Abstract

Pengesahan Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (KUHP Nasional) yang diproyeksikan berlaku efektif pada 2 Januari 2026, menandai sebuah milestone monumental sekaligus kontroversial dalam sejarah hukum pidana Indonesia. Legislasi ini mengklaim membawa misi agung dekolonisasi, demokratisasi, konsolidasi, dan harmonisasi hukum pidana nasional, mengakhiri dominasi Wetboek van Strafrecht warisan kolonial Belanda yang telah bercokol hampir satu abad. Namun, di balik narasi pembaharuan tersebut, pengesahan ini memantik diskursus konstitusional yang tajam karena sejumlah pasal dinilai secara substansial bertentangan dengan prinsip negara hukum demokratis dan menghidupkan kembali ketentuan otoritarian yang sebelumnya telah dibatalkan oleh Mahkamah Konstitusi (MK) melalui mekanisme judicial review. Penelitian ini menyajikan analisis mendalam dan ekstensif mengenai peran Mahkamah Konstitusi dalam mengawal konstitusionalitas KUHP baru, dengan fokus spesifik pada putusan-putusan terkait pengajuan uji materiil di masa transisi serta proyeksi prospek pengujian di masa mendatang. Menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach), pendekatan kasus (case approach), dan pendekatan konseptual (conceptual approach), studi ini membedah bahan hukum primer berupa UUD NRI 1945, naskah komprehensif KUHP Baru, putusan-putusan MK yang relevan (seperti Putusan Nomor 013-022/PUU-IV/2006 dan Putusan Nomor 1/PUU-XXI/2023), serta literatur sekunder yang otoritatif. Hasil penelitian menunjukkan bahwa MK cenderung mengambil posisi judicial restraint dengan menolak permohonan judicial review pada masa vacatio legis dengan alasan prematuritas, sebuah sikap yang menyisakan ruang ketidakpastian hukum dan potensi pelanggaran hak konstitusional (constitutional injury) yang tertunda. Temuan juga mengungkapkan adanya fenomena inkonsistensi radikal antara ratio decidendi putusan MK terdahulu dengan substansi KUHP baru, khususnya terkait revitalisasi pasal penghinaan Presiden (lèse-majesté) dan penghinaan lembaga negara, yang mengindikasikan defisit moralitas konstitusi (constitutional morality) dari pembentuk undang-undang. Penelitian ini merekomendasikan perlunya reorientasi paradigma pengujian undang-undang dari yang bersifat murni represif menjadi akomodatif terhadap preventive review dalam situasi luar biasa, serta pengawalan ketat masyarakat sipil pasca-berlakunya KUHP pada 2026.

Abstract

Purpose: This study examines whether Indonesia’s Job Creation Law promotes decent work under SDG 8 through an ex post RIA framework. Research Design and Methodology: Using juridical-normative legal research supported by secondary labour data, this study analyses statutory provisions, implementing regulations, Constitutional Court jurisprudence, policy reports, labour statistics, and academic literature. The analysis compares the law’s objectives of regulatory simplification, labour market flexibility, and job creation with five decent work indicators: productive employment opportunities, job stability and security, adequate earnings and fair working conditions, social protection, and labour rights and social dialogue. Findings and Discussion: The findings show that the law has contributed to formal regulatory simplification and quantitative employment growth. However, its alignment with SDG 8 remains limited because expanded fixed-term contracts, outsourcing flexibility, reduced termination costs, wage pressures, selective job loss protection, and weak social dialogue increase the risk of precarious work. Implications: This study recommends institutionalising SDG 8-based ex post RIA so that future labour law reforms assess not only job numbers, but also job quality, legal protection, social security, and substantive worker rights.

Abstract

The rapid infiltration of Artificial Intelligence (AI) into various sectors, including the legal domain, generates a fundamental paradox between technocratic efficiency and substantive justice. This study aims to analyze the threats posed by the mechanistic logic of AI to the epistemic authority of the Constitutional Court (MK) as the guardian of the constitution. Employing a juridical-normative method with a conceptual approach, this research conducts a systematic literature study of legal, legal philosophy, and legal technology sources published between 2017 and 2025, analyzed through hermeneutic interpretation encompassing textual, conceptual, and teleological dimensions. The findings reveal two principal threats: first, AI risks shifting the paradigm of constitutional interpretation away from a dynamic and contextual living constitution approach toward rigid legal formalism anchored in historical data, thereby neglecting moral, social, and contextual dimensions; second, the dominance of algorithmic logic threatens the delegitimization of the Constitutional Court, as algorithmically influenced decisions fail to capture the complexity of societal justice and the humanistic dimension of judicial proceedings. Unlike previous studies that focus on technical aspects or general algorithmic ethics, this research introduces the conceptualization of a dichotomy between mechanistic justice and contextual justice in the specific context of Indonesia’s civil law constitutional adjudication. The study concludes that while AI serves a legitimate role as a technical tool, its logical dominance fundamentally endangers the essence of the Constitutional Court as an institution that resolves disputes through wisdom, conscience, and constitutional values. A strict regulatory framework comprising five key components is therefore proposed to ensure that AI remains a supportive instrument rather than a substitute for constitutional authority.

Abstract

Indonesia's growing population has contributed to the expansion of e-commerce, but state revenue stagnates. Meanwhile, social commerce platforms have created harmful rivalry, threatening MSMEs' sustainability. The study seeks to identify legal issues in social commerce platforms, including taxation and fair competition, and provide a regulatory framework that maximizes digital sector state revenue while protecting domestic firms. This study uses legal research methodology, focusing on a statutory and comparative approach. The finding reveals that insufficient tax compliance among e-commerce participants, inadequate oversight of foreign social commerce businesses, and predatory pricing practices are the main causes of structural inequality.  Additionally, uneven government policies reduce domestic enterprises' competitiveness.  This study recommends mandating foreign social commerce platforms to establish a permanent presence in Indonesia to comply with national tax regulations, allocating a minimum of 30% of social commerce tax revenues to empower MSMEs and support digitalization programs, implementing cross-ministerial big data monitoring for transaction oversight, and strengthening the Business Competition Supervisory Commission to combat predatory behavior. A comprehensive regulatory reform is expected to balance governmental interests, MSMEs, and the global digital economy.
