Abstract

Globalization certainly has an impact on developments in every country, therefore forest conversion activities are carried out with government permission. In practice, several acts of excessive forest exploitation were found which were classified as criminal acts of illegal logging. The purpose of this study is to understand the existence of the state in forest monitoring and management, and to compare illegal logging crimes in Indonesia, Malaysia, and the Philippines in terms of the laws and regulations of each country. The normative legal research method is in the form of secondary data, the author makes a legal comparison between the laws of the three countries collected through literature study. The results obtained, that the crime of illegal logging is a large and organized crime, in their regulations have condemned all actions related to environmental destruction including illegal logging, weak law enforcement is a factor that causes this crime to be repeated every year.

Abstract

Keberadaan Pengadilan Partai dalam tata negara dengan sistem corka multipartai menjadi penting guna mengatasi permasalahan perselisihan parpol dimana perselisihan parpol akan sangat mempengaruhi suatu tatanan negara demokrasi Indonesia. Metode penulisan menggunakan penelitian doktrinal dengan jenis bahan hukum sekunder dan primer dan pendekatan kasus, pendekatan konstruksi peraturan perundang-undangan, dan pendekatan konseptual. Keberadaan Pengadilan Partai tertuang dalam Undang-Undang Partai Politik tahun 2011, Pengadilan Partai merupakan kuasi yudikatif yang berperan dalam mengatasi dan mengadili berbagai persoalan perselisihan internal partai politik, yang putusannya bersifat final dan mengikat. sengketa kepengurusan internal partai politik. Akibat hukum tidak adanya Partai Makmamah di tubuh Partai Politik jelas berdampak tidak dapat diajukannya gugatan perselisihan partai politik di Pengadilan Negeri atau kasasi di Mahkamah Agung. Banyak sengketa partai politik yang tidak diputuskan oleh negara melalui peradilannya dengan alasan jalur pengadilan partai tidak ditempuh terlebih dahulu, akibat adanya gugatan yang cacat atau prematur dan kedudukan Pengadilan Negeri yang tidak memiliki kewenangan mutlak dan reaktif untuk mengadili. sengketa partai politik itu sendiri. Dengan demikian, keberadaan Pengadilan Partai menjadi sangat penting dan memiliki posisi strategis sebagai peradilan semu internal Partai Politik.

Abstract

The integrity of Indonesia’s democratic elections depends on the impartial enforcement of electoral laws and the protection of citizens’ political rights. The Election Supervisory Board (Bawaslu), although not explicitly established in the Constitution, serves as a key institution mandated by statutory law to oversee electoral neutrality and protect the fairness of electoral processes. Its supervisory mandate intersects with broader constitutional principles and human rights norms, particularly in addressing violations of political neutrality by state officials and safeguarding the right to political participation. This study aims to critically analyze the extent to which Bawaslu incorporates constitutional oversight and human rights considerations into its supervisory practices and how these frameworks influence its effectiveness. Using a normative legal research method with statutory, conceptual, and comparative approaches, the study evaluates national legal instruments, Bawaslu regulations, and selected case studies. Findings indicate that Bawaslu’s oversight capacity is constrained by gaps in legal clarity, inconsistent inter-institutional coordination, and the absence of explicit constitutional grounding for its human rights obligations. Strengthening its institutional independence, refining the legal framework, and aligning domestic electoral oversight with international human rights standards are crucial steps for enhancing both electoral integrity and political neutrality. Beyond the Indonesian context, this study contributes to the global discourse on the role of non-constitutional electoral oversight bodies in consolidating democratic governance, offering comparative insights relevant to emerging democracies worldwide.

Abstract

The management of village funds is a crucial aspect in community development and empowerment at the village level. However, implementation in the field still faces various challenges, such as weak legal capacity of village officials, lack of financial accountability, and lack of community participation in supervision. This condition has the potential to cause budget irregularities and hinder village development goals. Therefore, an integrated effort is needed that combines legal and accounting knowledge to encourage transparent, accountable, and participatory governance of village funds. This service activity aims to increase the capacity of village and community apparatus through an interdisciplinary approach. From the legal side, participants will be given an understanding of village financial management regulations, the legal responsibilities of village officials, and criminal risks in budget abuse. In terms of accounting, the training will focus on recording transactions, preparing financial statements, and simulating simple audits that are relevant to village practices. This activity uses a participatory method with the Participatory Action Research (PAR) model, which involves village officials and the community actively in each stage of the activity. This approach was chosen so that the results of the service were really in accordance with the needs of the field and could be applied directly by the participants. The implementation of activities is carried out through an interdisciplinary approach, which is a combination of the fields of law and accounting. The targeted outputs of this activity include: (1) increasing legal and accounting literacy among village officials; (2) the preparation of practical modules for the management of village funds based on law and accounting; and (3) the formation of an accountability-aware village community that can be a driver of budget supervision based on citizen participation. Abstrak Pengelolaan dana desa merupakan aspek krusial dalam pembangunan dan pemberdayaan masyarakat di tingkat desa. Namun, implementasi di lapangan masih menghadapi berbagai tantangan, seperti lemahnya kapasitas hukum perangkat desa, minimnya akuntabilitas keuangan, serta kurangnya partisipasi masyarakat dalam pengawasan. Kondisi ini berpotensi menimbulkan penyimpangan anggaran dan menghambat tujuan pembangunan desa. Oleh karena itu, perlu upaya terpadu yang menggabungkan keilmuan hukum dan akuntansi untuk mendorong tata kelola dana desa yang transparan, akuntabel, dan partisipatif. Kegiatan pengabdian ini bertujuan untuk meningkatkan kapasitas perangkat desa dan masyarakat melalui pendekatan interdisipliner. Dari sisi hukum, peserta akan diberikan pemahaman terkait regulasi pengelolaan keuangan desa, tanggung jawab hukum aparatur desa, serta risiko pidana dalam penyalahgunaan anggaran. Dari sisi akuntansi, pelatihan akan difokuskan pada pencatatan transaksi, penyusunan laporan keuangan, serta simulasi audit sederhana yang relevan dengan praktik desa. Kegiatan ini menggunakan metode partisipatif dengan model Participatory Action Research (PAR), yaitu melibatkan perangkat desa dan masyarakat secara aktif dalam setiap tahap kegiatan. Pendekatan ini dipilih agar hasil pengabdian benar-benar sesuai dengan kebutuhan lapangan dan dapat diterapkan langsung oleh peserta. Pelaksanaan kegiatan dilakukan melalui pendekatan interdisipliner, yaitu gabungan antara bidang hukum dan akuntansi. Luaran yang ditargetkan dari kegiatan ini meliputi: (1) peningkatan literasi hukum dan akuntansi di kalangan perangkat desa; (2) tersusunnya modul praktis pengelolaan dana desa berbasis hukum dan akuntansi; dan (3) terbentuknya komunitas desa sadar akuntabilitas yang dapat menjadi penggerak pengawasan anggaran berbasis partisipasi warga.

Abstract

Pandemi Covid-19 menyebabkan berbagai sektor kehidupan menjadi tak teratur, pemenuhan hak dan kewajiban menjadi terhambat tak terkecuali pemenuhan hak anak. Pemenuhan hak anak merupakan hal yang harus dilakukan seperti yang kita ketahui bahwa hak-hak anak termasuk kedalam hak asasi manusia yang dijamin. Di tengah pandemi seperti ini, berbagai resiko atau dampak bukan tidak mungkin tidak bisa dihindari, seperti halnya kekerasan, eksploitasi dan stigmatisasi terhadap anak dan orang tuanya yang terkena dampak covid-19. Berdasarkan pembahasan di atas penulis membahas mengenai upaya perlindungan hak anak di tengah pandemi covid-19 di Karawang. Metode penelitian yang digunakan adalah pengumpulan data yang berhubungan dengan hak anak di tengah pandemi Covid-19 baik dari undang-undang maupun sumber alternatif lainnya yang kemudian dikumpulkan dalam kesimpulan deskriptif. Adapun tujuan penulisan ini untuk mengetahui bagaimana perlindungan hak anak di tengah pandemic Covid-19 di kabupaten Karawang.

Abstract

This study examines the constitutional framework of regional autonomy in sustainable water resource management, with the Citarum River as the case study. The research focuses on the distribution of authority among the central government, provincial government, and regency or municipal governments in controlling pollution, protecting river ecosystems, and coordinating water governance. This study uses a normative-empirical legal approach based on document analysis of constitutional norms, statutory regulations, policy documents, official reports, and relevant academic literature. The findings show that the Citarum River is governed through a strong constitutional mandate under Article 33 paragraph (3) of the 1945 Constitution, yet its implementation still faces overlapping authority, sectoral coordination gaps, uneven local capacity, and weak continuity of law enforcement. The study concludes that sustainable Citarum management requires clearer authority mapping, stronger provincial coordination, consistent enforcement, community participation, and policy harmonization between national strategic programs and regional autonomy.

Abstract

This article discusses the relationship between legal ethics and corruption in Indonesia’s public sector after the Reformasi era by using a normative-empirical approach and selected case studies. It explains the position of legal ethics in public governance, maps the transformation of corruption patterns after decentralization, and assesses the effectiveness of anti-corruption law enforcement through the e-KTP, BLBI, and Hambalang cases. The analysis shows that law enforcement has generated important achievements, particularly in exposing grand corruption, but its impact remains constrained by political intervention, uneven institutional capacity, weak asset recovery, and the fragile internalization of ethical standards within public institutions. The article argues that anti-corruption policy will be more effective when punitive mechanisms are integrated with ethical governance, bureaucratic reform, transparency systems, and public participation.

Abstract

This article examines how personal data protection should be integrated into restorative justice (RJ) mediation in digital fraud cases through a juridical and philosophical reading of John Rawls. The study uses a normative-empirical legal approach by reviewing criminal law regulations, the Personal Data Protection Law, and practical risks faced by victims during mediation. The analysis shows a regulatory gap: RJ rules still do not expressly regulate informed consent, technical data security, the right to erasure, and liability when data leaks occur in mediation. From Rawls's justice as fairness perspective, the current model also tends to sacrifice the equal liberty of victims and fails to protect the least advantaged party, namely victims with weak digital literacy and unequal bargaining positions. Based on these findings, the article proposes a reconstruction of digital-fraud mediation through a victim-centred data protection model consisting of explicit consent, limited data access, anonymized mediation, controlled documentation, and mandatory post-mediation data deletion.

Abstract

Purpose: This study investigates the legal implications and cybersecurity vulnerabilities surrounding the leak of 102 million electronic identity (E-KTP) records allegedly originating from the Indonesian Ministry of Social Affairs. It highlights the urgency of improving data protection mechanisms in the era of digital governance. Research methodology: The research adopts a qualitative document analysis method, collecting and examining data from laws, government regulations, academic literature, credible news sources, and case studies related to cybercrime and information security. An interdisciplinary approach is applied, integrating perspectives from law, information technology, and cybersecurity. Results: The study reveals that the current regulatory framework is insufficient to fully address the growing risks of data breaches in public digital infrastructures. It identifies critical gaps in cybersecurity readiness, institutional accountability, and legal enforcement related to personal data protection. Conclusions: Strengthening personal data protection in Indonesia requires a combination of stricter regulatory enforcement, increased public awareness, technological investment, and cross-sector collaboration. The legal system must adapt more proactively to emerging digital threats. Limitations: This research is limited to secondary data sources and does not include interviews or empirical fieldwork, which may restrict the depth of analysis on institutional practices. Contribution: This paper contributes to the development of cyber law discourse in Indonesia by offering legal and policy recommendations aimed at enhancing data privacy, institutional responsibility, and public trust in digital identity systems.
