Abstract

The pattern of medical rehabilitation carried out by countries that legalize the use of medical marijuana, and the process of healing users from narcotic dependence varies, so various strategies and therapies for marijuana use are needed in various countries with emphasis on several indicators, such as: religion, form, and/or the basis of a country, what legal system is adopted by a country, what institutions exist in a country, which really focuses on the values ​​that live and grow in that country, which are feared will affect the aspects of national and state life , undermines the stability of the nation's economy, which of course affects a country's efforts to realize the welfare elements of a country, one of which can be obtained through legal development in general, as well as health development in particular.

Abstract

The growth of illegal shrimp ponds in Batang Anai, Padang Pariaman Regency has been very widespread recently. This is because the advantages of shrimp cultivation include fast growth, high survival rate, high shrimp appetite, greater resistance to disease attacks and relatively short rearing time, namely 90-100 days per cycle. As shrimp cultivation develops in this area, environmental pollution problems arise. Of course, this is contrary to Law number 36 of 2009 concerning Health, Article 4 and Article 6 states that everyone has the right to health and everyone has the right to a healthy environment for achieving a level of health. Based on preliminary interviews with the community around the shrimp ponds, it was stated that the existence of illegal shrimp ponds does not take into account the impact on the environment, and even disturbs the community. Meanwhile, there is no action by the district or local government to control or manage the impacts, so various efforts are needed to restore optimal health status for the surrounding community.

Abstract

Health services lead to health development which aims to achieve awareness, will, and the ability to live healthy for every resident in order to achieve optimal public health status as aspired to in Law Number 36 of 2009 concerning Health. In terms of optimal health services, it is certainly expected to create professional health workers in carrying out their profession, especially dentists. However, in carrying out medical practice, it is possible for a dentist to commit medical crimes that have an impact on the patient's health. Where medical negligence that results in disruption of patient health can result in disruption of medical health between doctors and patients. But not infrequently in terms of legal protection and in solving medical problems there are significant obstacles to solving legal problems. So to answer this problem, it is necessary to know the form of patient legal protection for the existence of medical justice by dentists and how to settle medical settlements between patients and their families and doctors based on the provisions in force in health law. The research method used is descriptive normative research. The results of the study revealed First, that legal protection for patients due to dentist negligence has been specifically accommodated in several laws related to health, but this legal protection has not run optimally because there are still massive obstacles originating from the legal substance of the legal structure and legal culture. who have not been able. Second, the causes for the medical settlement are qualified into three things, namely due to the absence of medical negligence, medical failure and medical malpractice, then in terms of the settlement of medical settlements it has not run optimally either through non-litigation or litigation, therefore the need for a Medical Dispute Settlement Court (PSSM) which specifically resolves cases related to health law in Indonesia.

Abstract

Topik baru di dalam ilmu kesehatan Indonesia melahirkan pertanyaan terhadap kedudukan rumah sakit untuk bertanggungjawab secara pidana terhadap penerapan sistem patient safety dalam menyelenggarakan asuhan keperawatan. Patient safety atau dikenal dengan keselamatan pasien menjadi topik penting dalam menghindari bahaya atau kemungkinan cedera pada pasien selama masa rawatan inap di rumah sakit. Rumah sakit sebagai korporasi bertanggungjawab atas kelalaian yang dilakukan oleh stafnya berdasarkan hubungan kerja yang terjalin di antara keduanya. Saat ini, dalam menetepkan tanggung jawab pidana rumah sakit dilakukan dengan melakukan proses penemuan hukum berdasarkan ketentuan Undang-Undang Kesehatan, Undang-Undang Rumah Sakit, Kitab Undang-Undang Hukum Pidana dan kebijakan hukum lainnya yang memiliki relevansi. Dalam penerapannya, patient safety sudah diatur secara hukum dalam Peraturan Menteri Kesehatan Republik Indonesia 1691/VIII/2011 tentang Keselamatan Pasien yang diperbaharui dalam Peraturan Menteri Kesehatan Nomor 11 Tahun 2017 tentang Keselamatan Pasien. Perawat dalam melaksanakan praktik keperawatannya dilakuaan dengan pemberian asuhan keperawatan yang telah diatur dalam Undang-Undang Keperawatan.

Abstract

One of human rights guaranteed and protected in the 1945 Constitution is the right to live and maintain life, stated in Article 28 A of the 1945 Constitution. The right to live and maintain life is the highest right that is inherent in human beings as the subject of law since humans were born to death in the world. The right to live and maintain life is not only inherent in human beings who have been born, but also in humans or children who are still in the womb, stated in Article II of the Civil Code that "Children are considered to have been born when interest is desired. However, in fact the guarantee and protection of the right to live and maintain life has been neglected in line with the legalization of abortion against victims of rape crimes stated in Law Number 36 Year 2009 concerning health. The legalization of abortion against victims of rape crimes certainly has drawn polemics in various circles, namely between pro life and pro choice groups.

Abstract

This research aims to see the effectiveness of the E-Berpadu system which was launched by the Supreme Court through Perma Number 4 of 2020 and refined with Perma 8 of 2022. The E-Berpadu system is an application used to simplify processes in the criminal justice system. This application emerged as an initiative during the Covid-19 pandemic where everyone was encouraged to carry out activities from home. This is why this application with the E-Berpadu system is here to make things easier for the public and law enforcement officers in the criminal justice system. This research uses a normative juridical legal approach with analytical descriptive methods. The results of this research are that through the E-Berpadu system, it has provided convenience to the public and law enforcement officers in the criminal justice system. The E-Berpadu system makes it easy for law enforcement officers to access it only through their respective offices via the application.

Abstract

This research aims to examine and analyze the application of the principles of restorative justice to judges' considerations in decisions to release all legal claims (case study decision number:28/Pid.B/2022/PN.LBB). This research uses the method normative juridical, while the approach used in this research is a statutory approach , then the data is analyzed using qualitative descriptive research analysis methods. The results of this research are : 1) Application of restorative justice in Decision No.28/Pid.B/2022/PN.Lbb, where the judge handed down a decision to release all legal charges against Defendant Dedi on charges of theft. 2) In terms of implementing the principles of Restorative Justice This is an obstacle to the implementation of restorative justice, including in very serious violations, the difficulty in creating public trust in the implementation of restorative justice in serious cases. Apart from that, the reasons for recidivist actions by perpetrators after undergoing a restorative justice process raise questions from the public if they have to repeat the process several times against the same perpetrator.

Abstract

This research was motivated by a mother from Panpajung Village, Modung, Bangkalan, Madura, East Java, reporting a midwife to the police on suspicion of malpractice. The mother lost the baby she was carrying after the baby's head was left in the womb during the birth process at the health center. The explanation of this case is interesting for the author to discuss who should be responsible for it all, and what criminal responsibility is like regarding the occurrence of patient safety incidents at a community health center resulting in the baby's head being left in the mother's womb before birth in the perspective of health law in Indonesia. The death that occurred to the baby is of course the subject of our collective evaluation, while remaining in favor of the aim of criminal law to provide protection against crimes against a person's body and life, and the death that occurred to the baby, of course, is contrary to the mandate of Law no. 39 of 1999 concerning Human Rights regarding: The Right to Life, and the Right to Defend Life, and also contradicts the aim of health law to reduce suffering, prolong life, and accompany patients until the end of their lives.

Abstract

Pemalsuan surat adalah kejahatan yang dapat merugikan pihak-pihak terkait, baik secara langsung maupun tidak langsung. Dalam penelitian ini, kasus yang dibahas adalah Putusan Pengadilan Negeri Padang Nomor 196/Pid.B/2020/PN.Pdg, di mana terdakwa memalsukan tanda tangan dalam dokumen persetujuan kaum untuk memperoleh Sertifikat Hak Milik atas tanah. Kejahatan ini terjadi akibat lemahnya pengawasan dan verifikasi dokumen serta adanya motivasi untuk memperoleh keuntungan secara ilegal. Penelitian ini berfokus pada dua rumusan masalah, yaitu pertama, jenis kesalahan yang dilakukan terdakwa dalam pemalsuan surat tersebut, dan kedua, dasar pertimbangan hakim dalam menentukan unsur pertanggungjawaban pidana pada kasus ini. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan deskriptif kualitatif. Hasil penelitian menunjukkan bahwa terdakwa melakukan kesalahan dengan sengaja memalsukan tanda tangan untuk memperoleh keuntungan pribadi berupa kepemilikan tanah. Sementara itu, hakim dalam putusan tersebut menyatakan terdakwa tidak bersalah, walaupun terdapat bukti yang cukup untuk menunjukkan bahwa unsur-unsur tindak pidana telah terpenuhi. Keputusan ini memperlihatkan kurang cermatnya hakim dalam mempertimbangkan bukti yang ada, meskipun seharusnya bukti yang kuat mendukung adanya pertanggungjawaban pidana dalam kasus ini. Pembuktian dan keyakinan hakim merupakan aspek penting untuk menentukan bersalah atau tidaknya terdakwa dalam suatu tindak pidana.

Abstract

The object of this writing is based on the present, very often occurs among doctors, and or health workers proven to have made a mistake, and or medical negligence. Medical errors and or negligence can result in disability, and death of a patient. Disability and death of a patient cause thinking among doctors and/or health workers, it is considered that they have committed an alleged crime that endangers the safety of the body and life of a patient, so that doctors and/or health workers feel that they have been criminalized by certain parties. This criminalization is of course very confusing, considering that in fact in This criminal law perspective certainly cannot be said to be criminalization, in fact it can be said to be a form of criminal responsibility.
