Abstract

Penelitian ini bertujuan untuk mengetahui perbandingan desain isu kewenangan judicial review di Mahkamah Konstitusi Indonesia dan Mahkamah Konstitusi Thailand. Rumusan masalah dalam penelitian ini adalah: (1) Bagaimana desain isu kewenangan judicial review di Mahkamah Konstitusi Indonesia dan Mahkamah Konstitusi Thailand? (2) Bagaimana perbandingan karakteristik desain isu kewenangan judicial review antara Mahkamah Konstitusi Indonesia dan Mahkamah Konstitusi Thailand?. Metode penelitian yang penulis gunakan ialah metode penelitian kualitatif dan jenis penelitian normatif yang menggunakan sumber data sekunder berupa peraturan perundang-undangan, jurnal, buku, dan sumber internet. Hasil penelitian menunjukkan adanya kesamaan karakteristik desain isu kewenangan judicial review di Mahkamah Konstitusi Indonesia dan Thailand dari segi model judicial review sentralistik, jumlah hakim, dan akses pengadilan yang dapat dilakukan oleh setiap warga negara

Abstract

ABSTRACT The armed conflict in Myanmar has escalated since the military coup in 2021. In this armed conflict, many civilian casualties have fallen and civilian facilities have been destroyed. This type of research is normative legal research with a descriptive prescriptive nature. This scientific article consists of three sub-discussions. First, this scientific article discusses international regulations governing the protection of Myanmar civilians when a non-international armed conflict is taking place. Second, it discusses gross human rights violations committed by the Military Junta against Myanmar civilians when in conflict with the Rebel Forces. Third, it discusses international mechanisms that can be carried out to resolve the conflict and protect Myanmar civilians. The results of this study state that the armed conflict between the Rebel Forces fighting against the military junta in Myanmar territory meets the elements of a Non-International Armed Conflict as stipulated by International Humanitarian Law. Since the 2021 military coup, there have been many gross human rights violations by the military junta, including attacks on demonstrators, torture, cutting off access to aid, and indiscriminate airstrikes. International mechanisms that can be used to resolve this problem include conducting diplomatic intervention and international community political resolution, implementing accountability for enforcing international legal instruments, and conducting humanitarian intervention and civil protection.

Abstract

This study analyzes the legal framework of Indonesia's Food Estate policy, evaluating its alignment with the constitutional mandate of Food Sovereignty and State Obligations. Employing normative legal research with Regulatory Impact Assessment (RIA) and ROCCIPI frameworks, the study diagnoses regulatory disharmony and effectiveness. The findings reveal a fundamental paradigm shift from "Food Sovereignty" to "Food Security" within the Food Estate regulations, characterized by a corporate-centric approach that marginalizes local farmers. The research identifies critical vertical and horizontal disharmonies, particularly between the Forestry Law and implementing regulations, which facilitate land conversion in protected forests and weaken environmental safeguards through "Fast KLHS" mechanisms. This creates a "state of exception" that risks repeating historical ecological failures. The study concludes that the current policy contains structural legal flaws violating the state's obligation to respect and protect human rights. It recommends an immediate moratorium on land clearing in protected areas, regulatory harmonization, and a strategic pivot towards a community-based food sovereignty model.

Abstract

This research aims to analyze and review the policy of eliminating MSME debt in Indonesia based on Government Regulation Number 47 of 2024. As a government commitment to support the sustainability of MSME businesses that experience financial constraints due to bad loans. The approach is carried out using normative juridics with the specifications of applicable laws and regulations, study of documents and literature. The results of the study show that this policy depends on clear implementation, alignment in legal regulations, clear mechanisms, and supervision from the government or financial institutions. The realization of this policy needs to be optimized to support the clearer, more effective, and transparent elimination of MSME debt

Abstract

This study evaluates the Tourism Information Center (TIC) Digital Nusantara’s regulatory framework regarding industrial efficiency. The primary issue is the fragmented, non-binding nature of current circular letters, leading to inconsistent implementation and budgetary waste. Using normative legal research and the Regulation Impact Assessment (RIA) framework, findings show that existing executive rule-making provides flexibility but fails to ensure national data integration. Aligned with Presidential Instruction No. 1/2025 on budget efficiency, this study concludes that a non-regulatory approach—revising technical guidelines and strengthening private-sector partnerships is more effective than creating rigid new regulations. Therefore, the government must prioritize data interoperability standards and formalize digital platform cooperation to ensure a cost-effective, integrated tourism ecosystem.
