Abstract

Article 115 of Law Number 22 of 2009 concerning Road Traffic and Transportation (UU LLAJ) regulates the prohibition of illegal racing. This research is an empirical juridical research. The handling of wild races in the City of Padang by the Padang Traffic Police with synergy between the Padang Traffic Police and the Community in tackling illegal racing in the City of Padang is carried out preventively with community leaders by conducting outreach to schools, in print and electronic media. Making banners on the streets, broadcasting on the radio, social media such as Instagram by involving respected community leaders in the illegal racing area. Patrol activities to create conditions at night with people who carry out patrols at night. Patrols are carried out by walking along streets that have the potential to be used as places for speeding. Supervision at posts that are prone to wild racing with the local community. Repsentially, the synergy with the community is that the community helps officers search for illegal racers. The obstacle in the synergy between the Padang Traffic Police and the community in tackling illegal racing in the city of Padang is that there are still people who do not want to assist police officers in catching and raiding illegal racers. Because the large number of illegal racers who have been caught in cases of illegal racing in the city of Padang is not proportional to the number of police personnel who are on night picket duty. The level of legal awareness of the people of Padang City to comply with traffic rules is very low. Society that is less corporative by becoming spectators of wild racing, there are workshops and motorcycle gangs that provoke teenagers, there is betting (gambling), lack of attention and supervision of parents towards children, lack of facilities and infrastructure, and lack of funds to channel the hobby of racing.

Abstract

Keadilan Restoratif atau Restorative justice dalam penyelesaian tindak pidana di Indonesia diatur Peraturan Polri Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana berdasarkan Keadilan Restoratif. Dalam Upaya Penyelesaian Tindak Pidana Penipuan Terhadap Perusahaan Asuransi Jiwa Bersama Bumiputera 1912 Jakarta, Keadilan Restoratif telah diterapkan berulang kali. Spesifikasi penelitian ini adalah deskriptif analitis. Pendekatan yang digunakan adalah pendekatan yuridis normatif yang didukung dengan pendekatan yuridis empiris dengan penelitian ke lapangan yaitu di Kantor Pusat Asuransi Jiwa Bersama Bumiputera 1912 Jakarta. Berdasarkan hasil penelitian, diperoleh Pertama, penerapan Restorative Justice dalam penyelesaian tindak pidana penipuan terhadap perusahaan Asuransi Jiwa Bersama Bumiputera 1912 telah memenuhi seluruh syarat formil dan materil penerapan Restorative Justice yang tercantum Peraturan Polri Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana berdasarkan Keadilan Restoratif. Kedua, Upaya Penanggulangan Tindak Pidana Penipuan Terhadap Perusahaan Asuransi Jiwa pada Asuransi Jiwa Bersama Bumiputera 1912 terbagi menjadi dua yaitu tindakan Represif dan Preventif.

Abstract

Illegal gold mining in Manggani, Nagari Koto Tinggi, Fifty Cities Regency, causes serious environmental damage as well as a source of livelihood for the community, so that the countermeasures face ecological and socio-economic dilemmas. This study aims to analyze the role and obstacles of the 50 City Police Satintelkam in overcoming environmental crimes due to illegal gold mining through cross-police cooperation, especially with the Pasaman Police. This research is a legal research with descriptive-analytical specifications using a normative juridical approach supported by empirical data; Secondary data is obtained through literature studies, while primary data is collected through interviews, then analyzed qualitatively. The results of the study show that Satintelkam plays a strategic role in early detection, mapping of actors and networks of cross-regional miners, collecting and disseminating intelligence information, and mobilizing cross-agency cooperation for unlicensed mining control operations. Cross-police cooperation expands the scope of supervision and enables enforcement of illegal gold distribution channels and financiers outside the administrative area of the 50 City Police. However, the effectiveness of countermeasures is constrained by limited human resources and monitoring technology in protected forest areas, the support of some communities for mining as an economic source, indications of collusion between individuals and mining companies, and coordination between institutions that are not optimal. It is recommended to strengthen the capacity of police intelligence, increase sustainable multi-sector coordination, and legal education to the public to realize more effective and equitable enforcement of environmental laws.

Abstract

Penelitian ini bertujuan untuk menganalisis pertimbangan jaksa selaku penyidik dalam penghentian penyidikan perkara tindak pidana korupsi terkait pengadaan perlengkapan Pekan Olahraga Provinsi (Porprov) Sumatera Barat Tahun Anggaran 2018. Metode yang digunakan adalah yuridis normatif dengan pendekatan deskriptif analitis. Hasil penelitian menunjukkan bahwa penghentian penyidikan didasarkan pada temuan BPK RI dan ketentuan Pasal 109 ayat (2) KUHAP. Kerugian negara yang awalnya sebesar Rp827.377.397,- menurut BPK RI dalam Laporan Hasil Pemeriksaan Nomor 4/LHP/XVIII.PDG/01/2020 pada 24 Januari 2020, telah direvisi menjadi Rp143.034.500,- dan sepenuhnya dikembalikan oleh penyedia barang, PT. Novalindo Jaya Utama. Selain itu, tidak ada niat jahat atau kesengajaan dari pelaku, sehingga tidak memenuhi unsur tindak pidana korupsi sesuai UU No. 31 Tahun 1999 jo UU No. 20 Tahun 2001. Penghentian penyidikan ini sesuai dengan Pasal 109 ayat (2) KUHAP dan mengikuti Surat Edaran Jaksa Agung Muda Tindak Pidana Khusus Nomor B-1113/Fd.1/05/2010 tanggal 18 Mei 2010 sebagai pedoman dalam menangani kasus korupsi. Penelitian ini menyimpulkan bahwa penghentian penyidikan bukanlah cara untuk menghindari penuntutan, tetapi merupakan bagian dari profesionalisme penegakan hukum yang berlandaskan kepastian dan keadilan. Rekomendasi yang diberikan mencakup perlunya peningkatan koordinasi antar lembaga, transparansi hasil penghentian penyidikan, dan publikasi informasi kepada masyarakat untuk menjaga kepercayaan publik terhadap proses penegakan hukum.
