This research explores the implementation of the COLREG (Convention on the International Regulations for Preventing Collisions at Sea 1972) in efforts to prevent ship accidents in Indonesian waters, with the aim of supporting the country's economic growth. COLREG, referring to the Convention on the International Regulations for Preventing Collisions at Sea 1972, is a set of international rules governing ship navigation in global open waters. These rules are established by the International Maritime Organization (IMO) and focus on regulating ship navigation to prevent collisions at sea. Ship collision accidents have serious impacts, including risks to human life, property damage, and environmental consequences. The causes of these accidents can vary and may include human error, equipment malfunction, procedural violations, rule violations, external actions, and natural factors. The implementation of COLREG in Indonesia is essential for reducing collision incidents, especially those caused by human error. Although COLREG has not received official ratification, its implementation based on Presidential Decree No. 50 of 1979 serves as guidance followed by ships in Indonesia. Adherence to COLREG rules enhances navigation safety, ultimately contributing to economic growth through the maritime sector.

The Maritime Employment Agreement is the legal basis and framework that influences the professional lives and welfare of ship crew in the maritime industry. This thesis explores the form of a Maritime Work Agreement along with the legal remedies that can be taken regarding problems that occur in the Maritime Work Agreement for Harbor Tug crew members at PT. Waruna Nusa Sentana Jakarta is a leading shipping company in Jakarta, based on the laws and regulations in force in Indonesia. This research includes an in-depth analysis of the Sea Work Agreement implemented by PT. Waruna Nusa Sentana Jakarta, with a focus on the validity of the Sea Work Agreement, the implementation of the Sea Work Agreement, obstacles in implementing the Sea Work Agreement, as well as resolving problems if disputes occur in the Sea Work Agreement in Harbor Tug ship crew PT. Waruna Nusa Sentana Jakarta. Through a mixed approach involving surveys, and document reviews, this thesis uncovers a variety of individual perspectives and experiences in maritime employment relations. The research results highlight variations in Maritime Labor Agreements implemented in these companies and their implications for crew welfare and motivation. In a broader context, this thesis also discusses the challenges and opportunities faced by shipping companies and the government in ensuring the protection of maritime workers' rights and maintaining the sustainability of the maritime industry. The findings of this research provide important insights for Harbor Tug Crew members who will join to work on board ships, for shipping companies in improving their Maritime Labor Agreements, promoting healthy working relationships, and ensuring better welfare standards for crew members and for governments. as a legal regulator in Indonesia. Thus, this thesis contributes to a better understanding of the role and impact of Maritime Work Agreements in the vital harbor tug vessel sector at PT. Waruna Nusa Sentana Jakarta and the maritime sector as a whole.

This academic article aims to analyze the legal protection for container terminal operators regarding container damage that occurs during the loading and unloading processes at container terminals. Container terminals are crucial components in the logistics and international trade supply chain, and container damage during the loading and unloading processes can lead to serious consequences, including financial losses and shipment delays. This research documents the legal framework governing the obligations and responsibilities of container terminal operators in the loading and unloading services. The article discusses the legal aspects that regulate the responsibilities of terminal operators related to container management, procedures for damage claims, and compensation mechanisms for container owners. Additionally, the study analyzes common issues that arise in container loading and unloading practices, including regulatory ambiguities, differences in contract interpretation, and challenges in proving damage occurring during transportation. In this analysis, the impact of legal regulations on the responsibilities of container terminal operators and the role of dispute resolution institutions in handling damage claims will be considered. The research also evaluates ways to enhance legal protection for container terminal operators and container owners. The research findings highlight the need for improvements in the implementation and understanding of legal aspects related to legal protection for container terminal operators against container damage in loading and unloading services. This article contributes to a deeper understanding of the legal framework governing responsibilities in the container terminal industry and promotes improvements in regulations and industry practices that are fair and transparent.

This academic article aims to analyze the employment status certainty of seafarers from the perspective of Indonesian positive law. Seafarers are a unique group of workers as they work on ships that sail in international waters. In this context, the article documents and analyzes the legal framework governing the employment status of seafarers in Indonesia, as well as the common issues that arise in seafarer employment practices. The study examines the legal aspects that influence the employment status of seafarers, such as labor regulations, labor standards, and relevant international conventions. The article also highlights crucial issues, including workers' rights, terms of employment, wages, and social protection for seafarers. In this analysis, it will be considered how far Indonesian legal regulations provide employment status certainty for seafarers and how they are implemented in daily practice. The research also evaluates the challenges faced by seafarers in obtaining their rights and appropriate legal protection. The research findings indicate that the employment status certainty of seafarers under Indonesian positive law still requires attention and improvement. This article contributes to a deeper understanding of the legal framework governing seafarer employment and encourages improvements in regulations and the protection of seafarer employment rights in Indonesia.

This study explores the concept and implementation of dignified education in Indonesia, emphasizing the importance of integrating legal, moral, and philosophical values into the national education system. The research is motivated by the increasing cases of academic dishonesty and the weakening of moral values in the academic environment, particularly at the university level. The objective is to analyze how dignified education, rooted in the values enshrined in the 1945 Constitution and National Education Law, can be upheld and safeguarded through legal and philosophical frameworks. Using a normative juridical approach, this literature-based study examines secondary data such as regulations, philosophical theories—especially pragmatism as articulated by John Dewey—and documented cases of educational malpractice. The findings reveal that Indonesia’s legal structure already provides strong support for dignified education, but challenges persist due to the dominance of pragmatic, result-oriented attitudes over idealism in academia. Such attitudes foster unethical practices like the use of assignment jockeys and the commercialization of academic degrees. The study implies that dignified education must go beyond intellectual development to include the nurturing of moral integrity and legal compliance. It calls for a cultural and structural reform in higher education institutions to prioritize integrity and ethical conduct, supported by strict enforcement of academic regulations and promotion of holistic character education. This integration is essential to produce responsible and dignified citizens, which aligns with the national goal of educating the life of the nation.

This study aims to provide a juridical analysis of dispute resolution in the Industrial Relations Court involving an individual who claims to have an employment relationship with a company, focusing on Case Decision No. 141/Pdt.Sus-PHI/2023/PN.Jkt.Pst. Employment disputes frequently arise due to unclear worker status and the legal relationship between individuals and companies. This research applies a normative juridical method using statute and case approaches. Data were obtained through library research, including primary, secondary, and tertiary legal materials. The findings indicate that the elements of an employment relationship, as regulated by law, must be objectively fulfilled for a person to be recognized as a worker. In the case study, the court assessed the existence of an employment relationship based on relevant legal facts. This research contributes to the understanding of legal protection for workers with disputed status and highlights the importance of justice in resolving industrial relations disputes.

Sektor pertambangan di Indonesia merupakan salah satu industri dengan tingkat risiko kecelakaan kerja yang tinggi. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum yang diatur dalam peraturan perundang-undangan bagi pekerja yang mengalami kecelakaan kerja di sektor pertambangan dan mengkaji tanggung jawab pemberi kerja terhadap pekerja yang mengalami kecelakaan kerja menurut ketentuan hukum yang berlaku. Metode penelitian menggunakan pendekatan yuridis-normatif dengan analisis peraturan perundang-undangan dan konsep hukum yang relevan. Hasil penelitian menunjukkan bahwa perlindungan hukum bagi pekerja tambang diatur melalui dua pendekatan utama yaitu preventif dan represif. Perlindungan preventif meliputi kewajiban perusahaan menerapkan Sistem Manajemen Keselamatan dan Kesehatan Kerja (SMK3), menyediakan alat pelindung diri, dan mematuhi kaidah teknik pertambangan yang baik. Perlindungan represif mencakup sanksi administratif, penghentian operasi, dan ancaman pidana bagi pelanggaran keselamatan kerja. Tanggung jawab pemberi kerja pasca kecelakaan meliputi pemberian pertolongan pertama, pelaporan kepada otoritas terkait, pembiayaan pengobatan dan rehabilitasi, pemberian kompensasi, serta larangan pemutusan hubungan kerja selama masa pengobatan.

Perlindungan hukum memiliki makna yang sangat luas, dikatakan demikian karena perlindungan hukum dapat diberikan kepada konsumen/ nasabah/debitur, dan perlindungan hukum juga dapat diberikan kepada kreditur dan/ataupun produsen. Penelitian ini bertujuan untuk menganalisis dan mengetahui penyalahgunaan dokumen SKA serta mencari perlindungan hukum yang ideal bagi produsen dalam negeri dalam menghadapi maraknya impor tekstil dengan memanfaatkan dokumen SKA. Metode Penelitian yang akan dilakukan adalah penelitian yuridis normative. Hasil dari pembahasan kasus penyalahgunaan dokumen Surat Keterangan Asal (SKA) dalam penyelundupan tekstil dari Cina ke Indonesia melibatkan terdakwa, Drs. IRIANTO, yang merupakan Komisaris PT. FLEMINGS INDO BATAM (FIB) dan Direktur PT. PETER GARMINDO PRIMA (PGP). Mereka memanfaatkan kebijakan bea masuk dari Negara India untuk mengimpor tekstil berkualitas tinggi dengan menggunakan dokumen invoice yang dimanipulasi untuk mengurangi pembayaran bea masuk. Barang impor tersebut tidak diolah di perusahaan mereka tetapi disimpan di Petrolog Batam untuk diimpor kembali ke Jakarta dengan dokumen palsu. Tindakan ini melanggar peraturan impor tekstil dan Kepabeanan serta UU Pemberantasan Tindak Pidana Korupsi. Terdakwa juga disebut menyuap pejabat Bea Cukai Pelabuhan Batam agar tidak memeriksa kontainer impor. Akibatnya, industri tekstil dalam negeri mengalami kerugian. Proses hukum melibatkan penyidikan, penuntutan, dan pengadilan di Pengadilan Tindak Pidana Korupsi Jakarta yang menghasilkan hukuman penjara dan denda bagi terdakwa dan beberapa pejabat Bea Cukai Pelabuhan Batam. Kasus ini termasuk dalam kejahatan jabatan yang dapat menyebabkan pemberhentian sementara PNS yang terlibat.

Perusahaan asuransi menanggung pertanggungan selama pengangkutan dari pelabuhan hingga ke tempat tujuan. Penelitian ini bertujuan untuk memahami dan menganalisis upaya dan hambatan Otoritas Jasa Keuangan terhadap penyelesaian sengketa tentang penolakan klaim polis asuransi, mengkaji dan menganalisa tentang kewenangan Otoritas Jasa Keuangan dalam perlindungan hukum terhadap tertanggung dalam penolakan klaim polis asuransi. Teori yang digunakan ialah Teori keadilan, teori perlindungan hukum dan teori pertanggungjawaban hukum. Metode yang diterapkan dalah kajian metode penelitian yuridis normatif. Pendekatan penelitian yang digunakan dalam penelitian ini Pendekatan Undang-Undang (Statue Approach) dan Pendekatan analitis (Analytical Approach). Hasil Penelitian upaya pemberian perlindungan hukum terhadap tertanggung khususnya dalam penolak klaim polis asuransi yang diajukan ke Otoritas Jasa keuangan. Otoritas Jasa Keuangan dalam melakukan prinsip – prinsip pelaksanaannya, antara lain: Prinsip Transparansi, Prinsip Perlakuan yang adil, Prinsip Keadilan, Prinsip Kerahasiaan dan Keamanan Data, Prinsip Penanganan Pengaduan dan Hambatan yang dihadapi adalah Kendala Internal, meliputi Pengaduan yang disampaikan nasabah kurang jelas dan Bukti pengaduan berupa dokumen pendukung yang disampaikan kurang lengkap, kendala Eksternal, yaitu: Kurangnya Informasi yang didapat dan Kurangnya pemahaman Tertanggung terhadap produk-produk asuransi yang ingin dilakukan. Serta, Otoritas Jasa Keuangan berfungsi menyelenggarakan sistem pengaturan dan pengawasan terintegrasi terhadap keseluruhan kegiatan dalam sektor jasa keuangan di Indonesia. Kesimpulan: kewenangan Otoritas Jasa Keuangan dalam memberikan perlindungan hukum terhadap Tertanggung dalam penolakan klaim asuransi asuransi, yaitu dengan memberikan perlindungan hukum preventif dan represif.

Pencemaran dan kerusakan lingkungan hidup akan terjadi apabila kandungan limbah B3 yang tercemar ke dalam lingkungan telah melampaui baku mutu lingkungan hidup. Tujuan dari penelitian ini adalah untuk menguraikan dan menganalisis landasan hukum yang mengatur hak korban pencemaran lingkungan akibat limbah B3 untuk memperoleh restitusi, serta menguraikan dan menganalisis tata cara permohonan, pelaksanaan, dan pemberian restitusi kepada korban pencemaran lingkungan hidup akibat limbah B3. Metode penelitian ini adalah penelitian hukum yuridis normative dengan pertimbangan bahwa titik tolak penelitian analisis terhadap peraturan perundang-undangan yang mengatur pelanggaran pencemaran lingkungan. Hasil penelitian menunjukan Penelitian ini menganalisis restitusi dalam Undang-Undang Nomor 32 Tahun 2009 tentang Pengelolaan dan Perlindungan Lingkungan Hidup (UUPPLH). Pembangunan yang tidak terkontrol sering menyebabkan pencemaran lingkungan, yang berdampak buruk pada korban. Meskipun UUPPLH tidak secara khusus mengatur pemberian ganti rugi atau restitusi kepada korban pencemaran lingkungan, Peraturan Mahkamah Agung (Perma) Nomor 1 Tahun 2022 tentang Tata Cara Penyelesaian Permohonan dan Pemberian Restitusi dan Kompensasi kepada Korban Tindak Pidana memberikan harapan baru. Perma ini mencakup hak restitusi bagi korban pencemaran lingkungan, namun pelaksanaannya memerlukan inisiatif dari korban. Hingga saat ini, belum ada putusan pengadilan yang memberikan restitusi kepada korban pencemaran lingkungan berdasarkan UUPPLH. Kesimpulan menunjukkan perlunya penguatan mekanisme hukum yang menjamin perlindungan dan pemulihan hak-hak korban pencemaran lingkungan, baik melalui jalur peradilan maupun di luar pengadilan.
