Abstract

The existence of traditionally managed Balinese city hotels is increasingly threatened by the presence of chain hotels, which are internationally managed with an excellent standard of hotel hospitality. In a commercial context, franchised hotels benefit the franchisor, franchisee, and consumers in terms of the quality of hotel standardization and reputation. Still, such hotels remain incomparable to the Balinese city hotels managed traditionally by family owners. In the legal context, the emergence of various types of modern franchised city hotels in Bali is influenced by suitable laws and policies, such as the World Trade Organization (WTO) Agreement with one of its ground bases called the “Non-Discrimination Principle” at the international level and at the regional level, the Association of Southeast Asian Nations Economic Community, which also emphasizes that one of the important central pillars of the multilateral trading system is a region fully integrated into the global economy. The emergence of modern chain city hotels has prevented the local city hotels from competing in terms of both the infrastructure and quality management services. To overcome these crucial issues, the model provisions of the local government regulation and self- regulation framework of hotel associations must be constructed to strengthen the local city hotels as chain hotels by implementing traditional values, e. g. , the Tri Hita Karana, the corporate social responsibility as a strategic development, and human rights approaches, that comply with the WTO Agreement and the laws and policies at the regional level.

Abstract

The presence of foreigners in Indonesia for a long period certainly requires a place to live or a residential house. According to Article 144 (1) b of Job Creation Law, foreigners have the right to own flat units in Indonesia. Is this regulation intended to attract foreign investors? If it is yes, does not it contradictory to the “kenasionalan” principle stipulated in the Basic Agrarian Law (BAL) and other Indonesian regulations? This study is aimed to deal with those legal issues, by using the normative legal method. The result shows that the ownership right of flat units given to foreigners by the Job Creation Law is in contradiction with the “kenasionalan” principle, Article 33 paragraph (3) of the 1945 Constitution, and the BAL which only allows land/building use and lease right for foreigners. In addition, the regulation which allows the establishment of flats on land with building-use rights for a maximum of 80 (eighty) years raises a legal problem since such regulation had been revoked by the Constitutional Court of the Republic of Indonesia with its Decision Number 21-22/PUU-V/2007. Thus, the study recommends that the Government conduct a review of the regulation which allows foreigners to have ownership right to flat units under the Job Creation Law.

Abstract

ABSTRAK Tujuan penelitian ini adalah untuk mengetahui bagaimana tinjauan hukum humaniter internasional dalam memberikan perlindungan kepada jurnalis perang dan juga bagaimana peran yang dimiliki oleh International Criminal Court (ICC) dalam menangani kasus tewasnya jurnalis asal Al Jazeera yakni Shireen Abu Akleh dalam Konflik Bersenjata antara Palestina dengan Israel. Penelitian ini menerapkan sebuah metode hukum normatif melalui pendekatan produk hukum atau instrumen hukum (statute approach) yaitu melakukan penelitian terhadap regulasi di berbagai level dan peraturan di berbagai level sesuai dengan kasus hukum yang difokuskan. Berdasarkan hasil penelitian, didapatkan bahwa jurnalis merupakan objek sipil dari Hukum Humaniter Internasional. Selain itu, ICC mempunyai sebuah otoritas untuk mengadili sebuah kasus pada negara yang tidak meratifikasi Statuta Roma 1998 selama memenuhi ketentuan yang berlaku. Kata Kunci: Hukum Humaniter Internasional; Jurnalis; Pengadilan Pidana Internasional ABSTRACT The purpose of this research is to find out how the review of international humanitarian law in providing protection to war journalists and also how the role of the International Criminal Court (ICC) in handling the case of the death of Al Jazeera journalist Shireen Abu Akleh in the armed conflict between Palestine and Israel. This research applies a normative legal method through a legal product approach or legal instrument (statute approach), namely conducting research on regulations at different levels and regulations at different levels in accordance with the focused legal cases. Based on the results of the research, it is found that journalists are civilian objects of international humanitarian law. In addition, the ICC has the authority to try a case in a country that has not ratified the 1998 Rome Statute, as long as it meets the applicable provisions. Abstract

Legal certainty for Communal Intellectual Property protection on the inventory and record-keeping arrangements in terms of ownership proof in Indonesia, has increasingly been regulated in various regulations. However, threats are also growing. Traditional Cultural expression works are easily turned into personal video works. Along with that, such works are also vulnerable as those are easily threatened by Artificial intelligence’s ability to express works made from previous works of art such as paintings. This article aims to analyze Traditional Cultural Expressions protection which are transformed or adapted into personal works or works made by Artificial Intelligence and the measures to overcome these threats. The results show that referring to Government Regulation 56/2022, the commercial use of Traditional Cultural Expressions works both in the form of adaptation and transformation by individual humans and Artificial Intelligence is required to obtain a permit and pay attention to the distribution of benefits which will further be determined by the Minister. However, regulations on this mechanism has not been explicitly regulated. Measures to overcome threats can be made through measures to turn threats into opportunities and strengths. It is also relevant to prioritize countervailing measures, namely by following the pattern of threats as a balancing act.

Abstract

Jurnal ini bertujuan untuk mengetahui implementasi konvensi internasional dalam konteks eksploitasi anak di industri pertambangan kobalt Republik Demokratik Kongo, selain itu untuk mengetahui tentang sanksi internasional terhadap pelaku “genosida tersembunyi” dalam industri tambang Republik Demokratik Kongo tinjauan dari perspektif hukum internasional dan juga untuk memberikan informasi tentang tanggung jawab negara dalam menghormati, melindungi, dan juga untuk menjamin hak asasi manusia di tengah krisis “genosida tersembunyi” di Republik Demokratik Kongo. Dalam jurnal ini juga digunakan metode pendekatan yuridis normatif melalui studi literatur yang menggunakan berbagai macam sumber bahan pustaka dan memakai metode berpikir deduktif. Eksploitasi Pekerja anak di dalam industri tambang kobalt di Republik Demokratik Kongo mencerminkan pelanggaran Hak Asasi Manusia yang serius. Meskipun berbagai instrumen internasional telah diratifikasi, namun lemahnya penegakan hukum menimbulkan ketimpangan antara kepentingan ekonomi dan juga perlindungan hak asasi manusia. Maka oleh sebab itu diperlukan keterlibatan aktif dari komunitas internasional untuk mendorong akuntabilitas dan menjamin perlindungan hak anak secara efektif.
