Abstract

This article aims to analyze the psychology of Sufis in the industrial era 4.0 from the perspective of the Koran. This research is library research using the tafsir maudhu'i method (based on theme in the Koran interpretation) which refers to the verses of the Koran. The results of the study show that Sufi psychology directs and guides the moral and spiritual decline of modern humans to become human beings with Qur'anic character in increasing productivity and creativity in the industrial era 4.0. Sufi psychology presents a path of balance between the body and the spirit. The Sufi psychology approach in responding to modern human life in the industrial era 4.0 is carried out by contextualizing the verses of the Koran based on Sufi psychology. Sufistic verses of the Qur'an in various terms, namely, al-taubah (repetance), al-sabr (patient), al-faqr (a situation where the heart does not need except to Allah), al-zuhud (the decision to forget the world to love Allah SWT alone), al-wara', al-tawakkal and al-rida, is used as a basis for guiding and directing dynamic and diverse developments and changes in the contemporary modern era 4.0. Sufi psychology also serves to revitalize moral and spiritual disorientation in the contemporary modern era.

Abstract

With the implementation of the Merdeka Belajar Kampus Merdeka (MBKM) Curriculum in 2020, the opportunities for online learning, particularly through the utilization of e-learning, have significantly expanded. How prepared are universities to realize this MBKM initiative, and what challenges do they face? This research aims to construct the development of e-learning to accelerate the Merdeka Belajar – Kampus Merdeka (MB-KM) Program at IAIN Sultan Amai Gorontalo and UHAMKA Jakarta. This descriptive research employs a mixed-methods approach. Data collection techniques include observation, interviews, and Focus Group Discussions (FGD). Data is analyzed using reduction, display, and conclusion techniques. The research findings indicate that the implementation of MBKM at universities, whether face-to-face or online, can be achieved through student exchanges within the same or different universities, entrepreneurial activities, and thematic community service/fieldwork activities. The design of e-learning development to accelerate the implementation of MBKM can be initiated through: (a) ensuring the accessibility and stability of internet, electricity, telephone, and other infrastructure networks, (b) selecting reliable and modern hardware and software, (c) establishing a strong IT management institution with adequate operational funding, and (d) preparing professional human resources with a high work ethic. The next step is to enhance the performance of university e-learning and study programs in terms of content performance, accuracy, format, appropriateness, ease of use, security and privacy, and response speed

Abstract

The purpose of this study is to describe and analyze the decisions of the Unaaha Religious Court in guaranteeing the rights of children and women after divorce and to examine the constraints of the panel of judges of the Unaaha Religious Court in guaranteeing the rights of women and children in case decisions. This research is a normative-empirical research. Data collection techniques and legal materials are document studies and interviews. While the process of data analysis is carried out in three steps, namely: first, identification of legal facts. secondly, examining or and seeking legal norms related to legal facts. Third, applying legal norms to legal facts. The results of this study show that: First, in the period from July 2021 to June 2022 the Unaaha Religious Court decided 493 divorce and divorce cases. Of the 493 cases that have been decided, only 22 cases involving the fulfillment of the rights of wives or children. Where the reasons for fulfilling these rights can be made into four (4) typologies. First, because it was requested in the convention as many as 12 cases. Second, because of an agreement in mediation in 8 cases. Third, because the posita of the application is 1 case. Fourth, because of the posita lawsuit of 1 case. From the four typologies it can be concluded that the judges have not exercised their rights ex-officio in order to fulfill the rights of women and children. Therefore, it can also be concluded that the judges have not fully implemented the Letter of the Director General of Badilag Number 1669/DJA/HK.00/5/2021 Concerning Guarantees for the Rights of Post-Divorce Women and Children. Second, the constraints faced by judges in fulfilling the rights of women and children in case decisions, namely: 1) the financial ability of the husband or father, 2) the ability of the parties in the evidentiary process, 3) the presence of the parties (wife or husband) in the trial , 4) there is no coordination and cooperation between the Religious Courts and related agencies in the case of parties who work as ASN/PNS.

Abstract

This study aims to compare Islamic law in Indonesia and Egypt regarding child custody (hadhanah) regulations after divorce, with a focus on the principles of protection and the best interests of the child. This research employs a library research method, examining sources such as the Qur’an, hadith, classical Islamic jurisprudence texts, statutory regulations, and relevant scholarly studies. The research process involves reading, reviewing, and analyzing literature related to the implementation of hadhanah in both legal systems. The findings indicate that Indonesia views hadhanah as an essential aspect of family Law that emphasizes child protection and welfare. Legally, mothers receive priority in caring for young children; however, final decisions are always made in the child's best interests. This reflects the adaptive, humanistic, and justice-oriented nature of Islamic Law in Indonesia, which remains responsive to modern societal needs. Meanwhile, Egypt places maslahah al-thifl (the child’s best interest) at the core of its regulation of hadhanah and has successfully integrated Islamic values into modern national law. Both countries affirm that the child’s welfare is the paramount consideration in determining custody after divorce.
