Abstract

The Covid-19 pandemic has significantly impacted the economic sector, especially the banking sector in obtaining debt repayments from debtors. To obtain debt repayment from a defaulting debtor, it can be done by selling debt guarantees that have been tied with Mortgage Rights. This study aims to examine and analyze the legal rules, mechanisms and obstacles faced in the implementation of the Mortgage Execution auction through the internet media during the Covid-19 pandemic based on the ITE law. This study uses a normative juridical legal research method with a historical, explanatory and synchronization legal approach using primary, secondary and tertiary legal materials then data analysis is carried out qualitatively. The results of the study show that the auction of Mortgage executions through the internet media during the Covid-19 pandemic based on the ITE law at the Medan KPKNL has been carried out based on applicable law and the resulting auction minutes are valid authentic deeds. However, it is still necessary to improve both in terms of regulations and support systems so that auctions via the internet can be carried out effectively, transparently, accountable, fair, and guarantee legal certainty.

Abstract

Bases to this study, take then three points of questionable such as; 1) what factors cause taking place pedophilia, 2) how to apply law enforcement to a pedophilia  case on Aceh, 3) what actions to be taken by Syariah Court to minimize pedophilia  criminal case. This study is an analysis descriptive research method with data research approach, to analyze the data of regulations rules regarding pedophilia cases. In collecting the data, adopted library research and field research. Still, in analyzing the data from variously resources, to classify them according to the purpose and aim of conducting the research. All the data that has been gained and classified should be interpreted later. The result indicated that 1) causes of occurrence any pedophilia cases mostly on the effect of environmental such as seeing video with porno, internal factor originally from the actor since he got abnormal sexual desires, external factor there is connecting with social and cultural aspects and due to advancement of technology and informatics. Still, locally, 2) Law enforcement with Qanun Jinayat is ruled in a Qanun Jinayat in Article 46 and 47 to this case one as actor should be sentenced with whips in 90 times  and set fine with 900 gram or jailed for 90 months. 3) in order to minimize pedophilia acts as provided by  Syariah court  with syariat trial which by the execution done before public.

Abstract

Sesuai dengan kewenangan Pemerintah Provinsi Sumatera Utara di bidang pertanahan, maka perlu dilihat lebih lanjut bagaimana peran pemerintah dalam proses penyelesaian permasalahan konfliks pertanahan. Konflik pertanahan yang berlangsung lama dan belarut-larut adalah sengketa/konflik lahan eks HGU PTPN II. Metode deskriptif digunakan untuk mendiskripsikan secara sistematis, faktual dan akurat terhadap penyelesaian permasalahan konfliks pertanahan. Hasil penelitian menunjukkan bahwa Pemerintah Provinsi Sumatera Utara melaksanakan kewenangannya yang penyelesaiannya terganjal sampai saat ini. Salah satu isi diktum dari SK BPN Nomor 42,43,43/2002 dan No. 10/204 yang memuat kalimat: menyerahkan Pengaturan, Penguasaan, Pemilikan, Pemanfaatan dan Penggunaan Tanah tersebut kepada Gubernur Sumatera Utara. Untuk selanjutnya diproses sesuai ketentuan peraturan perundangan yang berlaku, setelah memperoleh ijin dari Menteri. Permasalahan menjadi rumit, karena ijin tersebut tidak terbit sampai sekarang. Upaya untuk mencari solusi masih terus dilakukan termasuk dengan pemerintah pusat yaitu kementerian Dalam Negeri maupun Kementerian BUMN. Berdasarkan fakta lapangan, banyak kelompok masyarakat baik penuntut maupun pemohon juga perusahaan swasta yang saat ini menguasai lahan eks HGU PTPN II. Maka Pemerintah Provinsi Sumatera Utara harus sesegera mungkin mengadakan pendataan ulang dan verifikasi/permohonan yang disampaikan oleh kelompok masyarakat penuntut/pemohon, sehingga dapat diperoleh kebenaran yang seobjektif mungkin untuk memperoleh hak atas redistribusi tanah-tanah eks HGU tersebut.

Abstract

Penelitian ini bertujuan untuk mengetahui Gambaran Pelaksanaan  SIMDA Keuangan Versi 2.7 Berbasis Akrual pada Pemerintah Kabupaten Dairi dan produk  yang dihasilkan SIMDA Keuangan Versi 2.7 Bebasis Akrual. Peneliti memilih menggunakan teori George C. Edwards III yang mengatakan 4 faktor yang mempengaruhi implementasi kebijakan publik yaitu komunikasi, sumber daya, disposisi dan struktur birokrasi dalam penelitian ini. Penelitian ini adalah penelitian deskriptif dengan menggunakan pendekatan kualitatif. Teknik pengumpulan data dilakukan dengan teknik wawancara, observasi dan telaah dokumen. Teknik analisis data yang digunakan adalah melalui model Irawan. Dari hasil penelitian menunjukkan bahwa (1) pelaksanaan SIMDA Keuangan Versi 2.7 Berbasis akrual sudah terlaksana melalui faktor komunikasi dan disposisi. Adapun permasalahan adalah dari faktor sumber daya dan struktur birokrasi (2) Penganggaran dan Penatausahaan dilaksanakan berdasarkan Peraturan Menteri Dalam Negeri Nomor 13 Tahun 2006 tentang Pedoman Pengelolaan Keuangan daerah  sementara penatausahaan berdasarkan Peraturan Menteri Dalam Negeri Nomor 64 Tahun 2013 tentang Penerapan Standar Akuntansi Pemerintahan Berbasis Akrual.

Abstract

Pedoman kinerja Kepala Sekolah yang dikeluarkan Permendiknas tentang standar pengelolaan sekolah harus menjadi Evaluasi kinerja kepala sekolah yang berdasarkan tupoksinya. Tupoksi kepala sekolah yang mengacu pada Permendiknas Nomor 19 Tahun 2007 tentang standar pengelolaan sekolah. Rumusan masalah dalam penelitian ini adalah Bagaimana Kinerja dan Akuntabilitas Kepala Sekolah Menengah Kejuruan se-Kabupaten Langkat dalam mengimplementasikan Permendiknas Nomor 19 Tahun 2007 sebagai standar pengelolaan sekolah, meliputi perencanaan program, pelaksaan rencana kerja, pengawasan dan evaluasi, kepemimpinan sekolah serta sistem informasi sekolah. Penelitian ini dilakukan bertujuan untuk Mengevaluasi kinerja dan Menganalisis akuntabilitas Kepala Sekolah menengah kejuruan se-kabupaten langkat dalam melaksanakan pengelolaan sekolah, meliputi perencanaan program, pelaksaan rencana kerja, pengawasan dan evaluasi, kepemimpinan sekolah serta sistem informasi sekolah. Penelitian ini dilaksanakan dengan menggunakan metode bersifat analisis deskriftif dimana yang menjadi informan adalah tujuh orang informan dengan waktu penelitian kurang lebih 2 (dua) bulan bertempat di Kantor dinas Pendidikan dan Pengajaran Kabupaten Langkat. Hasil dari penelitian ini dinilai kinerja Kepala Sekolah Menengah Kejuruan se-kabupaten langkat sudah cukup baik. Namun perlu ditingkankan lagi agar dapat menjadi lebih baik lagi.

Abstract

The formulation of the problem in this study is How is the service quality of the Office of Investment and One Stop Integrated Services in Batu Bara Regency in managing permits to the community?. And What are the obstacles for the Batu Bara Regency Investment and One Stop Service Office in obtaining permits to the public? The method used in this study is a qualitative research, with data collection instruments are interviews, documentation, and observation. While the data analysis used descriptive analysis. The results showed that the quality of public services at the Investment and One Stop Service Office of Batu Bara Regency refers to the theory of Parasuraman, Zeithaml, and Berry (Parasuraman, 1988), namely: public services that are in poor or unsatisfactory. In terms of reliability, the Office of Investment and One Stop Integrated Services of Batu Bara Regency is not yet classified as good. In providing service, the time is quite long. The technical team is not in place because the technical team also holds other positions. However, the physical evidence (tangibles), reliability (reability), responsiveness (responsiveness), assurance (assurance) and empathy can be said to be good. The service barrier at the Investment and One Stop Service Office of Batu Bara Regency is technological failure. Not all permits can be accessed by the public. Like building permits. In practice, it has not been implemented optimally. And limited resources. This is because the technical team is not in place, and concurrently with other positions, and is in their respective offices.

Abstract

The purpose of this research is to find out and analyze, how the implementation of policies of the Mayor of Binjai in terms of improving the quality and quality of public services, especially transportation services to the people of Binjai City. The method used in this research is descriptive qualitative using the Merille S. Grindle theory where there are several variables that determine the effectiveness of policy implementation. From the results of the study it can be seen that after the implementation of the Mayor's Regulation at the Binjai City Transportation Agency, there was a change where previously the transportation management process, which had been in PD Angkutan Kota Binjai using transportation costs and other transportation, is now transferred to the Transportation Office to manage it with free of charge so that it can make it easier for people to carry out daily activities using Trans Binjai.

Abstract

The level of community satisfaction with services from the kelurahan is still relatively low, as can be seen from the many protests from the community against the kelurahan policy. This situation can be seen from the implementation of the work which is still slow so that most of the work cannot be completed on time. This study aims to determine what policies and constraint factors cause the less successful policy of Regent Regulation no. 6 of 2019 concerning Provision of Additional Income for Civil Servants in Central Tapanuli Regency in Improving Employee Performance in Sibuluan Indah Village, Pandan District. The research used was descriptive method, and the data analysis technique used descriptive qualitative. The results of the study show that the TPP policy has not fully succeeded in improving the performance of employees in Sibuluan Indah Village, Pandan District, with the following recommendations: 1) that the Central Tapanuli Regency government needs to revise the TPP policy so that it is more detailed about the elements of performance appraisal, 2) Officials appraisers need to eliminate the influence of personal relationships in making assessments of the performance of subordinates, and 3) The government needs to pay attention to the payment of TPP funds can be made in a timely manner.

Abstract

The government has launched the Public Service Agency / Regional Public Service Agency (BLU / BLUD) program with the issuance of Government Regulation Number 23 of 2005. PP 23 of 2005 concerning Financial Management of Public service agency which basically explains, Public service agency are not only a new form in management of state finances but also as a new paradigm for public sector service management. The purpose of this study was to determine and analyze how the implementation of PPK-BLUD policies in RSUD Dr. RM Djoelham Binjai in terms of improving the quality and quality of public services, especially health services to the people of Binjai City. The method used in this research is descriptive qualitative using the Merille S. Grindle theory where there are several variables that determine the effectiveness of policy implementation. From the research results it can be seen that after the implementation of PPK-BLUD in Dr. RM. Djoelham Binjai, there was a change where previously the budget management, finance and reporting processes, which had been purely based on financial regulations with the APBD mechanism. However, with the implementation of PPK-BLUD, all the income that the RSUD Dr. RM. Djoelham receives can be directly managed and used for the needs and needs of the RSUD. So it is hoped that it can simplify the bureaucracy, especially finance, so that in the end it can improve the quality of hospital services. In its implementation, there are several obstacles faced, especially the understanding of other sections and fields of PPK-BLUD in RSUD Dr. RM. Djoelham Binjai so that good coordination between divisions and fields is needed.

Abstract

This study aims to analyze how the implementation of the Gayo Lues Regent’s Regulation Number 14 of 2014 concerning urban and rural land and building taxes in Gayo Lues District and to find out the obstacles in the implementation of the Gayo Lues Regent’s regulation number 14 of 2014 concerning urban and rural land and building taxes in Gyao Lues district. The research method used in this research is descriptive with qualitative analysis. Data collection was obtained from interviews, observations and documentation. The Research results were tasted using George Edward III’s theory, wich consisted of (1). Communication, (2). Resources, (3). Bereaucratic Structure and (4). Dispotition. The results of this study indicate that the implementation og Gayo Lues Regent’s Regulation Number 14 of 2014 concerning Urban and Urban Land and Building Taxes in Gayo Lues District has been implemented but has not given optimal result, because it faces several obstacles, including the lack of diect socializatation of land and building taxes to the community, limited human resources in terms of quantity and competence possessed. limited facilities to support activities, lack of budget to support the implementation of activities.
