Abstract

Divorce, even though it is permitted, is still an act that is not recommended in religion, especially Islam which considers divorce as "the most hated halal matter". In Islamic law, khulu 'is one way out of the domestic turmoil proposed by the wife to the husband. The purpose of this study was to find out and analyze the form of legal protection for the wife in filing khulu' and the relationship between khulu' provisions in marriage law based on the Compilation of Islamic Law related to Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage. The research method used is normative juridical research with a statutory approach. The results of this study indicate that the form of legal protection for the wife in submitting khulu' to her husband to divorce herself from the marriage bond is accompanied by the payment of 'iwadh, namely in the form of money or goods to the husband from the wife's side as a reward for the divorce.Keywords: Marriage; Divorce and Khulu' AbstrakPerceraian, meskipun diizinkan, namun tetaplah menjadi suatu perbuatan yang tidak dianjurkan dalam agama, terutama agama Islam yang menganggap perceraian sebagai “Perkara halal yang paling dibenci”. Dalam Hukum Islam khulu’ merupakan salah satu jalan keluar dari kemelut rumah tangga yang diajukan oleh pihak istri kepada pihak suami. Tujuan penelitian ini adalah untuk mengetahui dan menganalisis bentuk perlindungan hukum bagi pihak istri dalam pengajuan khulu’ dan hubungan ketentuan khulu’ dalam hukum perkawinan berdasarkan Kompilasi Hukum Islam dihubungkan dengan Undang Undang Nomor 16 Tahun 2019 tentang Perubahan Atas Undang Undang Nomor 1 Tahun 1974 tentang Perkawinan. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundangan-undangan. Hasil penelitian ini menunjukkan bahwa bentuk perlindungan hukum bagi pihak istri dalam pengajuan khulu’ kepada suaminya untuk menceraikan dirinya dari ikatan perkawinan dengan disertai pembayaran ’iwadh, yaitu berupa uang atau barang kepada suami dari pihak istri sebagai imbalan penjatuhan talaknya.

Abstract

AbstractThis study aims to review legally Law Number 1 of 1974 concerning Marriage and Islamic Law concerning contract marriages and how the legal consequences are for children and wives. The conclusion of this study shows that Law No. 1 of 1974 concerning Marriage does not regulate existing contract marriages, whereas in Islamic law, both in the Compilation of Islamic Law (KHI) and the words of the Prophet Muhammad have banned contract marriages, even though the Shiite groups stated differently. From this study it was found that there were legal consequences for wives regarding marital status, namely that it was not recognized by the state because the state did not regulate contract marriages, wives only obtained social and economic status. Regarding shared property, because contract marriages are not recognized, marriages also cannot be sued. Other legal consequences for children based on Article 42, 43 Paragraph 1 regarding the position of the child, the child only has a civil relationship with his mother only, the child does not have a mutual inheritance relationship with his father, because the child of a contract marriage is considered an unmarried child. Then regarding the assets and guardians, the child of a contract marriage cannot claim inheritance or the father does not have the rights to the child because the right falls entirely to the mother.Keywords: Contract Marriage, Rights of Children and Wife, Islamic Law AbstrakPenelitian ini bertujuan untuk meninjau secara yuridis Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan Hukum Islam mengenai kawin kontrak dan bagaimana akibat hukum terhadap anak dan istri. Kesimpulan penelitian ini menunjukkan bahwa UU Nomor 1 tahun 1974 tentang Perkawinan tidak mengatur mengenai kawin kontrak yang ada, padahal dalam hukum Islam, baik dalam Kompilasi Hukum Islam (KHI) maupun sabda Nabi Muhammad telah melarang kawin kontrak, meskipun golongan syi’ah menyatakan berbeda. Dari penelitian ini ditemukan adanya akibat hukum bagi istri mengenai status perkawinan yaitu tidak diakui oleh negara karena negara tidak mengatur kawin kontrak, istri hanya memperoleh status sosial dan ekonomi. Mengenai harta bersama karena kawin kontrak tidak diakui, maka perkawinan juga tidak dapat dituntut. Akibat hukum lainnya bagi anak dengan berdasar Pasal 42, 43 Ayat 1 mengenai kedudukan anak, anak hanya mempunyai hubungan perdata dengan ibunya saja, anak tidak mempunyai hubungan saling mewarisi dengan bapaknya, karena anak kawin kontrak dianggap anak luar kawin yang tidak diakui. Kemudian mengenai harta dan wali, anak kawin kontrak tidak dapat menuntut waris atau bapak tidak memiliki hak atas anak tersebut karena hak jatuh sepenuhnya kepada ibu.Kata Kunci: Kawin Kontrak, Hak Anak dan Istri, Hukum Islam

Abstract

Common house gecko (Cosymbotus platyurus) is the most abundant house gecko species in Indonesia. The geckos live in home yard, garden, and in homes. It is part of food chain in its habitat, as its preys include cockroaches, flies, and termites. Previous studies found that this gecko are not found in mountainous area in West Java. In this study, the researchers observe population density of common house geckos in various types of habitats (houses and parks) with their home territory. The methods used were direct survey methods followed by literature study. The study is conducted in Java island (Jakarta, Tangerang, Bandung, Bogor, Sleman). Preliminary result of this study is house geckos are very active at night, because of the effect of light produced by lights that attract the attention of insects, gecko food.

Abstract

Pengabdian ini berjudul Penyuluhan Peraturan Perundang-undangan Pemilihan Umum (PEMILU) Tahun 2019 (Studi Kasus pada Politeknik Ilmu Pemasyarakatan (POLTEKIP) Kementerian Hukum dan HAM RI, Depok, Jawa Barat). Tujuan umum dari kegiatan pengabdian kepada masyarakat ini adalah memberikan materi-materi tentang Hukum dan Ilmu Perundang-undangan yang berlaku saat ini di dalam sistem hukum Indonesia.  Metode yang digunakan adalah pada Tahap Persiapan menggunakan : Pendekatan dan kunjungan langsung dengan Direktur Poltekip dan para pejabat yang terkait. Pemantapan dan penentuan lokasi PKm dengan mengkoridinasikan dengan para pihak terkait, Direktur Pascasarjana, Ketua Prodi MH, para Dosen, mahasiswa dan alumni. Penyusunan bahan ajar/materi pelatihan dan sosialisasi yang meliputi : Infocus, Slide serta handsout. Pada Tahap Pelaksanaan : Pelatihan serta sosialisasi materi yang bersifat tutorial yang disampaikan langsung oleh para nara sumber. Tanya jawab serta diskusi secara dua arah antara para nara sumber dengan para peserta PKM. Kesimpulan dalam PKM ini bahwa sosialisasi tentang Hukum dan Ilmu Perundang-Undangan yang disampaikan kepada para ASN dan PNS di lingkungan Poltekip Kementerian Hukum dan HAM RI yang kebetulan sedang melakukan pendidikan dan pelatihan. Dengan pemberian materi-materi tambahan berupa wawasan tentang Hukum dan Ilmu Perundang-Undangan dapat memberikan wawasan dalam pemahaman tentang hukum kepada para peserta diklat

Abstract

The values contained in Pancasila are real representations of the scope of human rights (HAM) practice. In various views, human rights (HAM) are an absolute thing and need to be upheld for every human being, including in the view of Islam. Pancasila is the ideology of the Indonesian nation that has been agreed upon fairly and cannot be changed just because it follows current developments. This country, which has been contained in Human Rights (HAM) such as equality in the eyes of God Almighty (YME) and human attitudes in respecting other individuals, is an illustration that this country is a state of law. Meanwhile, one of the conditions for running a democracy is the protection of human rights (HAM), which is the main goal of a Pancasila democratic state. This study aims to describe the values of Pancasila in practice in the context of human rights (HAM) and from an Islamic point of view. The method used in this study uses a qualitative method. The results of this study explain that Pancasila is the philosophy of the Indonesian nation. It consists of the essential values for living in Indonesia. Protecting human rights is the goal and condition for democracy to work in Indonesia. Islam and Pancasila are not two contradictory ideas.Keywords: Pancasila; Human Rights; Islam AbstrakNilai-nilai yang terkandung dalam Pancasila adalah representasi nyata pada lingkup praktik Hak Asasi Manusia (HAM). Dalam berbagai pandangan, Hak Asasi Manusia (HAM) adalah hal yang mutlak dan perlu di junjung tinggi bagi setiap manusia, termasuk dalam pandangan Islam. Pancasila merupakan ideologi bangsa Indonesia yang telah disepakati secara adil dan tidak dapat berubah hanya karena mengikuti perkembangan yang berjalan. Pancasila yang telah termuat dalam Hak Asasi Manusia (HAM) seperti kesetaraan di mata Tuhan Yang Maha Esa (YME) dan sikap manusia dalam menghargai antar individu lainnya, menjadi gambaran bahwa negara ini adalah negara hukum. Sedangkan, syarat berjalannya demokrasi salah satunya adalah perlindungan Hak Asasi Manusia (HAM) yang dijadikan tujuan utama suatu negara demokrasi Pancasila. Penelitian ini bertujuan untuk mendeskripsikan nilai-nilai Pancasila dalam praktiknya pada konteks Hak Asasi Manusia (HAM) dan dari sudut pandang Islam. Metode yang digunakan dalam penelitian ini menggunakan metode kualitatif. Hasil penelitian ini memaparkan bahwa Pancasila adalah falsafah bangsa Indonesia. Itu terdiri dari nilai-nilai penting untuk hidup di Indonesia. Melindungi hak asasi manusia adalah tujuan dan syarat agar demokrasi dapat berjalan di Indonesia. Islam dan Pancasila bukanlah dua gagasan yang saling bertentangan.Kata Kunci: Pancasila; Hak Asasi Manusia; Islam

Abstract

Freedom of expression is one of the human rights (HAM) that is still often violated. Until now, there are still many people who do not respect and respect one's right to freedom of expression. The purpose of this study is to protect the right to freedom of expression on social media under Law on Information and Electronic Transactions (ITE) and the right to freedom of expression on social media from the perspective of human rights (HAM) and Islam. The method used in this research is normative legal research or instructional research. The results of the research obtained are that the protection of freedom of expression has not received adequate protection in Law No. 19 of 2016 amending Law No. 11 of 2008 on Information and Electronic Transactions (ITE). In this ITE Act there is only one article provision related to the right to freedom of expression through internet media, in this case social media, namely Article 27(3). The right to freedom of expression in social media belongs to the first generation of rights from a human rights perspective, which are identical to a person's civil, political and religious rights, save for a personality right that requires their fulfilment and protection.Keywords: Right to Freedom, Opinion, Islam AbstrakKebebasan berpendapat merupakan salah satu Hak Asasi Manusia (HAM) yang masih sering di langgar. Sampai saat ini, masih banyak orang yang belum menghargai dan menghormati hak kebebasan berpendapat seseorang. Tujuan dilakukan penelitian ini yaitu untuk mengetahui perlindungan atas hak kebebasan berpendapat di media sosial yang diatur dalam Undang-Undang tentang Informasi dan Transaksi Elektronik (ITE) dan untuk mengetahui hak kebebasan berpendapat di media sosial dalam perspektif Hak Asasi Manusia (HAM) dan Islam. Metode yang digunakan dalam penelitian ini adalah penelitian yuridis normatif atau penelitian doktrinal (doctrinal research). Hasil penelitian yang didapatkan yaitu perlindungan kebebasan berpendapat dalam Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik (ITE) belum mendapat perlindungan sebagaimana mestinya. Dalam Undang-Undang ITE ini, hanya terdapat satu ketentuan pasal yang berkaitan dengan hak kebebasan menyatakan pendapat melalui media internet dalam hal ini media sosial, yaitu dalam Pasal 27 ayat (3). Hak kebebasan berpendapat di media sosial dalam perspektif Hak Asasi Manusia, merupakan bagian dari hak generasi pertama yang identik dengan hak sipil, politik, beragama seseorang selain sebagai hak pribadi yang menuntut pemenuhan serta perlindungannya.Kata Kunci: Hak Kebebasan, Berpendapat, Islam

Abstract

Although bringing cases of environmental damage to court means prioritizing the principle of primum remedium by way of retributive justice or criminal justice, it unfortunately creates various problems including the practice of corruption, collusion and nepotism. Therefore, it is necessary for law enforcement officials to understand and apply restorative justice in environmental crime, which means prioritizing the principle of ultimum remedium, through civic engagement education. This research method includes social research which also covers the field of law since it analyzes positive laws that are relevant to solving problems using literature and other sources as needed. This research uses a juridical-normative legal approach which is very dependent on the researcher's conception of positive law. The results of this study indicate that law enforcement officials should understand their position as part of the community members who have duties and authorities based on the law, so that justice and ecological goals can be achieved in efforts to preserve the environment.

Abstract

At the theoretical and historical level, the campus has always been a symbol of resistance to all forms of deviation, without exception for efforts to fight corruption as an extraordinary crime. Morally, the campus has an enormous responsibility to ensure and guarantee that mother earth is free from all corrupt practices. Even so, the campus is not a sterile area for corrupt practices. This study used a qualitative research method with a statutory approach. The results of the study state that corruption has penetrated into the joints of the life of the academic community, which should actually play a role as a locomotive in eradicating corruption. Recognizing that the corruption virus has spread among the academic community, it is urgent to reposition the role of the campus in the fight against corruption. Repositioning the role of the campus can be started from (i) aspects of the tri dharma of higher education, (ii) administrative aspects, and (iii) exemplary aspects. Repositioning the role of the campus should be done considering that the campus with the characteristics of its value-oriented academic community is believed to be the best place to teach and instill anti-corruption values as an ongoing cultural movement. The cultural movement has made the campus a laboratory for the process of institutionalizing anti-corruption values, principles, and morality. In the long term, this movement will become a culture that can free the nation's leading cadres from corrupt behavior and mentality.Keywords: Campus; Cultural Movement; Corruption

Abstract

Legal pluralism poses a challenging issue in the application of law in society. Indonesia, as a pluralistic country with diverse ethnicities, customs, and religions, faces conflicts between legal systems. This study addressed the conflicts between Islamic law, state law, and customary law regarding inheritance within the kinship system of Indonesian society. Data were collected from court decisions and legal scholars' opinions, which were then analyzed using the theories of legal pluralism, receptio in complexu, and receptio a contrario. The study found that legal conflicts arise among customary laws within the matrilineal, patrilineal, and parental kinship systems, particularly in inheritance matters. Legal conflicts occur when faced with Islamic law, which resonates with religious practices, and state law, which applies to all citizens. Based on several court decisions, the inheritance distribution resulting from differences in legal systems, especially within the customary kinship system, is disregarded in favor of state and Islamic law. This study implies a shift in the inheritance distribution system, which is no longer purely based on the kinship system of indigenous communities. Keywords: legal pluralism; Islamic law; state law; inheritance distribution AbstrakPluralisme hukum menjadi isu yang menantang dalam penerapan hukum di suatu masyarakat. Indonesia sebagai negara plural yang memiliki perbedaan  suku,  adat,  dan  agama  menghadapi  pertentangan  antar  sistem hukum.  Studi  ini  membahas  pertentangan  hukum  Islam,  hukum  negara dan  hukum  adat  dalam  soal  pembagian  waris  dalam  sistem  kekerabatan masyarakat Indonesia. Data dikumpulkan dari putusan-putusan pengadilan dan  pendapat  para  sarjana  hukum  yang  kemudian  dianalisis  dengan  teori pluralisme  hukum,  teori  receptio in complexu dan teori receptio a contrario. Studi ini menemukan bahwa terjadi konflik hukum antar hukum adat dalam sistem  kekerabatan  matrilineal,  patrilineal,  dan  parental,  khususnya  dalam pembagian waris. Konflik hukum juga terjadi ketika dihadapkan pada hukum Islam yang menjadi afinitas masyarakat dalam beragama dan hukum negara yang menjadi hukum bagi semua warga negara. Berdasarkan sejumlah putusan pengadilan, pembagian waris akibat perbedaan sistem hukum, khususnya dalam sistem  kekerabatan  dalam  hukum  adat  dikesampingkan  dari  hukum  negara dan hukum Islam. Studi ini berimplikasi pada bergesernya sistem pembagian waris yang tidak lagi murni berdasarkan sistem kekerabatan masyarakat adat. Kata Kunci:  pluralisme hukum; hukum Islam; hukum negara; pembagian waris
