Abstract

The purpose of personnel analysis is to achieve professional civil servants in implementing the principles of good governance. To achieve this goal, one of the policies undertaken by the government is to issue a new regulation in the field of personnel as a substitute for the old regulation, namely Government Regulation No. 94 of 2021. The new policy issued by the government should be firmer, better and more effective. so that it will make Civil Servants who commit disciplinary violations become a deterrent. The new regulations have several changes to disciplinary penalties. One of the changes is severe disciplinary punishment. The old regulations set forth in PP No. 53 of 2010, regulated the existence of a penalty for dishonorable dismissal as civil servants, but in the replacement regulation this was omitted. By eliminating the word disrespect, it has an impact on the staffing sector, so that severe disciplinary punishment becomes lighter. The reduction in disciplinary punishment provides an opportunity for civil servants to commit repeated violations, thereby hampering the principles of good governance. In terms of staffing, these changes have an impact on civil servant pension rights. In this way, all civil servants who have been dismissed, both retired and for committing serious disciplinary violations, will receive pension rights. PP for PNS No. 94 of 2021 should carry out the Law's orders, but the new PP is not in line with Article 84 of the ASN Law.

Abstract

Pasca berlakunya UU Pemda 2014, konflik wewenang dalam penegakan hukum administratif melalui pengawasan dapat terjadi antara dua tingkat pemerintahan daerah. Hal ini disebabkan fungsi pengawasan bergeser kepada provinsi sejalan dengan pengalihan wewenang penerbitan izin pertambangan yang semula berada di kabupaten/kota, sementara wewenang bupati/walikota dalam UU Minerba belum dicabut. Tujuan penelitian adalah untuk mendeskripsi dan menganalisis konflik norma serta memecahkan dilema penegakan hukum adminsitratif melalui pengawasan dalam pengelolaan pertambangan. Metode yang digunakan untuk menganalisis masalah adalah pendekatan yuridis normatif. Informasi dan data yang dikumpulkan dianalisis berdasarkan metode interpretasi hukum maupun berdasar asas-asas hukum yang berlaku. Hasil kajian menunjukkan bahwa sebagai peraturan baru dan umum, UU Pemda mempunyai posisi lebih kuat dalam memenuhi hak masyarakat atas lingkungan hidup yang baik dan sehat. Namun demikian, usaha pertambangan yang lebih banyak berada di wilayah kabupaten/kota menuntut pengawasan kegiatan pertambangan oleh provinsi harus mengikusertakan bupati/walikota berdasarkan tugas pembantuan (medebewind).

Abstract

Penerapan Asas Freies Ermessen Dalam Pengambilan Kebijakan Oleh Administrasi Negara Berdasarkan Hukum Administrasi Negara  Merupakan  suatu kebebasan yang diberikan kepada tata usaha negara dalam melakukan penyelenggaraan pemerintahan. Sehingga Freies Ermessen merupakan kemerdekaan bertindak atas inisiatif dan kebijakan sendiri dari administrasi negara. Keberadaanya  yang lain karena adanya suatu peningkatan akan  tuntutan pelayanan publik yang harus di berikan tata usaha negara terhadap kehidupan sosial ekonomi pada warga memiliki keberagaman, dan untuk menyelesaikan persoalan-persoalan yang mendesak yang belum ada aturannya  dan harus dapat dipertanggungjawabkan secara hukum dan moral.

Abstract

This research addresses the urgent changes following the repeal of Law no. 28 of 2009, which governed Regional Taxes and Regional Levies, as incorporated into the Financial Relations between the Central Government and Local Governments Law (Law No. 1 of 2022). The repeal brings forth significant consequences, particularly affecting the authority of regional governments to shape their tax policies. To understand these impacts, we delve into the evolution of regional tax regulations in Indonesia. The legal landscape surrounding regional tax law under the HKPD Law presents a fascinating area of study. Our aim is to explore the legal politics that influence local tax management within the framework of regional autonomy in Indonesia. This study employs a normative juridical approach, utilizing various data collection methods, including interviews, focus group discussions (FGDs), and document analysis. Throughout the research, data processing and analysis occur continually as new information emerges. Our findings indicate a notable shift in legal politics surrounding local tax management in Indonesia. Current regional tax policies are increasingly designed to enhance local revenue, supporting regional autonomy while aligning with the central government’s fiscal harmonization goals. This approach aims to optimize public services and ensure the sustainability of fiscal framework.

Abstract

The use of community-based collaborative management has shown promising results in addressing the complex issues surrounding sea turtle conservation. However, the legal implications and barriers associated with this method have not been thoroughly investigated. This study seeks to examine legal policies governing conservation institutions that influence community-based turtle protection along the southern coast of Central Java, Indonesia. The focus of this study is on two specific case studies: a conservation group at Pantai Sodong and another at Pantai Kembar. Employing a qualitative research design, this study incorporated semi-structured interviews with conservation group administrators, government officials, and other relevant stakeholders. Apart from that, this research also involves analysis of legal and regulatory documents and policies which is complemented by field observations. These findings indicate that community-based conservation policies significantly increase legal behavior that is in line with conservation law provisions. However, this report also underscores the legal and institutional challenges faced by local community-based conservation groups. These challenges include the necessity of legal collaboration between community groups and the government, the availability of healthcare facilities such as quarantine centers and clinics, and the need for a permanent workforce with appropriate skills. This study emphasizes the need for more flexible standards regarding conservation institutional requirements and government support to encourage the fulfillment of the validity and legal certainty of conservation institutions. This study adds to the growing body of literature on legal approaches to community-based collaborative management, and offers important insights for policymakers and legal practitioners who wish to increase support for community-based conservation programs in Indonesia and other countries.

Abstract

This study analyzes the recognition and protection of indigenous peoples’ territorial rights in Indonesia and Russia within the framework of international human rights law and identifies factors affecting their effectiveness. Using a normative legal method with conceptual and comparative approaches, the study finds that Indonesia has a relatively progressive framework through constitutional recognition of indigenous communities, yet implementation remains weak due to fragmented sectoral regulations and reliance on regional administrative recognition. Russia, by contrast, adopts a centralized model that recognizes only small-numbered indigenous peoples and limits collective ownership and meaningful participation. Both countries face tensions between state sovereignty over natural resources and international obligations to protect indigenous collective rights. The study recommends adopting a multi-level governance model that balances national interests and indigenous autonomy, alongside legal reforms to strengthen implementation of the Free, Prior, and Informed Consent (FPIC) principle, enabling more effective integration of international human rights norms into domestic legal systems..
