Abstract

This study aims to analyze the correlation between the principle of equality before the law and the affirmative action policy, which is expressed in the form of a 30% quota for women's representation in the political field, as stipulated in Law Number 7 of 2017 concerning General Elections. The focus of the study is directed at the extent to which this quota policy is in line with the principle of equality before the law and reflects substantive justice in democratic practices in Indonesia. The research method used is normative research by examining laws and regulations, legal doctrine, and relevant literature. This approach is used to assess whether the quota policy for women's representation is in accordance with the constitutional principle of equality, while also considering the challenges of its implementation in a socio-political context that is still gender biased. The results of the study indicate that the 30% quota for women in legislative candidacy is a form of positive discrimination intended to correct structural and historical inequalities in women's political participation. This policy is expected to open wider spaces for participation so that women have equal opportunities to play a role in the legislative process and public policy making. However, this policy has also drawn criticism. Some believe that the quota emphasizes fulfilling numbers rather than the quality and capacity of the individuals nominated. Therefore, the quota must be accompanied by efforts to improve the quality of women's human resources, political education, and transparent, merit-based selection mechanisms. This way, women's representation will not only be formal but also substantial and contribute significantly to democratic development. In conclusion, the 30% quota policy remains necessary as an affirmative step toward de facto equality. However, strengthening capacity and supporting systems is crucial for its implementation to align with the principle of equality before the law and achieve substantive justice.

Abstract

Pendekatan Echotheology menawarkan lensa unik untuk memeriksa dampak interaksi manusia dan non-manusia, terutama dalam konteks spiritualitas dan agama. Dengan mengeksplorasi bagaimana agama dan budaya merespons masalah lingkungan, echotheology berusaha untuk menjembatani kesenjangan antara tradisi teologis dan ilmu lingkungan, sehingga mendorong pendekatan yang lebih etis dan berkelanjutan untuk planet ini. Pengabdian masyarakat berbasis echotheology ini merupakan inisiatif kolaboratif antara IAIN Ambon dan University of Malaysia Sarawak (UNIMAS) di Santubong, Kuching, Sarawak, Malaysia. Program ini bertujuan untuk mengintegrasikan nilai-nilai teologi dengan kesadaran ekologis guna mendorong masyarakat dalam menjaga lingkungan berdasarkan pendekatan spiritual dan moral. Kegiatan ini mencakup Focus Group Discussion (FGD) yang mendalami konsep institusi berbasis kearifan lokal, gerakan lingkungan berbasis nilai-nilai moral, wawancara dengan masyarakat dan observasi untuk mengamati kondisi lingkungan dan praktik-praktik yang berkaitan dengan pengelolaan sumber daya alam melalui wisata edukasi sekaligus untuk memperkenalkan budaya lokal serta nilai-nilai ekologis kepada masyarakat. Abstract

Tujuan pelaksanaan kegiatan pengabdian masyarakat ini adalah untuk memberikan pengetahuan tentang pengelolaan dan perencanaan keuangan yang baik bagi keluarga nelayan tradisional di Desa Liang Kabupaten Maluku Tengah serta memberikan pelatihan untuk membuat perencanaan keuangan bagi keluarga nelayan tradisional di Desa Liang Kabupaten Maluku Tengah. Kegiatan pengabdian masyarakat ini berupa penyuluhan, diskusi dan tanya jawab. Dalam penyuluhan tersebut, dijelaskan mengenai model-model perencanaan keuangan keluarga, manfaat penting perencanaan ekonomi keluarga dan cara mengelola keuangan yang baik dan benar. Selain itu, disampaikan juga upaya-upaya yang dapat dilakukan oleh para ibu rumah tangga dalam membantu meningkatkan pendapatan keluarga dengan cara melakukan investasi atau melakukan kegiatan-kegiatan produktif lainnya. Kegiatan pengabdian masyarakat ini melibatkan kontributor dari ibu-ibu rumah tangga yang telah terbentuk di Desa Liang. Untuk mengatasi masalah yang dihadapi oleh ibu-ibu dari keluarga nelayan dalam belajar mengelola keuangan rumah tangga agar lebih terkontrol dan mendukung kesejahteraan mereka, solusi yang ditawarkan adalah memberikan pelatihan tentang pengelolaan keuangan keluarga melalui perencanaan keuangan yang baik.

Abstract

The Free Nutritious Meal Program (MBG) is one of the Indonesian government's strategic policies aimed at improving the quality of human resources and addressing nutritional disparities. However, the implementation of this program has triggered serious debates in the constitutional and Islamic legal domains. This article analyzes the logic of the MBG program, which is deemed to conflict with the mandate of Article 31 paragraph (4) of the 1945 Constitution concerning the 20% allocation of the State Budget for education, as well as contradicting the principle of maslahah from the perspective of maqāṣid al-syarī'ah and fiqh siyasah. Using a normative-conceptual approach, this research demonstrates that the diversion of the education budget for MBG is potentially unconstitutional as it threatens the fulfillment of the right to education, reduces teacher welfare, and disrupts the teaching and learning process. From the perspective of Islamic law, the program's inclusive nature without clustering contradicts the provisions of zakat distribution which are limited to eight asnaf (recipient categories), and disregards the principles of distributive justice (al-'adalah) and public interest (al-maslahah al-'ammah). This article recommends improvements in governance, refinement of program targeting, and the search for alternative funding sources that do not compromise the education sector.

Abstract

This study aims to analyze the implementation of restitution rights for child victims of sexual violence and to identify obstacles and solutions from a victimological perspective. Although Law Number 12 of 2022 concerning Sexual Violence Crimes (UU TPKS) has provided normative reinforcement, the fulfillment of restitution rights in practice still faces significant obstacles. The research method used is normative legal research with a statutory and conceptual approach. The results indicate that the implementation of restitution is still far from ideal due to three main obstacles: normative obstacles related to the complexity of administrative procedures, structural obstacles in the form of law enforcement officials' lack of sensitivity in calculating losses, and substantial obstacles triggered by the perpetrator's financial inability. From a victimological perspective, the failure to execute restitution is a form of secondary victimization by the state. As a solution, this study recommends optimizing the role of the LPSK, activating the Victim Trust Fund mechanism as state compensation for indigent perpetrators, and implementing the seizure of the perpetrator's assets starting from the investigation stage to ensure the certainty of restoring the victim's rights Keywords: restitution, child sexual violence, victimology, victim recovery, UU TPKS

Abstract

Undang-Undang Nomor 21 Tahun 2008 tentang Perbankan Syariah merupakan landasan hukum utama dalam pengembangan industri keuangan Islam di Indonesia. Namun, dalam implementasinya, regulasi ini masih menyisakan berbagai celah yang berpotensi menjadi celah kejahatan finansial dan menghambat efektivitas dan daya saing perbankan syariah. Penelitian ini bertujuan untuk mengidentifikasi kelemahan-kelemahan dalam undang-undang tersebut serta menganalisis dampaknya terhadap praktik keuangan Islam. Dengan menggunakan pendekatan yuridis normatif dan metode analisis kritis, penelitian ini menemukan bahwa terdapat beberapa aspek yang menjadi celah potensi terjadinya kejahatan finansial, seperti batas maksimun penyaluran dana dan pengelolaan risiko, kerahasiaan bank yang menghambat investigasi, dan ketidakjelasan sanksi hukum terhadap pelanggaran prinsip syariah. Temuan ini mengindikasikan perlunya revisi undang-undang guna memperkuat fondasi hukum perbankan syariah yang lebih adaptif dan responsif terhadap perkembangan kejahatan keuangan global.

Abstract

Pregnancy outside lawful wedlock is a social and religious phenomenon that continues to develop in modern society. It not only raises moral debates but also creates complex issues in Islamic and positive law concerning the validity of marriage, marital relations, and the determination of a child's lineage (nasab). This study aims to analyze the issue of pregnant marriage from the perspectives of Prophetic Hadith, the four Sunni schools of jurisprudence (Hanafi, Maliki, Shafi'i, and Hanbali), and positive law under the Indonesian Compilation of Islamic Law (Kompilasi Hukum Islam or KHI). This study employs normative legal research using normative-theological, comparative, and statutory approaches. Legal materials were collected through a literature review of Hadith commentaries, classical fiqh texts, and Indonesian family law regulations. The findings indicate that no authentic Hadith explicitly addresses the marriage of a woman pregnant due to fornication; however, general Hadiths provide a basis for legal reasoning (istinbāṭ) to protect lineage (ḥifẓ al-nasab). The Shafi'i and Hanafi schools permit the marriage of a pregnant woman with either the man who impregnated her or another man, although the Hanafi school prohibits sexual relations until childbirth when she marries another man. In contrast, the Maliki and Hanbali schools consider such marriage invalid until childbirth and repentance. Meanwhile, Article 53 of KHI permits a pregnant woman to marry the man who impregnated her without waiting for childbirth. This provision reflects an approach based on public welfare (maslaḥah), legal certainty, women's dignity, and the civil rights of children.

Abstract

The progress or decline of a nation is determined by the strength and quality of its character. A nation with good and strong character demonstrates the honor and dignity of its people. This article employs a library research approach with qualitative descriptive analysis of social phenomena by referring to texts, theories, or expert opinions. The analysis results show that good and strong character is a fundamental factor determining the existence, progress, and sustainability of a nation. When this nation finds its true identity, it can be free and sovereign. However, during a moral crisis and weak national character, social facts show that this nation is far from the goals of independence. The strategic alternative for Indonesia to realize the goals of independence is to strengthen character and cultural nationalism. From an Islamic perspective, noble character (akhlak) is the primary goal of the prophetic mission, as exemplified by Prophet Muhammad SAW who was sent to perfect noble morals. The six pillars of character according to Josephson - trustworthiness, respect, responsibility, fairness, caring, and citizenship - serve as the foundation for national character development.

Abstract

Domestic violence (DV) remains a serious and increasingly prevalent issue in Indonesia, despite two decades since the enactment of Law Number 23 of 2004 concerning the Elimination of Domestic Violence. This article analyzes the intricate relationship between domestic violence and the deeply entrenched patriarchal culture within Indonesian society. Employing a qualitative approach through normative legal research and literature review, the study reveals that patriarchal culture constitutes the fundamental root cause of domestic violence, where unequal power relations between men and women place women in subordinate positions, making them vulnerable to various forms of violence. The findings demonstrate that domestic violence is not a matter of economic status or social class, but rather a manifestation of societal perspectives and social constructions that normalize male dominance over women. This study concludes that addressing domestic violence requires a holistic approach that extends beyond legal instruments to encompass cultural transformation and gender equality, beginning from the smallest unit of society—the family. The research advocates for enhanced legal frameworks, improved gender sensitivity among law enforcement officials, and comprehensive educational programs to dismantle patriarchal norms that perpetuate violence against women in domestic settings.

Abstract

The development of modern criminal justice systems has encouraged a shift in criminal case resolution through a negotiated justice approach. The introduction of the Guilty Plea mechanism (plea bargaining) under Law Number 20 of 2025 concerning the Indonesian Criminal Procedure Code expands the authority of public prosecutors in determining the direction of criminal case resolution. This development raises concerns regarding the limits of prosecutorial authority within the framework of the dominus litis principle, particularly concerning prosecutorial discretion and accountability mechanisms. This study aims to analyze the construction of prosecutorial authority in the implementation of plea bargaining and to formulate an appropriate model based on the dominus litis principle. This research employs a normative juridical method using statutory and conceptual approaches. The findings reveal that the New Criminal Procedure Code has expanded the meaning of dominus litis from controlling prosecution to determining criminal case resolution strategies. However, such expansion requires limitations through clear standards, legal accountability, and adequate oversight mechanisms. This study proposes the concept of Accountable Limited Dominus Litis as a model that maintains the prosecutor’s role as the controller of criminal proceedings while ensuring accountability, proportionality, and protection of defendants’ rights.
