Abstract

Sebagai daerah yang diberikan kewenangan otonomi khusus, provinsi papua memiliki sejumlah kewenangan yang berbeda dari daerah-daerah otonomi pada umumnya di indonesia, berikut mengenai struktur pemerintahan daerahnya. Gubernur provinsi papua sebagai kepala daerah sekaligus kepala pemerintahan berkedudukan sebagai wakil pemerintah di papua, memiliki sejumlah kewenangan namun kewenangan tersebut tidak mencirikan sistem pemerintahan daerah sesuai dengan konsep otonomi khusus sebagai perwujudan desentralisasi asimteris (asymetrical decentralization) tetapi cenderung mewujudkan administrasi pemerintahan daerah dalam Undang-Undang pemerintahan Daerah. Tulisan ini bertujuan untuk mengetahui apa esensi konsep desentralisasi dalam pelaksanaan pemerintahan daerah berbasis otonomi khusus di papua, serta bagaimana kewenangan pemerintah provinsi papua dalam otonomi khusus papua. Penelitian ini menggunakan jenis penelitian yuridis-normatif, dengan pendekatan teori hukum dan perundang-undangan (statuta approach). Hasil penelitian ini menunjukan bahwa pelaksanaan kewenangan gubernur dalam kerangka otonomi khusus papua masih dilaksanakan berdasarkan Undang-Undang pemerintahan Daerah. Dampak dari pelaksanaan kewenangan tersebut menghasilkan posisi subordinatif atau ataupun kewenangan yang sumir antara pemerintah provinsi dan kabupaten/kota dalam pelaksanaan otonomi khusus papua.

Abstract

Keberadaan serta kebiasan-kebiasaan yang hidup menjadi aturan hukum masyarakat adat dalam bingkai Negara Kesatuan Republik Indonesia hingga saat ini masih eksis dan mengalami perkembangan. Penelitian ini bertujuan untuk menganalisis mengenai proses penyelesaian tindak pidana berdasarkan adat suku moi (studi kasus di polres kota sorong). Penelitian ini menggunakan metode penelitian empiris yuridis. Teknik pengumpulan data dilakukan dengan cara melakukan studi lapangan (field reseach). Hasil penelitian ini menunjukan bahwa penegakkan hukum adat terhadap tindak pidana berdasarkan adat Moi dipengaruhi oleh penghormatan masyarakat adat Moi yang sangat menjunjung tinggi adat istiadat itu pedoman hidup. Sementara itu, penyebab digunakan adat Moi dalam proses penyelesaian masalah di adat Moi dianggap lebih adil dan mewakili suasana kebatinan masyarakat suku Moi, serta lebih memberikan efek jera pada pelaku, dan juga berkaitan dengan hukuman ghaib yang dipercaya akan dihadapi oleh pelaku.

Abstract

In the explanation of Law no. 1/PNPS/1965 stated that the recognized religions in Indonesia are Islam, Christianity, Catholicism, Hindu Buddhism, and Confucianism. As a result, other beliefs loses its legal standing and legal protection by the state. The issue of religious freedom is also influenced by the different interpretations of the terms "religion" and "belief" by the public and law enforcer. First, the terms "religion" and "belief" have different meanings. "Religion" refers to the religions adopted by Indonesian citizens, in accordance with the explanation in Law no. 1/PNPS/1965. While the term "belief" has no legal basis. Second, the terms "religion" and "belief" have identical meanings. If this opinion is recognized, then there will be generalization between "agama wahyu", and "agama budaya”. On the other hand, Article 29 paragraph (2) of the 1945 Constitution of the Republic of Indonesia does not yet have an adequate constitutional interpretation in resolving this issue.

Abstract

The Indonesian political atmosphere has recently been shocked by controversial issues regarding the postponement of the Indonesian elections in 2024 nationally. The reason for postponing the election is due to the unstable economic condition of the country after COVID-19 so that it is considered incapable of holding elections in 2024. This study aims to find out how the postponement of elections is regulated in Indonesia, as well as whether the postponement of elections is a constitutional action or for the interests of groups elite. The results of this study indicate that basically the Indonesian Election Law does not specifically regulate the postponement of elections. The postponement of elections in the provisions of election law in Indonesia only regulates regional election delays. Meanwhile, national election delays are not adequately regulated. Therefore, nationally postponing the election is considered a violation of the Indonesian constitution. In addition, it is seen that the postponement of the election is not an aspiration of the Indonesian people so that it is considered an attempt by the political elite to take political advantage in the 2024 election.

Abstract

This research highlights the background of Indonesia as a state of law, where state power is regulated by law to achieve legal order. However, the implementation of laws to protect women from violence still poses weaknesses that affect the sense of justice and impunity for perpetrators. As an alternative solution, the Restorative Justice approach is proposed to resolve acts of sexual violence by involving victims and perpetrators in dialogue and joint recovery, in accordance with the principle of consensus. This research uses the normative juridical method by analyzing relevant regulations and literature as well as conducting interviews at the Teluk Bitung District Police. It was found that the Restorative Justice approach can be a more inclusive and restorative alternative for victims and perpetrators of sexual violence. However, to implement it effectively, certain conditions need to be met, including admission of guilt, consent of the victim and perpetrator, and support from the police or prosecutor's office. The results show that this approach has the potential to provide a fairer resolution and have a positive impact on efforts to prevent and respond to violence against women in Indonesia.
