Abstract

Implementing the free market in the ASEAN region is one way to grow an advanced economy. Entrepreneurs must be able to compete in this free market era, including small businesses in Indonesia. Small businesses in Indonesia have an essential role in social welfare and economic development in Indonesia. Therefore, the presence of small businesses must be protected because small businesses are absorption of labor. For this reason, a problem must be answered: how to provide legal protection for small businesses in Indonesia's free market era. Meanwhile, the research method used in this study is a normative legal research method, namely library law research conducted by examining library materials or mere secondary data. This research resulted in a conclusion that legal protection is essential to be provided by the government for MSMEs in Indonesia so that there is legal certainty in guaranteeing the activities of small business actors; several Laws and Invitations have been issued which regulate them among others, the MSME Law, and Law No. 7 of 1994 concerning the Agreement Establishing the World Trade Organization.

Abstract

Abstract: Women play an important role in economic development, including in the Micro, Small and Medium Enterprises (MSME) sector. In Indonesia, women contribute significantly to MSMEs. However, women still face various obstacles in developing MSMEs. This research aims to analyze the role of women in MSMEs from an economic legal perspective. This study used qualitative research methods. The data collection technique in this research is literature study. The data that has been collected is then analyzed in three stages, namely data reduction, data presentation and drawing conclusions. The research results show that women have an important role in MSMEs, both as business owners, workers and consumers. Women contribute to MSMEs in various aspects, such as production, innovation and networks. Economic law has an important role in supporting women's empowerment in the MSME sector. Economic law can provide legal protection for women in MSMEs, such as the right to access capital, the right to training and education, and the right to protection from discrimination.

Abstract

This study aims to determine consumer legal protection in general insurance agreements and special marine creep insurance as one of Indonesia's economic development. This research is a mixed research method (mix method), namely normative juridical and empirical juridical. Data collection techniques Primary, secondary, and tertiary legal sources are among the legal materials studied and evaluated in this normative legal study. The results of the study show that legal protection for consumers in insurance agreements and practices is generally regulated in the Civil Code, the Commercial Code, Law No. 40 of 2014 concerning Insurance Business and the Consumer Protection Act which each of these rules contains related to the legal protection of insurance agreements. Legal protection for insurance customers, the insurance (guarantor) will provide compensation to the insured (customer) in accordance with the methods and conditions contained in the policy. Against losses resulting from guaranteed risks such as property losses resulting from a hazard or disaster.

Abstract

A fiduciary guarantee is one of the material guarantees known in positive law to carry out the function of a bank or creditor running its business, providing credit to its customer or debtor, and offering credit by the bank (the creditor) to its customer (the debtor), based on the ability and ability of the debtor to take debt advantage. In providing credit to customers (debtors), of course, there are conditions of a guarantee that must meet by debtors. There are problems from the results of the explanation, among others, first, legal protection for creditors in the fiduciary guarantee agreement, and second, the arrangement of fiduciary guarantee rights holders. This study uses a normative legal research method, which focuses on library studies, and this research uses a Legislation approach and is descriptive of qualitative analysis. Then from the first results, legal protection for the interests of creditors as fiduciaries is to provide definite provisions for creditors and complete data arrangements that must include in the fiduciary guarantee. Second, the performance of fiduciary rights holders in Indonesia, contained in Book II of the Civil Code, Law Number 42 of 1999 concerning Fiduciary Rights, and Law Number 4 of 1996 concerning Mortgage Rights

Abstract

The government has issued several Laws and Regulations - Invitations to overcome the economic impact of Covid-19 due to the increasing number of bankruptcies and Suspension of Debt Payment Obligations (DPO-PKPU) in court. Therefore, the government issued a policy through Financial Services Authority (FSA-OJK) Regulation Number 48/POJK.03/2020 of 2020 concerning Amendments to FSA Regulation Number 11/POJK.3/2020 concerning National Economic Stimulus as a Countercyclical Policy Impact of the Spread of Corona Virus Disease 2019. However, previously the government had issued Law Number 37 of 2004 concerning Bankruptcy and PKPU as a form of legal protection for Bankruptcy, especially recently since Indonesia experienced the Covid-19 pandemic. In general, the economy has not been comprehensively resolved, so creditors and debtors, in solving their problems, prefer to carry out legal settlements through Bankruptcy and PKPU. In this study, there are several problems, namely, 1) What is the role of the government towards creditors under the Law on Bankruptcy and PKPU; 2) What forms of legal protection arrangements are provided for Bankruptcy? This research method uses normative or doctrinal juridical research, namely legal research that is based on or refers to the application of legal norms or norms contained in the Legislation - Invitation concerning the role of government in legal protection of Bankruptcy based on the Bankruptcy Act and PKPU.

Abstract

Globalization has significantly changed international trade law and investment in countries like Indonesia. To improve people's welfare through international trade and foreign investment, because the more significant the output, the greater the foreign exchange that comes in, so that it becomes a source of income for the state treasury. To accelerate the national economy's growth and realize Indonesia's political and economic sovereignty, investment must be increased to transform economic potential into economic power. This study employs a normative juridical research approach, namely a procedure to identify the rule of law, legal principles, and legal doctrines about foreign commerce and investment in Indonesia. The problem of this research is 1). How is international trade regulation from the perspective of investment law in Indonesia? 2). What forms of international trade and investment are based on Law Number 25 of 2007 concerning Investment? This research resulted in the following conclusions: Regulations should be in international trade and investment, and regulations on taxes and agreements set forth by investment companies. The Forms of International Trade are divided into 2, namely bilateral trade and multilateral trade.

Abstract

Consumer protection law is essential in safeguarding rights against fraud and unfair practices, relying on both private institutions and governmental enforcement. This study aims to analyze the legal frameworks of consumer protection in Indonesia. It also examines the roles of institutions in the legal enforcement of consumer protection, particularly their function in maintaining the balance of relations between consumers and producers in the context of globalization and extensive online marketing. The methodology employed is normative legal research, which examines Indonesia’s Consumer Protection Law (Law Number 8 of 1999) through the lens of key concepts such as consumer rights, the institutional roles in enforcing these rights, and ensuring fair business practices. The findings underscore the importance of various consumer protection institutions, such as National Consumer Protection Agency (Badan Perlindungan Konsumen Nasional or BPKN), Non-Governmental Consumer Protection Institution (Lembaga Perlindungan Konsumen Swadaya Masyarakat or LPKSM), Consumer Dispute Resolution Agency (Badan Penyelesaian Sengketa Konsumen or BPSK), in Indonesia, which serve to educate, supervise, and assist consumers in resolving disputes with businesses. This study also identifies the challenges in implementing consumer protection law, particularly concerning the broad range of involved institutions, as well as the need for heightened consumer awareness and greater accountability from business actors.

Abstract

Article History Received: Revised: Published: Keywords: Consumer Protection Law, Maritime Transportation, Shipping Companies Abstract: Maritime cargo transportation is inherently fraught with risks that can cause losses to cargo owners. The goods being transported are at risk of damage or loss during the journey due to natural factors or human negligence, including ship accidents that can result in total loss. Therefore, it is crucial to explore the extent of the compensation obligations of shipping companies for transported goods under consumer protection law, as well as the application of compensation in cases of cargo ship accidents. This study employs a normative juridical method, focusing on the analysis of statutory regulations, books, journals, and relevant papers. The data collection technique utilized is library research, encompassing secondary materials. The findings of this study indicate that, first, the compensation obligations of shipping companies are in accordance with Law Number 8 of 1999 concerning Consumer Protection. From the perspective of consumer protection law, shipping companies are responsible for losses suffered by senders or third parties due to negligence in performing transportation services. This responsibility includes damage or delays in the delivery of goods. Second, in the event of a cargo ship accident, the affected parties can file an official and written claim with the shipping company, supported by valid documentation. Claim resolution is typically based on principles of kinship and deliberation but may also involve repairs to damaged goods as a form of compensation. KataKunci: Hukum Perlindungan Konsumen, Pengangkutan Laut, Perusahaan Kapal Abstrak: Pengangkutan barang melalui laut tidak terlepas dari berbagai risiko yang dapat merugikan pemilik barang. Barang yang diangkut berisiko mengalami kerusakan atau kehilangan selama perjalanan akibat faktor alam atau kelalaian manusia, termasuk kecelakaan kapal yang dapat menyebabkan kerugian total. Oleh karena itu, penting untuk mengeksplorasi sejauh mana kewajiban ganti rugi perusahaan perkapalan pengangkut barang berdasarkan hukum perlindungan konsumen, serta bagaimana penerapan ganti rugi dalam kasus kecelakaan kapal pengangkut barang. Penelitian ini menggunakan metode yuridis normatif dengan analisis substansi peraturan perundang-undangan, buku, jurnal, dan makalah terkait. Teknik pengumpulan data dilakukan melalui studi kepustakaan (library research) yang mencakup bahan sekunder. Hasil penelitian menunjukkan bahwa, pertama, kewajiban ganti rugi perusahaan perkapalan pengangkut barang sesuai dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Dalam perspektif hukum perlindungan konsumen, perusahaan pengangkutan barang bertanggung jawab atas kerugian yang dialami oleh pengirim atau pihak ketiga akibat kelalaian dalam pelaksanaan layanan pengangkutan. Tanggung jawab ini mencakup kerusakan atau keterlambatan pengiriman barang. Kedua, dalam kasus kecelakaan kapal pengangkut barang, pihak yang dirugikan dapat mengajukan klaim resmi dan tertulis kepada perusahaan pengangkut dengan melampirkan dokumen-dokumen yang sah. Penyelesaian klaim biasanya dilakukan berdasarkan asas kekeluargaan dan musyawarah, namun juga dapat meliputi perbaikan terhadap barang-barang yang rusak sebagai bentuk pembayaran ganti rugi.

Abstract

Housing sale-purchase transactions are complex activities and are prone to default. The purpose of this research is to analyze the legal protection of consumers who experience defaults in housing sales and purchase transactions. This research uses normative legal research methods. The data collection technique in this research is done through literature study. The data is collected through a search of legal literature, laws and regulations related to housing sales and consumer protection, as well as court decisions relevant to cases of default in housing sales. The data sources used include books, scientific journals, articles, legal documents, and court decisions. The data collected is analyzed qualitatively using the content analysis method. The results show that the legal protection of consumers due to default in the sale and purchase of housing is in the form of contract law and consumer protection law. Legal efforts that can be made by the consumer if the perpetrator or seller of housing does not fulfill its obligations are by filing a lawsuit for compensation, mediation and arbitration based on default.

Abstract

Penyelesaian sengketa perjanjian Kredit Pemilikan Rumah (KPR) melalui Badan Penyelesaian Sengketa Konsumen (BPSK) menjadi isu penting dalam sistem perlindungan konsumen di Indonesia. Banyak konsumen yang merasa dirugikan oleh pelaku usaha dalam perjanjian KPR, yang sering kali melibatkan inkonsistensi dalam pemenuhan kewajiban dan hak-hak yang tidak terlindungi dengan baik. Penelitian ini bertujuan untuk menganalisis dasar hukum dalam penyelesaian sengketa KPR melalui BPSK dan memahami pertimbangan hakim dalam membatalkan putusan BPSK melalui Putusan Mahkamah Agung Nomor: 163K/Pdt.Sus-BPSK/2017. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan deskriptif, yang mengkaji peraturan perundang-undangan dan studi kasus terkait sengketa KPR. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang Perlindungan Konsumen memberikan kewenangan kepada BPSK untuk menyelesaikan sengketa, praktik di lapangan menunjukkan adanya inkonsistensi dalam penerapan hukum yang menyebabkan putusan BPSK dapat dibatalkan oleh Mahkamah Agung. Implikasi penelitian ini diharapkan dapat memberikan pemahaman yang lebih mendalam mengenai mekanisme penyelesaian sengketa KPR, serta memberikan masukan bagi penguatan perlindungan konsumen dan penyempurnaan regulasi terkait penyelesaian sengketa di luar pengadilan.
