Abstract

The anti-corruption school is an essential solution to help build judges' integrity in the era of Industrial Revolution 4.0 and Society 5.0. The era of Industrial Revolution 4.0 and Society 5.0 requires judges to understand and face increasingly complex and diverse legal challenges, including overcoming increasingly sophisticated and well-organized corruption crimes. The research method used is qualitative. The approaches used are the statutory approach, the conceptual approach, the comparative approach, the futuristic approach, and the philosophical approach. The nature of this research is descriptive-prescriptive, and it was analyzed using content analysis. The result of this research is that the anticorruption school model will help strengthen the integrity of judges, promote transparency and accountability, and increase public trust in the judiciary through a comprehensive and integrated approach. The anti-corruption school model could be an effective solution for helping judges face the challenges of the Industrial Revolution 4.0 and Society 5.0. The Anticorruption School is the best model for creating judges' integrity. Judges can acquire the knowledge, skills, and attitudes through structured and systematic education and training to avoid corrupt practices and maintain their integrity as law enforcers.

Abstract

Hospitals have a strategic role in providing comprehensive health services and ensuring legal protection for medical personnel in carrying out their professional practices. The existence of Hospital Bylaws or internal hospital regulations is an important instrument in creating good hospital governance and providing legal protection for medical personnel against possible lawsuits due to alleged negligence or malpractice. This study examines the role of Hospital Bylaws in providing legal protection for medical personnel with a legislative and conceptual approach. The results of the study show that Hospital Bylaws have a role in setting ethical and professional standards, dispute resolution mechanisms, and legal responsibilities of hospitals and medical personnel. Therefore, the optimal implementation of Hospital Bylaws can be a preventive effort in reducing potential medical disputes and improving the quality of health services in hospitals.

Abstract

Keberadaan dan kelestarian sumber daya alam adalah tanggung jawab bersama, karenanya sumber daya alam yang ada harus dapat dilindungi dan dikelola dengan sebaik mungkin, sehingga generasi mendatang dapat turut serta merasakan dan menikmati keberadaan sumber daya alam yang melimpah. Dalam rangka pemanfaatan sumber daya alam yang bertanggungjawab, maka perlu dilakukan perlindungan terhadap sumber daya alam dalam berbagai perspektif. Salah satunya perlindungan terhadap pemanfaatan sumber daya alam yang diimplementasikan melalui penegakan hukum pidana terhadap tindak pidana dibidang pertambangan. Penerapan sanksi pidana dalam penegakan hukum pidana merupakan ultimum remedium. Artinya upaya hukum terakhir karena tujuanya adalah untuk memproses secara hukum pidana. Implementasi perlindungan terhadap pemanfaatan sumber daya alam melalui penegakan hukum pidana merupakah instrument represif yang digunakan untuk dapat menjawab tantangan antara kebutuhan investasi dan pelestarian lingkungan, pengelolaan sumber daya alam yang ramah lingkungan, yang berjalan secara efekktif, efisien dan bertanggungjawab guna memberikan kesejahteraan bagi masyarakat serta untuk mencegah eksploitasi yang berlebihan dalam upaya mendukung pembangunan nasional yang berkesinambungan

Abstract

Ketentuan Pasal 4 UU No. 39 Tahun 1999 tentang HAM yang di dalamnya menyebutkan bahwa hak hidup merupakan non derogable rights secara horizontal bertentangan dengan KUHP dan sejumlah UU di luar KUHP yang mencantumkan ancaman pidana mati. Konflik norma ini mencerminkan tidak adanya relevansi di antara aturan yang memberlakukan pidana mati dengan aturan yang menyebutkan bahwa hak hidup adalah non derogable rights. Menanggapi adanya konflik norma tersebut, perlu dikaji pengaturan pidana mati dan hak hidup sebagai non derogable rights dalam perspektif ius constituendum. Jenis penelitian ini yakni penelitian Hukum normatif dengan metode pendekatan statute approach, historical approach, dan conceptual approach. Hasil dan pembahasan bahwa kedepan tentang pidana mati masih dipertahankan, sehingga perlu melakukan perubahan UUDN RI Tahun 1945 dengan menambahkan ketentuan pasal yang menyatakan bahwa pidana mati tidak bertentangan dengan hak hidup sebagai non derogable rights. Selain itu, dalam KUHP baru eksistensi pidana mati tetap dipertahankan, tetapi pengaturannya dilakukan secara khusus (eksepsional).

Abstract

The illegal trade of traditional alcoholic beverage tuak in the jurisdiction of Lamandau Police Department, Central Kalimantan, reflects a complex socio-legal phenomenon, especially when local cultural practices intersect with formal legal systems. Once a cultural symbol in Dayak society, tuak has transformed into an unregulated commercial commodity, contributing to rising crime rates, public disorder, and health risks. This study employs a juridical-empirical and descriptive-analytical approach to examine the effectiveness of law enforcement against illegal tuak distribution. Findings indicate that weak regulatory oversight, the absence of specific local regulations, and strong cultural acceptance are key obstacles in controlling its spread. This article recommends the establishment of a Local Regulation (Peraturan Daerah) grounded in restorative justice, cross-sectoral collaboration, and community-based educational strategies rooted in local wisdom to address the issue comprehensively.

Abstract

Corruption, as an extraordinary crime, requires extraordinary measures—especially in recovering state financial losses—which demands legal certainty. This research aims to analyze legal certainty in procedures for recovering state financial losses caused by criminal acts of corruption, focusing on the role of public prosecutors and the effectiveness of the applicable legal mechanisms. Using normative legal research methods with legislative and conceptual approaches, this study processes primary and secondary legal materials through documentation and interpretative analysis techniques. The results of the study show that although procedures for recovering state losses are regulated in the Corruption Eradication Law and its derivative regulations, legal certainty has not been fully realized due to the unclear authority of the public prosecutor or the Corruption Eradication Commission (KPK) in tracking and seizing assets, as well as weak synchronization between criminal and civil instruments. Therefore, this study recommends reformulating regulations that explicitly define the authority of law enforcement agencies, providing adequate facilities and infrastructure for the Attorney General’s Office and the KPK, and strengthening the role of the community in reporting criminal acts of corruption. These efforts are expected to create legal certainty in the recovery of state losses, increase the effectiveness of restitution, and restore public confidence in the judicial system.

Abstract

Corruption offenses in Indonesia are positioned as extraordinary crimes that generate systemic impacts on state finances, the national economy, and public trust, thereby necessitating firm and effective criminal law policies. One of the punitive instruments normatively regulated is the death penalty, as specified in Article 2 paragraph (2) of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001, particularly when corruption is committed under certain circumstances. Nevertheless, in law enforcement practice, this provision has almost never been applied, giving rise to issues concerning its relevance, rationality, and consistency with the objectives of punishment, especially from the perspective of restorative sentencing and human rights protection. This study employs a normative legal research method using statutory, conceptual, and case approaches. The findings indicate that the death penalty in corruption offenses functions more as a symbolic normative threat than as an applicable sentencing instrument and is less aligned with the orientation toward restoring state financial losses. Therefore, this research emphasizes the need to reform corruption-related criminal law policies by balancing strict law enforcement with the strengthening of restorative sentencing, in order to achieve substantive justice, effective corruption eradication, and the sustainability of the national legal system

Abstract

Penelitian ini bertujuan untuk menganalisis keterwakilan perempuan dalam Kelembagaan Adat Dayak di Kota Palangka Raya dalam perspektif hak sipil dan politik serta prinsip non-diskriminasi. Latar belakang penelitian didasarkan pada fakta empiris bahwa seluruh Damang Kepala Adat di Kalimantan Tengah berjenis kelamin laki-laki, meskipun Peraturan Daerah Nomor 16 Tahun 2008 tidak secara eksplisit membatasi berdasarkan jenis kelamin. Penelitian ini menggunakan pendekatan yuridis empiris dengan teknik wawancara mendalam terhadap 12 informan (Damang, mantir adat, tokoh perempuan adat, dan akademisi), observasi partisipatif, serta analisis dokumen normatif. Data dianalisis melalui analisis tematik dengan triangulasi sumber. Hasil penelitian menunjukkan bahwa norma patriarki struktural membatasi representasi perempuan secara substantif. Dalam perspektif teori representasi politik Pitkin, keterlibatan perempuan masih bersifat deskriptif dan belum mencapai representasi substantif. Secara normatif, praktik tersebut berpotensi bertentangan dengan Pasal 28I UUD 1945 dan prinsip CEDAW mengenai penghapusan diskriminasi terhadap perempuan. Kontribusi penelitian ini terletak pada integrasi analisis pluralisme hukum dan teori patriarki dalam konteks kelembagaan adat Dayak serta rekomendasi ius constituendum untuk reformasi regulasi daerah.

Abstract

Money laundering crimes are generally classified into active and passive forms. In the Indonesian context, passive money laundering based on Article 607 paragraph (1) letter (c) of the Criminal Code adopts the pro parte dolus pro parte culpa model which equates criminal liability between intentional acts and those committed due to negligence. This approach raises normative issues related to the principle of proportionality which requires differentiating sanctions based on the degree of error. This study aims to analyze the principle of proportionality in Islamic criminal law and evaluate the suitability of the formulation through a comparative approach. This study uses normative legal methods with legislative, conceptual, and comparative approaches. The analysis was carried out on the provisions of Indonesian criminal law, Islamic criminal law principles, and several relevant foreign legal systems. The results of the study show that Islamic criminal law expressly distinguishes the level of error in the imposition of sanctions, as reflected in the concepts of qisas and diyat. This principle is also in line with a number of modern legal systems that separate intentional crimes (dolus) and negligent crimes (culpa) with different criminal consequences. On the other hand, the pro parte dolus pro parte culpa model in the Criminal Code has the potential to obscure these differences by imposing equivalent sanctions, thereby weakening the principle of proportionality and risking substantive injustice. This research contributes theoretically through strengthening the study of comparative criminal law based on the integration of Islamic law perspectives, as well as practically by recommending the reformulation of criminal policies to ensure more optimal proportionality and justice.

Abstract

Drug trafficking and terrorism have seriously threatened many countries' global stability and national security. However, in recent years, there has been an increasing trend of convergence between drug trafficking and terrorism, forming a phenomenon known as narco-terrorism. The article seeks to reveal the relationship between narcotics trafficking and terrorism, a phenomenon often called narco-terrorism. This study's normative legal research method utilizes conceptual and comparative approaches. The results reveal that the convergence between drug trafficking and terrorism seriously impacts security, economy, and social stability. The drug trade provides a substantial source of income for terrorist groups, enabling them to expand their networks, purchase weapons, and launch terror attacks. Conversely, terrorist groups provide drug traffickers protection, infrastructure, and access to drug markets. This study provides important insights for governments, law enforcement agencies, and international organizations in designing effective strategies and policies to counter narco-terrorism. By understanding the dynamics and mechanisms of convergence between drug trafficking and terrorism, appropriate preventive and countermeasures can be taken to mitigate the threats faced by the global community.
