan. Artikel ini membahas peran, kelebihan, kelemahan, dan efektivitas implementasi arbitrase dan ADR dalam menciptakan penyelesaian sengketa yang cepat, efisien, dan damai, terutama dalam konteks sengketa lintas negara. Arbitrase menawarkan kepastian hukum melalui keputusan yang bersifat final dan mengikat, dengan proses yang lebih cepat dan fleksibel dibandingkan litigasi. Selain itu, sifat privat arbitrase menjaga kerahasiaan informasi para pihak. Di sisi lain, ADR seperti mediasi, negosiasi, dan konsiliasi berfokus pada dialog dan kerja sama untuk mencapai kesepakatan bersama, menciptakan penyelesaian yang saling menguntungkan. Kelebihan arbitrase dan ADR mencakup efisiensi waktu, penghematan biaya, dan fleksibilitas prosedural, yang sangat bermanfaat dalam sengketa bisnis dan lintas negara. Namun, keduanya juga memiliki kelemahan, seperti biaya arbitrase yang tinggi, keterbatasan banding, dan tantangan dalam menegakkan keputusan arbitrase di yurisdiksi berbeda. Efektivitas ADR dalam sengketa lintas negara ditingkatkan dengan penggunaan mediator yang netral dan berpengalaman, meski tantangan seperti ketimpangan kekuasaan atau perbedaan budaya dapat menjadi hambatan. Kesimpulannya, arbitrase dan ADR adalah solusi alternatif yang relevan untuk menyelesaikan sengketa secara cepat, efisien, dan damai, dengan potensi besar untuk mengurangi beban pengadilan serta menciptakan keadilan yang lebih adaptif. Implementasi yang optimal membutuhkan kolaborasi semua pihak untuk memaksimalkan manfaatnya dalam sistem hukum nasional maupun internasional.

Abstract

The concept of regional autonomy is explicitly regulated in Article 18 of the 1945 Constitution and several related laws and regulations which essentially provide authority and flexibility for provincial, district and city governments to regulate and manage their own government affairs according to the principles of autonomy and assignment tasks including the implementation of regional head elections carried out democratically. In the implementation of regional government, elected regional heads must also be able to realize the principles of democracy and must be able to run effective and responsive regional government to the needs of the community, must not deviate from moral norms and deviate from democratic principles. The problem in this study is How is the Legitimacy of Regional Heads in the Implementation of Regional Government in Accordance with the Principles of Democracy. This study uses an empirical legal method, namely in addition to reviewing data through literature, it also reviews data on events that actually occur through observation activities and so on. The purpose of this study is to analyze legislation and examine cases that have occurred in Indonesia regarding the legitimacy of regional heads in the implementation of regional government in accordance with democratic principles. The conclusion of this study is that based on the analysis of several laws regarding regional heads in the implementation of regional government and based on the analysis of cases of regional heads in leading regional government, they are not yet legitimate and are not in accordance with the principles of democracy

Abstract

Internet merupakan teknologi yang memiliki dampak paling besar dalam kehidupan manusia. Teknologi juga mengubah bagaimana cara kita dalam berinteraksi antara satu sama lain. Sehingga mengubah cara kita dalam menyelesaiakn konflik infrastruktur telekomunikasi bagi kehidupan masyarakat. Penyelesaian sengketa yang dilakukan melalui internet disebut dengan penyelesaian sengketa online atau ODR. Online Dispute Resolution adalah inovasi hukum dengan memanfaatkan kemajuan teknologi dalam metode penyelesaian sengketa secara alternatif dimana melalui ODR pihak yang bersegketa tidak perlu bertemu secar langsung (tatap muka) guna menyelesaikan sengketanya. Dengan metode penelitian normatif, yang bersumber dari data hukum sekunder, dengan bahan hukum primer dan bahan hukum sekunder, menggunakan metode analisis data kualitatif yaitu pengumpulan data dengan cara pengelompokkan dalam data-data dari hasil penelitan. Hasil penelitian ini menunjukkan bahwa implementasi teknologi dalam penyelesaian sengketa studi kasus penggunaan platform Online Dispute Resolution di Indonesia terdapat kendala-kendala seperti masih terdapat penduduk yang belum mengenal penggunaan internet seperti WhatsApp, Telegram, Line, WeChat, dan masyarakat Indonesia kurang percaya dengan keberhasilan sistem ODR.

Abstract

Corporate Social Responsibility (CSR) is increasingly recognized as more than just a corporate obligation—it is a strategic approach to achieving sustainable development goals. In Indonesia, where regional autonomy gives local governments significant authority, their role in supervising CSR becomes particularly important, especially in ensuring transparency and accountability. Despite this, many CSR programs still suffer from a lack of clear oversight, limited regulatory support, and varying levels of corporate commitment. This study explores how local governments carry out their supervisory role in CSR programs from the perspective of business law. Using a qualitative juridical-normative approach complemented by field data, this research focuses on Klaten, Central Java, as a case study. Data were obtained through interviews with local officials, CSR practitioners, and community members, as well as analysis of regional regulations and corporate CSR reports. The findings reveal that while some local governments have made efforts to regulate CSR through regional policies, the lack of binding legal instruments and standardized monitoring systems poses significant challenges. In many cases, accountability still depends more on voluntary compliance than enforceable obligations. Moreover, transparency in CSR reporting is often limited, making it difficult for stakeholders to evaluate the actual impact. The study concludes that strengthening the legal basis of CSR at the local level—through clearer regulations, transparent reporting standards, and inclusive supervision involving civil society—could lead to more effective CSR governance. This would not only improve corporate accountability but also ensure that CSR efforts align more closely with community needs and sustainable development goals. Abstract

Investasi fiktif merupakan bentuk kejahatan ekonomi yang marak terjadi di era digital dan menimbulkan kerugian besar bagi masyarakat. Meskipun aparat penegak hukum telah berupaya menindak pelaku melalui jalur pidana, kenyataannya sistem peradilan pidana di Indonesia masih berfokus pada penghukuman pelaku dan belum sepenuhnya menjamin pemulihan kerugian korban. Akibatnya, korban sering kali tidak memperoleh ganti rugi yang sepadan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Kebaruan dalam penelitian ini terletak pada penekanan pentingnya peran lembaga seperti Otoritas Jasa Keuangan (OJK) dan Satgas Waspada Investasi dalam menyediakan perlindungan hukum tambahan di luar sistem peradilan melalui mekanisme yang lebih cepat dan responsif. Penelitian ini bertujuan untuk menganalisis pengaturan hukum yang mengatur pengembalian kerugian bagi korban investasi fiktif serta mengidentifikasi bentuk upaya perlindungan hukum yang dapat diperkuat. Hasil penelitian menunjukkan bahwa mekanisme pemulihan kerugian sebenarnya telah diatur dalam Pasal 98–101 KUHAP melalui penggabungan gugatan perdata dalam perkara pidana, Pasal 7A ayat (1) UU No. 31 Tahun 2014 tentang hak restitusi korban, serta POJK No. 6/POJK.07/2022 tentang kewajiban ganti rugi oleh pelaku usaha jasa keuangan. Sementara itu, Pasal 378 KUHP menjadi dasar pemidanaan terhadap pelaku penipuan investasi. Namun dalam praktiknya, perlindungan korban belum optimal. Oleh karena itu, diperlukan langkah konkret seperti pembentukan dana perlindungan investor, penyederhanaan mekanisme restitusi, serta putusan pengadilan yang lebih berpihak pada korban demi mewujudkan keadilan yang berimbang antara pelaku dan korban.

Abstract

Investasi berkelanjutan menjadi isu penting dalam mendorong pertumbuhan ekonomi yang inklusif dan ramah lingkungan di tengah tantangan global. Penelitian ini bertujuan untuk menganalisis peran Badan Koordinasi Penanaman Modal (BKPM) dalam meningkatkan investasi berkelanjutan di Indonesia serta mengidentifikasi hambatan dan strategi yang digunakan dalam proses tersebut. Penelitian ini menggunakan pendekatan hukum normatif dengan metode kualitatif berbasis studi pustaka yang berfokus pada data sekunder dari regulasi, literatur akademik, dan publikasi relevan. Hasil penelitian menunjukkan bahwa BKPM memiliki peran strategis dalam membentuk iklim investasi yang kondusif melalui koordinasi lintas sektor, penerapan sistem OSS, penyusunan panduan investasi lestari, serta promosi investasi hijau yang responsif terhadap prinsip keberlanjutan. Implikasi dari temuan ini menggarisbawahi pentingnya penguatan kelembagaan dan harmonisasi regulasi sebagai prasyarat utama untuk menjadikan Indonesia sebagai destinasi investasi berdaya saing di tingkat global

Abstract

Investment plays a strategic role in driving economic growth and job creation. However, the dynamics of investment law regulation in Indonesia still face various challenges that impact business certainty for investors. This study aims to: (1) analyze the dynamics of investment law regulations in Indonesia over time until the enactment of the Job Creation Law; (2) identify the forms of investment law regulations and the challenges of their implementation; and (3) formulate legal solutions to improve business certainty for investors. The research method used is normative legal research with a legislative and conceptual approach. Data was obtained from relevant regulations, scientific journals, and academic literature, then analyzed using descriptive-qualitative methods. The results of the study show that although regulations such as Law No. 25 of 2007 and the Job Creation Law have strengthened the legal framework for investment, their implementation is still hampered by bureaucracy, inconsistencies between central and regional policies, and weak oversight in digital investment. The conclusion of this study is that regulatory harmonization, strengthening arbitration institutions, and improving legal literacy are important steps to enhance legal certainty and investment attractiveness in Indonesia.

Abstract

Mundu Village is a village in Indonesia located in Tulung District, Klaten Regency, Central Java Province. The Statistics Indonesia (BPS) revealed that more than 60% of the residents of Mundu Village own cattle. This condition has led the community to utilize cattle manure as a source of renewable energy. Additionally, cattle manure is processed into fertilizer to nourish various plants, some of which serve as a food source for the livestock. This activity is known as zero-waste agriculture. This condition encouraged the Mundu Village government to establish a Tourism Village that offers educational tourism based on renewable energy. Mundu Village already has several buildings to support the realization of the Tourism Village. However, Mundu Village is not yet ready in terms of institutions. The community service team from the Faculty of Economics and Business and the Faculty of Law of Muhammadiyah University of Surakarta provided education and assistance in preparing Standard Operating Procedures (SOPs) to support the acceleration of institutional readiness in the effort to establish an Educational Tourism Village based on Renewable Energy. The activity proceeded successfully, marked by the preparation of a draft SOP that is ready to be approved, supporting the institutional strengthening of the Tourism Village.

Abstract

Urgensi penelitrian ini adalah mengingat bahwa negara Indonesia Masyarakat yang pluralistic, baik suku maupun agamanya. Pluralistik  agama bisa dilihat dari agama yang diakui negara terdapat 5 yaitu agama Islam, katholik, Kristen, Hindu, Budha dan Kong huchu. Setiap agama selalu meyakini bahwa agamanya yang paling benar. Klaim kebenaran juga dimiliki agama Islam. selain klaim kebenaran, Islam memiliki Sejarah tersendiri dibandingi agama lainnya. Tidak bisa dipungkiri bahwa muslim memiliki andil besar dalam kemerdekaan Indonesia. Sehingga tidak heran Sebagian umat Islam menginginkan Indonesia menjadi negara islam (Islamic state). Fenomena di atas tentu bisa menjadi ancaman bagi persatuan bangsa Indonesia. Padahal negara Indonesia yang berasaskan Pancasila telah mengakomodasi kepentingan semua agama. Khususnya agama Islam yang telah mengakomodasi tujuan syari’ah. Sehingga harapannya dengan konsep negara hukum pencasila berbasis maqasidu shari’ah bisa meredamkan keinginan untuk mendirikan negara islam. Tujuan Penelitian ini adalah : 1) Bagaimana konsep negara hukum Pnacasila berbasis maqasidu shari’ah, 2) bagaimana moderasi beragama dalam konsep negara hukum Pancasila berbasis maqasidu Shari’ah. Metode  penelitian ini  kepustakaan dengan pendekatan kualitatif. Metode penelitian yang digunakan pada penelitian ini adalah analisis isi. Analisi isi merupakan suatu studi yang menggabungkan hasil banyak studi orisinal, sistematis, dan terencana. Metode ini dilaksanakan melalui lima tahap, yaitu (1) Pengumpulan data; (2) Pertanyaan penelitian; (3) Hipotesis yang akan diuji; (4) Penyajian data dan (5) Penarikan kesimpulan. Sumber data dalam artikel ini adalah jurnal dan buku. Luaran yang ditargetkan dalam penelitian ini adalah publikasi hasil penelitian pada jurnal internasional bereputasi yang terindek Scopus. Indonesia is a pluralistic state with various ethnic groups and religions. Even so, it cannot be denied that Muslims have a great role in claiming Indonesian independence. Thus, it is no wonder that part of the Muslim community wishes Indonesia to become an Islamic state, even though it is based on Pancasila, which accommodates the interests of all religions. This condition certainly becomes a threat to the unity of the Indonesian nation. The Pancasila legal state concept based on maqasid sharia is hoped to dampen the desire to establish an Islamic state. This research aims to: (1) analyze the Pancasila legal state concept based on maqasid sharia, and (2) analyze religious moderation in the Pancasila legal state concept, based on maqasid sharia. This was library research which employed the qualitative approach. The research method used in this study was the content analysis, which was a study which combines various original, systematic, and planned studies. Research results showed that religious moderation in Indonesian diversity is crucial. One of the reasons is that Indonesia is a plural country both in terms of ethnic groups and religions. A religious understanding that is exclusive may be directed to religious moderation. A radical religious thought regards Pancasila as violating Islamic teachings. This paper shows that the Pancasila legal state concept is according to maqasid sharia as it accommodates the protection of religion, the protection of lives, the protection of offspring, the protection of the mind, and the protection of wealth.
