Abstract

Artikel ini mengkaji konsep Dar al-‘Ahd wa al-Shahadah (negara perjanjian dan persaksian) yang diajukan oleh Muhammadiyah. Konsep ini penting dikaji, karena merupakan konsep elaborasi antara doktrin Siyar – hukum perang dan hubungan internasional dalam tradisi Islam – dan Pancasila yang bertujuan: memberikan pedoman bagi para aktivis Muhammadiyah mengenai hubungan negara dan organisasi, sebagai fondasi pertahanan ideologis, sebagai alat harmonisasi politik, dan manifestasi intelektual dan politik yang menekankan pentingnya nasionalisme. Artikel ini secara argumentatif menyatakan bahwa melalui konsep tersebut, Muhammadiyah berupaya meredam laju gerakan Islamisme (termasuk populisme Islamis sebagai akibat dari faktor merebaknya Islamisme) di Indonesia. Secara implementatif, Muhammadiyah harus menghadapi pelbagai tantangan seperti konservatisme di lingkungan internal Muhammadiyah, infiltrasi ideologis (khususnya Islamisme) sehingga menyebabkan pemisahan diri dan pengerasan sikap keberagamaan, dan adanya kontestasi politik praktis musiman yang melibatkan pelbagai instrumentalisasi agama untuk kepentingan politik kekuasaan (populisme Islamis).

Abstract

De-radicalization is an attempt to stem the rate of radicalism. The radicalism should be stemed due to its movement and thought both individual and group are oriented to radical activities, such as leading to violence, war and terror, which is very dangerous for mankind. However, thing need to be clarified are who is meant by this radical? What is the Islamic radicalism? In the Islamic context, the discussion is strongly related to the fundamental doctrines espoused by adherents, even become the ideology that stands firmly. Nonetheless, fundamentalism not necessarily lead to radicalism.

Abstract

Can the bisexual orientation in a marriage bond be considered a legal argument for formulating a verdict in the Indonesia Islamic courts? Does it have such a specific legal standing mentioned directly within any regulation covering the issue of Islamic private law? In answering both these questions, this article implements a normative-juridical inquiry that examines various rational possibilities in developing arguments of law. This article finds that in handling the case of bisexual orientation, the Indonesian legal system has remained a legal vacuum. Consequently, it seems it might not be a direct legal argument because it has no legal standing. This article argues that there is no single legal instrument has been imposed that explicitly mentions the case of the orientation. However, the judge may implement the analogous of the possibility of "adultery that leads to unresolved conflicts" to make a ratio legis of divorce due to the orientation.   AbstrakApakah orientasi biseksual dalam suatu ikatan perkawinan dapat dijadikan sebagai dalil hukum untuk merumuskan suatu putusan di pengadilan? Apakah ia memiliki kedudukan hukum tertentu yang disebutkan secara langsung dalam peraturan apa pun yang mencakup masalah hukum privat Islam? Dalam menjawab kedua pertanyaan tersebut, artikel ini menerapkan penelitian yuridis-normatif yang mengkaji berbagai kemungkinan rasional dalam mengembangkan argumentasi hukum. Artikel ini menemukan bahwa dalam menangani kasus orientasi biseksual, sistem hukum Indonesia masih mengalami kekosongan hukum. Akibatnya, seolah-olah tidak bisa menjadi argumentasi hukum langsung karena tidak memiliki legal standing. Artikel ini berargumen bahwa tidak ada satu pun instrumen hukum yang diberlakukan yang secara eksplisit menyebutkan kasus orientasi tersebut. Namun demikian, hakim dapat menerapkan analogi kemungkinan “perzinahan yang berujung pada konflik yang tidak terselesaikan” untuk membuat rasio logis perceraian karena orientasinya.

Abstract

This article focuses to examine the process of Muhammadiyah’s ijtihād has evolved, specifically in constructing the notion of Negara Pancasila sebagai Dār al-‘Ahd wa al-Shahādah (the state of consensus and witness) and the arguments on which it is built. The scholarly issues that have been highlighted in this article are study on this specific discourse has not been done yet, the ijtihad in the field of Siyar (law of war and international relations in Islamic traditions) which has been elaborated with ideas of contemporary social sciences is very rare, and the discourse of Siyar has dominantly covered only the area of Middle East. Accordingly, this article confidently fulfils these gaps applying qualitative research method and analysis of social contextualisation. This article argues that the way of Muhammadiyah’s ijtihād in producing the idea of Indonesia as the state of consensus and witness is applying theologising democracy. It consists of trajectory in which Muhammadiyah has objectified Islam and substantialised it to enhance the meaning of democracy.

Abstract

Indonesia, as one of the largest majority Muslim countries, has had a consistent stance on the Israel-Palestine conflict since its inception. Despite the general pro-Palestinian stance, this article explores the discourse of three significant leaders of the Indonesian people - Soekarno, Abdurrahman Wahid and Ahmad Syafii Maarif. As presidents of Indonesia of different time periods of Indonesia, Soekarno and Wahid tended to be pragmatic in their articulation of their political stances, though it is articulated in different ways. Maarif, as the leader of Muhammadiyah, a popular non-governmental organisation on the ground, was more idealistic and concerned with anti-Zionism. This article highlights that the different nuances of the three leaders is due to their different capacities as leaders, their social and political contexts, and the intellectual leanings and experiences.

Abstract

This article aims to examine the interaction between social science and tradition in Malay-Indonesian scholarship, with a particular focus on the perspectives of Muslim intellectuals. This interaction is represented by two approaches: autonomous social science and prophetic social science. The article argues that both approaches have their distinct inclinations in perceiving and formulating theoretical foundations. These inclinations are shaped by their unique qualities, alternative values, intellectual stances, and thinking styles. Moreover, during the process of development, they are influenced by various factors that give them their distinct characteristics, such as autonomy, a problem-based approach, and a strong commitment to rethinking society and driving change and transformation. The social concept of Islam Nusantara represents this development. It is a collection of arguments and practices of Islam adopted by Muslims in Nusantara, which have shaped patterns of social relations and cohesiveness through communicative actions throughout a specific historical epoch in the region. The article also highlights two essential factors that significantly shape these approaches: the dominant schools of thought in social science and the peculiar Malay-Indonesian traditions. While Western social sciences have played a central role in understanding certain concepts, Malay-Indonesian traditions have contributed significantly to shaping the paradigm of local scholars.

Abstract

Nikah sirri merupakan permasalahan dalam masyarakat yang tak kunjung berakhir, banyak implikasi yang ditimbulkan dari pernikahan sirri ini. Adapun tujuan dari penelitian ini adalah untuk mengetahui pelaksanaan nikah sirri, faktor-faktor apa saja yang mendorong seseorang melakukan nikah sirri, dan bagaimana dampak nikah sirri terhadap keharmonisan dalam rumah tangga di Desa Kalimati Kecamatan Japara Kabupaten Kuningan dalam persfektif maqasid syariah. Penelitian ini merupakan penelitian lapangan (field research), sumber data yang digunakan adalah sumber data primer dan sekunder. Berdasarkan hasil penelitian bahwa pelaksanaan nikah sirri di Desa Kalimati dalam perspektif hukum Islam adalah sah karena rukun dan syarat pernikahan telah terpenuhi, meskipun dianggap sah namun tidak tercatat legal oleh Negara di KUA.

Abstract

This article aims to examine the phenomenon of cooperation among Southeast Asian countries in dealing with the case of maritime security and counter-terrorism. The study uses the legal approach covering both international law and Islamic law perspectives. The finding of this article reveals that the implementation of the ASEAN Convention on Counter-Terrorism (ACCT) plays a crucial role in combating terrorism in the context of maritime security. Furthermore, relevant ASEAN member state authorities need follow-up support to enhance cooperation. The supports are important to counter, prevent, and suppress terrorism, terrorist organizations, associations, and networks' plans of the act. Yet, the implementation of ASEAN cooperation has faced the challenging reality of the paradox of maritime sovereignty among states in the region. The problem is likely encouraged by the factor of the internal political dynamics within each state involving the instrumentalization of the issue of national security. Instead of remaining as the problem on the surface, the conceptual initiation of the cooperation forged by religious doctrine such as ta'awun may be considered.

Abstract

‘Urf or customary law is a law that lives, develops, and is implemented by society. In the practice of marital disputes, people tend to implement customary law, or 'urf, first before resolving them through formal mechanisms regulated in statutory regulations. This research aims to analyze 'urf or customary law in marriage disputes from the living law aspect. This research is normative legal research that prioritizes conceptual and statutory approaches. The research results confirm that the position and existence of 'urf or customary law in marriage disputes is permissible as long as it does not conflict with Islamic law, guarantees benefits, and contributes to the successful implementation of Islamic law. Legal efforts to resolve marriage disputes through 'urf are viewed from a living law perspective because, as a law that applies and its value is appreciated by society, in marriage disputes, the role of 'urf or customary law is important to bring justice to the parties in dispute. Apart from that, legal efforts to resolve marital disputes through 'urf from a living law perspective can also be the first attempt to resolve marital disputes, and if efforts through 'urf or customary law are not successful, then efforts can be made to resolve them through procedures in the KHI and statutory regulations.
