Abstract

Munculnya 2 (dua) keputusan lembaga peradilan di atas terhadap pasal yang sama tentunya menjadikan penerapan Pasal 182 huruf l Undang-Undang No. 7 Tahun 2017 Tentang Pemilihan Umum terkait syarat seseorang untuk melakukan pendaftaran bakal calon DPD berbeda dan kecenderungannya terjadi kontradiktif. Oleh karenanya, perlu dilihat maksud dan tujuan masing-masing putusan lembaga peradilan tersebut. Oleh karena itu, perlu dikaji pengaruh Putusan Mahkamah Konstitusi No. 30/PUU-XVI/2018 dan Putusan Mahkamah Agung No. 65P/HUM/2018 terhadap syarat pencalonan anggota DPD RI di Indonesia. Berdasarkan hasil penelitian, pengaruh Putusan Mahkamah Konstitusi No. 30/PUU-XVI/2018 terhadap proses rekrutmen bakal calon DPD ialah dimana persyaratan bakal calon DPD bertambah dimana pengurus (fungsionaris) partai politik tidak dibenarkan mencalonkan diri sebagai bakal calon DPD namun dikarenakan keberlakuannya tidak berlaku surut maka putusan tersebut dan aturan yang mengimplementasikan putusan tersebut tidak berlaku bagi para bakal calon yang pendaftarannya tanggal 26 Maret sampai 11 Juli 2018 dan Pengumuman/Pemberitahuan Hasil Verifikasi tanggal 19 Juli 2018. Artinya, putusan atau aturan tidak boleh berlaku surut dimana hal tersebut juga sesuai dengan putusan Mahkamah Agung No. 65P/HUM/2018. Abstract The emergence of the 2 (two) decisions of the judiciary above on the same article certainly makes the application of Article 182 letter l of Law no. 7 of 2017 concerning General Elections regarding the requirements for someone to register for DPD candidates are different and tend to be contradictory. Therefore, it is necessary to look at the intent and purpose of each of these judicial decisions. Therefore, it is necessary to study the effect of the Constitutional Court Decision No. 30/PUU-XVI/2018 and Supreme Court Decision No. 65P/HUM/2018 on the requirements for the nomination of DPD RI members in Indonesia. Based on the results of the study, the effect of the Constitutional Court Decision No. 30/PUU-XVI/2018 regarding the recruitment process for DPD candidates is where the requirements for DPD candidates are increased where political party administrators (functionaries) are not allowed to nominate themselves as DPD candidates, but due to the fact that it does not apply retroactively, the decision and the rules that implement the decision does not apply to prospective candidates whose registration is from March 26 to July 11 2018 and the Announcement/Notification of Verification Results dated July 19, 2018. This means that decisions or rules may not apply retroactively where this is also in accordance with the decision of the Supreme Court no. 65P/HUM/2018. Abstract

Diskresi merupakan kewenangan yang diberikan oleh undang-undang kepada pejabat publik berdasarkan Undang-Undang Republik Indonesia Nomor 30 Tahun 2014 Tentang Administrasi Pemerintahan. Kabupaten Gayo Lues adalah salah satu kabupaten Di Provinsi Aceh yang berpedoman kepada undang-undang tersebut, mengingat bahwa tugas pokok dan fungsi sebagai bupati, Bupati Gayo Lues harus dapat menyelesaikan semua persoalan-persoalan yang dihadapi oleh pemerintah Kab.Gayo Lues, berdasarkan kewenangan dan tanggungjawab yang dimiliki oleh bupati sesuai Undang Undang Administratif Negara Nomor 30 Tahun 2014, Undang Undang Nomor 11 Tahun 2006 Tentang Pemerintahan Aceh dan Qanun Aceh Nomor 8 Tahun 2019 tentang Majelis Adat Aceh, berdasarkan Asas – Asas Pemerintahan Umum Yang Baik. Dari hasil penelitian ini maka di peroleh, sejauh apa kewenangan dan batasan Bupati Gayo Lues dalam menggunakan instrumen Hukum Administrasi Negara serta peraturan perundang-undangan terkait, sekaligus mengantisipasi potensi konflik di Lembaga Majelis Adat Aceh Kabupaten Gayo Lues. Kata kunci: Bupati Gayo Lues, Diskresi, Penyelenggaraan Pemerintah. Abstract Discretion is the authority granted by law to public officials based on the Law of the Republic of Indonesia Number 30 of 2014 concerning Government Administration. Gayo Lues Regency is one of the regencies in Aceh Province that is guided by the law, given that the main tasks and functions as regents, Gayo Lues Regents must be able to solve all the problems faced by the Gayo Lues Regency government, based on the authority and responsibility owned by the regent according to the State Administrative Law Number 30 of 2014, Law Number 11 of 2006 concerning the Government of Aceh and the Aceh Qanun Number 8 of 2019 concerning the Aceh Customary Council, based on the Principles of Good General Governance. From the results of this study, it was obtained, to what extent the authority and limitations of the Regent of Gayo Lues in using State Administrative Law instruments and related laws and regulations, as well as anticipating potential conflicts in the Aceh Traditional Council Institution, Gayo Lues Regency. Abstract

Abstract: Land is one of the natural resources listed in Article 33 of the 1945 Constitution and is implemented based on national land law in the Basic Agrarian Law. The problem in land management is the difficulty in procuring land for public interest. Much land is controlled by brokers or land speculators that are abandoned. This condition hampers national development and requires enormous funding. To overcome this, the government has formed a Land Bank which is regulated in Law Number 11 of 2020 concerning Job Creation. This study aims to describe and explain the regulation of the Land Bank in the Job Creation Law and the PP on the Land Bank Agency and the implications for national land law. Land problems in Indonesia have increased along with the presence of Law Number 11 of 2020 concerning Job Creation. The regulation of the Land Bank in the Land cluster in the law is an important topic to note because it is a crucial part of land practices. The results of the study show that the presence of the Land Bank Agency has great potential to cause overlapping authority between institutions in the land sector. Fulfillment of the value of justice is needed to create a balance of rights and obligations between the parties involved in the implementation of land banks. Fulfillment of the value of legal certainty is intended so that the state guarantees legal certainty in the form of laws and regulations that specifically regulate the implementation of land banks in Indonesia. Keywords: Land Bank, Agrarian Law, Utility Abstrak: Tanah merupakan salah satu sumber kekayaan alam yang dicantumkan dalam Pasal 33 UUD 1945 dan dilaksanakan berdasarkan hukum tanah nasional dalam Undang-Undang Pokok Agraria. Permasalahan dalam pengelolaan tanah adalah kesulitan melakukan pengadaan tanah bagi kepentingan umum. Banyak tanah yang dikuasai oleh makelar atau spekulan tanah yang diterlantarkan. Kondisi ini menjadikan pembangunan nasional menjadi terhambat dan memerlukan pembiayaan yang begitu besar. Untuk mengatasi hal tersebut pemerintah membentuk Bank Tanah yang diatur dalam UndangUndang Nomor 11 Tahun 2020 tentang Cipta Kerja. Penelitian ini ditujukan untuk menguraikan dan menjelaskan pengaturan Bank Tanah dalam UU Cipta Kerja dan PP Badan Bank Tanah serta implikasi yang ditimbulkan terhadap hukum tanah nasional. Permasalahan pertanahan di Indonesia menjadi bertambah seiring dengan hadirnya UndangUndang Nomor 11 Tahun 2020 Cipta Kerja. Pengaturan Bank Tanah dalam klaster Pertanahan pada undang-undang itu menjadi topik yang penting untuk diperhatikan karena merupakan bagian krusial dari praktik pertanahan. Hasil penelitian menunjukkan bahwa hadirnya Badan Bank Tanah berpotensi besar menyebabkan tumpang tindih kewenangan antar lembaga dalam bidang pertanahan. Pemenuhan terhadap nilai kepastian hukum ditujukan agar negara menjamin adanya kepastian hukum dalam wujud peraturan perundang-undangan yang secara spesifik mengatur penyelenggaraan bank tanah di Indonesia. Kata kunci: Bank tanah, Hukum Pertanahan, Kemanfaatan

Abstract

Abstract: The dynamics and development of society in Indonesia which is pluralistic in the constitutional system, is known for the existence of political parties as a component in the implementation of democratic life in a rule of law state as a system that we all recognize. The verification stage for political parties before becoming election participants is the most important process to ensure that the eligibility requirements for participating in the election are met. At this stage, disputes often occur between parties that do not pass verification and the General Election Commission (KPU). The presence of the General Court in adjudicating political party verification disputes raises pros and cons in society. The aim of this research is to find out the mechanism for resolving pre-election political party disputes and the competence of the General Court in adjudicating pre-election political party disputes. The method used in this research is normative juridical with a literature study approach. Based on Article 24 of Bawaslu Regulation Number 9 of 2022, the stages of resolving election process disputes start from receiving the application, reviewing the application through formal verification and material verification, conducting mediation between the disputing parties, carrying out adjudication between the parties and deciding the dispute. Based on the Election Law, the Judicial Power Law and the General Courts Law, there is not a single article which confirms that the General Court is competent in adjudicating election process disputes that occur between political parties and the KPU. Keywords: Competence, General Justice, Political Party Disputes Abstrak: Dinamika dan perkembangan masyarakat di Indonesia yang majemuk dalam sistem ketatanegaraan, dikenal adanya partai politik sebagai suatu komponen dalam pelaksanaan kehidupan demokrasi dalam negara hukum sebagai sebuah sistem yang kita akui bersama. Tahapan verifikasi bagi partai politik sebelum menjadi peserta pemilu merupakan proses terpenting guna memastikan syarat-syarat kelayakan mengikuti pemilu terpenuhi. Pada tahapan ini sering terjadi sengketa antara partai yang tidak lolos verifikasi dan Komisi Pemilihan Umum (KPU). Hadirnya Peradilan Umum dalam mengadili sengketa verifikasi partai politik menimbulkan pro dan kontra di masyarakat. Tujuan penelitian ini untuk mengetahui bagaimana mekanisme penyelesaian sengketa partai politik pra pemilu dan bagaimana kompetensi Peradilan Umum dalam mengadili sengketa partai politik pra pemilu. Metode yang digunakan dalam penelitian ini yuridis normatif dengan pendekatan studi kepustakaan. Berdasarkan Pasal 24 Peraturan Bawaslu Nomor 9 Tahun 2022, tahapan penyelesaian sengketa proses pemilu dimulai dari menerima permohonan, mengkaji permohonan melalui verifikasi formal dan verifikasi materil, melakukan mediasi antar pihak yang bersengketa, melakukan adjufikasi antar pihak dan memutus sengketa. Berdasarkan Undang-Undang Pemilu, Undang-Undang Kekuasaan Kehakiman dan Undang-Undang Peradilan Umum, tidak ada satu pasal pun yang menegaskan bahwa Peradilan Umum berkompeten dalam mengadili sengketa proses pemilu yang terjadi antara partai politik dan KPU. Kata kunci: Kompetensi, Peradilan Umum, Sengketa Partai Politik

Abstract

Abstract: This study discusses the comparison between open and closed proportional systems in legislative elections, focusing on the analysis of the Constitutional Court (MK) Decision No. 114/PUU-XX/2022 which tests the material of Law No. 7 of 2017 concerning General Elections. In an open proportional system, voters have the freedom to directly elect legislative candidates, while in a closed proportional system, voters only elect political parties, and legislative candidates are determined by the party. This MK decision is important because it confirms the validity of the system used in Indonesian elections and its implications for democracy, political representation, and voter rights. This study aims to outline the legal basis, constitutional arguments, and socio-political impacts of the legislative election system regulated in the Election Law, by viewing the MK decision as a basis for strengthening the clarity of the election system in Indonesia. The results of the study show that the chosen election system affects political representation and public involvement in the election process. Keywords: general election, open proportional system, closed proportional system,                  constitutional court Abstrak: Penelitian ini membahas perbandingan antara sistem proporsional terbuka dan tertutup dalam pemilihan umum legislatif, dengan fokus pada analisis Putusan Mahkamah Konstitusi (MK) No. 114/PUU-XX/2022 yang menguji materi Undang-Undang No. 7 Tahun 2017 tentang Pemilihan Umum. Dalam sistem proporsional terbuka, pemilih memiliki kebebasan untuk memilih calon legislatif secara langsung, sedangkan dalam sistem proporsional tertutup, pemilih hanya memilih partai politik, dan calon legislatif ditentukan oleh partai tersebut. Putusan MK ini penting karena menegaskan validitas sistem yang digunakan dalam pemilu Indonesia serta implikasinya terhadap demokrasi, representasi politik, dan hak pemilih. Penelitian ini bertujuan untuk menguraikan dasar-dasar hukum, argumen konstitusional, serta dampak sosial-politik dari sistem pemilihan legislatif yang diatur dalam UU Pemilu, dengan melihat keputusan MK sebagai landasan dalam memperkuat kejelasan sistem pemilu di Indonesia. Hasil penelitian menunjukkan bahwa sistem pemilu yang dipilih mempengaruhi keterwakilan politik serta keterlibatan publik dalam proses pemilihan. Kata kunci: pemilihan umum, sistem proporsional terbuka, sistem proporsional tertutup, mahkamah konstitusi

Abstract

Pembentukan Mahkamah Konstitusi (MK) secara global sering kali menandai transisi dari pemerintahan otoriter ke pemerintahan demokratis, dengan constitutional review sebagai kewenangan utamanya. Studi tentang pembentukan MK di Eropa, Amerika, Afrika, dan Asia menyoroti perannya dalam menegakkan demokrasi. Judicial activism muncul sebagai pendekatan progresif dalam constitutional review, memperkuat konstitusi dan prinsip checks and balances. Namun, dalam praktiknya, beberapa putusan MK tidak diindahkan oleh para adresatnya, meskipun putusan tersebut memiliki makna filosofis dalam kerangka ketatanegaraan Indonesia. Penelitian normatif ini menggunakan studi kasus dan studi perbandingan hukum untuk menekankan kekuatan filosofis dalam putusan MK, terutama dalam kewenangan constitutional review. Judicial activism dipandang penting untuk menegakkan konstitusi dan menjaga nilai-nilai filosofis Pancasila yang terkandung dalam UUD 1945.

Abstract

ABSTRACT Member countries of the Organisation for Economic Co-operation and Development (OECD), make MSMEs a default factor in every economic law, especially investment law. However, the role of MSMEs in Indonesia is still often underestimated and has not received adequate opportunities to play their role in national economic development. The main problem in this research is to question how the issue of providing opportunities for the development of MSMEs in the rule of law in the economic sector in Indonesia. By using the normative juridical legal research method, it appears that MSMEs have an important role in national economic development, and therefore become an important target in efforts to achieve the State's Goal in promoting general welfare. The data collection technique in this study uses secondary data with qualitative data analysis techniques. From this research, it was found that there is an awareness of the importance of the role of MSMEs in national economic development, which is contained in various policies and legal regulations. The problem is that the implementation of these policies and regulations are still not in line with expectations. From the results of this research, it is recommended that the Government of Indonesia to reform the investment law in which it is mandated to provide opportunities for the development of MSMEs, so that MSMEs can really play an important role in the national economic development. Abstract

Village Head Election in Indonesia still has several problems. Not only at the application level, but also from the regulation still has problems. The limitation of the quantity of Village Head candidates will not be found in Law No. 6 of 2014 concerning Villages, but the regulation related to this limitation can be found in its derivative regulations, namely Government Regulation Number 43 of 2014 concerning Implementing Regulations of Law Number 6 of 2014 concerning Villages and Regulation of the Minister of Home Affairs Number 112 of 2014 concerning Village Head Elections. So that with the limitation regulations regulated in the derivative regulations of Law No. 6 of 2014, there is a potential for a conflict of norms between the Law and the PP. thus causing legal uncertainty regarding the number of village head candidates. This study uses a normative legal research method with a statutory regulatory approach. The results of this study indicate that in the provisions of Law No. 6 of 2014 concerning Village Heads, especially in the section on the requirements for Village Head candidates, there are no regulations related to the limitation of the quantity of Village Head candidates. So this regulation opens up opportunities for village communities who are declared to meet the requirements to be able to participate in the village head election. The regulation relating to the limitation of the number of village head candidates as regulated in the derivative regulation of Law No. 6 of 2014 concerning villages can be categorized as contradictory and inconsistent with the principle of lex superior derogate legi inferiori because Law No. 6 of 2014 as its main regulation does not provide a limit on the maximum number of village head candidates .

Abstract

Proposing the position of Constitutional judge from 3 (three) branches of power to guarantee the independence of the Constitutional Cout ar as  a Defender of Constitution On September 29 2022, the DPR RI proposed dismissing MK judge Aswanto in the middle of his term of office on the grounds that he often disappointed the DPR. Aswanto, who was elected by the DPR, was the subject of dismissal which raised questions regarding the independence and impartiality of the Constitutional Court (MK). This article aims to discuss how proposals for the dismissal of Constitutional Judges should be carried out in accordance with the mandate of Law Number 7 of 2020, and to emphasize that the Constitutional Court has no obligation to be responsible for the proposing institution. As a result, there is no place for the removal process of judges while they are still in tenure due to political considerations in implementing judicial policies.

Abstract

Since the 4th amendment to the 1945 Constitution, Governors, Regents and Mayors, who are the respective heads of Provincial, Regency and City regional governments, have been elected democratically. At the beginning of 2020, coinciding with the 2020 regional head elections, the world was faced with a serious problem, namely the Corona virus disease (Covid-19) pandemic. The research method used in this writing is a combination of normative research methods and empirical research methods, with a statutory approach and a comparative legal approach. The research location is Medan City. The research data in this research is primary data and also secondary data with data collection techniques and tools, namely library research, document research and field data collection which are analyzed qualitatively. In the implementation of regional head elections, it is carried out using the Health Protocol and violations of the health protocol are categorized as administrative violations; There was an increase in voter participation in 2020 compared to the 2015 mayoral and deputy mayoral elections under normal circumstances, and the provision and implementation of health protocols were obstacles to holding the 2020 regional head elections in Medan City and this can be resolved well. Keyword: 2020 Regional Election, Medan City Regional Election, Corona virus disease (Covid 19). Abstrak: Sejak amandemen ke-4 Undang-undang Dasar 1945 Gubernur, Bupati dan Walikota yang merupakan masing-masing kepala pemerintahan daerah Provinsi, Kabupaten dan Kota dilakukan pemilihan secara demokratis. pada awal tahun 2020 bertepan dengan pelaksanaan pemilihan kepala Daerah pada tahun 2020, Dunia dihadapkan dengan masalah serius, dimana adanya pandemi wabah Corona virus dessease (Covid-19). Metode Penelitian yang dipakai dalam penulisan ini yaitu gabungan dari metode penelitian normatif dan metode penelitian empiris, dengan pendekatan perundang-undangan (statute Approach) dan pendekatan perbandingan hukum (comparative approach). Adapun lokasi penelitian adalah Kota Medan. Data penelitian dalam peneitian ini adalah Data Primer dan juga Data sekunder dengan teknik dan alat pengumpulan data yaitu Studi kepustakaan (Library research), Studi dokumen (dokumen research) dan Pengumpulan data lapangan (field reseacrh) yang dianalisis secara kualitatif. Dalam pelaksanaan Pemilihan Kepala derah dilaksanakan dengan Protol Kesehatan dan pelanggaran Terhadap Protokol kesehatan dikategorikan sebagai pelanggaran administrasi; adanya peningkatan partisipasi pemilih di tahun 2020 dibandingkan dengan pelaksanan pemilihan walikaota dan wakil walikota tahun 2015 dalam keadaan normal, dan penyediaan dan penerapan protokol kesehatan merupakan hambatan utapa peleksanaan pemilihan kepala derah tahun 2020 di Kota Medan dan hal tersebut dapat diselesaikan dengan baik. Kata kunci: Pilkada 2020, Pilkada Kota Medan, Corona virus disease (Covid 19)
