Abstract

Praktik money politics di Indonesia berkelindan dengan politik berbiaya tinggi dan pola patronase-klientelisme, sehingga merusak integritas elektoral dan menurunkan kualitas demokrasi. Pada saat yang sama, uang juga merupakan komponen fungsional demokrasi untuk menopang partisipasi dan kompetisi, sehingga problem kuncinya terletak pada desain dan penegakan regulasi pembiayaan politik (political finance). Artikel ini bertujuan memetakan bentuk kekaburan yuridis dalam rezim larangan money politics, mengurai dampaknya terhadap efektivitas penegakan hukum, serta merumuskan agenda reformasi yang dapat diaudit. Penelitian menggunakan metode yuridis normatif (doctrinal) dengan pendekatan perundang-undangan dan konseptual, didukung telaah literatur serta analisis atas problem pembuktian dan batasan prosedural penanganan tindak pidana pemilu. Hasil analisis menunjukkan empat klaster kekaburan: (i) ketidakjelasan subjek hukum (calon, tim kampanye, perantara, dan/atau partai); (ii) cakupan objek dan stadium pemilihan yang tidak sepenuhnya mengunci variasi modus; (iii) keterbatasan temporal dan standar pembuktian yang tidak proporsional dengan kompleksitas praktik transaksional; serta (iv) ambiguitas kualifikasi delik antara tindak pidana pemilu dan tindak pidana korupsi. Kekaburan ini memproduksi ketidakpastian hukum, memicu disparitas penanganan, dan meningkatkan peluang impunitas. Artikel merekomendasikan penajaman norma (definisi, unsur, dan perluasan subjek), perbaikan arsitektur monitoring/pelaporan pembiayaan kampanye, penguatan pembuktian berbasis bukti elektronik dan jejak keuangan, perpanjangan waktu penanganan, serta opsi pembiayaan publik yang terukur.

Abstract

Technological developments and increasingly high business competition make MSME actors must have a good marketing strategy to be able to compete with their competitors. This research was conducted to determine the marketing strategy carried out by Ledys Cake SMEs in facing competition in the digital era. The research method in this study uses a qualitative approach through structured interviews with business actors. The results of the study show that MSMEs provide added value and differentiation to the products and services provided, while in terms of price, they apply competitive prices. The application of technology is more widely used in culinary businesses through websites and social media to establish good relationships and communicate with consumers. The researcher concludes that there are several discussions, namely Strategy, Constraints and Solutions. The strategy carried out by MSMEs is that there is a 4P (Product, Promotion, Price, Place) mix. Product strategy in the form of innovation, promotion strategy in the form of price discounts, price strategy for every purchase of cake will get a bonus, and place strategy in the form of flexibility in sending cake orders, so as to maintain and improve the quality of the taste of the cake. Although there are financial constraints and product raw materials, we can still find solutions and alternatives, namely by managing finances and using raw materials efficiently. Then, MSME solutions by maintaining cash flow, product innovation, maximizing social media and delivery services

Abstract

The protection of the employment rights of Indonesian adolescents working abroad, especially in Cambodia, is a legal issue that needs serious attention. In practice, not a few Indonesian teenagers working in Cambodia experience violations of labor rights, such as unfair wages, excessive working hours, and working conditions that are not in accordance with humanitarian standards. This study aims to examine the protection of Indonesian adolescent employment rights in Cambodia based on the provisions of Indonesian labor law. This research uses normative legal research methods with a legislative approach and a conceptual approach. The results of the study show that laws and regulations in Indonesia, especially Law Number 13 of 2003 concerning Manpower and Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers, have provided an adequate legal basis related to the protection of the rights of workers, including adolescents. However, the implementation of this protection is still not optimal due to weak supervision, lack of coordination between agencies, and low legal understanding of workers. Therefore, it is necessary to increase supervision, strengthen cooperation between countries, and play an active role of the government in ensuring the protection of the employment rights of Indonesian adolescents abroad.
