Abstract

ABSTRACT Purpose of the study: This research aimed to fill gap by detailing the arguments around legal responsibility of juvenile narcotics use that are not intended for recreational purposes, but rather for medical purposes. This seeks to contribute to the growing literature on restorative justice in Indonesia, particularly for the development of the juvenile justice system. Methodology: This study examined the phenomenon of narcotics uses in the self-medication context, particularly among youth, utilizing the normative legal research method and bolstered by a case study (Judicial Decision). It also utilized the statutory approach, which involved an in-depth analysis of applicable legal provisions regarding juvenile crimes and narcotics. Results: While conceptual analysis found that there are many connections between the emerging trend of self-diagnosis and self-medication with narcotics use among children, yet the normative support to deal with this phenomenon through restorative justice remains poor. The impact of the lack of normative support is shown in the judicial decision, in which restorative justice through the application of diversion was applied incautiously, blurring children’s well-being;  disturbed by medical issue at first and later worsened by marijuana addiction. Applications of this study: The study can be an instrumental reference in guiding legal reforms, shaping healthcare policies for juvenile narcotic use, and providing information on educational and awareness programs that distinguish between medical and non-medical use of narcotics by minors. Novelty/Originality of this study: The originality of this study lies in its specific accent on the intersection of juvenile law, narcotics use, and medical treatment, which is a relatively underexplored area in legal research in Indonesia. It is also found in its analysis of a decision of a juvenile court regarding the use and possession of narcotics. Keywords: Legal Responsibility, Medical Purposes, Narcotics Crime, Restorative Justice, Case Study   ABSTRAK Tujuan: Penelitian ini bertujuan untuk mengisi kesenjangan dengan menjelaskan argumen seputar tanggung jawab hukum penggunaan narkotika oleh anak di bawah umur yang tidak dimaksudkan untuk tujuan rekreasi, melainkan untuk tujuan medis. Penelitian ini juga dilakukan untuk berkontribusi terhadap berkembangnya literatur mengenai keadilan restoratif di Indonesia, khususnya untuk pengembangan sistem peradilan anak. Metodologi: Studi ini mengkaji fenomena penggunaan narkotika dalam konteks swamedikasi, terutama di kalangan anak-anak, dengan menggunakan metode penelitian hukum normatif yang didukung oleh studi kasus (Putusan Pengadilan). Studi ini juga menggunakan pendekatan undang-undang, yang melibatkan analisis mendalam terhadap ketentuan hukum yang ada mengenai tindak pidana remaja dan narkotika. Temuan: Analisis konseptual menunjukkan bahwa meskipun terdapat banyak keterkaitan antara tren berkembangnya swadiagnosis dan swamedikasi dengan penggunaan narkotika di kalangan anak-anak, dukungan normatif untuk mengatasi fenomena ini melalui keadilan restoratif masih kurang. Dampak dari kurangnya dukungan normatif ini terlihat dalam putusan pengadilan di mana keadilan restoratif melalui penerapan diversi diterapkan dengan tergesa-gesa, tanpa fokus pada kesejahteraan anak, yang awalnya terganggu oleh masalah medisnya dan kemudian memburuk akibat kecanduan ganja. Kegunaan: Studi ini dapat menjadi referensi penting dalam reformasi hukum, membentuk kebijakan kesehatan yang berkaitan dengan penggunaan narkotika pada anak, dan menginformasikan program pendidikan dan kesadaran yang membedakan antara penggunaan narkotika untuk tujuan medis dan non-medis oleh anak di bawah umur. Kebaruan/Orisinalitas: Orisinalitas penelitian ini terletak pada fokus spesifiknya pada titik temu antara hukum peradilan anak, penggunaan narkotika, dan perawatan medis, yang merupakan area yang kurang dieksplorasi dalam penelitian IndonesiaIndonesia. Orisinalitas juga terletak pada analisisnya terhadap putusan pengadilan anak mengenai penggunaan dan kepemilikan narkotika. Abstract

Joint venture merupakan bentuk kerjasama penggabungan sumber daya antar dua perusahaan dengan tujuan meningkatkan ekonomi pribadi. Pendirian perusahaan joint venture ini melibatkan pihak asing dan pihak Indonesia dan tertuang dalam perjanjian kerjasama joint venture, perjanjian kerjasama ini memuat hak dan kewajiban para pihak secara rinci. Kenyataanya, jumlah investor asing yang banyak dan beragam sehingga adanya potensi terjadinya sengketa seperti tidak dipenuhinya kesepakaan antar pihak asing dengan pihak Indonesia, tidak melaksanakan kewajiban yang telah disepakati oleh para pihak atau wanprestasi. Penelitian ini bertujuan untuk mengkaji bagaimana pengaturan perusahaan joint venture di Indonesia, bagaimana perlindungan hukum bagi pihak Indonesia atas wanpestasi investor asing terhadap perjanjian joint venture ditinjau dari kepastian hukum, serta bagaimana upaya hukum jika terjadinya sengketa kerjasama joint venture antara para pihak penanam modal. Metode Penelitian yang digunakan dalam penelitian ini yaitu metode penelitian hukum yuridis normatif. Joint venture diatur dalam Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal, dan Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Perlindungan hukum yang diberikan bersifat preventif dan represif. Penyelesaian sengketa yang dapat ditempuh oleh para pihak yakni diselesaikan melalui musyawarah dan mufakat, konsultasi, negosiasi, mediasi, atau penilaian para ahli dan litigasi atau pengadilan.

Abstract

Introduction to The Problem: Traditional cuisines are an important part of national identity in Indonesia and a significant driver in the tourism industry, which are currently threatened by the constantly accelerating waves of globalization.Purpose/Objective Study: This research aims to analyze the ways to protect traditional cuisines through the intellectual property law, comparing the regime of GI and traditional knowledge, as suitable options of protection.Design/Methodology/Approach: This research utilizes normative legal research method, with statutory approach. To support this method, this research also utilizes literature analysis and comparative analysis technique to analyze the dichotomy between Geographical Indication and Traditional Knowledge.Findings: Analysis finds that the GI regime comes out as the superior regime of protection from the dichotomy, with lesser normative loopholes. Authenticity plays an important role in the comparative analysis between the two regimes, as it’s normatively backed as an important part of the tourism sector. Further analysis also finds that the GI regime can still be improved, particularly regarding substantive examination, which needs more definitive provisions to guarantee authenticity of traditional cuisines in Indonesia.Paper Type: Research Article

Abstract

Ships as collateral for mortgages in credit agreements are regulated in Articles 1162 to Article 1232 of the Civil Code and Shipping Law Number 17 of 2008. This departs from Indonesia's geographical conditions as a maritime country with important sea transportation, as well as its position in between the continents of Asia and Australia. Ships have two legal statuses, namely as movable and immovable objects. The Shipping Law states that the guarantee of a ship is determined by its region of registration, which is also linked to information about the ship and its owner in the national registration book. The nationality of the ship needs to be considered like other property rights. Banks are often hesitant to accept ship collateral due to the precautionary principle. However, the 2008 Shipping Law provides new hope for shipping entrepreneurs, even though many ships are not yet insured, making it difficult for banks to accept ships as credit collateral.

Abstract

E-wallet is a digital wallet that is used as a transaction tool in digital form, with the existence of an e-wallet the transaction process is faster and easier in this digitalization era because it only has to scan the QR code. However, behind the efficiency and benefits provided, of course there are risks arising from the use of this e-wallet such as the security of our personal data is threatened. The purpose of this study was to determine law enforcement against cybercrime on e-wallet and protection of personal data on e-wallet. The method used in this research is normative research. Based on the principle of legality of cyber crimes such as data theft has violated the ITE Law, therefore a person's personal data must be protected according to the Regulation of the Minister of Communication and Information and Bank Indonesia. According to Philipus M. Hadjon's theory of legal protection, to overcome legal problems such as data theft on e-wallet, preventive and repressive measures are needed.

Abstract

The current crisis situation, due to the Covid-19 pandemic, has caused the government to enact the Job Creation Law as an effort to advance the economy, in particular, micro and small businesses. The existence of the Job Creation Law expands the concept of a limited liability company with the recognition of a new legal entity, namely an individual company. The existence of an individual company gave birth to a number of contradictions in the basic concept of a limited liability company. This normative juridical research will discuss the regulation of micro and small business criteria based on the Job Creation Law and the limited liability company law as well as legal loopholes and proposed improvements. This study aims to determine the arrangements related to individual companies. The results of the study indicate that the legal basis for individual companies still has legal loopholes so that the government plays an important role in strengthening the regulation.

Abstract

Foreign Investment or commonly referred to as PMA is an investment activity carried out by foreign investors with the aim of being able to expand business or business in a country territory. In this case, the Indonesian government is trying to improve the investment climate in Indonesia by presenting the Job Creation Law. The existence of the Employment Creation Law has created a number of contradictions with the laws and regulations. This normative juridical research will discuss legal certainty for foreign investment in relation to the constitutional work creation law. This study aims to determine the basis and reasons for the formal examination of the Job Creation Act in the Constitutional Court, as well as to determine legal certainty for PMA. The results of the study indicate that legal certainty for PMA is currently a problem, so that the government plays an important role in making policies that do not harm the parties.

Abstract

Child sexual abuse is a serious phenomenon that continues to increase in the Riau Islands Province. To address this problem, the government has formed the Regional Technical Implementation Unit for the Protection of Women and Children (UPTD PPA), tasked with providing protection and services to victims. This study aims to evaluate the extent to which UPTD PPA services are effective in handling cases of child sexual abuse, identifying obstacles, and formulating solutions to improve the quality of services.In its implementation, this study used an empirical legal method through a qualitative approach and collected primary data through interviews and observations and secondary data from documents and statistical reports. The research findings revealed that UPTD PPA has attempted to provide legal, psychological, and social services to victims, but its effectiveness is hampered by a lack of trained staff, inadequate facilities, suboptimal cross-sectoral coordination, and low public awareness of the rights of child victims. In addition, social stigmatization and obstacles in providing legal evidence exacerbate victim trauma and hinder the recovery process.This study emphasizes that increasing the capacity of companions, inter-agency coordination, public education, and accelerating the legal process are very important to optimize protection and services for child victims of sexual abuse. It is hoped that the implementation of these recommendations will increase the role of UPTD PPA in creating a safe environment and supporting victim recovery.

Abstract

Considering that housing is a fundamental human need, the fulfillment of adequate housing constitutes a governmental responsibility. This aligns with the mandate of Article 27 paragraph (2) of the 1945 Constitution of the Republic of Indonesia, which guarantees a decent standard of living for all citizens. The government has a responsibility to provide decent housing for all Indonesian people. The absence of legal regulations regarding the limitation of ownership of land rights for residential houses for individuals causes a person to freely and without limits buy a residential house. Through a normative legal study, this research aims to examine the dimensions of the theory of developmental law and its application in addressing legal gaps concerning land ownership restrictions in Indonesia. To answer the problems in this research, the researcher uses a normative type of research with a legal approach to fill the lacuna of existing legal regulations in Indonesia since the object of the research is not yet legally regulated. The findings indicate that the theory of developmental law serves as a highly relevant and appropriate theoretical framework to be further explored and applied in filling the existing legal vacuum related to the study’s object. The problems faced by each individual (especially people of the middle to lower income) to get a decent house are of course the responsibility of the government. This situation is constitutionally mandated under the 1945 Constitution of the Republic of Indonesia. The answers to the problems, the researcher will approach the study by utilizing the approaches, in particular the Welfare State Theory of John Rawls, and the Law Development Theory of Mochtar Kusumaatmadja.
