Abstract

ABSTRAK:  Wabah pandemi virus covid-19 yang saat ini terjadi tidak hanya mempengaruhi aspek kesehatan masyarakat dibelahan dunia, melainkan juga menembus pula kehidupan sosial, ekonomi, politik dan bahkan hukum. Untuk meminimalisir kasus penularan covid-19 diberbagai daerah di Indonesia, pemerintah lewat Kemendagri membuat produk hukum yang berupa “Instruksi  Nomor 6  Tahun  2020  tentang  Penegakan  Protokol  Kesehatan Untuk  Pengendalian  Penyebaran  Corona Virus  Disease   2019”  yang dalam hal ini  menginstruksikan kepada seluruh Kepala Daerah  agar dapat menegakkan secara konsisten protokol kesehatan untuk mencegah penyebaran covid-19 yang semakin meningkat. Permasalahan yang dibahas dalam penelitian ini ialah Bagaimanakah pengaturan yang seharusnya terkait Pemakzulan Kepala Daerah di masa Pandemi. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan Pendekatan filosofis, Pendekatan Undang-Undang (Statute Approach), Pendekatan Penafsiran dan Pendekatan Konseptual (Conseptual Approach). Berdasarkan hasil penelitian pengaturan yang ideal terkait Pemakzulan Kepala Daerah pada saat pandemi covid-19 saat ini ialah dengan cara merevisi Undang-Undang Pemerintahan Daerah menambahkan sanksi berupa pemakzulan bagi Kepala Daerah yang melanggar dan tidak menegakkan protokol kesehatan dimasa pandemi.

Abstract

The use of foreign workers in Indonesia is intended to transfer knowledge and SKILL. Various requirements must be met as a condition if the entrepreneur/company wishes to bring in foreign workers. The purpose of placing foreign workers in Indonesia; first, is to meet the need for skilled and professional workers in certain fields that cannot be filled by Indonesian Migrant Workers; second, accelerating the process of national development by accelerating the process of technology transfer or knowledge transfer, especially in the industrial sector; third, provide expansion of employment opportunities for Indonesian Migrant Workers; fourth, increase foreign investment as a support for development capital in Indonesia. This type of research uses normative methods by analyzing legal provisions with statutory and case approaches, is descriptive analysis in nature which aims to describe, inventory, and analyze regarding the provisions governing foreign workers in Indonesia through library research. The discussion in this study is an effort to avoid legal problems and the excessive use of foreign workers, the government must carefully determine the policies to be taken in order to maintain a balance between foreign workers and domestic workers. The manpower aspect, especially in terms of the obligation to use Indonesian workers and the necessity to hold industrial training, transfer of knowledge and technology as well as work permits for foreign workers is an absolute requirement in relation to the use of labor.

Abstract

Abstrak Penerapan Sistem Pemerintahan Berbasis Elektronik (SPBE) di Pemerintahan Daerah ditujukan untuk mewujudkan proses kerja yang efisien, efektif, transparan, dan akuntabel, serta meningkatkan kualitas pelayanan publik. Agar pelaksanaan SPBE dapat berjalan sesuai dengan tujuannya, maka dalam rangka penerapannya perlu diatur berdasarkan prinsip-prinsip Good Governance. Metode penelitian yang digunakan adalah penelitian normatif dengan Pendekatan Perundang-Undangan (Statute Approach), Pendekatan Sejarah (Historical Approach) dan Pendekatan Futuristik (Futuristic Approach). Terselenggaranya good governance dapat mewujudkan aspirasi masyarakat dalam mencapai tujuan dan cita-cita bangsa dan negara. Maka diperlukan pengembangan dan penerapan sistem partisipasi, transparansi dan akuntabilitas yang jelas dan nyata sehingga Penerapan SPBE di Pemerintah Daerah dapat berlangsung secara berdaya guna, berhasil guna, bersih dan bertanggung jawab. karena masih ditemukan di beberapa pemerintah daerah yang masih belum melaksanakan SPBE karena itu di masa mendatang dengan membuat dasar hukum yang lebih tinggi daripada Peraturan Presiden Nomor 95 Tahun 2018 tentang SPBE agar SPBE dapat dilaksanakan oleh pemerintah daerah dengan sebagaimana mestinya.Kata Kunci: Sistem Pemerintahan Berbasis Elektronik (SPBE), Pemerintah Daerah, Pelayanan Publik, E-government, Good Governance AbstractThe implementation of the Electronic-Based Government System (SPBE) in Regional Governments is aimed at realizing an efficient, effective, transparent and accountable work process, as well as improving the quality of public services. In order for the implementation of the SPBE to run in accordance with its objectives, in the context of its implementation, it is necessary to regulate it based on the principles of Good Governance. The research method used is normative research with the Statute Approach, the Historical Approach and the Futuristic Approach. The implementation of good governance can realize the aspirations of the people in achieving the goals and ideals of the nation and state. Therefore, it is necessary to develop and implement a clear and tangible system of participation, transparency and accountability so that the implementation of SPBE in local governments can take place in an efficient, effective, clean and responsible manner. because it is still found in some local governments that have not implemented SPBE because of that in the future by making a higher legal basis than Presidential Regulation Number 95 of 2018 concerning SPBE so that SPBE can be implemented by local governments properly.Keywords: Electronic-Based Government System (SPBE), Local Government, Public Service, E-government, Good Governance

Abstract

AbstrakTerhadap tindak kriminal yang dilakukan oleh anak yang terpaksa harus berkonflik dengan hukum pada tabel diatas tidak terlepas dari pengaruh Juvenile Deliquency (Kenakalan anak) yang menjadi pendorong kriminalitas. Hukum perlindungan anak sangat esensi sekali dalam menentukan masa depan pembentukan keluarga, masyarakat, bangsa dan negara. Rumusan Masalah dalam penelitian ini adalah: Pertama, bagaimana perlindungan hukum terhadap anak korban perkosaan yang melakukan aborsi terkait putusan Nomor 5/Pid.Sus-Anak/2018/PN.Mbn? Kedua, bagaimana Ganti rugi terhadap anak korban perkosaan yang melakukan aborsi terkait putusan Nomor 5/Pid.Sus-Anak/2018/PN.Mbn? Ketiga, apakah Putusan Hakim Pengadilan Negri Muara Bulian Nomor 5/Pid.Sus-Anak/2018/PN.Mbn telah sesuai dengan prinsip perlindungan hukum bagi anak? Metode penelitian yang digunakan adalah metode penelitian hukum normative. Kerangka teori yang digunakan adalah Teori Perlindungan Anak. Kesimpulan dalam penelitian ini adalah bahwa Perlindungan hukum terhadap tindak pidana aborsi yang dilakukan oleh anak pada putusan Nomor: 5/Pid.Sus-Anak/2018/PN.MBN. belum memenuhi rasa keadilan.Kata Kunci: Perlindungan Anak, Korban Perkosaan, AborsiAbstractAgainst crimes committed by children who are forced to come into conflict with the law in the table above cannot be separated from the influence of Juvenile Deliquency (Child Delinquency) which drives crime. The child protection law is very essential in determining the future of forming a family, society, nation and state. The formulation of the problem in this research is: First, what is the legal protection for child victims of rape who have abortions related to decision Number 5/Pid.Sus-Anak/2018/PN.Mbn? Second, what about compensation for child victims of rape who have abortions related to decision No. 5/Pid.Sus-Anak/2018/PN.Mbn? Third, is the Muara Bulian District Court Judge's Decision Number 5/Pid.Sus-Anak/2018/PN.Mbn in accordance with the principles of legal protection for children? The research method used is normative legal research method. The theoretical framework used is the Child Protection Theory. The conclusion in this study is that legal protection for the crime of abortion committed by children is in decision number: 5/Pid.Sus-Anak/2018/PN.MBN. not fulfilling a sense of justice.Keywords: Child Protection, Rape Victims, Abortion

Abstract

Research shows a wave of layoffs and a decrease in labor/employee/employee income during the COVID-19 pandemic. The percentage of dismissed workers/employees/employees in Indonesia at the end of April 2020 was 15.6%. Based on data obtained by the South Sumatra Regional Office of Manpower and Transmigration on April 29, 2020, as many as 612 workers in South Sumatra experienced layoffs due to the COVID-19 pandemic. A total of 7,020 workers were laid off and received no wages during the pandemic. The research method used is socio legal research, namely research that examines the social symptoms that exist in society and then correlates them with statutory regulations. The impact of layoffs during this pandemic, many of these companies often use force majeure reasons. On the other hand, to tackle the Covid-19 problem, one of the efforts made by the Government is the Circular of the Minister of Manpower Number M/3/HK04/II/2020 concerning Protection of Workers/Laborers and Business Continuity in the Context of Preventing and Overcoming Covid-19. Some companies that cut off work relations during the COVID-19 pandemic often use force majeure reasons, to avoid wages and severance pay that should be the rights of workers/laborers.

Abstract

ABSTRAK : Proses penyelesaian sengketa melalui Non Litigasi bukanlah sesuatu yang baru dalam nilai-nilai budaya bangsa dan kooperatif dalam menyelesaikan masalah. Diperlukan pengaturan khusus mengenai penyelesian sengketa non litigasi yang dilakukan oleh Jaksa pengacara negara untuk menjadi tolak ukur dalam keberhasilan penyelesaian sengketa tersebut dengan mengacu dalam pengeturan mengenai kejaksaan di atur dalam Undang-Undang Nomor 11 Tahun 2021 tentang Perubahan Atas Undang-Undang Nomor Undang-Undang Nomor 16 Tahun 2004 tentang Kejaksaan Republik Indonesia. Penulisan penelitian ini bertujuan mengidentifikasi dan menganalisis penerapan upaya sengketa non litigasi oleh Jaksa Pengacara Negara di Kejaksaan Negeri Penukal Abab Lematang Ilir serta menggagas idealnya upaya penyelesian sengketa non litigasi oleh Kejaksaan Negeri dimasa yang akan datang. Metode penelitian penulisan ini termasuk tipe penelitian normatif dengan pendekatan penelitian perundng-Undangan, pendekatan kasus dan pendekatan futuristik. Hasil penelitian ini diketahui Pengaturan kewenangan kejaksaan secara abstracto penyelesaian sengketa non litigasi dalam melakukan mediasi di Kejaksaan Negeri Penukal Abab Lematang Ilir yakni memiliki unsur keadilan para pihak dengan berpedoman pada Undang-Undang Republik Indonesia Nomor 11 Tahun 2021 Tentang Perubahan Atas Undang-Undang Nomor 16 Tahun 2004 Tentang Kejaksaan Republik Indonesia meskipun secara khusus belum mengatur mengenai mediasi. Selain itu untuk meningkatkan profesionalisme Jaksa Pengacara Negara melalui berbagai metode antara lain; mengikutkan Jaksa Pengacara Negara pendidikan tehnis DATUN; mewajibkan para jaksa untuk menghadiri sidang perkara perdata dan Tata Usaha negara di Pengadilan Negeri sehingga mengetahui dan memahami prosedur dan tata cara beracara Perdata dan TUN di Pengadilan bukan hanya memahami beracara Pidana di Pengadilan; mempelajari tehnik-tehnik bernegosiasi dan terampil membuat legal opinion. Kata Kunci : Kewenangan, Jaksa Pengacara Negara, Sengketa ABSTRACT : The process of resolving disputes through non-litigation is not something new in the nation's cultural values and is cooperative in solving problems. Special arrangements are needed regarding the resolution of non-litigation disputes carried out by state prosecutors to become a benchmark in the success of the settlement of these disputes with reference to the arrangements regarding the Attorney stipulated in Law Number 11 of 2021 concerning Amendments to Law Number 16 of 2004 concerning the Attorney of the Republic of Indonesia. This study aims to identify and analyze the implementation of non-litigation dispute efforts by State Prosecutors at the Penukal Abab Lematang Ilir District and to initiate ideal efforts in resolving non-litigation disputes by State Prosecutors in the future. This is normative research with statutory, case and futuristic approaches. The results of this study showed that the arrangement of the prosecutor's authority in abstracto non-litigation dispute resolution in conducting mediation at the District Attorney of Penukal Abab Lematang Ilir fulfilled the elements of justice for all parties guided by the Law of the Republic of Indonesia Number 11 of 2021 concerning Amendments to Law Number 16 2004 concerning the Attorney of the Republic of Indonesia, although it does not specifically regulate mediation. In addition, in increasing the professionalism of State Prosecutors, the following methods can be carried out: enrolling them in civil and state administrative technical education, requiring them to obtain a special certificate for mediation prosecutors and to learn negotiation techniques, and be skillful in making legal opinions.   Key words: Authority, State Prosecutor, Dispute

Abstract

Along with modern developments that exist today, various polemics have emerged in determining the typology of village governance that is in accordance with the principles of legal policy (legal policy) related to the sociological foundation in the form of understanding village conditions is absolutely necessary. Therefore, a stronger State institution is needed in dealing with the rational division of tasks and authorities between the State and regions (villages). In its preparation, it is necessary to describe a sociological condition of an intact village, which is viewed from the village elements which include the village area, village life system and village administration. The method and approach used was empirical (sociological research). There were several arguments for the need to understand the condition of the village sociologically where various villages throughout Indonesia have always been the basis of community livelihoods that have autonomy in managing the governance of the population, local institutions and economic resources with all the local wisdom possessed by local Indonesian communities. Furthermore, the regulation on village governance is intended to respond to the globalization process marked by the liberalization process of information, economy, technology, culture, etc.

Abstract

The fourth paragraph at the opening of the Constitution of the Republic of Indonesia states that the Government of the Republic of Indonesia is obliged to protect the entire Indonesian nation, promote the general welfare, and educate the nation's life which is a manifestation of the responsibility of the state which is obliged to create welfare for its people fairly and equitably equally. This constitutional mandate is spelled out in the form of regulations aimed at preventing injustice from the stronger party against the weaker party so that a just and peaceful society can be created. The method used to analyze this problem is through normative and empirical mix and match. The approach used in this study is a statute approach, conceptual approach, and case approach. Legal protection for workers is an obligation for the fulfillment of basic rights inherent and protected by the constitution as regulated in Article 27 paragraph (2) of the 1945 Constitution of the Republic of Indonesia. The logical consequence of this mandate is the birth of the State's obligation to accommodate facilities and the widest possible opportunity for the community so that they can get a job as well as make it something worthy of humanity. Thus, the violation of basic rights guaranteed by the constitution is a violation of human rights. Protection of workers is regulated in Articles 67 to 101 of the Manpower Law, including those concerning wages and welfare. However, when faced with the COVID-19 pandemic situation, the company immediately provided a force majeure reason to avoid paying severance pay for workers/laborers affected by layoffs. The problem that occurs, in this case, is the termination of employment carried out by companies using force majeure reasons by companies in Indonesia unilaterally. Abstract

Regional Original Revenue (PAD) is income obtained by the region, collected based on Regional Regulations by statutory regulations that are sourced from regional taxes, regional levies, separated regional wealth management results, and others including one the incentives and investment. as a measure to stimulate economic growth. If examined based on discussions with the four commissions, they approved the 2022 APBD of the Palembang City Government of IDR 3.84 trillion with a target of IDR 1.07 trillion of Original Regional Revenue (PAD). Efforts to increase investment must be supported by the development of quality infrastructure, professional apparatus, and the bureaucratic system as well as a safe and peaceful condition of the city of Palembang. The method used in this research is empirical with a statutory approach. Using the tools of analytical prescriptive analysis. To increase Regional Original Income (PAD) there are 2 (two) social implications that can be enjoyed by the region. First, the investment provides opportunities for potential economic resources to be processed into real economic forces that can encourage local economic dynamics, which in the end will also lead to economic growth and improvement of community welfare. Second, the investment will be followed by economic activities that can create new job opportunities. The availability of new jobs will certainly increase people's income and encourage the realization of prosperity and reduce poverty.

Abstract

Some of the values contained in the regulation of the National Social Security System Law (SJSN) and the Social Security Management Agency Law (BPJS) are contrary to constitutional values. The purpose of this paper is to examine the conflict of values. The study was conducted using normative legal research methods, which focused on the statutory and theoretical approach. This study found that social welfare mandated by the 1945 Constitution to the state is developed through the national social security system: (a) as an obligation, (b) to empower the weak and incapable people to develop themselves in accordance with human dignity, and (c) in order to fulfill basic needs, both the right to education, the right to health, and the right to get a job. In addition, although the 1945 Constitution does not specify the pattern of the social security system to be developed, the SJSN Law and the BPJS Law use a mixed model between social insurance from participants and social assistance from the state to the poor. Based on this, it is recommended to adjust the formulation of legal norms of the SJSN Law and BPJS Law contained with constitutional values.
