Abstract

Penggunaan pestisida kimia di Indonesia telah memusnahkan 55% jenis hama dan 72 % agens pengendali hayati. Oleh karena itu diperlukan pengganti, yaitu pestisida yang ramah lingkungan. Satu alternatif pilihan adalah penggunaan pestisida hayati yang berasal dari tumbuhan. Pestisida nabati adalah salah satu pestisida yang bahan dasarnya berasal dari tumbuhan. Salah satu tumbuhan yang digunakan sebagai pestisida nabati adalah tanaman kemangi. Kemangi merupakan sejenis tumbuhan yang banyak digunakan dalam masakan terutamanya masakan Indonesia. Daun kemangi mengandung minyak atsiri dengan bahan aktif eugenol dan sineol yang mempunyai potensi sebagai larvasida dan hormon juvenil yang menghambat perkembangan larva nyamuk (Anopheles aconitus). Minyak kemangi berfungsi sebagai larvasida dengan cara kerja sebagai racun kontak (contact poison) melalui permukaan tubuh larva karena fenol (eugenol) mudah terserap melalui kulit Kata Kunci: Kemangi, Pestisida Nabati.

Abstract

This empirical law research is aimed at embodying the capacity-based policy to the difable. The instrument for data’s collection was conducted by structured interview and observation which were supported by literature data. Capacity-based Approach is a model that recognizes disability based on the value of ability and function. This approach provides a framework for learning disability, particularly analyzing the defects of existing paradigms and assessing economic sources along with the disability consequences. The key point of operational level on Capacity-based Approach to the empowerment of the disable in poverty prevention includes four points: Inclusion, Participation, Access, and Quality. This study suggests a holistic approach to reform the policy to empower the disable to be free from poverty.  Key words: embodying, difable, poverty alleviation

Abstract

The primary objective of this study is to provide a comprehensive description of the role and position of the Medical EthicsCouncil of Indonesia (MKDKI) in facilitating the equitable resolution of medical disputes within the Indonesian context. Thepresent study constitutes a normative legal research. The research findings indicate that the resolution of medical disputes shouldbe channelled through MKDKI, as it possesses the necessary expertise in the application of professional discipline within themedical field. Furthermore, MKDKI is an authoritative institution responsible for determining whether a doctor has violatedprofessional disciplinary standards. The term "can" as stipulated in Article 66 paragraph (1) of Law Number 29 of 2004regarding Medical Practise encompasses the possibility of either initiating a complaint against MKDKI or refraining fromdoing so. Legal confusion may occur, thus necessitating the replacement of the word "can" with "must." This implies thatcomplaints regarding medical issues must be resolved through MKDKI as a mandatory step. It is imperative to conduct ajudicial review of Article 66, paragraph (1) of Law Number 29 of 2004 pertaining to Medical Practise. Additionally, it isessential to deliberate on the authority of the Medical Council of Indonesia (MKDKI) in determining compensation for disputingparties. In order to ensure legal clarity for both medical practitioners and the general public, it is imperative that every decisionmade by the MKDKI (Medical Knowledge and Decision-making Institute) is carefully considered.Keywords: Medical Disputes; MKDKI; Doctors

Abstract

This research aims to analyze health policies related to excise on sugary drinks and packaging labeling regulations, with a focus on public health implications in Indonesia. Normative research method to analyze Consumer Protection Laws and regulations from other countries that have implemented excise taxes on sweet drinks in an effort to reduce excessive sugar consumption. Supporting data from other countries includes the implementation of excise tax on sugary drinks, its impact on people's consumption patterns, and evaluation results related to reducing the prevalence of diabetes. This research uses a comparative approach to evaluate the effectiveness of sugary drink excise policies and labeling regulations on product packaging in reducing sugar consumption in various country contexts. Countries that implement excise taxes on sweet, high-calorie drinks have succeeded in reducing the prevalence of diabetes by influencing consumer behavior to choose products with lower sugar content. Countries that have implemented excise taxes on sweet, high-calorie drinks generally have a significant positive impact on reducing the prevalence of diabetes in society because they influence people's purchasing behavior to prefer healthier foodstuffs (lower sugar content). Therefore, legal reconstruction is needed regarding the application of excise and labeling regulations on product packaging regarding sugar content information with certain classifications for sweet drinks in order to reduce the prevalence of diabetes in Indonesia. It is hoped that the results of this research will provide insight to the Indonesian government in developing effective strategies to reduce the prevalence of sugar-related diseases and improve overall public health.

Abstract

As the times develop, the more complex the problems faced, one of which is problems related to the family, namely domestic violence (KDRT). The emergence of violence results in victims who must be protected, both physically and psychologically. The protection provided to victims of domestic violence is legal protection and health protection. Health social security for victims is an important factor needed by victims of violence, legal protection for victims is no less important considering that until now there are still not many victims who report acts of domestic violence that have befallen them. Based on the description above, it becomes an interesting problem which is outlined in the formulation of the problem as follows: 1) Cases of violence and influencing factors; 2) Principles of health insurance protection for victims of domestic violence; 3) Legal protection efforts for children and women as victims of domestic violence. Thus, the focus of this research is how the urgency of regulation on the protection of victims of criminal acts in obtaining social health insurance. This research is a normative-empirical legal research (applied law research) that uses case studies in the form of legal behavior products. This research is a normative legal research that is perspective analysis with a statutory approach. The result of this research is the importance of social health insurance and legal protection for victims of domestic violence.

Abstract

This paper explores the relationship among freedom of expression and earth-friendly governance in a global context, highlighting how the former serves as a fundamental enabler of transparency, public participation, and access to data—principles that are vital to effective earth-friendly governance. Although international legal instruments, such as the Rio Declaration and the International Covenant on Civil and Political Rights, give a framework for upholding free speech, the extent to that this right is realized in the realm of earth-friendly advocacy remains inconsistent across different regions. This research highlights challenges faced by earth-friendly activists, including political and economic pressures, suppression, and legal constraints. By analyzing case studies by Indonesia, Norway, and Brazil, this paper underscores the paradox of freedom of expression that is sometimes perceived as a threat to political stability. The findings advocate for enhanced global cooperation to protect freedom of expression inside earth-friendly law, supporting sustainable enhancement and earth-friendly justice. This paper contributes to a deeper understanding of the legal frameworks necessary to uphold freedom of expression as foundational in promoting global earth-friendly democracy.

Abstract

The rise of Free Trade Zones (FTZs) led by China marks a significant trend in the global economy. This study explores the legal validity of novel policies within Chinese FTZs; how legitimate are these policies? It assesses how FTZ policies align with national and global trade regulations by analyzing legislative frameworks, policy documents, and international treaties. Results show that China's legal advancements in FTZs, which feature regulatory streamlining and improved foreign investment practices, generally align with global standards but sometimes conflict with domestic regulations. These advancements are bolstered by targeted economic legislation designed to stimulate growth and test reforms for possible nationwide implementation. Furthermore, the study highlights FTZs as hubs for international trade and arenas for economic experimentation. The conclusion offers policy suggestions to strengthen the legal basis and global alignment of FTZ innovations, ensuring they effectively contribute to economic development.

Abstract

Blasphemy is a sensitive and complex issue in Indonesia, the largest Muslim-majority country in the world. This article examines the regulation of blasphemy, which often clashes with Indonesia's social, cultural, and political dynamics. It evaluates the reconstruction of blasphemy laws through the lens of maqāṣid al-‘uqūbāt in Islamic law. The study concludes that reconstructing the blasphemy law is necessary as part of legal reform that aligns with Indonesia's constitutional principles of the rule of law and democracy. This reconstruction should integrate Islamic legal principles based on maqāṣid al-‘uqūbāt in several key areas, including defining the legal subjects of blasphemy, providing clarification as part of the resolution process by considering shubhāt and al-dan ta'wīl, and developing mechanisms for resolving blasphemy cases. The urgency for reform arises from several critical factors: the ambiguous formulation of blasphemy norms, which significantly impacts court decisions; the absence of consistent justice-based law enforcement mechanisms; disparate treatment toward certain groups; and the tendency to generalize blasphemy cases as criminal acts due to a lack of alternative measures. These issues reflect legal uncertainty and the potential misuse of blasphemy laws for political purposes.AbstrakPenistaan agama merupakan isu yang sensitif dan kompleks di Indonesia, negara berpenduduk mayoritas Muslim terbesar di dunia. Artikel ini mengkaji pengaturan penodaan agama yang sering kali berbenturan dengan dinamika sosial, budaya, dan politik di Indonesia. Artikel ini mengevaluasi rekonstruksi hukum penodaan agama melalui lensa maqāṣid al-'uqūbāt dalam hukum Islam. Penelitian ini menyimpulkan bahwa rekonstruksi undang-undang penodaan agama diperlukan sebagai bagian dari reformasi hukum yang selaras dengan prinsip-prinsip konstitusional Indonesia tentang negara hukum dan demokrasi. Rekonstruksi ini harus mengintegrasikan prinsip-prinsip hukum Islam berdasarkan maqāṣid al-'uqūbāt di beberapa bidang utama, termasuk mendefinisikan subjek hukum penodaan agama, memberikan klarifikasi sebagai bagian dari proses penyelesaian dengan mempertimbangkan syubhat dan al-ta'wīl, dan mengembangkan mekanisme penyelesaian kasus penodaan agama. Urgensi reformasi muncul dari beberapa faktor kritis: rumusan norma penodaan agama yang ambigu, yang secara signifikan berdampak pada putusan pengadilan; ketiadaan mekanisme penegakan hukum yang berbasis keadilan yang konsisten; perlakuan yang tidak adil terhadap kelompok-kelompok tertentu; dan kecenderungan untuk menggeneralisasi kasus-kasus penodaan agama sebagai tindakan kriminal karena kurangnya upaya-upaya alternatif. Isu-isu ini mencerminkan ketidakpastian hukum dan potensi penyalahgunaan undang-undang penodaan agama untuk tujuan politik.

Abstract

"Land Information Letter" once played an important role in land registration, but their issuance often caused problems such as overlapping and lack of understanding by village heads regarding the legal basis for their issuance. The government continues to strive to improve the land registration system, one of which is by revising Government Regulation Number 24 of 1997 to Government Regulation Number 18 of 2021.This research is a Doctrinal/normative research that adopts a statutory approach to analyze Land Information Letter. The data used are secondary data in the form of primary legal materials, secondary legal materials, and non-legal materials. Based on an in-depth analysis of the position of the “Land Information Letter” as proof of land ownership in the context of land registration in Indonesia, it can be concluded that the “Land Information Letter” does not provide a strong guarantee of legal certainty regarding land ownership. Government Regulation Number 18 of 2021, which changes the function of the “Land Certificate” to merely instructions in the land registration process, is expected to encourage the public to immediately take care of land registration and obtain stronger land title certificates. However, the implementation of this regulation needs to be carried out carefully and pay attention to the rights of vulnerable communities, as well as ensuring that they get sufficient understanding and information regarding changes in land registration regulations.

Abstract

The seizure of assets resulting from criminal acts will be easier for law enforcement officials to carry out if the Draft Law on Asset Forfeiture is passed. Assets that are seized are not only related to corruption crimes but also general crimes that carry a prison sentence of 4 years or more. The amount of assets seized is also at least IDR 100 million. This paper will explore the urgency of the Asset Forfeiture Bill in terms of the politics of legislation and then be limited to discussions on the direction of law enforcement that is considered responsive, especially regarding institutions that have authority in implementing the law. This paper is a type of doctrinal research that the data collection technique used is a literature technique, while the analysis in this study is after all legal materials are collected both from primary legal materials and secondary legal materials then clarified. Without strong watchdog institutions, impunity becomes the very foundation upon which systems of corruption are built. And if impunity is not demolished, all efforts to bring an end to corruption are in vain. Integrity, transparency, and the fight against corruption have to be part of the culture.
