Abstract

Jamaah Islamiyah era Para Wijayanto bertransformasi menjadi kelompok teroris dengan pola pendanaan yang lebih beragam. Berbagai cara dilakukan oleh kelompok Jamaah Islamiyah untuk megumpulkan dana untuk pembiayaan operasional aksi teror. Melalui kontra intelijen yang dilakukan, Jamaah Islamiyah mampu mengumpulkan dana dari berbagai macam sumber. Penelitian ini bertujuan untuk menganalisis upaya kontra intelijen dalam pengumpulan pendanaan terorisme oleh Jamaah Islamiyah, dengan menggunakan studi kasus dokumen putusan Para Wijayanto. Penelitian menggunakan pendekatan kualitatif untuk mendapatkan gambaran yang lebih holistik mengenai fenomena tersebut yang tidak dibatasi pada variabel tertentu. Melalui analisis dokumen putusan pengadilan terhadap Para Wijayanto, penelitian berhasil mengidentifikasi metode tradisional yang digunakan oleh Jamaah Islamiyah dalam pendanaan terorisme dan sejauh mana upaya kontra intelijen telah berhasil dilakukan oleh Jamaah Islamiyah untuk menutupi pendanaan terorisme yang mereka lakukan. Temuan penelitian ini memberikan masukan dalam upaya pencegahan terorisme di masa depan dan menyoroti pentingnya kerjasama antara intelijen dan lembaga keamanan dalam memerangi pendanaan terorisme.

Abstract

This research is based on the fact of Indonesia's great efforts in combating money laundering and terrorism financing practices that brought Indonesia to be recognized as the 40th member of the FATF. The purpose of this study is to analyze the threats, vulnerabilities and risks of money laundering and terrorism financing crimes and describe the potential impact of Indonesia's involvement as a member of the FATF on the prevention, supervision and enforcement of these crimes. Using a descriptive qualitative approach, this study uses secondary data from related institution documents and a number of previous research journals as a basis for analyzing the problem under study. The results showed that money laundering and terrorism financing crimes are very high when viewed from the trend in the number of crackdowns in recent years. In addition, the vulnerability related to several problems that are still faced such as weak declarations on carrying cash, large objects of supervision, problems with data input in the system, not standardized supervisory infrastructure, limited authority of the DGT and not integrated reporting applications among related institutions. The potential impact of Indonesia's involvement as a member of the FATF on the prevention, supervision and enforcement of crimes is to increase the credibility of the country's economic management as the main investment attraction. Safeguarding Indonesia's international political interests in influencing international policy in accordance with Indonesia's national interests. And become a catalyst that encourages or "forces" Indonesia to focus on strengthening supervision and law enforcement through various efforts and strategies.

Abstract

This article began with the existence of a major threat to national resilience related to transnational organized crime (TNOC) in wildlife trade and smuggling. The Directorate General of Customs and Excise (DJBC) as the guard of Indonesia's entrance has a strategic role in efforts to supervise TNOC activities. This study aims to analyze the threat of TNOC acts of animal smuggling and all efforts made by DJBC with other law enforcement officials. This paper uses a qualitative approach, with the research method of literature study or document study. Data collection techniques come from secondary data such as related institutional documents and literature that are in accordance with the concepts discussed. The results of the study show that the threat of wildlife smuggling is still very high which has the potential to pose a great risk to national resilience in the context of biodiversity conservation, community protection from various viruses to economic losses that Indonesia can get. From the perspective of strategic intelligence, the supervision of TNOC actions requires various strengthening, especially in strengthening data and intelligence information systems, strategic intelligence resources and creative thinking of law enforcement. Finally, various efforts to strengthen the legal foundation require dynamic efforts by adjusting environmental conditions and international laws and regulations, accompanied by synergy between institutions.

Abstract

This article discusses collaborative strategies in tertiary prevention of drug abuse, with a focus on the active role of the community and government institutions in the rehabilitation and reintegration of drug victims. Through the literature review method, this article explores various efforts involving various parties in dealing with drugs. The research results show that the dynamics of the process in dealing with drugs are good, including the promotion of shared principles, shared motivation and the capacity to take action. Collaborative actions have also been good, including facilitating and advancing the collaboration process. The impact and adaptation of collaboration in dealing with drugs has also been good, trying to suppress drug users. Overall, efforts to rehabilitate and reintegrate drug users into society are complex efforts and require cooperation from various parties. Support is needed from the government, non-governmental organizations, family, friends and society as a whole to facilitate the rehabilitation and reintegration process of drug users into society. With effective rehabilitation and reintegration efforts, drug users can be expected to return to living normal and productive lives in society. Apart from that, rehabilitation and reintegration efforts can also help reduce the rate of drug abuse and improve the quality of life of society as a whole.

Abstract

This study examines the impact of artificial intelligence (AI) algorithms on the protection of individual rights, with a focus on transparency and accountability. The research aims to analyze how regulations like the GDPR in the European Union influence AI decision-making processes to safeguard human rights. Using a comparative legal analysis method, this research investigates the role of prospective and retrospective transparency in ensuring that AI systems operate ethically and fairly. The results highlight that transparency significantly enhances accountability and user rights, particularly in preventing discrimination and promoting security. The study concludes that collaboration among policymakers, developers, and users is critical to aligning AI technologies with human rights principles, ultimately fostering more equitable and secure outcomes.

Abstract

This research explores the rise of apoliticalism at the intersection of human rights and legal violations in Indonesia. The objective is to examine how factors such as education, access to information, and trust in the political system influence apolitical attitudes and evaluate the legal frameworks governing political participation. The study uses a literature review method, analyzing academic journals, reports, and government data. Results indicate that while apoliticalism aligns with human rights principles, it threatens democratic legitimacy when widespread. The research concludes that balancing individual freedoms with collective responsibility is essential to mitigate the adverse effects of apoliticalism, ensuring both human rights protection and democratic participation.

Abstract

The movement of Foreign Terrorist Fighters (FTFs) in Syria has emerged as a global phenomenon, drawing serious attention from numerous countries due to its significant scale. Indonesia is among the nations contributing to the movement of FTFs in this context. A critical aspect currently under scrutiny is the discourse around their repatriation to Indonesia. Therefore, a key component that must be considered is the potential threat these individuals pose upon returning to Indonesia. To address this, the study employs a qualitative approach, gathering data through literature reviews and interviews with stakeholders directly involved with Indonesian FTFs. The research provides an analysis of the various potential threats posed by these FTFs upon their return to Indonesia, based on a review of literature and factual data regarding the actions previously undertaken by FTFs in Indonesia.

Abstract

ABSTRAK  Kerawanan pemilu yang berasal dari dimensi politik memiliki potensi dampak pada ketahanan sosial wilayah di Provinsi DKI Jakarta dan dapat mengancaman persatuan dan kesatuan bangsa seperti yang pernah terjadi pada pelaksanaan Pilkada DKI Jakarta tahun 2017 dan Pelaksanaan Pemilihan Presiden tahun 2019 lalu. Penelitian yang mengumpulkan data dari November s.d Desember 2023 dengan metode penelitian campuran mengambil data kuantitatif dari IKP 2024 untuk diuji dengan pengukuran kerawanan alternatif, yaitu metode analisis kerawanan dari perspektif Hank Prunckun dan validasi secara kualitatif yang melibatkan sekitar 27 informan dengan teknik wawancara semi terstruktur. Temuan akar masalah sebagai sumber kerawanan mendasar adalah adanya kampanye hitam dengan penggunaan isu SARA sehingga perlu dirumuskan strategi untuk memitigasi hal tersebut. Rumusan strategi yang dapat disampaikan antara lain: [1] Penggunaan UU No 7/2017 dan kewenangan serta fungsi Bawaslu secara kelembagaan untuk mengoptimalkan keberadaan Gakkumdu menindak tegas kampanye hitam dengan isu SARA agar keharmonisan masyarakat Provinsi DKI Jakarta tetap terjaga; dan [2]Penggunaan UU No 7/2017 dan kewenangan serta fungsi Bawaslu secara kelembagaan untuk mengoptimalkan keberadaan dan fungsi sosial Tokoh Agama (Toga), Tokoh Adat (Todat), Tokoh Masyarakat (Tomas), dan Forum Komunikasi Masyarakat yang ada di Provinsi DKI Jakarta untuk mengedukasi masyarakat bahwa kampanye hitam dengan isu SARA tidak sesuai dengan nilai-nilai luhur Bangsa Indonesia agar keharmonisan masyarakat Provinsi DKI Jakarta tetap terjaga.

Abstract

In this digital era, cyber espionage is a serious threat to countries around the world, including Indonesia. This study looks at the legal framework governing cyber espionage, and the challenges and opportunities for law enforcement it faces as well as its development. Through a qualitative methodology based on institutional theory, this study reveals that the existing legal framework, particularly The Electronic Information and Transactions Law (ITE Law) and Penal Code (KUHP), is still not sufficient. Lack of legal clarity and inconsistencies — both internationally and nationally — make things even more difficult. Other contributing factors to poor law enforcement include limited institutional capacity resulting in the lack of well-trained human resources, insufficient technological infrastructure, and inter-agency collaboration. The process of isomorphism, which is understood in institutional framework as imitation of best practices implemented by other countries to cope with cyber espionage, does not always work because each country has different contexts and needs. This study shows that most literature in cyber espionage underscores the need for comprehensive legal reform, improvement of institutional capacity, quality of cooperation, and better understanding of the role of non-state actors in building an effective cyber security system in Indonesia.

Abstract

This investigation aims to explore digitalization as a tool to prevent corruption at the local government level in Indonesia. A normative legal approach was used in this investigation, which analyzed secondary data, such as laws, regulations, and academic studies. This study indicated that digitalization had the potential to reduce the vulnerability to corruption by increasing transparency, accountability, and integrity in local government governance. By integrating e-catalogs and local government information systems, the government can create a tighter oversight mechanism for procuring goods and services. Several limitations in implementation are still to be found, including differences in infrastructure and technological readiness in various regions, which hinder the effectiveness of implementing digital policies in preventing corruption. This study concludes that a comprehensive and consistent digitalization strategy across all regions is essential to strengthening law enforcement and reducing corruption in Indonesia.
