Abstract

A banking law should be based on the ideology that determines the purposes and principles. Similarly, banking law which naturally has the purpose and principles laid down by Allah and His Messenger. However, banking law studies not only see the purpose and principles of a particular, but also analyzes the behavior of economic agents in an effort to achieve their respective goals. The principles outlined by Islam always flexible. However, the atmosphere of social and environmental change over the circulation of the times. Therefore, an assessment of the banking laws and signs in the agency should consider it important to change the environment that is in place and time. Many writers of Islamic economics tends to focus on certain aspects without giving proper attention to other aspects.

Abstract

General Explanation of Law Number 11 Year 2006 concerning Aceh Government stated that the trip constitutional Republic of Indonesia put Aceh as a unit of regional government that are special and specific, relating to the distinctive character of the historical struggle of the people of Aceh who have endurance and perseverance. Aceh's community life, articulated in a modern perspective of the state and government to be democratic and accountable. Such order of life is the embodiment in the motto Unity in Diversity. Keppres not have the capacity to regulate the power and authority of the judiciary especially Shari'a Courts in Nanggroe Aceh Darussalam. This is because the law has expressly delegated to the Qanun Aceh province to regulate the authority of the Court Syar'iyah based benchmark defined solely by the law that is based on the Islamic Shariah. But if we are concerned about the progress of the preparatory steps undertaken in order to take over its jurisdiction by the Court and the District Court Syar'iyah is still far from optimal, so for the time given device either incomplete legislation, secretariat and other Syari'yah Court administration still seems to take longer for the Court Syari'yah Aceh province can take over completely the authority of the District Court.

Abstract

Human rights issues are still a never-ending debate, between a Western perspective and an Islamic perspective. Muslims responded in various ways. The difference of views on the articles in the declaration is inseparable from the differences in the background and interpretation of religious and historical texts in the golden age of Islamic history. Among the attitudes of Islamists to the Declaration of Human Rights, as follows: First, reject the Declaration of Human Rights. There are several classical reasons which are the factors behind why Islamists reject them. Among other things, it is a very different socio-cultural condition between the West and Islam. References of different values, in the West embrace liberal values ​​or abandon the values ​​of Christianity, which assume authority entirely in the hands of man, without including the sovereignty of God. The paradigm of some Muslims to this day, still assume that religion has universal coverage, while human rights have only part of the universal religion rather than vice versa. Secondly, to receive fully, for seeing the teachings and values ​​of Islam in a substance. The group is of the opinion that the Declaration of Human Rights is in accordance with the teachings of Islam, both in substance and mission that fought. The principles in the Declaration of the United Nations on Human Rights have been in line with the principles of Islamic jurisprudence (kulliyat al-khams: hifdh al-din, the right to upholding religion and freedom of religion, al-'aql: the right to the development of sound thinking, including the right to freedom of thought and opinion, al-nafs, the protection of the right to life, al-nasl, the assurance of the right to the development of kind and descent, al-mal, the protection of the right to property ownership).

Abstract

Ralf Dahrendorf's conflict theory states that the structural changes can be classified on the basis of their extremities and based on their abrupt or unexpected levels. In this case Ralf Dahrendorf admits that his theory of emphasis on conflict and social change is a one-sided perspective of social reality. This is because although the theory of structural functionalism and conflict theory is perceived by Ralf Dahrendorf as a valid perspective in approaching social reality, it includes only a part of the social reality that should be. Both theories are incomplete when used separately, and therefore should be used together, in order to obtain a complete picture of social reality. As an example of case studies, the intra-religious authoritative conflict occurring in Sampang between the Sunni and Shiite schools is a flow rush that has reduced social harmonization among the Sampang and Madurese communities in general, causing intense social tensions. Sociologically, the existence of ulema among the Madurese is not only regarded as a religious elite, but also as a non-formal leader by the Madurese people who are considered to have social authority to determine life and community life.

Abstract

This paper discusses the corporate crime of human trafficking. The background used is the assessment that classifies Indonesia in third place for the handling of human trafficking by the international community. The word “Hero Exchange” may often be heard, they are the workers from Indonesia who often become victims of Human Trafficking, victims sometimes traded not only for the purpose of prostitution or other forms of sexual exploitation, but also includes other forms of exploitation, such as forced labor or services, slavery or practices similar to slavery. Various government policies are made concerning the protection of women and children, basically made ​​relatively comprehensive policies, ranging from Basic Act 1945 and the rules below. However many government policies in tackling this problem is not followed by real action in the field and it can be concluded, the legal protection of women and children victims of human trafficking is still felt less effective. This is evident from the very rarity of severe criminal imposed by the judge against traffickers. The absence of compensation in the form of sanctions against traffickers also add to the sense of injustice padakorban trafficking who have suffered both physically, mentally, and economically.

Abstract

Pawn is the right to a movable item that is attached to a person for assistance in the form of giving debt to another person. Submission of the movable goods by the person who owes the party giving the debt, is given as collateral. If in the future the debtor is defaulted, does not repay the debt when it is due, the collateral can be auctioned. Pawnshops based on the Civil Code Article 1150 are pocketing official permission to manage, assist, and develop all forms of financial activities by giving injections of funds to people in the form of financing. Auth (main tasks and functions) of pawning is protecting, fostering, and providing protection in the form of loan funds with the intent and purpose so that people are not caught up in various offers and financial assistance by non-formal financial institutions that relatively utilize the community, "strangling" with interest very high. Based on the analysis of the author's research, there are many non-formal financial institutions that provide loans with very high interest rates, this pattern of loans weighs heavily on society. This action is contrary to the law which aims to prosper society. The legal basis for shari'ah mortgage is to refer to the values ​​or norms contained in the DSN-MUI fatwa No. 25 / DSN-MUI / III / 2002 dated June 26, 2002 which confirms that it is permissible to borrow money by pawning goods as collateral for debt. However, at the perfective level of institutional governance, it is based on Government Regulation No. 10 of 1990 which was ratified on April 10, 1990.

Abstract

Mahfud MD states that the Pancasila State is a constitutional state and is final, even in terms of religious/fiqh law can be declared valid and correct. The results of the ijtihad of the ulama of ushul fiqh also mentioned that the choice of national law based on the Pancasila and the 1945 Constitution of the Republic of Indonesia was the right choice and was recognized syara'. Indonesia's legal state also accepts the spiritual value of religious law. Written law and all procedural provisions (rechtsstaaf) are accepted but must be put in order to uphold justice (the rule of law). Written provisions that prevent justice can be abandoned. This is confirmed in the provisions of Article 24 paragraph (1) of the 1945 Constitution which states that the function of the judicial authority is to enforce law and justice, and Article 28D paragraph (1) concerning the right to obtain legal certainty and Article 28H that the law must be built on the basis of justice benefits. Jurisprudence law with national law has the same substance in maintaining and encouraging the development of a legal system based on social justice and public benefit (al-manfa'ah al-ammah) as has also been voiced and championed by the founders of the state when they are compiling the state ideology, namely Pancasila. Those who are predominantly Muslim have an open attitude to respect and accommodate the interests of other faith groups and religions. Abdurrahman Wahid also emphasized that the founders of the nation (such as Ki Bagus Hadikusumo, Abdul Wahid Hasyim, Kahar Mudzakkar, Agus Salim, and Ahmad Subardjo) who were experts in the field of Jurisprudence had absorbed and adopted the principles and objectives of fiqh law that had a value of justice, benefit, humanity and shura in the Pancasila state system.

Abstract

The aims of this study were: 1. Developt teaching materials for reading skills based on Higher Order Thinking Skills (HOTS) 2. Measure the effectiveness of developing teaching materials for reading skills based on Higher Order Thinking Skills (HOTS). This research is a research and development of the ADDIE model which consists of five stages, namely analysis, design, development, implementation, and evaluation. Data collection techniques using observation, interviews, documentation, questionnaires, and tests. After the author designing teaching materials, conduct experiments, analyze all the data, the authors get a summary; 1) Teaching materials for reading skills were developed based on higher order thinking skills (HOTS) in the form of textbooks in accordance with the principle of learning based on higher order thinking skills, student desires, and analysis of student needs. The material is taken from the topic of actual and real problems and phenomena that occur in society. This material consists of ten topics that aim to enable students on obtaining inferential comprehension, evaluation, and appreciation. The product of this resource is the book text contents and methods considered good 76%, it means that the book is suitable for learning. 2) The teaching material is effective for improving speaking skills for students, it is based on the pretest and posttest results increased from an average of 66 % to an average of 81,5 % in posttest. This is supported by the results of questionnaires and interviews that most of the students had good grades and increased. Tujuan penelitian ini adalah: 1. Mengembangkan bahan ajar keterampilan membaca berbasis Higher Order Thinking Skills (HOTS) 2. Mengukur efektivitas pengembangan bahan ajar keterampilan membaca berbasis Higher Order Thinking Skills (HOTS). Penelitian ini merupakan penelitian dan pengembangan model ADDIE yang terdiri dari lima tahap yaitu analisis, desain, pengembangan, implementasi, dan evaluasi. Teknik pengumpulan data menggunakan observasi, wawancara, dokumentasi, angket, dan tes. Setelah penulis merancang bahan ajar, melakukan percobaan, menganalisis seluruh data, penulis mendapatkan ringkasan; 1) Bahan ajar keterampilan membaca dikembangkan berdasarkan keterampilan berpikir tingkat tinggi (HOTS) dalam bentuk buku teks sesuai dengan prinsip pembelajaran berdasarkan keterampilan berpikir tingkat tinggi, keinginan siswa, dan analisis kebutuhan siswa. Materi diambil dari topik permasalahan dan fenomena aktual dan nyata yang terjadi di masyarakat. Materi ini terdiri dari sepuluh topik yang bertujuan agar siswa memperoleh pemahaman inferensial, evaluasi, dan apresiasi. Produk dari sumber ini adalah teks buku, isi dan metodenya dinilai baik 76%, artinya buku tersebut layak untuk dipelajari. 2) Bahan ajar efektif untuk meningkatkan keterampilan berbicara siswa, hal ini berdasarkan hasil pretest dan posttest meningkat dari rata-rata 66% menjadi rata-rata 81,5% pada posttest. Hal ini didukung dengan hasil angket dan wawancara bahwa sebagian besar siswa mempunyai nilai baik dan meningkat.

Abstract

The aim of writing this paper is to find out the importance of learning English at school. Writing the paper uses the literature review method (library research). From the discussion it can be concluded that learning English at school is very important. The learning method that is very often used is CLT because it is effectively used as a method in the English language teaching and learning process. This is based on the communication skills obtained by students, not just mere knowledge, students will be motivated and feel that something they have learned can be useful and used in language. English is a universal language because it is used by most countries in the world as the main language. Apart from that, English is an international language that is important to master or learn. Several countries, especially former British colonies, place English as a second language that must be mastered after their native language. Moment This, aged child early faced with media digital Which based Language English. So strategies are needed so that young children's English language skills develop more optimal. Method study in matter This is descriptive qualitative, subject study amount 14 child from class A1, 12 child from A2 And 1 Teacher Language English in R.A Arrosyidiyah Sampang. Collection data done with observation, interview, And documentation. The results of research at RA Arrosyidiyah Mambaul Ulum Sampang developed English language learning in the teaching and learning process and providing stimulation to students from an early age school. Through this strategy, children succeed develop ability Language English with Good. Tujuan penulisan makalah ini adalah untuk mengetahui pentingnya pembelajaran bahasa Inggris di sekolah. Penulisan makalah menggunakan metode tinjauan pustaka (library study). Dari pembahasan dapat disimpulkan bahwa pembelajaran bahasa Inggris di sekolah sangatlah penting. Metode pembelajaran yang sangat sering digunakan adalah CLT karena efektif digunakan sebagai metode dalam proses belajar mengajar bahasa Inggris. Hal ini didasarkan pada kemampuan komunikasi yang diperoleh siswa, bukan sekedar pengetahuan belaka, siswa akan termotivasi dan merasa bahwa sesuatu yang dipelajarinya dapat bermanfaat dan digunakan dalam berbahasa. Bahasa Inggris merupakan bahasa universal karena digunakan oleh sebagian besar negara di dunia sebagai bahasa utama. Selain itu, bahasa Inggris merupakan bahasa internasional yang penting untuk dikuasai atau dipelajari. Beberapa negara, terutama negara bekas jajahan Inggris, menempatkan bahasa Inggris sebagai bahasa kedua yang harus dikuasai setelah bahasa ibu. Saat ini, anak usia dini dihadapkan pada media digital yang berbasis bahasa Inggris. Maka diperlukan strategi agar kemampuan bahasa Inggris anak usia dini berkembang lebih optimal. Metode penelitian pada materi ini adalah deskriptif kualitatif, subjek penelitian berjumlah 14 anak dari kelas A1, 12 anak dari A2 dan 1 orang Guru Bahasa Inggris di R.A Arrosyidiyah Sampang. Pengumpulan data dilakukan dengan observasi, wawancara, dan dokumentasi. Hasil penelitian di RA Arrosyidiyah Mambaul Ulum Sampang mengembangkan pembelajaran bahasa Inggris dalam proses belajar mengajar dan memberikan stimulasi kepada siswa sejak usia dini di sekolah. Strategi pembelajaran Bahasa Inggris dengan metode bernyanyi, bermain, bertanya jawab, dan memanfaatkan item-item yang tersedia di kelas. Melalui strategi ini, anak berhasil mengembangkan kemampuan Bahasa Inggris dengan Baik.

Abstract

The Qur'an is the word of Allah which was revealed to mankind as a guide in organizing life, so that humans can achieve happiness in life in this world and in the hereafter. In order for this to be achieved, the aim of the Islamic teachings is to protect and maintain religion, soul, lineage, intellect and property which are adh-dharuriyatal-khamsu (five urgent matters in human life). All actions that are prohibited by Allah SWT. and threatened with had and ta'zir punishments. Had is a criminal act and the criminal sanctions have been regulated in such a way in the texts of the Qur'an and Al-Hadith. According to Abdul Qadir Audah, there are seven types of hudud, namely: adultery, accusing of adultery, drinking wine, theft, khirobah, apostasy, and rebellion. There are verses explaining Hudud 9 times in the Qur'an in 5 letters, namely, 3 times in the QS. Al-Baqarah, 2 times in QS An-Nisa', 2 times in Surah At-Taubah, 1 time in Surah Al-Mujjadi, 1 time in Surah Ath-talak. all of them are classified as madaniyah. The conclusion from what I wrote is that Hudud is a limit that has been determined by Allah which cannot be violated and anyone who violates it will be subject to Hadd sanctions. These provisions have been regulated in the Nash Al-Qur'an and Hadith. Al-Qur’an adalah firman Allah yang diturunkan kepada umat manusia sebagai pedoman dalam menata kehidupan, agar manusia memproleh kebahagian hidup di dunia dan di akherat. Supaya hal tersebut tercapai, Tujuan pensyari’atan ajaran Islam adalah untuk menjaga dan memelihara agama, jiwa, keturunan, akal dan harta yang merupakan adh-dharuriyatal-khamsu (lima perkara mendesak pada kehidupan manusia).segala perbuatan yang dilarang oleh Allah swt. dan diancam dengan hukuman had dan ta’zir. Had adalah tindak pidana dan sanksi pidananya sudah diatur sedemikian rupa dalam nash Al-Qur’an dan Al-HadisMenurut Abdul Qadir Audah yang termasuk dalam jarimah hudud seban- yak tujuh macam, yaitu: zina, menuduh zina, peminum khamar, pencurian, khirobah, murtad, dan pemberontakan. Ayat-Ayat yang menerangkan Hudud dalam terdapat 9 kali dalam Al-Qur’an pada 5 surat yaitu, 3 kali dalam QS. Al-Baqarah, 2 kali dalam QS An-Nisa’, 2 kali dalam surat At-Taubah, 1 kali dalam surat Al-Mujadalah, 1 kali dalam surat Ath-talak. kesemuanya Tergolong madaniyah. Kesimpulan dari yang sy tulis adalah bahwa Hudud itu adalah batasan yang telah ditentukan oleh Allah yang tidak boleh dilanggar dan barng siapa yang melanggar, maka akan kenak Sanksi Had. Ketentuan itu telah diatur Dalam Nash Al-Qur’an dan Hadist.
