Abstract

In Carrying out his position, a Notary has the potential to be involved in legal cases, including criminal law cases, which result in him having to be examined by investigators, public prosecutors and judges. Based on Article 66 paragraph (1) of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the position of Notary, the examination of a Notary is carried out with the approval of the Notary honorary council. Basically this approval is necessary because to protect the Notary from breaches of disclosing the secret of the deed and to protect the Notary’s own deed so that it remains confidential. To review and analyze this research, the authors used the statutory approach and the conceptual approach. The results of the study show that the rules for summoning a Notary by an investigator are related to a Notary deed that has an indication of a criminal act regulated in Article 66 paragraph (1) of Law Number 2 of 2014 and Permenkumham Number 17 of 2021. Notary summons by an investigator must have the approval of the assembly honorary regional Notary. The procedures are: First, the investigator submits a letter of request for summons of a Notary to the regional Notary honorary council; Second, the regional Notary honorary council forms the examining council; Third, the examining council conducts an examination of the Notary; Fourth, the examining council submits a report to the head of the regional Notary honorary council; Fifth, the regional Notary honorary council provides answers regarding giving approval or refusing. Notaries in providing legal services to the public need to get legal protection and guarantees from the state, in this case through the regional Notary honorary council. The legal protection in question is that investigators may not immediately summon or examine a Notary, without prior approval from the regional Notary honorary council. If the investigator commits the violation, then the investigator’s actions can be categorized as an act that violates the law, so that the summons or examination carried out by the investigator has been procedurally flawed.

Abstract

The pattern of medical rehabilitation carried out by countries that legalize the use of medical marijuana, and the process of healing users from narcotic dependence varies, so various strategies and therapies for marijuana use are needed in various countries with emphasis on several indicators, such as: religion, form, and/or the basis of a country, what legal system is adopted by a country, what institutions exist in a country, which really focuses on the values ​​that live and grow in that country, which are feared will affect the aspects of national and state life , undermines the stability of the nation's economy, which of course affects a country's efforts to realize the welfare elements of a country, one of which can be obtained through legal development in general, as well as health development in particular.

Abstract

Cases of distribution of goods, especially illegal cigarettes, which are rife in Limapuluh Kota Regency, must be a serious concern. A very significant spike was found in cases resulting from prosecution during the 2019 to 2020 period where the number of illegal cigarettes of various brands destroyed was 4,180,352 (four million one hundred eighty thousand three hundred and fifty two) cigarettes. This research is legal research with descriptive analytical research specifications. The approach used is a normative juridical approach, supported by an empirical juridical approach. The data used is secondary data as main data and primary data as supporting data, which was collected through literature study/document study and field study using interview techniques. The data was then analyzed qualitatively and presented in analytical descriptive form. Based on the results of research, discussion and analysis, the following conclusions can be drawn: First, law enforcement at the level of investigating criminal acts of distribution of illegal cigarettes at the Fifty Cities Police Criminal Investigation Unit by applying the provisions of Article 199 in conjunction with Article 114 of Law Number 36 of 2009 concerning Health in conjunction with Article 62 Paragraph ( 1) Juncto Article 8 Paragraph (1) Letter I of Law Number 8 of 1999 concerning consumer protection Juncto Article 55, Article 56 of the Criminal Code. Second, the obstacles faced by the Limapuluh Kota Resort Police Criminal Investigation Unit in enforcing the law against the criminal act of distributing illegal cigarettes are the lack of personnel, lack of community role and the difficulty of finding illegal cigarette distributors. Third, the efforts made by the Limapuluh Kota Resort Police Criminal Investigation Unit in enforcing the law against the criminal act of distributing illegal cigarettes are by conducting examinations of health experts, conducting examinations of criminal experts and conducting examinations of witnesses of PT Leadon Tobacco, which is a factory that produces Luffman brand cigarettes.

Abstract

Sextortion as part of Cyber Gender-Based Violence (KBGS) is a cybercrime that often occurs today. Sextortion is carried out by extorting or exploiting the victim materially or sexually by utilizing the victim's pornographic content. Prior to the promulgation of Law Number 12 of 2022 concerning Crimes of Sexual Violence (TPKS Law) on May 9 2022, the crime of sextortion was regulated separately and spread across several laws and regulations, where these regulations still had juridical weaknesses which led to overcoming sextortion crimes in Indonesia are not sufficient. This study discusses the form of sextortion arrangements in Indonesian criminal law. This research uses normative research methods with statutory and case approaches, with secondary data sources. The results of this study concluded that the forms of regulation of sextortion in Indonesian criminal law consist of criminal acts of decency, criminal acts of extortion, criminal acts of threats, criminal acts against the independence of others, criminal acts of pornography, and criminal acts of electronic-based sexual violence (KSBE). The existence of the TPKS Law has regulated formulations of sextortion crimes that are better and more comprehensive than formulations in the Criminal Code, the Pornography Law, and the ITE Law. The implementation of the TPKS Law is expected to be able to realize the prevention of sextortion crimes that reflect the values of justice and legal certainty.

Abstract

Nowadays, social media users are faced with the rise of cyber-phishing, which is carried out using various modes of deception that are troubling. This cybercrime mode causes material and immaterial losses. This crime has been regulated in the Electronic Information and Transaction Law Number 11 of 2008, Article 35 jo. Article 51 paragraph (1) carries a maximum threat of 12 years in prison. One of the cases that has been decided and permanent legal force is Decision Number: 155/Pid.Sus/2018/PN-Cbn. This research will answer the problem of how to analyse the judge's considerations in adjudicating cases of phishing on social media in Decision Number 155/Pid.Sus/2018/PN-Cbn and how to apply criminal sanctions based on the a quo decision. This study uses case approach and statutory approach with juridical-normative research method. Based on the research, juridically, the judge in making a decision only focuses on the demands of the prosecutor and does not consider concurrent criminal acts committed by the defendant, for which the judge can provide a weighting punishment based on Article 65 paragraph (2) of the Criminal Code. Because the statement of the accused is also an important juridical aspect to be considered by the judge in imposing a verdict. This is what makes the punishment given low—only eight months in prison. Then, the application of relatively mild criminal sanctions has not been able to fulfil the goals of punishment and a sense of justice, so it will have an impact on the ineffectiveness of punishment.

Abstract

The norms of judge's consideration are regulated juridically in Article 183 of the Criminal Procedure Code, which states that a judge, when imposing a crime on a defendant, may not impose the crime unless there are at least two valid pieces of evidence, so that the judge has confidence that a crime actually occurred and the defendant is guilty of doing it. The case that often occurs is child molestation as regulated in Article 81 of Law Number 35 of 2014 concerning Child Protection. The purpose of legal regulations regarding child molestation is to protect child victims from perpetrators of these crimes. In its application, discrepancies were found between written legal rules and those applied by judges. Another case of child molestation that occurred and that the author examined was in Payakumbuh, case number 120/Pid.Sus/2022/PN. This is quite unfortunate with the existence of SEMA Number 1 of 2017, because ultimately it is not SEMA that clarifies or provides guidance to Judges, but rather disrupts the legal order and tries to create new norms in the midst of existing norms. The conclusions (1) The judge's considerations from the "justice side" which are guided by SEMA Number 1 of 2017 according to the author have not paid attention to considerations of philosophical, juridical, sociological, educative, preventive, corrective and repressive aspects of imposing a crime below the special minimum for the crime of child molestation. . (2) It is realized that evidence in the form of the defendant's own confession does not always prove the truth. Confession sometimes does not guarantee that the defendant actually committed the act charged. Therefore, the Judge's own confidence is needed. The suggestions that the author makes are (1) Judges in making legal considerations are expected to be able to make them more comprehensively, especially in the case of SEMA Number 1 of 2017. (2) it is recommended that every member of the community take an active role in preventing and dealing with the problem of sexual abuse, such as Immediately report to the authorities if you see and find out.

Abstract

Artikel ini ingin menjawab bagaimana kepastian hukum dalam pelaksanaan perlindungan hukum terhadap anak sebagai korban tindak pidana pencabulan di Kota Padang. Dengan menggunakan metode yuridis sosiologis, penelitian ini menemukan bahwa keikutsertaan penyidik dalam proses memilih menentukan bentuk perlindungan dan dukungan keamanan anak korban tindak pidana pencabulan. Kendala yang dihadapi oleh penyidik dalam melaksanakan pemenuhan hak-hak anak sebagai korban tindak pidana pencabulan terbagi atas kendala internal dan eksternal. Secara internal, kurangnya sarana dan prasarana yang memadai dan tidak adanya laporan dari korban atau keluarga korban pencabulan. Upaya dalam mengatasi kendala adalah sosialisasi dan koordinasi sehingga tidak membutuhkan waktu yang lama dalam penanganan kasus tindak pidana pencabulan. Hal ini mengingat korban membutuhkan pertolongan segera karena mengalami penderitaan secara fisik dan mental. Legal Protection on Children as Victims  of Sexual Abuse This article wants to answer how legal certainty in implementing legal protection for children as victims of sexual abuse in the city of Padang. By using a sociological juridical method, this study found that the participation of investigators in the process determines the form of protection and security support for children victims of sexual abuse. Constraints faced by investigators in carrying out the fulfillment of children's rights as victims of sexual abuse are divided into internal and external constraints. Internally, the lack of adequate facilities and infrastructure and the absence of reports from victims or families. Efforts to overcome obstacles are socialization and coordination so it does not require a long time in handling sexual abuse cases. This is because the victims need immediate help because they suffer physically and mentally.

Abstract

Pencemaran nama baik merupakan salah satu tindak pidana yang termasuk ke dalam kualifikasi penghinaan. Pencemaran nama baik diatur dalam Pasal 310 Kitab Undang-Undang Hukum Pidana dan dalam Pasal 27 Ayat (3) Undang-Undang Informasi dan Transaksi Elektronik. Tujuan dari adanya aturan hukum tentang pencemaran nama baik ini adalah untuk melindungi harkat dan martabat setiap orang, khususnya mengenai harga diri kehormatan (eer) maupun nama baik (goeden naam) seseorang. Namun dalam penerapannya ditemukan adanya ketidaksesuaian antara aturan hukum pencemaran nama baik yang tertulis dengan apa yang diterapkan oleh hakim selaku aparat penegak hukum. Rumusan masalah yang dibahas dalam penelitian ini ialah menganalisis (1) Pengaturan tindak pidana pencemaran nama baik dalam Kitab Undang-Undang Hukum Pidana dan Pasal 27 Ayat (3) Undang-Undang Informasi dan Transaksi Elektronik (2) Analisis pertimbangan hakim dalam putusan nomor 1909K/Pid.Sus/2021 tentang pencemaran nama baik dikaitkan dengan Surat Keputusan Bersama Pedoman Implementasi Undang-Undang ITE. Metode penelitian yang digunakan adalah penelitian normatif, yaitu penelitian yang bertumpu pada sumber data sekunder sebagai data rujukan utama. Hasil yang diperoleh dari penelitian didapatkan kesimpulan (1) Pengaturan mengenai tindak pidana pencemaran nama baik diatur dalam Pasal 27 ayat (3) Undang-Undang Informasi dan Transaksi Elektronik. Untuk menentukan telah dipenuhinya unsur pencemaran nama baik dalam Undang-Undang ITE harus merujuk pada Pasal 310 KUHP. (2) Dari putusan nomor 1909K/Pid.Sus/2021 yang penulis teliti, maka dapat dianalisis bahwa putusan hakim dalam perkara tersebut telah menyimpangi beberapa poin pedoman implementasi Pasal 27 ayat (3) Undang-Undang ITE sebagaimana yang dimuat dalam Surat Keputusan Bersama Pedoman Implementasi Undang-Undang ITE, tepatnya poin (j) dan (k). Padahal Surat Keputusan Bersama Undang-Undang ITE dikeluarkan pemerintah untuk menjadi pedoman dalam penerapan Pasal 27 ayat (3) UU ITE yang bertujuan menciptakan kepastian hukum.

Abstract

Melindungi keselamatan jiwa raga, harta benda, masyarakat dan lingkungan dari gangguan ketertiban merupakan tugas dan kewajiban Kepolisian sebagaimana diatur dalam Pasal 14 Undang-undang Nomor 2 Tahun 2002 tentang Kepolisian Negara Republik Indonesia. Termasuk menanggulangi terjadinya tindak pidana yang terjadi di tengah masyarakat. Salah satunya tindak pidana yang dilakukan oleh anak terhadap orang atau barang secara bersama-sama, yang marak terjadi akibat aksi tawuran di wilayah hukum Polsek Pauh Kota Padang. Peristiwa pidana tersebut membutuhkan penanganan serius, sebab tindak pidana tersebut berujung merugikan masyarakat sekitar lokasi terjadinya aksi kekerasan yang dilakukan secara bersama-sama. Tidak hanya mengakibatkan luka pada korban juga perbuatan tersebut sangat meresahkan masyarakat, sehingga diperlukan strategi penanggulangannya.

Abstract

Pemilu adalah sarana kedaulatan rakyat untuk memilih wakil-wakilnya yang dilaksanakan secara luber dan jurdil. Namun dalam pelaksanannya tidak jarang terjadi pelanggaran. Oleh karenanya hukum pidana memegang peranan penting sebagai instrumen dalam mengawal pemilihan umum yang jujur dan adil. Dengan menggunakan pendekatan pidana, diharapkan berbagai pelanggaran yang dilakukan dapat ditindak guna memastikan proses pemilu berjalan secara fair. Meskipun demikian, dalam pengaturan dan pelaksanaannya, hukum pidana penyelenggaraan pemilu belum terasa efektif. Salah satunya adalah proses hukum tindak pidana pemilu hanya dibatasi sampai tingkat banding. Pembatasan tersebut telah menimbulkan ketidakpastian hukum dan ketidakadilan hukum di tengah masyarakat. Perumusan masalah dalam penelitian 1. Bagaimana pengajuan upaya hukum banding terhadap putusan bebas perkara tindak pidana pemilu berdasarkan Undang-Undang Nomor 7 Tahun 2017 tentang Pemilu di Kota Solok tahun 2019? 2. Mengapa upaya hukum kasasi dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilu tidak diperbolehkan dalam mensikapi putusan bebas perkara tindak pidana pemilu? Metode dalam penelitian ini menggunakan pendekatan yuridis empiris dan bersifat deskriptif. Data utama dalam penelitian ini adalah data primer dengan menggunakan metode wawancara dan pengumpulan data di Kejaksaan Negeri Solok. Data sekunder diperoleh meliputi Undang-Undang, putusan hakim serta didukung oleh berbagai literatur seperti buku, jurnal akademik, laporan penelitian, dan artikel ilmiah lainnya. Kesimpulan dari penelitian menyatakan bahwa pengajuan upaya hukum banding terhadap putusan bebas perkara tindak pidana pemilu telah bertentangan dengan ketentuan pasal 67 KUHAP dan Putusan Mahkamah Konstitusi Nomor: 114/PUU-X/2012 dan telah menimbulkan multitafsir dan ketidakpastian hukum dalam penerapannya. Alasan upaya hukum kasasi tidak ada dalam perkara tindak pidana pemilu adalah karena pembuat undang-undang menilai proses penyelesaian perkara kasasi di Mahkamah Agung memakan waktu lama sehingga dikhawatirkan akan mengganggu agenda ketatanegaraan yang potensial dapat mengancam ketertiban kehidupan berbangsa dan bernegara. Untuk itu perlu agar dilakukan revisi terhadap Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum khususnya pasal 482 ayat (5) mengenai pembatasan upaya hukum. Selanjutnya melakukan perubahan sistem di Mahkamah Agung sehingga proses kasasi perkara pemilu dapat selesai dalam jangka waktu 1 (satu) bulan.
