Abstract

This study analyzes community organizations located in the buffer zone of the Jragung River in Demak Regency, which is legally a protected area under Indonesian spatial planning and water management regulations. The primary issue discussed is the continued presence of these organizations in the river boundary area despite clear laws, specifically those stipulated in Demak Regency Regulation Number 6 of 2011, Article 83 paragraph (3), which prohibits development within the river buffer zone, and Law Number 1 of 2011, Article 140, which restricts housing development outside the designated community organization area. These regulations stipulate a minimum distance of five meters from river embankments in areas outside the urban zone. This study aims to explore solutions to these problems. It uses an empirical legal method with a descriptive approach. The legal analysis focuses on the laws and regional regulations governing the river buffer zone, while empirical data is obtained through field observations and interviews with residents living along the Jragung River. Findings indicate that organizations in the river buffer zone developed gradually due to inherited land ownership, economic constraints, strong social continuity with the settlement, and weak government oversight and legal dissemination. While relocation provides hydrological and ecological benefits, it also poses significant social and economic challenges for affected communities. In contrast, river engineering measures, such as river channel straightening and embankment construction, are considered more feasible in the study area because they reduce disaster risk without causing significant social disruption.

Abstract

Land occupies a strategic position in the Indonesian agricultural legal system, in which the right to land ownership is reserved for Indonesian citizens (WNI) only, in accordance with Article 21 of the Basic Agrarian Law (UUPA). This provision poses a problem for WNI who are in mixed marriages. The reason for this is that the joint property system can lead to land ownership rights being regarded as mixed ownership and thus run the risk of passing into the hands of foreign nationals (WNA). This study analyzes the role of marriage contracts as a legal solution to protect the land ownership rights of WNI in mixed marriages. The study uses a legal-normative method with a legislative and conceptual approach. The results of the study show that Constitutional Court Decision No. 69/PUU-XIII/2015 recognizes prenuptial agreements concluded after marriage, allowing for retroactive separation of property. Furthermore, this protection is reinforced by Government Regulation No. 18 of 2021, Article 70, which states that Indonesian citizens married to foreigners can retain land rights based on a property division agreement. This is further reinforced by technical regulations issued by the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency, which provide legal certainty and administrative mechanisms for land ownership. Overall, marriage contracts serve as an important tool for protecting the constitutional rights of Indonesian citizens, preventing control of land by foreigners, and ensuring justice and legal certainty in mixed marriages.

Abstract

The establishment of the Daya Anagata Nusantara Investment Management Agency, hereinafter referred to as Danantara, through Law Number 1 of 2025 marks a fundamental shift in the governance and control of State-Owned Enterprises (SOEs), including their subsidiaries. This transformation replaces the previous governance model, which relied on the administrative authority of the Ministry of SOEs, with a centralized control framework implemented through investment management and holding mechanisms. This study aims to analyze the changes in governance and control over SOE subsidiaries following the establishment of Danantara, particularly with regard to the limits of state control authority, its implications for the principles of good corporate governance, and legal accountability within the SOE corporate group structure. The findings indicate that the establishment of Danantara strengthens state control over SOE subsidiaries both structurally and functionally, particularly through capital management, business planning, and the approval of strategic corporate actions, without altering the legal status of subsidiaries as independent limited liability companies. However, such reinforcement of control has the potential to restrict the autonomy of corporate organs and poses challenges to the implementation of the principles of independence and accountability. This study concludes that clear delineation of Danantara’s control authority is necessary to ensure consistency with the principle of entity separation and the implementation of good corporate governance.

Abstract

The development of Islamic banking financing in Indonesia plays an important role in supporting the growth of the Micro, Small, and Medium Enterprises (MSMEs) sector. However, in practice, a phenomenon known as overcollateralization often occurs, where the value of collateral required exceeds the amount of financing provided to customers. This condition raises concerns regarding the balance of legal relations between Islamic financial institutions and customers, particularly MSME actors who generally have limited assets and relatively weaker bargaining positions. This study aims to analyze the legal regulation related to the practice of overcollateralization in sharia financing in Indonesia and to examine its legal implications for MSME customers from the perspective of Maqashid Sharia. The research uses a normative legal method with statutory, conceptual, and philosophical approaches, supported by field data obtained through interviews with twelve MSME actors who have received financing from Islamic financial institutions. The findings indicate that regulations concerning collateral in sharia financing have been recognized in the Sharia Banking Law, the Civil Code, and the fatwas issued by the National Sharia Council of the Indonesian Ulema Council. However, these regulations do not specifically regulate the proportionality between the value of collateral and the amount of financing. This situation creates room for overcollateralization practices which, although not explicitly unlawful, may potentially create an imbalance of risk for MSME customers. From the perspective of Maqashid Sharia, such practices may conflict with the objective of protecting wealth (ḥifẓ al-māl). Therefore, stronger regulations and more proportional financing policies are necessary to ensure fairness, balance, and benefit for all parties.

Abstract

This study aims to analyze the form of errors in issuing waqf land certificates in the Complete Systematic Land Registration Program (PTSL) and examine the Legal Implications and the role of Wakif, Nadzir, KUA, and BPN in resolving these errors, with a Case study in Paninggaran Village, Pekalongan Regency. The main problem identified is the discrepancy between social facts (land that has been orally endowed and used for public interest) with administrative facts (certified land does not belong to individuals because there is no Deed of Waqf Pledge/AIW). This study uses the Empirical Juridical method with a Case Study approach. Primary data was obtained through Semi-structured interviews with Wakif, Hadir, and BPN Officers, while secondary data was obtained from laws and regulations, books, and scientific articles. Data analysis was carried out interactively with descriptive juridical techniques. The research findings indicate that errors in issuing certificates occurred because waqf was carried out orally without AIW, even though AIW is an absolute requirement based on Article 6 paragraph (2) of the Minister of ATR/BPN Regulation No. 2017. As a result, the National Land Agency (BPN) procedurally issued a land ownership certificate based on the available documents. This error created legal uncertainty and potentially transferred the waqf land to a third party. The resolution requires the preparation of an AIW by the KUA, coordination by the Nadzir, active participation of the Wakif, and verification and issuance of the certificate by the BPN. This study concludes that orderly administration from the beginning of the waqf is very important, and strengthening multistakeholder coordination can prevent similar errors in the future.

Abstract

Penelitian ini bertujuan untuk menganalisis konsep prinsip maqashid syariah dalam perspektif hukum ekonomi syariah serta penerapannya dalam kebijakan pembiayaan UMKM pada perbankan syariah di Indonesia. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan yuridis-normatif, dilengkapi studi literatur dari buku, jurnal, dan dokumen resmi terkait hukum ekonomi syariah dan praktik pembiayaan UMKM. Hasil penelitian menunjukkan bahwa maqashid syariah berfungsi sebagai kerangka normatif dan filosofis yang menekankan kemaslahatan masyarakat melalui perlindungan terhadap harta, jiwa, akal, keturunan, dan agama. Prinsip ini diterapkan melalui pembiayaan yang inklusif dan berkeadilan, dengan integrasi pendidikan keuangan dan pendampingan usaha bagi pelaku UMKM. Temuan penelitian ini menegaskan bahwa penerapan maqashid syariah tidak hanya memastikan kepatuhan syariah dalam transaksi, tetapi juga memperkuat peran bank syariah sebagai agen pemberdayaan ekonomi dan pembangunan sosial yang berkelanjutan. Implikasi penelitian mencakup kontribusi teoritis dalam pengembangan hukum ekonomi syariah modern dan arahan praktis bagi perbankan syariah dalam merancang kebijakan pembiayaan UMKM yang lebih adil, inklusif, dan berkelanjutan.

Abstract

Profesi advokat memegang peranan krusial dalam sistem peradilan sebagai penegak hukum yang bertugas memberikan bantuan hukum kepada masyarakat. Advokat kerap menghadapi dilema etika ketika harus membela klien yang secara faktual diketahui bersalah, sehingga menimbulkan pertentangan antara kewajiban profesional untuk memberikan pembelaan maksimal dengan tanggung jawab moral terhadap nilai keadilan. Penelitian ini bertujuan menganalisis dilema etika yang dihadapi advokat dalam membela klien yang bersalah serta meninjau bagaimana prinsip-prinsip etika profesi mengatur batasan perilaku advokat dalam menjalankan tugasnya. Metode yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan dan kode etik profesi advokat. Hasil kajian menunjukkan bahwa advokat tetap memiliki kewajiban profesional untuk memberikan pembelaan kepada klien tanpa memandang kesalahan yang dilakukan, karena pembelaan tersebut merupakan bagian dari perlindungan hak asasi manusia dan penerapan asas praduga tak bersalah. Namun demikian, kewajiban tersebut tidak bersifat tanpa batas advokat harus tetap mematuhi ketentuan hukum dan kode etik profesi yang melarang segala bentuk manipulasi bukti, keterangan menyesatkan, maupun tindakan lain yang merusak integritas proses peradilan. Keseimbangan antara kewajiban profesional dan tanggung jawab moral menjadi kunci profesionalisme advokat dalam menjaga kepercayaan masyarakat terhadap sistem hukum.
