Abstract

Kebijakan Dasar Pertanahan yang menetapkan tanah sebagai Karunia Tuhan Yang Maha Esa diatur dalam Undang-Undang Pokok Agraria adalah mengenai bumi, air dan ruang angkasa dalam wilayah Negara Republik Indonesia harus selalu dilandasi persatuan kesatuan bangsa untuk sebesar-besarnya kemakmuran rakyat, Dalam penelitian ini, penulis menggunakan tipe penelitian hukum Yuridis Normatif, yaitu suatu jenis penelitian hukum dengan menguraikan suatu permasalahan hukum dengan menganalisis suatu hukum serta melalui peraturan Perundang-Undangan, literatur yang dapat diperoleh melalui studi kepustakaan. Pelaksanaan Tahapan sinkronisasi Penetapan Peta Lahan Sawah yang Dilindungi (LSD) dengan Rencana Tata Ruang Wilayah (RTRW) Kabupaten/Kota, Sering terjadinya alih fungsi lahan sawah di Indonesia mendorong pemerintah untuk melakukan upaya perlindungan eksistensi lahan sawah untuk menjamin ketersediaan lahan sawah sebagai bentuk hak menguasai dari negara. Oleh karena itu, melalui Peraturan Presiden Nomor 59 Tahun 2019, pemerintah mengamanatkan untuk percepatan penetapan peta lahan sawah yang dilindungi sebagai bentuk perlindungan eksistensi lahan sawah. Dalam praktiknya, terjadi ketidaksesuaian antara peta lahan sawah yang dilindungi dengan rencana tata ruang wilayah suatu daerah, penetapan peta lahan sawah yang dilindungi melalui tiga tahapan yaitu verifikasi lahan sawah, sinkronisasi hasil verifikasi lahan sawah, dan pelaksanaan penetapan peta lahan sawah yang dilindungi, kedua, sinkronisasi peta lahan sawah yang dilindungi dengan rencana tata ruang wilayah dapat dilakukan melalui permohonan dikeluarkannya lahan dari peta lahan sawah yang dilindungi selama memenuhi kriteria dalam Petunjuk Teknis Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional Nomor 5/Juknis-HK.02/VI/2022 dan selanjutnya dilakukan perubahan peta lahan sawah yang dilindungi oleh perangkat daerah, ketua tim pelaksana, dan tim terpadu untuk terwujudnya sinkronisasi antar peraturan

Abstract

Implementing the free market in the ASEAN region is one way to grow an advanced economy. Entrepreneurs must be able to compete in this free market era, including small businesses in Indonesia. Small businesses in Indonesia have an essential role in social welfare and economic development in Indonesia. Therefore, the presence of small businesses must be protected because small businesses are absorption of labor. For this reason, a problem must be answered: how to provide legal protection for small businesses in Indonesia's free market era. Meanwhile, the research method used in this study is a normative legal research method, namely library law research conducted by examining library materials or mere secondary data. This research resulted in a conclusion that legal protection is essential to be provided by the government for MSMEs in Indonesia so that there is legal certainty in guaranteeing the activities of small business actors; several Laws and Invitations have been issued which regulate them among others, the MSME Law, and Law No. 7 of 1994 concerning the Agreement Establishing the World Trade Organization.

Abstract

Abstract: Women play an important role in economic development, including in the Micro, Small and Medium Enterprises (MSME) sector. In Indonesia, women contribute significantly to MSMEs. However, women still face various obstacles in developing MSMEs. This research aims to analyze the role of women in MSMEs from an economic legal perspective. This study used qualitative research methods. The data collection technique in this research is literature study. The data that has been collected is then analyzed in three stages, namely data reduction, data presentation and drawing conclusions. The research results show that women have an important role in MSMEs, both as business owners, workers and consumers. Women contribute to MSMEs in various aspects, such as production, innovation and networks. Economic law has an important role in supporting women's empowerment in the MSME sector. Economic law can provide legal protection for women in MSMEs, such as the right to access capital, the right to training and education, and the right to protection from discrimination.

Abstract

Globalization has significantly changed international trade law and investment in countries like Indonesia. To improve people's welfare through international trade and foreign investment, because the more significant the output, the greater the foreign exchange that comes in, so that it becomes a source of income for the state treasury. To accelerate the national economy's growth and realize Indonesia's political and economic sovereignty, investment must be increased to transform economic potential into economic power. This study employs a normative juridical research approach, namely a procedure to identify the rule of law, legal principles, and legal doctrines about foreign commerce and investment in Indonesia. The problem of this research is 1). How is international trade regulation from the perspective of investment law in Indonesia? 2). What forms of international trade and investment are based on Law Number 25 of 2007 concerning Investment? This research resulted in the following conclusions: Regulations should be in international trade and investment, and regulations on taxes and agreements set forth by investment companies. The Forms of International Trade are divided into 2, namely bilateral trade and multilateral trade.

Abstract

Article History Received: Revised: Published: Keywords: Consumer Protection Law, Maritime Transportation, Shipping Companies Abstract: Maritime cargo transportation is inherently fraught with risks that can cause losses to cargo owners. The goods being transported are at risk of damage or loss during the journey due to natural factors or human negligence, including ship accidents that can result in total loss. Therefore, it is crucial to explore the extent of the compensation obligations of shipping companies for transported goods under consumer protection law, as well as the application of compensation in cases of cargo ship accidents. This study employs a normative juridical method, focusing on the analysis of statutory regulations, books, journals, and relevant papers. The data collection technique utilized is library research, encompassing secondary materials. The findings of this study indicate that, first, the compensation obligations of shipping companies are in accordance with Law Number 8 of 1999 concerning Consumer Protection. From the perspective of consumer protection law, shipping companies are responsible for losses suffered by senders or third parties due to negligence in performing transportation services. This responsibility includes damage or delays in the delivery of goods. Second, in the event of a cargo ship accident, the affected parties can file an official and written claim with the shipping company, supported by valid documentation. Claim resolution is typically based on principles of kinship and deliberation but may also involve repairs to damaged goods as a form of compensation. KataKunci: Hukum Perlindungan Konsumen, Pengangkutan Laut, Perusahaan Kapal Abstrak: Pengangkutan barang melalui laut tidak terlepas dari berbagai risiko yang dapat merugikan pemilik barang. Barang yang diangkut berisiko mengalami kerusakan atau kehilangan selama perjalanan akibat faktor alam atau kelalaian manusia, termasuk kecelakaan kapal yang dapat menyebabkan kerugian total. Oleh karena itu, penting untuk mengeksplorasi sejauh mana kewajiban ganti rugi perusahaan perkapalan pengangkut barang berdasarkan hukum perlindungan konsumen, serta bagaimana penerapan ganti rugi dalam kasus kecelakaan kapal pengangkut barang. Penelitian ini menggunakan metode yuridis normatif dengan analisis substansi peraturan perundang-undangan, buku, jurnal, dan makalah terkait. Teknik pengumpulan data dilakukan melalui studi kepustakaan (library research) yang mencakup bahan sekunder. Hasil penelitian menunjukkan bahwa, pertama, kewajiban ganti rugi perusahaan perkapalan pengangkut barang sesuai dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Dalam perspektif hukum perlindungan konsumen, perusahaan pengangkutan barang bertanggung jawab atas kerugian yang dialami oleh pengirim atau pihak ketiga akibat kelalaian dalam pelaksanaan layanan pengangkutan. Tanggung jawab ini mencakup kerusakan atau keterlambatan pengiriman barang. Kedua, dalam kasus kecelakaan kapal pengangkut barang, pihak yang dirugikan dapat mengajukan klaim resmi dan tertulis kepada perusahaan pengangkut dengan melampirkan dokumen-dokumen yang sah. Penyelesaian klaim biasanya dilakukan berdasarkan asas kekeluargaan dan musyawarah, namun juga dapat meliputi perbaikan terhadap barang-barang yang rusak sebagai bentuk pembayaran ganti rugi.

Abstract

Sebagai negara maritim dengan ribuan pulau, Indonesia memerlukan sarana angkutan laut yang efektif. Alur Laut Kepulauan Indonesia (ALKI) diatur untuk memfasilitasi pelayaran dan penerbangan internasional melintasi perairan Indonesia. Namun, kecelakaan kapal, seperti tenggelam, terguling, kandas, dan tabrakan, sering terjadi, dengan faktor-faktor seperti kelalaian manusia, faktor teknis, dan kondisi cuaca yang berkontribusi. Penelitian ini bertujuan untuk memberikan pemahaman yang lebih baik tentang implementasi undang-undang terkait pelayaran, khususnya dalam konteks penyingkiran kerangka kapal dan peran asuransi dalam mengelola risiko kecelakaan kapal. Metode penelitian yang digunakan adalah normatif evaluatif dengan pendekatan studi kepustakaan. Data sekunder diperoleh dari undang-undang, peraturan pemerintah, serta literatur dan jurnal hukum terkait. Penelitian juga mencakup wawancara dengan narasumber untuk memperoleh informasi yang lebih mendalam. Hasil analisis data bersifat kualitatif dan deskriptif, dengan fokus pada implementasi Undang-Undang Nomor 17 Tahun 2008 dan peran asuransi dalam mengatasi risiko kecelakaan kapal. Selain itu, penelitian mencoba menjawab beberapa permasalahan praktis, seperti apa yang terjadi jika pihak asuransi melepaskan tanggung jawab atau jika klaim tidak mencukupi untuk proses pengangkatan bangkai kapal.

Abstract

This research explores the implementation of the COLREG (Convention on the International Regulations for Preventing Collisions at Sea 1972) in efforts to prevent ship accidents in Indonesian waters, with the aim of supporting the country's economic growth. COLREG, referring to the Convention on the International Regulations for Preventing Collisions at Sea 1972, is a set of international rules governing ship navigation in global open waters. These rules are established by the International Maritime Organization (IMO) and focus on regulating ship navigation to prevent collisions at sea. Ship collision accidents have serious impacts, including risks to human life, property damage, and environmental consequences. The causes of these accidents can vary and may include human error, equipment malfunction, procedural violations, rule violations, external actions, and natural factors. The implementation of COLREG in Indonesia is essential for reducing collision incidents, especially those caused by human error. Although COLREG has not received official ratification, its implementation based on Presidential Decree No. 50 of 1979 serves as guidance followed by ships in Indonesia. Adherence to COLREG rules enhances navigation safety, ultimately contributing to economic growth through the maritime sector.

Abstract

The Maritime Employment Agreement is the legal basis and framework that influences the professional lives and welfare of ship crew in the maritime industry. This thesis explores the form of a Maritime Work Agreement along with the legal remedies that can be taken regarding problems that occur in the Maritime Work Agreement for Harbor Tug crew members at PT. Waruna Nusa Sentana Jakarta is a leading shipping company in Jakarta, based on the laws and regulations in force in Indonesia. This research includes an in-depth analysis of the Sea Work Agreement implemented by PT. Waruna Nusa Sentana Jakarta, with a focus on the validity of the Sea Work Agreement, the implementation of the Sea Work Agreement, obstacles in implementing the Sea Work Agreement, as well as resolving problems if disputes occur in the Sea Work Agreement in Harbor Tug ship crew PT. Waruna Nusa Sentana Jakarta. Through a mixed approach involving surveys, and document reviews, this thesis uncovers a variety of individual perspectives and experiences in maritime employment relations. The research results highlight variations in Maritime Labor Agreements implemented in these companies and their implications for crew welfare and motivation. In a broader context, this thesis also discusses the challenges and opportunities faced by shipping companies and the government in ensuring the protection of maritime workers' rights and maintaining the sustainability of the maritime industry. The findings of this research provide important insights for Harbor Tug Crew members who will join to work on board ships, for shipping companies in improving their Maritime Labor Agreements, promoting healthy working relationships, and ensuring better welfare standards for crew members and for governments. as a legal regulator in Indonesia. Thus, this thesis contributes to a better understanding of the role and impact of Maritime Work Agreements in the vital harbor tug vessel sector at PT. Waruna Nusa Sentana Jakarta and the maritime sector as a whole.

Abstract

This academic article aims to analyze the legal protection for container terminal operators regarding container damage that occurs during the loading and unloading processes at container terminals. Container terminals are crucial components in the logistics and international trade supply chain, and container damage during the loading and unloading processes can lead to serious consequences, including financial losses and shipment delays. This research documents the legal framework governing the obligations and responsibilities of container terminal operators in the loading and unloading services. The article discusses the legal aspects that regulate the responsibilities of terminal operators related to container management, procedures for damage claims, and compensation mechanisms for container owners. Additionally, the study analyzes common issues that arise in container loading and unloading practices, including regulatory ambiguities, differences in contract interpretation, and challenges in proving damage occurring during transportation. In this analysis, the impact of legal regulations on the responsibilities of container terminal operators and the role of dispute resolution institutions in handling damage claims will be considered. The research also evaluates ways to enhance legal protection for container terminal operators and container owners. The research findings highlight the need for improvements in the implementation and understanding of legal aspects related to legal protection for container terminal operators against container damage in loading and unloading services. This article contributes to a deeper understanding of the legal framework governing responsibilities in the container terminal industry and promotes improvements in regulations and industry practices that are fair and transparent.

Abstract

This academic article aims to analyze the employment status certainty of seafarers from the perspective of Indonesian positive law. Seafarers are a unique group of workers as they work on ships that sail in international waters. In this context, the article documents and analyzes the legal framework governing the employment status of seafarers in Indonesia, as well as the common issues that arise in seafarer employment practices. The study examines the legal aspects that influence the employment status of seafarers, such as labor regulations, labor standards, and relevant international conventions. The article also highlights crucial issues, including workers' rights, terms of employment, wages, and social protection for seafarers. In this analysis, it will be considered how far Indonesian legal regulations provide employment status certainty for seafarers and how they are implemented in daily practice. The research also evaluates the challenges faced by seafarers in obtaining their rights and appropriate legal protection. The research findings indicate that the employment status certainty of seafarers under Indonesian positive law still requires attention and improvement. This article contributes to a deeper understanding of the legal framework governing seafarer employment and encourages improvements in regulations and the protection of seafarer employment rights in Indonesia.
