Abstract

This article discusses working according to sandal craftsmen in Wedoro village, Waru, Sidoarjo. The research was conducted in Wedoro village, Waru, Sidoarjo, East Java. Data collection through observation, interviews and documentation. The collected data was analyzed deductively using Islamic law. The study results concluded that most sandal craftsmen came from among the santri and were affiliated with the Nahdhatul Ulama religious organization. The concept of work they have is influenced by the religious teachings they acquire. They do five things at work, namely diligent and diligent, knowledgeable, innovating and understanding market needs, expanding networks and relationships, and being grateful. These five things are in accordance with the concept of Islamic law. In maqāṣid al-Sharia, work as a sandal craftsman corresponds to the objectives of hifẓ al-dīn, hifẓ al-nafs, hifẓ al-‘aql, hifẓ al-nasl and hifẓ al-māl.

Abstract

The backpacker umrah phenomenon reflects the community’s aspiration to perform worship in a more flexible and economical manner, yet it simultaneously generates serious concerns from both positive law and sharī’ah perspectives, as it is conducted outside the framework of official state mechanisms. This study analyzes backpacker Umrah from the perspective of Maqashid al-Shariah and legal sociology and offers ideal regulations that protect pilgrims. This research is an empirical legal study that uses primary data from a Google Form questionnaire to analyze the reasons and objectives of pilgrims performing Umrah as backpackers, supported by legal materials in the form of statutory regulations. The research findings demonstrate that the phenomenon of backpacker umrah embodies broader social dynamics and represents community responses to economic constraints and technological developments, as pilgrims increasingly opt for a more flexible and affordable mode of worship. In the perspective of legal sociology and maqashid asy-syariah, this practice demonstrates a culturally legitimate social construction, but it creates tension with formal regulations, particularly in aspects of security, legal protection, and compliance with legislation. Although it provides benefits to some segments of society, backpacker umrah still carries potential harms that need to be addressed proportionally. Based on the findings of this study, it is recommended that regulations governing ḥajj and umrah be more effectively organized to prevent long queues for pilgrims, and that specific provisions addressing backpacker umrah be formulated to ensure legal protection, along with guarantees of safety and comfort for those undertaking the pilgrimage independently.

Abstract

During the Covid-19 pandemic, the family cluster was among the clusters that caused the spread of this virus. For families exposed to this virus, their family's resilience has been tested. This article discusses the resilience of families exposed to Covid-19 to be analyzed in maqasid al-shari’ah. The method used in this research is qualitative and field research. Data were collected through observation, interviews, and documentation. The collected data were analyzed as normative-descriptive. This study concluded that families exposed to Covid-19 work together to fight this virus by adjusting their respective conditions. For the mild, they self-isolate at home, and those with severe illnesses are hospitalized. If a family dies from Covid-19, the family left behind is isolated. What the family exposed to Covid does is maintain family resilience and maintain the physical and psychic health of the family. From the perspective of maqasid al-shari'ah, the effort corresponds to the concepts of hifz al-din (guarding religion), hifz al-nasl (guarding offspring), hifz al-nafs (guarding the soul), and hifz al-'aql (guarding reason).
