Abstract

The mission of the state, as stipulated by the constitution, is to accomplish social welfare, as stated in the fourth paragraph of the Preamble to the 1945 Constitution of the Republic of Indonesia, which serves as the foundation for the Indonesian country to operate as a National Development Document. As a result, state administrators are now required to strive for public welfare, including state-provided facilities, such as public services, whose service requirements must be met in line with statutory regulations. Public Services are one of the eight areas of change in the implementation of bureaucratic reform in the Minister of State Apparatus Empowerment and Bureaucratic Reform Regulation Number 25 of 2020 concerning the Road Map for Bureaucratic Reform 2020-2024. The 8 (eight) areas of change in bureaucratic reform are as follows: (1) Change management; (2) Policy Deregulation; (3) Organizational Structuring; (4) Management Arrangement; (5) Arrangement of HR Apparatus; (6) Strengthening Accountability; (7) Strengthening Supervision; and (8) Improving the Quality of Public Services. The method utilized for analyzing the issue is a combination of normative and empirical, with approaches including the statutory approach, conceptual approach, and case approach.  The discussion in this article is based on the Public Services Law, which declares that every public service provider is required to deliver quality services to all users. Lactation rooms for breastfeeding mothers and toddlers are one of the features that help to make inclusive courts a reality. Lactation rooms in workplaces and public facilities are also protected by the Minister of Health of the Republic of Indonesia's Regulation No. 15 of 2013 on Procedures for Providing Special Facilities for Breastfeeding and/or Expression of Breast Milk. This regulation is, of course, inextricably linked to Law Number 36 of 2009 concerning Health, particularly Article 128, which governs babies' right to receive exclusive breast milk from birth for 6 (six) months, as emphasized in Palembang City Regional Regulation No. 2 of 2014 concerning the Provision of Exclusive Breast Milk. As a result, the study's findings suggest that several colleges in Palembang City do not provide lactation rooms for breastfeeding moms, instead offering only locked rooms, making it uncomfortable for working women who bring their newborns to work. As a result, this does not meet the requirements of public services for breastfeeding.

Abstract

Dana desa digunakan untuk membiayai penyelenggaraan pemerintahan, pelaksanaan pembangunan, pembinaan, kemasyarakatan dan pemberdayaan masyarakat, sebagai pengejawantahan dari prinsip good governance melalui prinsip transparansi yaitu keterbukaan informasi publik, seluruh informasi tentang penggunaan dana desa harus diberikan secara rinci dan transparan kepada masyarakat sebagai konsekuensi pertangggungjawaban kepala desa dalam mengelola dana desa. Penggunaan alokasi dana desa yang diterima pemerintah desa 30% alokasi dana desa dipergunakan untuk operasional penyelenggaraan pemerintah desa dalam pembiayaan operasional desa, biaya operasional BPD, biaya operasional tim penyelenggara alokasi dana desa. Sedangkan 70% dana desa dipergunakan untuk pemberdayaan masyarakat dalam pembangunan sarana dan prasarana ekonomi desa, pemberdayaan dibidang pendidikan, kesehatan, pemberdayaan ekonomi masyarakat terutama untuk mengentaskan kemiskinan. Tujuan PKM ini adalah memberikan penyuluhan mentransfer informasi dan pengetahuan tentang pengelolaan dan perencanaan anggaran desa bagi perangkat desa yang mempunyai kewenangan untuk membuat anggaran desa. Metode yang digunakan adalah penyuluhan dengan diskusi dan tanya jawab. Simpulan yang didapat bahwa pada kegiatan ini menginformasikan mengenai perencanaan anggaran desa kepada aparat desa khususnya kepala desa, sebab mereka di tuntut untuk bertanggungjawab penuh dalam pengelolaan dana desa untuk mengembangkan potensi desa yang terwujud dalam pembangunan infrastruktur dan lain sebagainya, oleh karenanya pemerintah desa harus menerapkan prinsip penyelenggaraan yang baik untuk mewujudkan good governance.

Abstract

The Constitutional Court Decision Number 90/PUU-XXI/2023 Concerning the Age Limit for Vice Presidential Candidates in the 2024 Presidential Election has caused much controversy, both politically and legally. This decision has profound implications for Indonesia’ political configuration, as it grants constitutional legitimacy to Gibran Rakabuming Raka, enabling him to run as a candidate for vice president of the Republic of Indonesia in the 2024 General Election. In the context of the legal debate, several problems have emerged, including the impact of this decision on the quality of democracy in Indonesia. One key concern is whether this decision is the initial gateway for Indonesia to enter a system called 'juristocracy'. This term refers to a situation where the Constitutional Court Decision justifies the practice of 'negative legislation', where the legislative function is constitutionally only given to the President and the DPR, but the Constitutional Court, through its 'final and binding' decision power, makes this a loophole that potentially damage democracy. This research is focused on examining the decision based on the two fundamental problems outlined above, using a library research method based on normative research, with a conceptual approach as its foundation. The analysis employs the theory of the rule of law to critically assess whether the decision has significant positive or negative implications for the sustainability of democracy and the existence of the rule of law in Indonesia in the future.

Abstract

The issuance of Perppu Number 2 of 2022 has led to various dynamic debates within society. The government's actions have shown attempts to "circumvent" Constitutional Court Decision Number 91/PUU-XVIII/2020 and even eliminate the legislative role in the process of amending laws. Autocratic legalism is a situation where the law is utilized as a tool by the rulers (whether executive, legislative, judicial, or a combination thereof) to legitimize their actions in accumulating and consolidating power under the guise of law. The research findings indicate that the consequences of the issuance of Perppu Number 2 of 2022 include the violation of the legislative drafting grace period, failing to resolve legal uncertainties, and being considered non-aspirational, non-participatory, and non-transparent in its formation.

Abstract

Pemerintah Indonesia telah mengupayakan untuk memberikan pelayanan jaminan kesehatan bagi seluruh warga negara melalui BPJS Kesehatan, namun bagi manusia gerobak belum dapat merasakan pelayanan dikarenakan ada persyaratan yang belum bisa dipenuhi, tentunya hal ini bertentangan dengan UUD Tahun 1945. Tujuan tesis ini adalah untuk mengidentifikasi dan menganalisis bagaimana pengaturan hak konstitusional warga negara di bidang kesehatan khususnya manusia gerobak. Metode Penelitian yang digunakan yaitu penelitian Normatif di dukung dengan Data Empiris. Pendekatan penelitian yang digunakan adalah pendekatan perundang-undangan, pendekatan konseptual, pendekatan sosiologis, pendekatan kasus, dan pendekatan futuristik. Hasil Penelitian diperoleh kesimpulan Pengaturan mengenai manusia gerobak di bidang kesehatan belum diatur secara khusus, aturan yang ada belum mampu menjamin manusia gerobak untuk memperoleh jaminan kesehatan. Saran dari penulis untuk pemerintah agar membuat aturan yang mempermudah akses kesehatan bagi warga negara seperti KTP yang bisa dijadikan untuk akses berobat di seluruh wilayah Indonesia

Abstract

The agrarian conflict in Moro-Moro Register 45, Mesuji Regency, Lampung, has significantly impacted the local community, particularly in restricting children's access to education. The enforcement of Law No. 18 of 2013 on the Prevention and Eradication of Forest Destruction and Law No. 30 of 2014 on Government Administration has further complicated the situation by limiting the community's rights to manage and utilize natural resources, making it difficult for residents in forest areas to access adequate educational services. This research examines two key issues: the role of education as a tool of resistance for the Moro-Moro Register 45 community in defending their rights and the impact of agrarian conflict on their struggle for land access. Using a qualitative and socio-legal approach, this research integrates legal analysis with social inquiry, drawing on desk research, direct observations, and in-depth interviews with community members and stakeholders. The findings indicate that the politics of education is a crucial instrument for the Moro-Moro community in advocating for social change, particularly in addressing agrarian disputes and seeking social justice at the governmental level. Furthermore, agrarian conflicts often stem from systemic injustices in the distribution and management of natural resources, with land emerging as a central point of contention between the state, private enterprises, and local communities or small-scale farmers.

Abstract

Water is essential for all forms of life, and its importance is also emphasized in Islamic teachings. The quality of water that is not guaranteed can affect health or even the validity of worship. Base on the problem, the existence of water becomes important, especially in efforts to ensure the hygiene of water quality standards in order to provide security for its users. The existence of water requires guaranteed protection from supply to distribution. In fact, it is not governed by strict regulations that ensure legal certainty. This study aims to describe the level of urgency of legalizing water and sanitation quality standards in the form of higher and legally binding regulations. Empirical legal methods by taking primary and secondary data sources in conducting problem analysis. Observations and interviews were conducted to obtain primary data, while secondary data was obtained from legislative and conceptual approach are used to strengthen arguments in ensuring that the concepts offered remain in the correct legal corridor. The findings show the inconsistency of the government in recognizing the existence of water that is important for life but the implementation of systematic quality standard supervision, even the application of sanctions for violators cannot be carried out because the legal instrument is only limited to the regulations of the Minister of Health. The need to establish regulations in the form of Government Regulations on water quality standards and sanitation is a crucial consideration for safeguarding public health and well-being.

Abstract

Quality standards for water health requirements for sanitation hygiene, swimming pools, solus per aqua (SPA), and malls monitor by the Public Health office. Still, the monitoring process has yet to publish. It has not provided legalization, such as labels or signs that consumers can recognize, even though information and legalization need as an effort to protect consumer rights, especially a guarantee of security and comfort when using or utilizing products from business actors. This article used an empirical study to describe the urgency of the publication and labeling of water quality standards for swimming pools, spas, and mall sanitation.  The data were by polling managers of five swimming pools, ten spas, five malls, and 100 consumers as respondents. The research results are described in a qualitative descriptive manner based on primary and secondary data through a statutory approach and a legal sociology approach by prioritizing the fulfillment of transparent consumer services. The addition of benefits resulting from the supervision of water quality standards on the website of the Public Health office is one solution to strengthen consumer protection and, at the same time, become evidence of enhancing the state's role as a supervisor.

Abstract

The potential of traditional knowledge of the indigenous people of Tenganan Pegringsingan, Manggis District, Karang Asam Regency, Bali, leads readers to a new insight that this potential can be measured through the concept of Intellectual Property Rights. This is in accordance with the parameters listed in WIPO and the mandate of Government Regulation No. 56 of 2022 concerning Public Intellectual Property. However, this potential has not been identified as an intellectual property right. This article explores the diverse traditional wisdom within the indigenous community of Tenganan that potentially has an intellectual property right. This traditional wisdom is recorded as part of the knowledge in the Intellectual Property Rights regime using a proprietary system. This study employs a qualitative method with hermeneutic analysis to explore the traditional wisdom of the indigenous people of Tenganan and its potential for protecting intellectual property rights. The results of this study aim to identify the traditional knowledge of the Tenganan indigenous community and classify it within the intellectual property rights regime as regulated in Indonesia’s Intellectual Property Rights Law, with the expectation of supporting the communal intellectual property of the Tenganan people.

Abstract

Penelitian yang berjudul “Pemenuhan Hak Normatif Pekerja Atas Pemutusan Hubungan Kerja Pasca Berlakunya Undang-undang Nomor 6 Tahun 2023 Tentang Penetapan Perpu Nomor 2 Tahun 2022 Tentang Cipta Kerja Menjadi Undang-undang” yang diatur dalam Pasal 153 - 160. Membahas tentang Pemutusan Hubungan Kerja (PHK) diatur dalam undang-undang cipta kerja. Pada penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatannya yakni perundang-undangan dan kasus. Untuk menganalisis bahan hukum digunakan teknik analisis secara deskritif kualitatif. Kuator adalah pihak yang ditunjuk pengadilan niaga guna penyelesaian kasus tersebut, hal ini memiliki kaitan dengan Undang-undang Nomor 2 Tahun 2004 Tentang Penyelesaian Perselisihan Hubungan Industrial dan Undang-undang Nomor 4 Tahun 2023 Tentang Kepailitan, terkait pesangon dan pembayaran upah pekerja. Perlindungan hukum bagi pekerja yang terkena Pemutusan Hubungan Kerja (PHK) secara sepihak diatur pada Pasal 153 Undang-undang Cipta Kerja, perusahaan memiliki larangan dalam Pemutusan Hubungan Kerja (PHK) pekerja. Peraturan Pemutusan Hubungan Kerja (PHK) diatur dalam Pasal 151 Undang-undang Nomor 6 Tahun 2023 Tentang Cipta Kerja, adapun PHK bisa dilakukan dan dibenarkan oleh perusahaan jika dalam keadaan yang memaksa (force majeure) hal ini tercantum dalam Pasal 154a Undang-undang Cipta Kerja.
