Abstract

This research aims to analyze and document the employment status certainty of seafarers from the perspective of Indonesian positive law. Seafarers are a unique group of workers as they work on ships that sail in international waters, and they are often faced with working conditions different from those onshore workers. The study examines the legal framework governing the employment status of seafarers in Indonesia, with a focus on labor regulations, labor standards, and relevant international conventions. The article also explores various issues that frequently arise in seafarer employment practices, including their rights, terms of employment, wages, social protection, as well as issues related to health and safety protection. The analysis in this research considers the extent to which legal regulations in Indonesia provide employment status certainty for seafarers and how the implementation of these regulations impacts day-to-day seafarer employment practices. Furthermore, the research also evaluates the barriers and challenges faced by seafarers in obtaining their rights and appropriate legal protection. The research findings indicate that from the perspective of Indonesian positive law, the employment status certainty of seafarers still has some gaps and challenges that need to be addressed. This article provides a deeper insight into the legal framework governing seafarer employment in Indonesia and encourages better understanding of the protection of seafarer employment rights and improvements in applicable regulations.

Abstract

Investment regulations in Indonesia play a crucial role in enhancing business opportunities and investments. However, there exists an issue of overlapping regulations and implementation permits in the field that need to be addressed for greater effectiveness. Besides regulations, bureaucratic management also requires attention to improve investments due to its current lack of efficiency. The enhancement of investment regulations, capital injection, and improved implementation efficiency will significantly contribute to increased investments and business prospects in Indonesia. The primary issue in managing fisheries resources in Indonesia involves economic policies promoting the exploitation of fisheries resources and a lack of a robust management and law enforcement system. Central and regional government systems, work programs, and organizations need adjustments to support sustainable development in the fisheries sector. Through normative juridical research, primary legal data, theories, concepts, legal principles, and relevant legislation are studied. Policy reforms, regulatory system strengthening, import simplification, and infrastructure investments can improve the business environment. Consultations and discussions among the government, industry, and other stakeholders can align necessary regulations and ease business processes. The formation of regulations through the harmonization of investment-related rules in fisheries should adhere to investment law principles to create an appealing business environment for investors. The Indonesian government should also establish regulations supporting investments in the fisheries sector to achieve resource sustainability and economic growth.

Abstract

Research Objectives: a) To find out and analyze the Legal Arrangements for Customer Personal Data Protection in banking mobile banking services are still happening to the detriment of customers. b) To find out and analyze the Bank's Responsibility for the Confidentiality of Customer Personal Data in accordance with Law no. 27 of 2022. The method applied in this legal research is the study of normative juridical research methods, which refers to substance research from laws and regulations, books, journals and papers as well as other jurisprudence. However, this research is also based on empirical research where the data is taken from field studies. As a result, the theory of legal protection and legal certainty has a close relationship in legal regulation to the protection of customer personal data in mobile banking services. Legal protection theory emphasizes the importance of protecting human rights, including the right to personal data protection. The right to personal data protection is a human right guaranteed by the Constitution of the Republic of Indonesia Year 1945 (UUD 1945) Article 28G Paragraph (1).

Abstract

. Dalam perjanjian terdapat hak dan kewajiban bagi para yang melaksanakan perjanjian tersebut. Walaupun telah mengetahui hak dan kewajibannya, tidak jarang terjadi penyimpangan terhadap suatu perjanjian, yang tentunya akan mmenimbulkan kerugian bagi salah satu pihak. Jika salah satu pihak tidak menjalankan hal yang tidak menjadi hak dan kewajibannya sesuai dengan isi perjanjian, maka kelalaian tersebut dapat menyebabkan seseorang digugat dimuka pengadilan. Perbuatan tidak melaksanakan isi perjanjian dalam ilmu hukum disebut wanprestasi. Tujuan penelitian ini adalah untuk mengetahui wanprestasi kontrak jasa pengetesan sumur minyak antra PT.CPI dengan PT.SWE di lapangan minyak Minas – Riau. Jenis penelitian yang digunakan dalam penelitian ini, jenis penelitian yuridis normative. Dan diperoleh hasil bahwa Faktor-faktor penyebab wanprestasi dalam kontrak ini dapat bervariasi, termasuk ketidak jelasan spesifikasi, perubahan kondisi lapangan yang tidak terduga, atau kurangnya koordinasi antara pihak-pihak yang terlibat. Wanprestasi dapat mempengaruhi kelancaran operasi, mengakibatkan kerugian finansial, dan merugikan reputasi kedua belah pihak. Dalam upaya penyelesaian sengketa, PT. CPI dan PT. SWE telah melakukan langkah-langkah yang proaktif. Mereka mungkin telah mencoba negosiasi langsung untuk mencapai kesepakatan mengenai perubahan kontrak atau kompensasi atas wanprestasi yang terjadi.

Abstract

Kebijakan Dasar Pertanahan yang menetapkan tanah sebagai Karunia Tuhan Yang Maha Esa diatur dalam Undang-Undang Pokok Agraria adalah mengenai bumi, air dan ruang angkasa dalam wilayah Negara Republik Indonesia harus selalu dilandasi persatuan kesatuan bangsa untuk sebesar-besarnya kemakmuran rakyat, Dalam penelitian ini, penulis menggunakan tipe penelitian hukum Yuridis Normatif, yaitu suatu jenis penelitian hukum dengan menguraikan suatu permasalahan hukum dengan menganalisis suatu hukum serta melalui peraturan Perundang-Undangan, literatur yang dapat diperoleh melalui studi kepustakaan. Pelaksanaan Tahapan sinkronisasi Penetapan Peta Lahan Sawah yang Dilindungi (LSD) dengan Rencana Tata Ruang Wilayah (RTRW) Kabupaten/Kota, Sering terjadinya alih fungsi lahan sawah di Indonesia mendorong pemerintah untuk melakukan upaya perlindungan eksistensi lahan sawah untuk menjamin ketersediaan lahan sawah sebagai bentuk hak menguasai dari negara. Oleh karena itu, melalui Peraturan Presiden Nomor 59 Tahun 2019, pemerintah mengamanatkan untuk percepatan penetapan peta lahan sawah yang dilindungi sebagai bentuk perlindungan eksistensi lahan sawah. Dalam praktiknya, terjadi ketidaksesuaian antara peta lahan sawah yang dilindungi dengan rencana tata ruang wilayah suatu daerah, penetapan peta lahan sawah yang dilindungi melalui tiga tahapan yaitu verifikasi lahan sawah, sinkronisasi hasil verifikasi lahan sawah, dan pelaksanaan penetapan peta lahan sawah yang dilindungi, kedua, sinkronisasi peta lahan sawah yang dilindungi dengan rencana tata ruang wilayah dapat dilakukan melalui permohonan dikeluarkannya lahan dari peta lahan sawah yang dilindungi selama memenuhi kriteria dalam Petunjuk Teknis Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional Nomor 5/Juknis-HK.02/VI/2022 dan selanjutnya dilakukan perubahan peta lahan sawah yang dilindungi oleh perangkat daerah, ketua tim pelaksana, dan tim terpadu untuk terwujudnya sinkronisasi antar peraturan

Abstract

Perkembangan teknologi informasi dan komunikasi (TIK) telah mengubah cara berbisnis, termasuk dalam hal promosi produk. Kini, banyak pelaku usaha kecil dan menengah (UMKM) di Indonesia yang memanfaatkan aplikasi TikTok sebagai sarana media promosi produk. Namun, penggunaan TikTok sebagai media promosi produk UMKM di Indonesia belum memiliki regulasi yang jelas. Tujuan penelitian ini untuk menganalisis politik hukum perdagangan dalam penggunaan aplikasi TikTok sebagai sarana media promosi produk UMKM di Indonesia. Penelitian ini menggunakan metode penelitian normatif. Teknik pengumpulan data pada penelitian ini yakni dengan studi dokumen  terhadap peraturan perundang-undangan, bahan hukum sekunder, dan putusan pengadilan. Data yang telah terkumpul kemudian dianalisis dalam tiga tahapan yakni reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian menunjukan bahwa TikTok sebagai media promosi produk UMKM di Indonesia dinilai efektif mengingat algoritma yang dimiliki aplikasi tersebut yakni menjangkau konten yang cocok untuk setiap penggunanya, sehingga promosi UMKM dapat menjadi relevan dengan target audiensnya. Namun, Pemerintah Indonesia melalui Peraturan Menteri Komunicasi dan Informatika Nomor 31 Tahun 2023 mendorong pemisahan antara bisnis media sosial dan layanan e-commerce, sehingga pemerintah harus memastikan bahwa promosi produk UMKM melalui TikTok berjalan sesuai dengan ketentuan hukum yang berlaku, termasuk dalam hal keamanan data dan transparansi informasi.

Abstract

The aim of this research is to implement legal protection for consumers regarding food that has expired in accordance with the Consumer Protection Law Number 8 of 1999 as well as legal considerations regarding decision Number 61/PID.B/2018/PN.CBN. This research writing method uses normative research methods because it is based on statutory regulations and doctrine, by examining the existing legal regulations and their relationship to cases that have occurred previously.The results and conclusions from writing this research are that by distributing food that has expired, the producer concerned does not comply with the rules contained in the Consumer Protection Law so that supporting institutions such as BPOM are needed to follow up and supervise food distributed in the community so that it can controlling expired consumer products so that they do not continue to harm consumers.

Abstract

The digital revolution has changed various aspects of life, including the trade sector. The development of information & communication technology (ICT) gave birth to renewable business models, such as e-transactions in buying and selling. However, online transaction activities in purchasing and vending also present various challenges, one of which is related to legal certainty for MSME business actors. This research aims to identify legal certainty problems MSME business actors face in online purchasing and vending. The method used in the study is a normative juridical approach that examines legislation. Data was collected through literature studies related to regulations when carrying out online buying and selling transactions, the rights of MSME business actors, and dispute resolution mechanisms. The data analysis method employed in this study is a qualitative analysis using deductive approaches. The research results show that legal clarity for MSME business actors involved in the online buying and selling process in the digitalization era is important in ensuring that trade transactions carried out via digital platforms occur with transparency, security, and by applicable legal Wprovisions. The law governing online purchasing and vending is based on principles stipulated in Article 34(1) of the 1945 Constitution. It is embodied in Legislation No. 20 of 2008 regarding Micro, Small, and Medium Enterprises (MSMEs). This regulation is the basis for all legal regulations governing MSMEs to provide adequate protection for MSME actors.

Abstract

Law Number 33 of 2014 concerning Halal Product Assurance (JPH Law) aims to protect consumers and increase the competitive ability of Indonesian halal products in the world market, which is included in the aspects listed in the JPH Law, namely the obligation for business actors to obtain halal certificates for goods that business actors produce and trade. The focus of the study aims to evaluate the extent of legal effectiveness in the application of halal product assurance certification by MSME business actors. The research method used is qualitative with techniques in collecting data, namely literature studies. After the data is collected, data analysis is carried out which includes the stages of data simplification, data presentation and conclusion making. The conclusion of the study explains that the effectiveness of the law in implementing halal product assurance certification for MSME business actors is still at a low level. Several obstacles were identified, such as lack of knowledge about the JPH Law and the halal certification process, the relatively expensive cost of halal certification, the halal certification process which is considered complicated and convoluted and lack of assistance and socialization from the government.

Abstract

This research explores the legal standing of a country as a distinct entity in international trade law, endowed with sovereign authority to regulate the inflow and outflow of goods and services across its borders. Emphasizing the multifaceted role of a country as a regulatory entity within the realm of international trade, this study specifically delves into its position as a buyer. The investigation centers on elucidating the dispute resolution mechanisms available to a country acting in the capacity of a buyer. As an autonomous legal subject in the sphere of international trade, a country possesses the inherent right to oversee and control the movement of goods and services, a prerogative that extends to its role as a buyer in commercial transactions. Notably, the research unveils that a country can function as a buyer through state-owned enterprises (SOEs), which bear the responsibility of reporting their trade activities to the Council for Trade in Goods. This process is instrumental in upholding the principles of non-discrimination and ensuring transparency in trade practices. Consequently, the trade relations between SOEs and individual traders can be characterized as contractual agreements, affording the application of principles such as freedom of contract. This includes the autonomy to select applicable laws and opt for specific forums for dispute resolution, underscoring the nuanced legal dynamics inherent in the interactions between countries and individual traders in the international trade landscape.
