Abstract

Corruption cases involving gold pawn (rahn) transactions within Islamic financial institutions highlight critical challenges related to sharia governance, fiduciary responsibility, and asset protection. Despite being founded on ethical and religious principles, sharia-compliant financial products remain vulnerable to financial crimes, particularly in high-value, asset-based transactions. This study examines asset confiscation mechanisms in a gold pawn corruption case in Pamekasan, Indonesia, analyzed through the perspectives of Islamic law and positive law. Employing a qualitative case study approach, this research utilizes statutory regulations, court-related legal documents, institutional reports, and secondary data from verified media and academic literature. The findings demonstrate that asset confiscation serves a dual function: as a legal instrument for state loss recovery under Indonesian anti-corruption law and as a normative mechanism aligned with Islamic legal principles such as amanah (trust), hifz al-mal (protection of property), justice, and public interest (maslahah). This study contributes to the literature by integrating Islamic jurisprudence with contemporary asset recovery discourse, emphasizing that asset confiscation is not merely a procedural legal act but a necessary governance mechanism to strengthen accountability and integrity within Islamic financial institutions. The research underscores the importance of harmonizing Islamic law and modern legal systems to restore public trust and enhance anti-corruption frameworks in sharia-compliant finance.

Abstract

Penelitian ini bertujuan membahas model penyelesaiansengketa akibat kelalain penjaga toko kelontong Madura dalam perspektif amanah muamalah. Metode yang digunakanyaitu pendekatan kualitatif, dengan teknik pengumpulan data melalui wawancara dan observasi. Hasil temuan menunjukkanbahwa kerugian yang terjadi disebabkan oleh pemberiankasbon tanpa pencatatan dan penggelapan dana yang melanggar prinsip amanah. penyelesaian sengketa dilakukanmelalui musyawrah kekeluargaan yang hasil keputusanditetapkan penggantian kerugian ditanggung penjaga tokoserta diperkuat melalu pembuatan surat pernyataanbermaterai. Hasil penelitian menemukan bahwa prinsipamanah dan musyawarah menjadi dasar efektif dalammenyelesaikan sengketa pada usaha ritel tradisional berbasiskepercayaan.

Abstract

This study aims to examine the issue of Mediation as an Alternative Dispute Resolution (ADR) in Cases of Lost/Damaged Packages in Shopee Express Pamekasan Hub. Consumer disputes in expedition services are a crucial issue, given that business actors are fully responsible for losses suffered by consumers. This study applies a normative legal method that focuses on the analysis of legal norms, principles, doctrines, and applicable laws and regulations. This study uses a descriptive qualitative approach with a case study method. As a solution, this dispute is resolved through mediation. The mediation process usually occurs if internal resolution through the return feature or direct contact with customer service fails or is rejected by one of the parties. This process involves a third-party mediator who is tasked with bridging communication between consumers and Shopee Express representatives to reach a peaceful and fair mutual agreement.

Abstract

This study examines Islamic Philanthropic practices (Zakat, Infaq, and Sadaqah) within a transnational context that has received limited scholarly attention, particularly among migrant workers. Legal issues arise from regulatory misalignment between Indonesia and Malaysia in Zakat governance, which affects the practice of religious obligations. The objective of this study is to introduce the concept of social delegitimation in relation to transnational religious obligations and to understand the process through which Madurese migrants in Malaysia fulfil Zakat, Infaq, and Sadaqah (ZIS). This research adopts an empirical study using anthropological and comparative approaches and applies Kenneth L. Pike's emic and etic perspectives. The findings indicate that the fulfilment of ZIS takes place through continuous negotiation within conditions of transnational uncertainty. Regulatory misalignment contributes to the social delegitimation of formal zakat institution in Malaysia, leading migrants to prefer channeling their ZIS through networks of kiai (religious scholars) and community groups in their hometowns, which are perceived to guarantee emotional proximity, blessing (barakah), and spiritual accountability. Accordingly, this study demonstrates that religious authority and the legitimacy of Islamic philanthropy in diaspora contexts are shaped more by social relations and transnational resilience strategies than by mere state legal frameworks.Penelitian ini mengkaji praktik filantropi Islam (zakat, infaq, dan sadaqah) dalam konteks transnasional yang jarang dieksplorasi, khususnya di kalangan pekerja migran. Terdapat isu hukum mengenai ketidakselarasan regulasi zakat antara Indonesia dan Malaysia yang memengaruhi praktik kewajiban agama. Tujuan studi ini adalah memperkenalkan konsep delegitimasi sosial terhadap kewajiban agama transnasional dan memahami proses pemenuhan zakat, infaq, dan sadaqah (ZIS) migran Madura di Malaysia. Metode yang digunakan adalah penelitian empiris dengan pendekatan antropologi dan komparatif, serta menerapkan perspektif emik dan etik Kenneth L. Pike. Hasil penelitian menunjukkan bahwa pemenuhan ZIS berlangsung melalui negosiasi berkelanjutan dalam situasi ketidakpastian transnasional. Ketidakselarasan regulasi mendorong delegitimasi sosial terhadap institusi zakat formal di Malaysia, menyebabkan migran lebih memilih menyalurkan ZIS melalui jaringan kiai dan komunitas di kampung halaman karena dinilai menjamin kedekatan emosional, keberkahan, dan akuntabilitas spiritual. Dengan demikian, kontribusi artikel ini memperlihatkan bahwa otoritas keagamaan dan legitimasi filantropi Islam di diaspora lebih ditentukan oleh relasi sosial dan strategi ketahanan transnasional daripada sekadar kerangka hukum negara.
