Abstract

Forest and land fires (karhutla) in Katingan Regency, Central Kalimantan, are a serious issue that occurs almost every year, particularly in peatland areas. Karhutla not only causes ecological damage, such as ecosystem degradation and loss of biodiversity, but also has social and economic impacts, including health problems caused by haze, economic losses, and increased carbon emissions that accelerate global warming. Peatland areas are of particular concern due to their large carbon reserves, which, when burned, release significant emissions. The issue addressed in this study is the effectiveness of the synergy between Katingan  regency Local Government in forest and land fire mitigation, which still faces challenges, particularly in coordination between central and local governments, budget constraints, and suboptimal resources in fire control in vulnerable areas such as Katingan. This study evaluates the synergy between local governments, communities, and stakeholders in mitigating karhutla using a juridical-empirical approach. Although various policies have been implemented, such as regional regulations and the construction of canal blocks, their implementation faces challenges, including geographical factors, limited budgets, a lack of trained human resources, and weak law enforcement. The findings of this research indicate that the mitigation of forest and land fires in Katingan  regency is still constrained by limited resources and coordination, hence stronger synergy among stakeholders is required. Hence, a more integrated approach and collaboration among all parties are needed to develop effective mitigation strategies, preserve ecosystem sustainability, and support the achievement of Sustainable Development Goals (SDGs).

Abstract

The utilization of Artificial Intelligence (AI) technology in the Supreme Court represents an innovative step toward modernizing Indonesia’s judicial system. AI offers advantages in efficiently processing legal data, analyzing jurisprudence, and providing legal recommendations to assist judges in decision-making. However, AI implementation in the legal system presents challenges, including regulatory issues, ethical considerations, and AI’s limitations in understanding the humanistic dimensions of legal rulings. This study employs a normative juridical method with a doctrinal approach to analyze the role, benefits, and legal implications of AI usage in Indonesia’s judicial system. The findings indicate that while AI can enhance judicial efficiency, strict regulations are necessary to ensure transparency, accountability, and legal compliance in its application.

Abstract

The mitigation of land-related crimes in Palangka Raya has become a serious challenge due to the increasing prevalence of land mafia practices, which harm the public and hinder legal certainty. To address this issue, the government established the Integrated Team for the Prevention and Eradication of Land Mafia, consisting of various agencies, including the police, the prosecutor's office, the National Land Agency (BPN), and local government authorities. This team plays a crucial role in preventing, uncovering, and taking action against various land mafia schemes, such as document forgery, land encroachment, and illegal land transactions. This study aims to analyze the effectiveness of the integrated team's efforts in handling land-related crimes and to identify the challenges faced in policy implementation. Using an empirical approach, the study finds that although the integrated team has successfully uncovered several land-related cases, various challenges remain, including limited inter-agency coordination, weak law enforcement, and a lack of public awareness regarding their legal rights to land. Data was collected through interviews, direct observation, and documentation studies. Therefore, a more comprehensive strategy is needed, including regulatory strengthening, capacity-building for law enforcement officers, and public education, to create a transparent and equitable land governance system in Palangka Raya.

Abstract

The rise of electric vehicles using AI technology and Autopilot mode has potential benefits and issues in Indonesia's transportation system. These cars are more energy efficient and safe to drive. Yet, the legality of autonomous electric cars is still unclear due to lacking regulations. This article explores the legal concerns of AI-driven electric vehicles, such as safety standards, liability in accidents, and data privacy. This study employs a normative legal research method with legislative and conceptual approaches to analyze various applicable regulations, such as Law Number 22 of 2009 concerning Traffic and Road Transportation and Presidential Regulation Number 55 of 2019 concerning Battery-Based Electric Vehicles. The research findings indicate that despite some rules that can serve as a basis for regulation, there are still legal loopholes that need to be addressed promptly. The government needs to formulate specific regulations covering safety aspects, feasibility tests, and mechanisms of legal responsibility in accidents involving autonomous vehicles. Additionally, user data protection must be reinforced to prevent the misuse of information collected by AI systems. In conclusion, strict regulations are needed to ensure that technological advancements can move forward while safeguarding safety and legal certainty for the public. This research encourages new regulations governing security aspects, legal responsibility, and data protection in AI-based autopilot electric vehicles to address legal gaps in the Road Traffic and Transport Law (LLAJ) and the Electronic Information and Transactions Law (ITE).

Abstract

This research aims to analyse the role of local government in realising Good Corporate Governance (GCG) in the tourism sector, particularly in Seruyan Regency. The method used is empirical juridical, which combines a statutory approach and an empirical approach. The statutory approach is carried out by examining various related regulations, such as Law Number 23 of 2014 concerning Regional Government, Law Number 10 of 2009 concerning Tourism, and other regulations that support sustainable tourism governance. Meanwhile, the empirical approach is used to evaluate policy implementation at the regional level, by collecting data through interviews with government officials and tourism businesses to understand the challenges in implementing GCG principles. The results show that although the local government has adopted GCG principles in tourism policy, there are still various challenges in its implementation. The main obstacles include a lack of transparency in the business licensing system, suboptimal coordination between agencies, and a lack of community participation in tourism management. In addition, limited budget and digital infrastructure are also obstacles in implementing more effective digitalisation-based policies. However, this study also found that collaborative efforts between local governments, businesses, and communities can improve the effectiveness of tourism sector governance in a more sustainable manner. The uniqueness and originality of this research lies in its analysis that connects the concept of GCG with tourism policies at the regional level, particularly in Seruyan Regency. Unlike previous studies that focus on legal aspects or governance theories, this research shows the actual challenges of implementing GCG principles in local governments.

Abstract

This study analyzes the existence of Restorative Justice House (Rumah Restoratif Justice) as a mechanism for resolving minor criminal cases in the jurisdiction of the Palangka Raya District Attorney's Office. The background of the problem shows an increase in the number of minor criminal cases resulting in excessive court workload and ineffective handling of conflicts in the society. In this context, Restorative Justice House emerges as an alternative solution that emphasizes restorative justice, where the main focus is the restoration of relationships between perpetrators, victims and the community. The purpose of this study is to evaluate the philosophical and practical role of Restorative Justice House in supporting the criminal justice system in Palangka Raya. This research seeks to answer the questions: What is the philosophical basis or main principle of the restorative justice house concept established by the Palangka Raya District Attorney's Office? What is the urgency of the existence of restorative justice houses in handling minor criminal cases in the jurisdiction of the Palangka Raya District Attorney's Office? The research method used was a qualitative approach with literature analysis and in-depth interviews with legal practitioners and communities involved in Restorative Justice House. The results of this study indicate that Restorative Justice House provides a practical solution to reduce the burden on the courts and strengthens the principles of restorative justice that are more inclusive and adaptive to local needs. The philosophical implications of Restorative Justice House underscore the importance of a restorative and rehabilitation-oriented approach, as opposed to a traditional retributive approach.

Abstract

Dalam pembuatan hukum pidana Indonesia menerapkan asas konkordansi, mengikuti hukum yang menjajah (Belanda) setelah berpuluh-puluh tahun menggunakan Hukum Pidana Belanda sebagai pedoman, Pemerintah Indonesia kemudian membentuk KUHP Nasional untuk mengakomodir nilai-nilai bangsa Indonesia dalam sistem hukum. Penelitian ini juga mengajukan dua pertanyaan sebagai perumusan masalah, yakni apakah asas konkordansi masih relevan di Indonesia, dan apakah perkembangan sistem hukum di Indonesia dapat memberikan kebaikan bagi bangsa tersebut. Dalam penelitian ini, digunakan metode yaitu penelitian hukum yang bersifat preskriptif, bertujuan untuk menemukan kebenaran koherensi antara norma hukum, prinsip hukum, dan tingkah laku dengan norma hukum. Pendekatan yang digunakan meliputi pendekatan konseptual, untuk memahami filosofis aturan hukum, dan pendekatan historis, untuk melacak perkembangan paradigma hukum pidana Indonesia dari waktu ke waktu. Hukum pidana Indonesia mengalami perubahan dari asas konkordansi dan mengadopsi KUHP Belanda. Pembaharuan dalam KUHP Nasional bertujuan untuk mencerminkan corak budaya dan keadilan yang lebih baik. KUHP Nasional menerapkan keadilan korektif, restoratif, dan rehabilitatif dengan fokus pada pencegahan, hak korban, dan pemulihan pelaku. Pengaturan sanksi pidana harus melalui undang-undang dan berlandaskan prinsip no punist without representative. Pembaharuan ini diharapkan menciptakan sistem hukum yang lebih adil, bermanfaat, dan mengedepankan hak asasi manusia di Indonesia.

Abstract

This study aims to put forward the idea of a strategy for internalising Green Politics in Indonesia by looking at good practices in other countries such as the practice of green party campaigns in Australia and the presence of Green Parties in Germany. This study uses Qualitative research. This method was chosen to analyse and deeply explore important issues related to Green Politic in this study. This study concludes that there are 2 (two) efforts to internalise Green Politic in Indonesia, namely First, by initiating an environment-based social movement into political parties in Indonesia such as the practice carried out by the Indonesian Forum for the Environment (WALHI) by looking at the good practices of the Green campaign in Australia and the second is the idea of internalising Green Politic through the formation of Green Parties in Indonesia such as the practice of green parties in Germany with the hope that these two efforts can make changes, especially in efforts to do justice in the environmental field through the process of formulating policies that are in favour of environmental issues in Indonesia.

Abstract

This research aims to analyse in depth the juridical aspects in the Palangka Raya District Court Decision Number: 109/Pid.B/2024/Pn.Plk related to persecution cases triggered by verbal provocation. The focus of the research is on the legal considerations used by the judge in deciding the case, as well as how the verbal provocation factor is used as the basis for imposing criminal sanctions. The research method used is normative juridical with the approach of analysing court decisions, literature studies on the Criminal Code (KUHP), and studies of criminal law doctrines related to criminal liability and factors that trigger criminal acts. The results showed that although verbal provocation by the victim was the trigger for the defendant's act of maltreatment, the court decided that the defendant's actions had exceeded proportional limits. The judge emphasised that verbal provocation cannot remove the element of culpability in the crime of maltreatment, although it can be taken into consideration in mitigating the punishment. This decision reflects the principles of fairness and proportionality in law enforcement, where judges must carefully weigh the triggering factors and the degree of guilt of the defendant. This research also identified that the verdict was in line with Article 351 of the Criminal Code on maltreatment, however the judge did not provide significant leniency because the defendant's actions were considered excessive.

Abstract

The illegal trade of traditional alcoholic beverage tuak in the jurisdiction of Lamandau Police Department, Central Kalimantan, reflects a complex socio-legal phenomenon, especially when local cultural practices intersect with formal legal systems. Once a cultural symbol in Dayak society, tuak has transformed into an unregulated commercial commodity, contributing to rising crime rates, public disorder, and health risks. This study employs a juridical-empirical and descriptive-analytical approach to examine the effectiveness of law enforcement against illegal tuak distribution. Findings indicate that weak regulatory oversight, the absence of specific local regulations, and strong cultural acceptance are key obstacles in controlling its spread. This article recommends the establishment of a Local Regulation (Peraturan Daerah) grounded in restorative justice, cross-sectoral collaboration, and community-based educational strategies rooted in local wisdom to address the issue comprehensively.
