Abstract

This article aims to analyze several issues of the implementation of the regulation of vaccination in Indonesia, encompassing the issues of the imposition of criminalization following the vaccination refusal, discussion on its objective, and practical challenges that potentially emerge. As qualitative research, this article employed a normative legal approach and social contextualization to comprehend regulations, legal interpretations, and arguments. This article finds that the government has amended the Presidential Regulation No. 99 of 2020 on the Procurement and Implementation of Vaccination to the Presidential Regulation No. 14 of 2021 on the Change of the Presidential Regulation No. 99 of 2020 in dealing with the issue of punishment imposed on those refusing the vaccination. From the perspective of utilitarian humanism, the regulation aims to ensure the success of the vaccination and is expected to result in the herd immunity of society that determines the social welfare in the country. The implementation of the regulation is being criticized on the practical level because it is claimed to raise the likelihood of the violation of human rights and overlook the public trust on account of excessive criminalization. This article argues that support from society is vital in the implementation of the regulation, while a positive campaign over public vaccinations need to be massively urged.

Abstract

Conventional methods for teaching Qur'anic memorisation (tahfizh) remain limited in accommodating the diverse learning styles of students and lack integration of modern learning theories that are more creative and engaging. This study aims to propose a novel concept for teaching Qur'anic memorisation by applying Hemisphere Theory, Multiple Intelligences, and Mind Mapping to address existing gaps in knowledge. The research methodology employed a descriptive-analytical approach through a literature review, gathering primary and secondary data from books, journals, and scholarly documents, followed by data analysis, interpretation, and generalisation. The findings reveal that this study presents an innovative approach to Qur'anic memorisation by comprehensively integrating modern learning concepts that had not been previously applied. The primary advantage lies in the combined application of Multiple Intelligences, Brain Hemisphere Theory, and Mind Mapping within the tahfizh process. This method is designed to be more understandable, enjoyable, and suitable for various age groups, distinguishing it from conventional methods, which tend to be rigid and less engaging. This approach emphasises rote memorisation and enhances students' comprehension and memory retention more creatively and adaptively tailored to individual needs. In conclusion, the innovation of Qur'anic learning methods incorporating modern theories such as Brain Hemisphere, Multiple Intelligences, and Mind Mapping is essential to overcome boredom, increase comfort, and encourage more in-depth research in the future.

Abstract

This paper evaluates Muhammadiyah’s effort to revitalise the doctrine of Siyar since the publication of Negara Pancasila sebagai Dār al-‘Ahd wa al-Shahādah (the state of Pancasila as the abode of covenant and the space of testimony). It finds that the ideas in the publication aim to provide guidance for Muhammadiyah members on the relationship between the state and Muhammadiyah. It ensures that its members will understand that Indonesia is Dār al-‘Ahd wa al-Shahādah. It seeks to defend itself against Islamist criticism, while also affirming its responsibility for state development. This paper argues that the idea is a product of Muhammadiyah’s contemporary ijtihad, an effort in theologising democracy based on the idea of Islam Berkemajuan (Islam with progress), in order to strengthen the social bonds of its members who are facing the challenging reality of the massive spread of Islamism and the associated social, political and economic problems.

Abstract

Religious moderation has been a government policy since 2015, aimed at countering radicalism and extremism. However, the hierarchical implementation of the program has led to the labeling of "moderate" and "conservative", and the policy's understanding remains unclear among the community, especially the middle class and youth. Despite the government's campaign, intolerance persists. This research aims to review the religious moderation policy and explore how urban Muslim youths could contribute to religious moderation education. The method involves in-depth interviews with urban Muslim youths in Manado and Semarang and critical analysis of relevant documents. The findings suggest that urban Muslim youths prioritize religious moderation through intensive dialogue and gatherings. Current educational practices should incorporate these informal approaches to be more effective. The inclusion of urban Muslim youths in religious moderation education appears to be a promising way to encourage religious moderation in Indonesia. This highlights the need for religious moderation implementation to be responsive to public aspirations.

Abstract

This paper aims to explore Muhammadiyah’s engagement with Islamic discourse on Sufism, neo-Sufism, and reform. Muhammadiyah appears to adopt a rather critical stance toward Sufism. This qualitative research study employs a combination of discourse analysis and hermeneutics to outline the organization’s perspective on Islamic spiritualism as a discursive phenomenon. This perspective is analyzed interpretively and enriched by scholarly sources, including its ideological framework, the ideas of its leaders, and its socio-cultural context. We find that Muhammadiyah, which espouses a Salafist-leaning ideology primarily opposed to superstition and heresy, does not reject Sufism outright. We argue that the organization’s reluctance to embrace organized Sufism as a modern Islamic expression aims to prevent misunderstanding among its Muslim constituency, while selectively incorporating discursive elements that align with Shari‘ah and modernity. Consequently, Muhammadiyah is more inclined to accept ideas associated with neo-Sufism. This study acknowledges the possibility of a conceptual reconstruction of thought around textualist and conservative ideas that should not be labeled as anti-Sufi.

Abstract

This research aims to develop the comprehensionof the presence of an Islamophobicoutlook in counter-terrorism measures in Indonesia. Thisoutlook affects both the process of formulating and implementing counter-terrorism policies.This undergoes a process of institutionalization by interpreting terrorism in statutory regulations because it crept through a formal structure whileformulating the policy.By using a qualitative approach, and content and critical analysis, this research investigates three cases of the implementation of the counter-terrorism policies:the screening of Muhammad and Alis names at Soekarno Hatta airport, contradiction in the status of the bomber by Leopard at the Taman Anggrek Mall, and the identification of Siyono as an extreme Islamic activist.We argue that the implementation of counter-terrorism policies encounters accountability issues, especially regarding the emergence of authority abuse and double standards during implementation. It confirms the public perception that the counter-terrorism policy is imbued with hostility towards Islam.

Abstract

In practice, there are several instances of criminal decisions that are not in accordance with the law. In such instances, the judge interprets the law or legal findings based on circumstantial evidence. As a result, the action taken does not achieve the highest degree of justice and legal certainty in a decision. This is because the decision is not based on the minimum requirements of two pieces of evidence that must be met in terms of evidence to impose a sentence. The objective of this research was to analyze the legal status of circumstantial evidence in the context of criminal cases. Our research findings indicate that the philosophy of circumstantial evidence, as it pertains to criminal procedural law, represents a form of evidence that can be considered by judges in relation to the absence of facts that are not directly visible by eyewitnesses. This evidence is intended to provide a comprehensive depiction of the truth of an event, thereby facilitating the acceptance of a reasonable account of events. Establishing circumstantial evidence is distinct from providing instructions, however. To do so, one must obtain clues from facts presented at trial in the form of witness statements, letters and statements of the accused. The ius constituendum application of circumstantial evidence in the process of proving a criminal case is to provide the judge with the authority to utilise circumstantial evidence in the process of proving a crime as an additional legal means of evidence in sentencing. The role of indirect evidence in the imposition of criminal penalties is a doctrine that is confined to be the domain of legal experts.

Abstract

Purpose – This study aims to examine Noeng Muhadjir’s perspective on constructing Islamic educational philosophy and its implications for developing scientific paradigms at Universitas Ahmad Dahlan (UAD). His ideas remain highly relevant amid the persistent dichotomy in Islamic education, which is still dominated by textual-theological reasoning and lacks empirical-rational contextualization. Methods – This study applies an abductive approach combining library (deductive) and field (inductive) research. Data from Noeng Muhadjir’s works and interviews with UAD leaders are analyzed philosophically to explore how his educational philosophy shapes UAD’s scientific paradigm, as reflected in the Science Unification guideline. Findings – Noeng Muhadjir’s Islamic educational philosophy, inspired by Ibn Rushd’s Peripatetic tradition, is based on monism, metaphysical realism, and theocratic humanistic ethics. He integrates empirical-rational (‘aqliyah) and divine-revelatory (naqliyah) reasoning to develop theocratic humanistic science and technology. At UAD, this thought underpins the unification of general and religious sciences grounded in Islamic and Muhammadiyah values (AIK) to advance science, humanity, and universal values. Research implications/limitations – This research advances the development of an Islamic educational philosophy that is empirical-rational in method yet spiritual in orientation. Based on Islamic Peripatetic principles, it positions Islamic education as integrating both religious and general sciences through empirical and experimental approaches. This perspective ultimately eliminates the dichotomy between wājib ‘ain (religious knowledge) and wājib kifāyah (general knowledge), viewing both as equally vital elements of a unified Islamic epistemology. Originality/value – Until now, much research and development in Islamic educational philosophy has tended to rely on Western philosophical frameworks rather than being grounded in authentic Islamic philosophical thought. In response, Noeng Muhadjir proposes Islamic Peripatetic philosophy as a genuine form of Islamic philosophy that serves as the foundation for developing an Islamic educational philosophy rooted in empirical and rational reasoning.

Abstract

This research aims to analyze the digital identity of Salafiyah santri (Islamic boarding school students) amidst the pervasive use of social media such as TikTok, Instagram, and YouTube. Initially regarded as a space for entertainment and information, social media has now become an arena for self-expression and Islamic proselytization (dakwah) for some santri. However, these digital activities often come into tension with the core values of the pesantren (Islamic boarding school), particularly zuhud (asceticism or simplicity) and tawadhu' (humility), which reject excessiveness and self-promotion. This research employs a descriptive qualitative approach, utilizing Giddens' theory of reflexive identity and Goffman's dramaturgical theory to understand how santri form and negotiate their self-image in the digital realm. Preliminary findings indicate that the santri experience moral ambivalence: on one hand, they strive to spread Islamic values through digital dakwah content, yet on the other hand, they grapple with the pressure to appear popular and appealing in the eyes of the online public. The study is expected to contribute to the development of a digital ethic for santri as part of the broader transformation of pesantren culture in the digital era
