Abstract

Abstract The nexus between investment and intellectual property often intersects with the international movement of capital. A robust legal structure is essential in comprehending potential issues, particularly concerning copyrights, which is one of the most frequently utilized intellectual property rights systems within the Indonesian economy. Consequently, this study seeks to pinpoint the elements linking these two notions within the framework of copyright regulations. Findings indicate that specific challenges may result in protracted and intricate administrative processes, as revealed through normative legal research methodologies. Concurrently, a thorough analysis employing the statutory approach reveals that these challenges stem from normative constraints, which may deter investors from engaging in the Indonesian economic landscape. Abstrak Hubungan antara investasi dan hak kekayaan intelektual sering kali saling terkait dengan arus modal global. Struktur hukum yang kokoh sangat penting untuk memahami potensi masalah, khususnya terkait hak cipta, yang merupakan salah satu sistem hak kekayaan intelektual yang paling sering digunakan dalam ekonomi Indonesia. Oleh karena itu, penelitian ini bertujuan untuk mengidentifikasi faktor-faktor yang menghubungkan kedua konsep ini dalam konteks regulasi hak cipta. Temuan menunjukkan bahwa tantangan-tantangan tertentu dapat mengakibatkan proses administratif yang panjang dan rumit, sebagaimana terungkap melalui metodologi penelitian hukum normatif. Sementara itu, analisis menyeluruh yang menggunakan pendekatan statutori menunjukkan bahwa tantangan-tantangan ini berasal dari pembatasan-pembatasan normatif, yang dapat menghalangi investor untuk terlibat dalam lanskap ekonomi Indonesia.

Abstract

Radicalism and terrorism are closely related as threats to peace and harmony, as bothare flawed manifestations of religious values and ideologies. The radicalization processcarried out by members of various terror organizations in Indonesia has not receivedmuch attention and hasn’t been responded with concrete efforts to stop its spread asthe precursor to terrorism. The normative legal research method is used in this studyto analyze the positive elements and purposes of regulations related to the educationalsystem, free speech, and radicalism prevention in Indonesia. Findings of this studyillustrate the legal urgency in Indonesia to carry out normative construction regardingthe criminalization process of radicalization, as well as its limitations and obstacles,as part of the effort to prevent criminal acts of terrorism. As a point of prevention andresistance to the spread of radicalism and terrorism in Indonesia, this criminalizationprocess is juxtaposed with the existing education system.

Abstract

Investment apps have become an important part of the investment culture throughout the world and have helped democratize investment opportunities for many people. The utilization of investment apps in Indonesia has opened many doors for Indonesians to invest their wealth and obtain many different kinds of assets, posing cybersecurity risks that threaten the interests of their users. This study aims to analyze and provide literature for possible future legislation that affects the utilization of investment apps. Using the normative legal research method, this study analyzes the intersection of investment law and consumer protection law in Indonesia in the context of the utilization of investment apps. Through the statutory approach, this study finds that the normative restrictions within the respective laws make it difficult to properly define legal liability for many kinds of problems that can arise from cybersecurity risks in the context of the utilization of investment apps. The findings of this article serve as a contribution to the constantly expanding literature for Indonesian legal development, specifically on the quest to adapt to the changes brought about by the latest technologies.Aplikasi investasi telah menjadi bagian penting dari budaya investasi di seluruh dunia dan telah membantu mendemokratisasi peluang investasi bagi banyak orang. Penggunaan aplikasi investasi di Indonesia telah membuka banyak pintu bagi masyarakat Indonesia untuk menginvestasikan kekayaan mereka dan mendapatkan berbagai jenis aset, yang menimbulkan risiko keamanan siber yang mengancam kepentingan penggunanya. Penelitian ini bertujuan untuk menganalisis dan menyediakan literatur untuk kemungkinan legislasi di masa depan yang mempengaruhi pemanfaatan aplikasi investasi. Dengan menggunakan metode penelitian hukum normatif, penelitian ini menganalisis persinggungan antara hukum investasi dan hukum perlindungan konsumen di Indonesia dalam konteks pemanfaatan aplikasi investasi. Melalui pendekatan perundang-undangan, penelitian ini menemukan bahwa pembatasan normatif dalam masing-masing undang-undang menyulitkan untuk mendefinisikan pertanggungjawaban hukum secara tepat untuk berbagai jenis masalah yang dapat timbul dari risiko keamanan siber dalam konteks penggunaan aplikasi investasi. Temuan dari artikel ini berfungsi sebagai kontribusi terhadap literatur yang terus berkembang untuk pengembangan hukum di Indonesia, khususnya dalam upaya untuk beradaptasi dengan perubahan yang dibawa oleh teknologi terbaru.

Abstract

The arbitrary economic exploitation of children by parents and other interested parties requires immediate attention. Batam City, located in the Riau Archipelago, is known for its innovation and low crime rates, primarily due to its focus on foreign relations. However, despite these positive aspects, the economic exploitation of children remains a significant issue, with economic factors playing a crucial role. This study aims to investigate the legal protection of children as victims of economic exploitation in Batam City using an empirical legal research method. This approach involves analyzing and examining the functioning of law within society, utilizing both primary and secondary data sources. The objective is to analyze legal protection for children as victims of economic exploitation from the perspectives of justice, utility, and legal certainty. The findings confirm that legal regulations concerning the protection of children from economic exploitation are clearly stipulated in the law. Various legal protection measures are available for children who fall victim to exploitation. However, enhancing parental awareness is essential to ensure consistent attention to the rights and obligations owed to their children.

Abstract

Numerous emerging economies have embraced Special Economic Zones (SEZs) as more than just an instrument for policymaking to encourage growth and industrial development. Today’s “SEZ 5.0,” which is based on novel digital inventions offers a gateway to economic progression. This research utilizes the normative juridical method and secondary data based on library research. This research is novel in the way that it illuminates the numerous key lessons from effective SEZ practices, such as: geographical advantage, interoperability of zone strategic plan with the overarching development plan, acknowledging the context of the industry, and harnessing comparative advantage, as well as, making sure that SEZs are “special” in contexts of a business-friendly atmosphere supported by a sound statutory and regulatory model, along with the articulation of sustainable practices and adaptability towards the volatility of the market. This research recommends key policy lessons for the Indonesian SEZ governance.

Abstract

The provisions pertaining to bankruptcy and summary proof in Law Number 37 of 2004 present various drawbacks in their application, particularly impacting debtors. Debtors can be declared bankrupt with relative ease, and the requirement for declaring bankruptcy does not directly indicate the debtor’s insolvency. This can present difficulties for other creditors, as the leniency in bankruptcy requirements for debtors is viewed as means to accelerate debt resolution, even though not all face the same circumstances. This research will focus on the issues regarding the urgency of revising Law Number 37 of 2004, specifically with regard to the conditions for bankruptcy and summary proof. The method used in this research is the doctrinal legal research method, which entails scrutinizing literary sources, legal theories or principles, research journals, and legislative regulations to analyze the subject of the research. Furthermore, a comparative approach is adopted to evaluate the development of Indonesian law by examining the bankruptcy legal frameworks in France and the Netherlands. The study concludes that the pressing need for amendments to the conditions for bankruptcy and summary proof in Law Number 37 of 2004 necessitates a responsive legal system. This can be achieved through a comprehensive review of problematic regulations. Therefore, the incorporation of additional measures, such as an insolvency test and a proactive approach by judges, establishes a regulatory mechanism that can be viewed as a responsive outcome in the future.

Abstract

A lot of major equity markets abroad have allowed the listing of the Dual-Class Share Structure (DCSS) corporations. DCSS is an agreement in which two types of shares are issued by the very same firm, with one type of share conferring greater power compared to the other. The Indonesian Stock Exchange only allows for limited access for DCSS technology-related corporations to list on its Mainboard. To remain attractive as Southeast Asia's top financial centre, Indonesia needs to alter its securities regulations while making its listing market adaptable to meet the needs of various enterprises. This research aims to analyse and elaborate on permitting DCSS corporations to go public and devise suitable governance safeguards to guarantee the highest possible standards of corporate governance are upheld. This research explores the legal certainty and applicability of DCSS in the Indonesian equity market and abroad, using a qualitative approach and thematic analysis of secondary data. The major finding of this research is the acceptance of DCSS adds to issues with abuse of power by the controlling shareholders, which was outweighed by their cash flow rights. While those in favour of DCSS argue that the existing shareholders' main reason for choosing a DCSS arrangement is to preserve company control. Most major exchanges in the world have taken action to accommodate DCSS going public, like those in the USA, Hong Kong, Singapore, and China. Considering the magnitude of the Asian market, Indonesia can emulate the accomplishments of other exchanges too. A series of recommendations are provided to guarantee the highest standards of corporate governance can be upheld, such as: permitting DCSS for new entrants and innovative businesses, regulating the ownership of enhanced voting shares, and setting out sunset provisions for DCSS arrangement.Keywords: Company Law, DCSS, Dual-Class Shares, Equity Market.

Abstract

Artikel ini menjelaskan tentang pertanggungjawaban notaris dalam menghadapi indikasi pemalsuan pada peralihan kepemilikan aset dari perspektif hukum positif di Indonesia. Metode penelitian yang digunakan adalah penelitian hukum yuridis normatif. Kasus pemalsuan surat pengalihan aset Bantuan Likuiditas Bank Indonesia (BLBI) di Bogor digunakan sebagai ilustrasi dalam konteks pembahasan. Dalam analisisnya, artikel ini menekankan pentingnya notaris untuk dapat mengidentifikasi indikasi pemalsuan, tindakan pencegahan, dan pelaporan terhadap indikasi tersebut. Notaris memiliki peran penting dalam memastikan keabsahan transaksi hukum dan harus bertindak dengan itikad baik. Selain itu, artikel ini juga membahas konsekuensi hukum yang mungkin dihadapi oleh notaris jika mereka gagal menjalankan kewajiban mereka dalam menghadapi pemalsuan, termasuk sanksi administratif, tindakan hukum pidana, dan tuntutan perdata. Keseluruhan, artikel ini menggarisbawahi pentingnya menjaga kepercayaan masyarakat terhadap sistem hukum dan peran notaris dalam menjaga integritas transaksi hukum.

Abstract

Debt is an obligation to pay an amount of money agreed and promised by both parties, but debt is often underestimated and not carried out in accordance with the rules so that a lawsuit for bankruptcy arises. A bankruptcy petition can be filed in court if it fulfills the requirements stipulated in Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. In addition to the declaration of bankruptcy, it can also be filed by the creditor against the debtor who does not pay his debt obligations to the commercial district court. Several lawsuits and applications have been submitted to the commercial court, one of which is the bankruptcy case that was tried at the Central Jakarta Commercial Court decision Number 36/Pdt.SusPailit/2020/PN Niaga Jkt.Pst. This study aims to analyze how the position case, the suitability of the reasons for filing this bankruptcy suit and the suitability of the judges' considerations in deciding the decision in this bankruptcy case. This research applies normative legal research methods. The results of the discussion produced in this study found that the reason for the judge in granting the case application submitted by PT. Pandega Design Weharima and CV. Media Konsultindo has complied with the facts and applicable laws

Abstract

NFT is the new tech-related trend. It is also predicted to become the new platform where artists can freely sell their art in any form. However, it is not as simple as that. As a trend, its popularity is increasing tremendously, where the good comes with the bad. One to mention, is the copyright infringement issue. The minting process or we can say, to produce the NFT is an easy process where it doesn’t even need an identification process of the real copyright owner. As a proof, there are many cases where traditional artists found a NFT based on their work with 100% similarity. For research in this writing, using normative research methods, which are based on written regulations, literature study that examine aspects of theory and legal explanations. The results of study indicate that law specializing in NFT hasn’t been formed yet, especially in Indonesia. The writer hopes that with this writing, readers can understand NFT more and at the same time how important this copyright issue is. Keywords : NFT, Copyright
