Abstract

Housing sale-purchase transactions are complex activities and are prone to default. The purpose of this research is to analyze the legal protection of consumers who experience defaults in housing sales and purchase transactions. This research uses normative legal research methods. The data collection technique in this research is done through literature study. The data is collected through a search of legal literature, laws and regulations related to housing sales and consumer protection, as well as court decisions relevant to cases of default in housing sales. The data sources used include books, scientific journals, articles, legal documents, and court decisions. The data collected is analyzed qualitatively using the content analysis method. The results show that the legal protection of consumers due to default in the sale and purchase of housing is in the form of contract law and consumer protection law. Legal efforts that can be made by the consumer if the perpetrator or seller of housing does not fulfill its obligations are by filing a lawsuit for compensation, mediation and arbitration based on default.

Abstract

Indonesia is an archipelagic nation with vast maritime territory. Consequently, maritime transportation plays a crucial role in supporting inter-island connectivity, trade, and various other economic sectors. In this context, ship leasing activities become a key aspect of the maritime industry in Indonesia. This academic article aims to analyze and document the legal protection for the parties involved in ship leasing activities in Indonesia. Ship leasing is a significant sector in the Indonesian maritime industry, involving various businesses and individuals. This research is conducted by delineating the legal aspects related to ship leasing contracts, the rights and obligations of the parties involved, and potential legal protection issues that may arise. The study discusses the legal framework governing ship leasing activities, including provisions regulating the rights and obligations of ship owners, lessees, and other relevant parties. In this research, the role of legal regulations in providing protection to the parties involved in ship leasing activities and the enforcement efforts will be considered. The research will also evaluate the challenges and opportunities faced by the parties in achieving adequate legal protection in ship leasing transactions. The research findings indicate the need for improvements in the implementation and understanding of legal aspects related to ship leasing in Indonesia. This article contributes to a better understanding of the legal framework governing these activities and promotes enhancements in the regulation and practices of the maritime industry.

Abstract

Indonesia has a large and rapidly growing maritime industry, with numerous shipping companies operating vessels for various purposes, including cargo and passenger transportation. Most of these vessels are managed by hardworking and high-risk crew members. Legal protection regarding social security benefits and employment termination for maritime crew in Indonesia is a crucial issue that demands serious attention. This research aims to analyze and document the implementation of legal protection for social security benefits and employment termination between shipping companies and crew members in Indonesia. The research is conducted by examining various legal sources and real-life cases within the maritime industry in Indonesia. This study discusses the legal framework governing the rights of crew members and the obligations of shipping companies in providing social security benefits, as well as the procedures for employment termination when necessary. Additionally, this article also highlights the challenges and issues frequently faced by crew members in attaining their rights, such as discrimination, unlawful termination, and gaps in social protection. In this research, the impact of legal regulations on the practices of shipping companies and the protection of crew members' rights will be considered. This research will also evaluate the effectiveness of oversight and law enforcement by authorities in safeguarding crew members' rights. The research results indicate the need for improvements in the implementation of legal protection for social security benefits and employment termination in the maritime sector in Indonesia. This article contributes to a better understanding of legal issues related to the rights of crew members and advocates for improvements in the regulation and practices of the maritime industry.

Abstract

The purpose of this study is to analyze and describe the responsibility of insurance parties for ship accidents at sea that provide legal certainty and justice; and to analyze and describe the legal protection and legal certainty provided by the insurance against ships2 that have accidents at sea. The type of research used is normative juridical Doctrinal legal research which is conceptualized as statutory rules, and doctrinal legal research which is conceptualized based on judges' decisions. Because normative legal research examines literature and library materials, there are also those who classify normative legal research as literature research. Insurance liability for ship accidents at sea is very important to provide legal certainty and justice for all parties involved. This requires legal certainty so that all parties know their respective rights and obligations, and justice to ensure that all parties get fair treatment according to the losses they have suffered. To protect the rights and interests of each party, the insurance provides legal protection and legal certainty for ships that have accidents at sea. With legal protection and certainty, the problems of the parties involved in ship accidents will be easier to resolve fairly

Abstract

This academic article aims to analyze the liability of shipowners for cases of environmental pollution resulting from oil spills by ships in Indonesia. Indonesia, as an archipelagic nation with significant maritime traffic, faces serious environmental pollution risks due to oil spills from maritime vessels. This research explores the legal aspects related to the liability of shipowners for environmental damage caused by oil spills in Indonesian waters. The article discusses the legal framework governing the responsibility of ship-owning companies, law enforcement procedures, and compensation responsibilities for environmental losses. Additionally, the research analyzes common issues that arise in oil spill cases, including difficulties in measuring environmental impacts, as well as the economic and social losses resulting from pollution. This analysis considers how existing legal regulations in Indonesia govern the liability of ship-owning companies in cases of environmental pollution, as well as the effectiveness of law enforcement in practice. The research also evaluates the challenges in handling oil spill cases and identifies efforts that can be improved to reduce negative impacts on the environment and society. The research findings indicate the need for improvements in the implementation and understanding of legal aspects related to shipowners' liability for oil spills in Indonesia. This article contributes to a deeper understanding of the legal framework governing the responsibility of ship-owning companies in cases of environmental pollution and encourages improvements in regulations and more sustainable industry practices in addressing environmental pollution issues caused by oil spills.

Abstract

This academic article aims to analyze the implementation of Government Regulation (GR) Number 31 of 2021 and GR Number 27 of 2021 in the issuance of certificates of fitness for fishing vessels at the Sorong Port in Indonesia. These regulations set the requirements and procedures related to certificates of fitness for fishing vessels, which are crucial for ensuring the safety and sustainability of the fishing industry in the region. This research documents how these government regulations are applied at the Sorong Port, identifies potential challenges that may arise in the certificate of fitness issuance process, and evaluates the effectiveness of law enforcement and oversight by relevant authorities. The study discusses the legal framework governing certificates of fitness for fishing vessels, including provisions related to safety standards, environmental protection, and other technical requirements that fishing vessels must comply with. Additionally, the article highlights common issues that arise in the practice of issuing certificates of fitness, such as meeting technical requirements and vessel fitness, as well as bureaucratic process-related problems. In this analysis, the impact of legal regulations on the practice of issuing certificates of fitness at the Sorong Port will be considered, as well as the role and effectiveness of oversight by authorities in ensuring that fishing vessels comply with applicable regulations. The research findings indicate the need for improvements in the implementation and enforcement of government regulations related to certificates of fitness for fishing vessels at the Sorong Port, Indonesia. This article contributes to a deeper understanding of the legal framework governing certificates of fitness for fishing vessels and promotes improvements in regulations and safer, more sustainable fishing industry practices.

Abstract

This research aims to analyze and document the employment status certainty of seafarers from the perspective of Indonesian positive law. Seafarers are a unique group of workers as they work on ships that sail in international waters, and they are often faced with working conditions different from those onshore workers. The study examines the legal framework governing the employment status of seafarers in Indonesia, with a focus on labor regulations, labor standards, and relevant international conventions. The article also explores various issues that frequently arise in seafarer employment practices, including their rights, terms of employment, wages, social protection, as well as issues related to health and safety protection. The analysis in this research considers the extent to which legal regulations in Indonesia provide employment status certainty for seafarers and how the implementation of these regulations impacts day-to-day seafarer employment practices. Furthermore, the research also evaluates the barriers and challenges faced by seafarers in obtaining their rights and appropriate legal protection. The research findings indicate that from the perspective of Indonesian positive law, the employment status certainty of seafarers still has some gaps and challenges that need to be addressed. This article provides a deeper insight into the legal framework governing seafarer employment in Indonesia and encourages better understanding of the protection of seafarer employment rights and improvements in applicable regulations.

Abstract

Investment regulations in Indonesia play a crucial role in enhancing business opportunities and investments. However, there exists an issue of overlapping regulations and implementation permits in the field that need to be addressed for greater effectiveness. Besides regulations, bureaucratic management also requires attention to improve investments due to its current lack of efficiency. The enhancement of investment regulations, capital injection, and improved implementation efficiency will significantly contribute to increased investments and business prospects in Indonesia. The primary issue in managing fisheries resources in Indonesia involves economic policies promoting the exploitation of fisheries resources and a lack of a robust management and law enforcement system. Central and regional government systems, work programs, and organizations need adjustments to support sustainable development in the fisheries sector. Through normative juridical research, primary legal data, theories, concepts, legal principles, and relevant legislation are studied. Policy reforms, regulatory system strengthening, import simplification, and infrastructure investments can improve the business environment. Consultations and discussions among the government, industry, and other stakeholders can align necessary regulations and ease business processes. The formation of regulations through the harmonization of investment-related rules in fisheries should adhere to investment law principles to create an appealing business environment for investors. The Indonesian government should also establish regulations supporting investments in the fisheries sector to achieve resource sustainability and economic growth.

Abstract

Research Objectives: a) To find out and analyze the Legal Arrangements for Customer Personal Data Protection in banking mobile banking services are still happening to the detriment of customers. b) To find out and analyze the Bank's Responsibility for the Confidentiality of Customer Personal Data in accordance with Law no. 27 of 2022. The method applied in this legal research is the study of normative juridical research methods, which refers to substance research from laws and regulations, books, journals and papers as well as other jurisprudence. However, this research is also based on empirical research where the data is taken from field studies. As a result, the theory of legal protection and legal certainty has a close relationship in legal regulation to the protection of customer personal data in mobile banking services. Legal protection theory emphasizes the importance of protecting human rights, including the right to personal data protection. The right to personal data protection is a human right guaranteed by the Constitution of the Republic of Indonesia Year 1945 (UUD 1945) Article 28G Paragraph (1).

Abstract

. Dalam perjanjian terdapat hak dan kewajiban bagi para yang melaksanakan perjanjian tersebut. Walaupun telah mengetahui hak dan kewajibannya, tidak jarang terjadi penyimpangan terhadap suatu perjanjian, yang tentunya akan mmenimbulkan kerugian bagi salah satu pihak. Jika salah satu pihak tidak menjalankan hal yang tidak menjadi hak dan kewajibannya sesuai dengan isi perjanjian, maka kelalaian tersebut dapat menyebabkan seseorang digugat dimuka pengadilan. Perbuatan tidak melaksanakan isi perjanjian dalam ilmu hukum disebut wanprestasi. Tujuan penelitian ini adalah untuk mengetahui wanprestasi kontrak jasa pengetesan sumur minyak antra PT.CPI dengan PT.SWE di lapangan minyak Minas – Riau. Jenis penelitian yang digunakan dalam penelitian ini, jenis penelitian yuridis normative. Dan diperoleh hasil bahwa Faktor-faktor penyebab wanprestasi dalam kontrak ini dapat bervariasi, termasuk ketidak jelasan spesifikasi, perubahan kondisi lapangan yang tidak terduga, atau kurangnya koordinasi antara pihak-pihak yang terlibat. Wanprestasi dapat mempengaruhi kelancaran operasi, mengakibatkan kerugian finansial, dan merugikan reputasi kedua belah pihak. Dalam upaya penyelesaian sengketa, PT. CPI dan PT. SWE telah melakukan langkah-langkah yang proaktif. Mereka mungkin telah mencoba negosiasi langsung untuk mencapai kesepakatan mengenai perubahan kontrak atau kompensasi atas wanprestasi yang terjadi.
