Abstract

Penelitian ini merupakan penelitian hukum dengan spesifikasi yang bersifat deskriptif analitis. Berdasarkan  hasil penelitian, pembahasan dan analisis dapat disimpulkan bahwa Pelaksanaan pemenuhan hak kesehatan warga binaan pada Lembaga Pemasyarakatan Kelas III Dharmasraya dilakukan melalui berbagai tahapan, mulai dari pemeriksaan kesehatan awal saat warga binaan pemasyarakatan masuk ke dalam lembaga pemasyarakatan, pemeriksaan rutin yang dilakukan secara berkala, pemberian layanan kesehatan dalam kondisi darurat, hingga rujukan ke fasilitas kesehatan eksternal jika terdapat kondisi yang memerlukan perawatan lebih lanjut. Data menunjukkan bahwa jumlah warga binaan yang mendapatkan layanan kesehatan di Lapas Kelas III Dharmasraya meningkat dari 180 orang pada tahun 2022 menjadi 220 orang pada tahun 2024, yang mencerminkan peningkatan kesadaran dan aksesibilitas terhadap layanan kesehatan di dalam Lapas. program pencegahan dan pengendalian penyakit menular melalui skrining rutin, penyuluhan kesehatan, serta pemberian vaksin bagi warga binaan pemasyarakatan. menyediakan layanan konseling dan bimbingan psikologis bagi warga binaan pemasyarakatan yang membutuhkan. Layanan ini dapat dilakukan melalui sesi konseling individu maupun kelompok, yang bertujuan untuk membantu warga binaan pemasyarakatan mengatasi stres dan meningkatkan kesejahteraan mental mereka selama berada di dalam lembaga pemasyarakatan. Kendala Yang Dihadapi Lembaga Pemasyarakatan Kelas III Dharmasraya dalam Pelaksanaan Pemenuhan Hak Kesehatan Bagi Warga Binaan adalah kendala internal yaitu keterbatasan fasilitas medis yang tersedia di dalam lembaga pemasyarakatan. Kurangnya tenaga kesehatan yang bertugas di dalam lembaga pemasyarakatan. Over kapasitas atau kelebihan penghuni di dalam Lembaga Pemasyarakatan Kelas III Dharmasraya. Kendala eksternal adalah Setiap warga binaan yang akan dirujuk ke fasilitas kesehatan eksternal harus melalui prosedur yang ketat, termasuk mendapatkan izin dari pihak berwenang dan memastikan ketersediaan pengawalan dari petugas keamanan.

Abstract

 Industri perhotelan modern menghadapi tantangan besar dalam menyeimbangkan efisiensi layanan digital dengan jaminan keamanan privasi tamu, sebagaimana tercermin dalam Putusan Nomor 1184/Pdt.G/2023/PN Dps. Penelitian hukum yuridis normatif yang bersifat deskriptif analitis ini bertujuan mengevaluasi pertimbangan dan bentuk tanggung jawab hukum hotel terhadap keamanan konsumen. Hasil penelitian menunjukkan bahwa hakim menyatakan hotel terbukti melakukan perbuatan melawan hukum berdasarkan Pasal 1365 dan 1367 KUHPerdata akibat kelalaian pengawasan penyalahgunaan kartu induk (master key) oleh staf, serta melanggar Pasal 18 UU Perlindungan Konsumen terkait larangan klausula eksonerasi dan kewajiban penjagaan barang titipan sesuai Pasal 1706 dan 1709 KUHPerdata. Sebagai konsekuensi hukum, hotel diwajibkan memikul tanggung jawab penuh dengan membayar ganti rugi materiil sebesar Rp304.414.150,00 dan ganti rugi imateriil sebesar Rp10.000.000,00 guna memulihkan hak konsumen serta memberikan kepastian hukum di sektor pariwisata.

Abstract

Pendekatan yang digunakan adalah pendekatan Yuridis Normatif yang didukung pendekatan Yuridis Empiris. Penerapan unsur tindak pidana oleh Penyidik pada Satuan Reserse Kriminal Kepolisan Resor Agam terhadap pelaku eksploitasi seksual dengan korban anak melalui media sosial adanya unsur obyektif yaitu pemaksaan berupa ancaman penyebaran foto dan pemanfaatan kerentanan anak. Adanya keuntungan materiil bagi pelaku, keterlibatan korban anak sebagai objek eksploitasi, serta adanya perbuatan yang dilarang oleh undang-undang. Unsur subjektif adalah pelaku dapat dipertanggungjawabkan secara pidana; objek adalah anak sebagai korban yang secara hukum berada dalam kategori dilindungi; perbuatan dilihat dari tindakan eksploitasi yang dilakukan melalui media sosial; sedangkan akibat merujuk pada kerugian fisik, psikis, dan sosial yang dialami korban. Hambatan yang ditemui penyidik pada Satuan Reserse Kriminal   Polres Agam dalam penerapan unsur tindak pidana eksploitasi seksual dengan korban anak melalui media sosial secara internal pertama adalah keterbatasan kompetensi teknis aparat dalam bidang digital forensik. Ketidaksinkronan pemahaman hukum antar unit di Satreskrim sering menimbulkan perdebatan panjang. Keterbatasan sarana dan prasarana. Ruang pemeriksaan khusus anak dan perempuan di Polres Agam belum sepenuhnya memenuhi standar perlindungan korban. Alat bantu pemeriksaan digital, perangkat forensik komputer, dan sistem penyimpanan bukti elektronik masih terbatas, penyidik harus meminta dukungan ke Polda atau bahkan Mabes Polri. Hambatan eksternal yang berkaitan dengan faktor masyarakat. Salah satunya adalah minimnya kesadaran hukum keluarga korban. Dalam beberapa kasus, keluarga korban merasa malu untuk melapor karena khawatir akan stigma sosial. Bahkan, ada keluarga yang lebih memilih menyelesaikan kasus secara kekeluargaan atau mediasi informal dengan pihak pelaku. Keterbatasan kerja sama antar lembaga. Penyidik sering kesulitan memperoleh data dari penyedia media sosial atau cloud storage yang servernya berada di luar negeri.

Abstract

This research is a legal research with specifications that are descriptive analytical. The implementation of verbal da'wah as a form of non-penal crime reduction in the jurisdiction of the South Coast Resort Police is to convey religious messages or moral values to others through words and oral communication. Conducted with I'tikaf, Da'wah, Weekly Recitation and Spiritual Flush activities. A persuasive approach by law enforcement officials to the community through activities carried out on community groups. Verbal da'wah is used to promote good deeds and positive activities in society, such as contributing to the general well-being, helping and avoiding harmful behavior. At events such as citizen gatherings, police can convey moral and ethical messages to participants. Giving Advice: Police officers may provide verbal advice to individuals involved in crimes or risky behavior. The impact of the implementation of verbal proselytizing as a form of non-penal crime reduction on the level of crime that occurs in the South Coast Resort Police Jurisdiction varies depending on the context, the message conveyed, and the recipient of the message. This da'wah approach looks quite effective characterized by Increasing Religious Awareness, Verbal da'wah can help individuals understand religious teachings better and increase their awareness of moral and ethical values. Positive Behavior Change, Da'wah can affect behavior change, such as reducing risky behavior, stopping criminal acts, or promoting social kindness and solidarity. The implementation of da'wah can benefit an individual's spiritual growth, help them search for meaning in life, and strengthen their relationship with their religion or belief.

Abstract

Article 19 Paragraph (2) of Law Number 22 of 2009 concerning Road Traffic and Transportation regulates Road Grouping according to the class of Roads and vehicles that can pass through it.  Coordination in the supervision of excess tonnage violations in freight transportation between the Sijunjung Police Satlantas and the Land Transportation Management Center Region III of Sijunjung Regency is carried out with functional supervision. Establishing supervision standards to assess the object of supervision to see which things or parts are wrong or violations. Supervision of the use of public roads on overloaded vehicles in Sijunjung district, Sijunjung Police Satlantas and  the Land Transportation Management Center Region III of Sijunjung Regency. The implementation of supervision coordination between the Sijunjung Police Traffic Police and the Land Transportation Management Center Region III of Sijunjung Regency obtained the results of supervision that has been carried out in 2023 that out of 19,543 vehicles, there were 1,632 vehicles that committed violations consisting of 1,618 capacity violations, 14 vehicles committed dimensional violations. The obstacles faced by the Sijunjung Police Satlantas and the Land Transportation Management Center Region III of Sijunjung Regency in the implementation of supervision coordination for violations of excess tonnage, including facilities, and insufficient Human Resources (HR) are reviewed from the aspects of quantity and quality. The limitations of surveillance patrols, the limited cargo terminals/unloading locations make it more difficult for supervisory implementers to provide firmer corrective actions (sanctions).

Abstract

The approach used is the Normative Juridical approach. The data used is secondary data collected through literature studies. The proof by the judge of the crime of illegal access in Decision Number 62/Pid.Sus/2020/PN Pti and Decision Number 10/Pid.Sus/2021/PN Pli is by means of evidence and corroborated by the judge's conviction through a criminal justice process. To determine that a criminal act has occurred, law enforcement officials must prove that the suspect has met the criminal elements suspected or charged. The evidence used is electronic documents and electronic information. The electronic documents in decision number 62/Pid.Sus/2020/PN Pti are print out data systems in the form of IMEI and MAC Address, printout transaction data and transaction data by the Shoppe seller account (seller) while in decision number 10/Pid.Sus/2021/PN Pli is 1 (one) bundle of printed credit delivery transaction reports through the Digipos application and 1 (one) sheet of screenshot prints of the DigiPos account. Application of Criminal Procedure by Judge where the defendant has been legally and convincingly proven guilty of committing a criminal act "Participating in deliberately and without the right to access the Electronic System belonging to another person in any way." Regarding the Crime of Illegal Access In Decision Number 62/Pid.Sus/2020/PN Pti, the judge sentenced  the defendants to imprisonment for 9 (Nine) months each and a fine of Rp.100,000,000,000 (one hundred million rupiah) each with the provision that if the fine is not paid, it will be replaced with imprisonment for 3 (three) months each and Decision Number 10/Pid.Sus/2021/PN Pli judge impose a penalty on the Defendant therefore with a prison sentence of 2 (two) years and 6 (six) months and a fine of Rp300,000,000.00 (three hundred million Rupiah) with the provision that if the fine is not paid, it will be replaced with imprisonment for 6 (six) months.

Abstract

Illegal gold mining in Manggani, Nagari Koto Tinggi, Fifty Cities Regency, causes serious environmental damage as well as a source of livelihood for the community, so that the countermeasures face ecological and socio-economic dilemmas. This study aims to analyze the role and obstacles of the 50 City Police Satintelkam in overcoming environmental crimes due to illegal gold mining through cross-police cooperation, especially with the Pasaman Police. This research is a legal research with descriptive-analytical specifications using a normative juridical approach supported by empirical data; Secondary data is obtained through literature studies, while primary data is collected through interviews, then analyzed qualitatively. The results of the study show that Satintelkam plays a strategic role in early detection, mapping of actors and networks of cross-regional miners, collecting and disseminating intelligence information, and mobilizing cross-agency cooperation for unlicensed mining control operations. Cross-police cooperation expands the scope of supervision and enables enforcement of illegal gold distribution channels and financiers outside the administrative area of the 50 City Police. However, the effectiveness of countermeasures is constrained by limited human resources and monitoring technology in protected forest areas, the support of some communities for mining as an economic source, indications of collusion between individuals and mining companies, and coordination between institutions that are not optimal. It is recommended to strengthen the capacity of police intelligence, increase sustainable multi-sector coordination, and legal education to the public to realize more effective and equitable enforcement of environmental laws.

Abstract

AI-driven digital markets transform the legal relationship between platforms and consumers because harm no longer arises only from misleading information, defective products, unfair terms, or contractual breaches, but also from algorithmic systems that shape recommendations, prices, profiling, product visibility, and automated decisions. This article examines digital platform liability for consumer harm through a comparative legal analysis of the European Union and Indonesia. Using normative legal research and a functional comparative method, it shows that the European Union has moved toward a risk-based model through the Artificial Intelligence Act, the Digital Services Act, the General Data Protection Regulation, and the Product Liability Directive. Indonesia, by contrast, still relies on fragmented regimes of consumer protection, electronic systems, electronic commerce, personal data protection, and ethical guidance on artificial intelligence. The article proposes a control-risk-harm nexus to connect platform control, algorithmic risk, and consumer harm. This model allocates responsibility proportionally through algorithmic risk assessment, meaningful transparency, rights to explanation and objection, algorithmic audits, limited reversal of the burden of proof, and effective consumer redress.Keywords: digital platform, consumer harm, artificial intelligence, algorithmic liability, comparative law
