Abstract

Large projects such as power plants require guarantees for the implementation of the work to ensure the project's smooth running. A Bank guarantee is commonly used in these large projects to ensure contract fulfillment and good performance. This research aims to evaluate bank guarantees' role in projects such as the 2 x 650 MW Muara Tawar Power Plant run by PT Hutama Karya (Persero) EPC Division. This research uses qualitative research methods. Data collection techniques in this study include literature studies and interviews. Data analysis techniques used in this study include data reduction, data presentation, and conclusion drawing. The results showed that bank guarantees are essential in implementing work on projects at PT Hutama Karya (Persero) EPC Division. Bank guarantees can be used to guarantee various things, such as quality of work, timely completion, and payments to third parties. Bank guarantees have various benefits in the implementation of work on projects at PT Hutama Karya (Persero) EPC Division, including increasing the employer's trust in service providers, increasing the certainty of work implementation, and increasing efficiency in the work implementation process.

Abstract

The problem studied in this final assignment islegal protection for third parties as buyers with good intentions for indicated abandoned land, so that it is known how the procedures for possession of abandoned indicated land are known, what are the legal consequences for land indicated as abandoned if it is sold by the right holder to a third party, and what is the legal protection for third parties as a willing buyer either on land indicated as abandoned. Based on this research, it was found that the government's authority regarding state rights in carrying out control of abandoned land is the duty and function of the Ministry of Agrarian Affairs and Spatial Planning/Head of the National Land Agency. Land becomes an object of abandoned land tenure if it is deliberately not cultivated, used and utilized in accordance with the purpose of granting the rights obtained. The process of controlling abandoned land is carried out in several stages, including: evaluation of abandoned land, notification, warning of abandoned land, proposal for designation of abandoned land if after the expiration of the third warning period the land remains abandoned, and determination of abandoned land which includes abolition of land rights, termination of law between land rights holders and their land, and affirmation that the land is directly controlled by the state. The legal consequences for third parties who acquire land through buying and selling plots of land that are indicated as abandoned are because there is no prohibition in the implementation of land registration, where the prohibition on legal action only applies to objects that have been proposed to be designated as abandoned land.

Abstract

AbstractMediation is a dispute resolution mechanism emphasizing deliberation and good faith between parties. In the Indonesian legal system, the mediation outcome embodied in a peace deed (akta dading) holds a significant position as a legally binding agreement once ratified by the court. This study aims to analyze the effectiveness of the peace deed as an instrument for civil dispute resolution in court, particularly within the framework of Supreme Court Regulation (PERMA) No. 1 of 2016 concerning Court-Annexed Mediation Procedures. This research employs a normative juridical approach with descriptive-analytical methods using primary, secondary, and tertiary legal materials. The findings indicate that the peace deed possesses the same legal force as a final court judgment (res judicata pro veritate habetur), yet its implementation is often hindered by the parties’ non-compliance and insufficient judicial oversight. Therefore, strengthening supervisory mechanisms and enhancing the capacity of court mediators are essential to ensure the peace deed’s effectiveness as a fair and efficient dispute resolution instrument. Keywords: Effectiveness, Peace Deed, Mediation, Dispute Resolution, Legal Certainty AbstrakMediasi merupakan salah satu mekanisme penyelesaian sengketa yang mengedepankan prinsip musyawarah mufakat dan itikad baik antar pihak. Dalam sistem hukum Indonesia, hasil mediasi yang dituangkan dalam akta dading memiliki kedudukan penting sebagai perjanjian yang berkekuatan hukum tetap setelah memperoleh pengesahan hakim. Penelitian ini bertujuan untuk menganalisis efektivitas akta dading sebagai instrumen penyelesaian sengketa perdata di pengadilan, khususnya dalam konteks penerapan Peraturan Mahkamah Agung (PERMA) Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan. Metode yang digunakan adalah pendekatan yuridis normatif dengan analisis deskriptif-analitis terhadap bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa akta dading memiliki kekuatan hukum yang sama dengan putusan pengadilan berkekuatan tetap (res judicata pro veritate habetur), namun implementasinya sering terkendala oleh faktor kepatuhan para pihak dan lemahnya pengawasan pelaksanaan oleh lembaga peradilan. Oleh karena itu, penguatan mekanisme pengawasan dan peningkatan kapasitas hakim mediator diperlukan untuk memastikan efektivitas akta dading sebagai instrumen penyelesaian sengketa yang adil dan efisien. Kata kunci: Efektivitas, Akta Dading, Mediasi, Penyelesaian Sengketa, Kepastian Hukum

Abstract

Disparitas putusan hakim dalam perkara perselisihan hubungan industrial merupakan isu krusial dalam penegakan keadilan bagi pekerja dan pengusaha. Penelitian ini bertujuan untuk menganalisis faktor-faktor penyebab terjadinya disparitas putusan hakim dalam perkara hubungan industrial di Pengadilan Negeri Medan dan Padang. Dengan menggunakan pendekatan yuridis normatif dan metode perbandingan hukum, penelitian ini mengkaji perbedaan pertimbangan yuridis dalam dua putusan yang memiliki substansi serupa namun menghasilkan amar putusan yang berbeda dengan menggunakan teknik analisis berupa content analysis. Hasil penelitian menunjukkan disparitas disebabkan oleh perbedaan interpretasi Pasal 139 vs 142 UU Ketenagakerjaan, serta pengaruh faktor non-hukum seperti tingkat unionisasi dan peran dinas tenaga kerja. Selain itu, subjektivitas hakim dalam menafsirkan norma hukum turut memengaruhi hasil akhir putusan. Implikasi praktis dari temuan ini menunjukkan diperlukan pedoman teknis dari Mahkamah Agung dalam penanganan perkara hubungan industrial serta peningkatan kapasitas dan pelatihan bagi hakim, guna menjamin konsistensi dan kepastian hukum dalam sistem peradilan ketenagakerjaan di Indonesia. Dengan demikian, diperlukan regulasi yang lebih ketat dan terstruktur dalam penyelesaian perselisihan hubungan industrial untuk mewujudkan putusan yang adil, seragam, dan dapat diprediksi.

Abstract

Non-penal policies should ideally be regulated as the legal basis for implementing the Land Mafia Prevention and Eradication Task Force Team. Legal certainty refers to the application of laws that are clear, permanent, and consistent. The restorative justice approach will serve as the basis for formulating non-penal policies to resolve land dispute cases in Indonesia. The purpose is to determine the position, role, and responsibilities of BPN in land settlement in Depok City. This research is normative juridical research with the character of prescriptive analysis. The novelty in this research is that the object of the dispute in the BPN Depok area has not involved resolution based on the principles of restorative justice. This study reveals that BPN Depok has achieved significant accomplishments in land case resolution, with a 99.66% dispute resolution rate exceeding national targets. The research demonstrates that BPN's integration of restorative justice principles through mediation, asset certification programs, and technological innovations (BERMATA application) has enhanced both the effectiveness and efficiency of dispute resolution. The findings indicate that BPN's dual role as both mediator and government authority requires careful navigation to maintain stakeholder trust. This study concludes that while restorative justice approaches show promise in land dispute resolution, comprehensive strategies addressing resource constraints, mediator capacity development, and multi-stakeholder collaboration are essential for sustainable implementation. The research contributes theoretically to conflict management literature and practically provides evidence-based recommendations for enhancing BPN's dispute resolution mechanisms in rapidly urbanizing contexts.

Abstract

Keberadaan undang-undang sebagai dasar penyelenggaraan pemerintahan merupakan salah satu ciri dari negara hukum. Konsep ini diadopsi Indonesia melalui Pasal 1 ayat (3) UUD NKRI Tahun 1945. Di tengah perkembangan teori dan praktik negara hukum, Indonesia justru menghadapi anomali dalam legislasi. Kondisi tersebut tercermin dari jumlah peraturan perundang-undangan yang berlebihan (hyper-regulation), tumpang tindih, inkonsisten, multitafsir, dan disharmonis. Secara teoritis, sumber tertinggi harmonisasi sistem hukum nasional terletak pada konstitusi (UUD NKRI Tahun 1945) sebagai norma dasar tertulis. Berdasarkan kerangka tersebut, penelitian ini bertujuan mengidentifikasi kehendak konstitusi dalam pembentukan undang-undang dan menganalisis sejauh mana hal tersebut diakomodasi oleh UU tentang Pembentukan Peraturan Perundang-undangan. Melalui metode yuridis normatif, penelitian ini menemukan bahwa kehendak konstitusi belum diatur secara memadai, baik yang terkait aspek struktural (kewajiban dan kewenangan kelembagaan DPR), substansial (tata cara pembentukan undang-undang), maupun jenis dan cakupan pengaturannya. Oleh karena itu, diperlukan penataan secara menyeluruh terhadap ketiga aspek tersebut guna menegaskan kembali prinsip konstitusionalisme dalam negara hukum.

Abstract

This study examines the application of Artificial Intelligence (AI), specifically Natural Language Processing (NLP), as a strategic tool in reviewing government procurement contracts to mitigate legal risks. Manual contract review processes are often inefficient, prone to human error, and unable to keep up with the volume and complexity of government contracts. Using a normative-judicial legal research method, the study analyzes how AI integration can enhance legal certainty, efficiency, and accountability in public procurement. Through document digitization, standardized contract formats, and audit trail systems, AI can identify ambiguous or risky clauses, verify compliance with regulations, and provide recommendations supported by legal data and precedents. The study also investigates the current legal framework in Indonesia, identifying gaps that hinder AI implementation in administrative practices. While the ITE Law and Presidential Regulations offer a foundation for digital systems in governance, there is still no specific regulation governing AI use in legal decision support. Comparative insights from the UK, US, EU, and Morocco show that AI has improved review accuracy, reduced processing time, and strengthened public sector integrity, although concerns over transparency and algorithmic accountability persist. The study concludes that the integration of AI into procurement contract management offers significant potential for bureaucratic reform and risk mitigation, but requires robust legal frameworks, clear boundaries of responsibility, and institutional readiness. With adaptive policy support, ethical oversight, and inter-agency collaboration, AI can serve as a transformative instrument for enhancing good governance, preventing legal disputes, and protecting public officials in the execution of procurement responsibilities.
