Abstract

Foreign direct investment plays a critical role in a host country's economic development. Tourism, with its distinct character as a service business, is one of the most appealing investment industries. It has made a substantial contribution to the creation of jobs, tax revenue, and domestic value-added. The existence of domestic laws and regulations is critical in determining the extent to which a country's performance in getting benefits from investment can be maximized while reducing the negative impact. This article is aimed to examine whether the newly-enacted Job Creation Law provides a better arrangement on foreign direct investment in tourism compared to the previous laws and regulations. This article employs a normative approach by analyzing relevant laws and regulations concerning foreign direct investment in tourism in Indonesia. By looking at aspects on the choice of business fields, the issuance of business permit, land ownership, and labour, this article contends that Job Creation Law fails to provide integrated and comprehensive arrangements on the existence of foreign direct investment in tourism.

Abstract

This study examines the legal position of a notary deed in the transfer of intellectual property and the role of a notary in making a deed of agreement regarding the transfer of intellectual property. This article used normative legal research with statutory and conceptual approaches. The legal materials used are primary and secondary legal materials. Techniques for collecting legal materials using legal literature studies. The legal material analysis technique used in this research is to use descriptive and argumentative techniques. The results of the research show that the position of a notarial deed in various laws and regulations in the field of Intellectual Property states that in the transfer of Plant Variety and Patent Protection is required to be made before a notary. The role of a notary is very important in the process of transferring intellectual property, who has the authority to make an authentic deed as written proof of the transfer of intellectual property rights and has the authority to provide legal counseling to provide a correct understanding of laws and regulations in the field of intellectual property.

Abstract

Pratama clinic is a facility that provides limited medical services carried out by a doctor or dentist with technical responsibility. This research uses a type of normative legal research, namely deductively starting with an analysis of articles in statutory regulations and their relationship to their application in practice. The results of this research are that currently, the regulatory framework relating to medical aesthetics in Indonesia does not have formal regulations. Regulations regarding medical aesthetics refer to several regulations regarding related medical services and can be used as a legal basis for medical aesthetics. Legal protection for aesthetic doctors operating in beauty clinics is currently regulated by Law Number 29 of 2004 concerning Medical Practice. This law provides legal protection for doctors who comply with professional standards and standard operational processes when practicing.

Abstract

The purpose of this study is to examine the abuse of authority committed by the State Civil Apparatus (ASN) and state officials who hold administrator positions in government, as well as to find out their accountability based on Law Number 5 of 2014 which regulates the State Civil Apparatus (ASN). This research uses normative legal research methods with a qualitative descriptive approach. Data is obtained through analysis of primary legal materials, such as Law Number 5 of 2014, and secondary legal materials, such as related literature and journal articles. The results show that abuse of authority can occur in various forms, including actions that are contrary to personal or public interests. Law Number 5 of 2014 clearly regulates the accountability of ASN and state officials related to abuse of authority, by providing administrative sanctions and disciplinary action. In conclusion, protection of integrity and fairness in state administration is essential to prevent abuse of authority in the future.

Abstract

ASEAN documents have officially upheld the principle of unity in diversity and agreed on the spirit of one identity and community. However, there is a pronounced tendency for ASEAN countries to struggle with each other with several differences, including cultural tensions. This paper aims to analyse the possibility of recognising a regionally shared culture as jointly claimed collective cultural rights by taking the example of Intangible Cultural Heritage ICH. It is designed as legal research applying statutory, historical, conceptual, and comparative approaches. This research collects norms and principles covering the issues of ICH and cultural rights and conducts a literature study, suggesting that cultural rights, which represent the intersecting of cultural and human rights aspects, have yet to be fully understood as collective cultural rights. ICH is an example of how ASEAN countries are sometimes heated up in non-harmony relations. The possibility of recognising a regionally shared culture in the context of collective cultural rights then, more or less, relies on the ongoing development of the Narrative of ASEAN Identity, the routine convening of human rights dialogues, and the initiation of the ASEAN Cultural Heritage List. These findings are then expected to be considered by ASEAN policymakers. Dokumen-dokumen ASEAN mencatumkan iktikad untuk menjunjung tinggi prinsip persatuan dalam keberagaman dan menyepakati semangat satu identitas dan komunitas. Dalam kenyatannya, negara-negara anggota ASEAN justru bergelut dengan sejumlah persoalan antara negara yang satu dengan negara lainnya, termasuk mengenai ketegangan budaya. Artikel ini bertujuan untuk menganalisis kemungkinan mengakui budaya bersama secara regional sebagai hak budaya kolektif yang diklaim bersama dengan mengambil contoh warisan budaya tak benda (WBTB). Artikel ini dirancang sebagai penelitian hukum yang menggunakan pendekatan perundang-undangan, sejarah, konsep, dan perbandingan. Penelitian dilakukan dengan mengumpulkan norma-norma dan prinsip-prinsip yang mengatur isu WBTB dan hak budaya serta melakukan studi literatur. Artikel ini menyimpulkan bahwa hak budaya, yang mewakili persilangan antara aspek budaya dan hak asasi manusia (HAM), belum sepenuhnya dipahami sebagai hak budaya kolektif. WBTB menjadi contoh bagaimana negara-negara ASEAN terkadang berada dalam hubungan yang tidak harmonis antara satu dengan lainnya. Adapun kemungkinan untuk mengakui budaya bersama secara regional dalam konteks hak budaya kolektif dapat disandarkan pada pengembangan Narasi Identitas ASEAN, penyelenggaraan dialog HAM secara rutin, dan upaya pembentukan Daftar Warisan Budaya ASEAN. Temuan-temuan ini diharapkan dapat dipertimbangkan oleh para pengambil kebijakan di ASEAN.

Abstract

Indonesia was regarded to be the world's second-largest food loss and waste-producing country. Food waste contributes the most significant amount in Indonesia compared to other types of waste. This paper aims to discuss three legal issues. First, it identifies, in descriptive-normative means, the legal framework regulating food waste, which is the intersection of two legal regimes: 'the food management' and 'the waste and environmental management”. Second, it presents a comparative study by exploring the more advanced food waste legal frameworks, which take examples from Europe. The third objective is to recommend legal, institutional, and policy steps to mainstream food waste management in Indonesia. This paper suggests that statutory regulations have indicated an initial concern about food waste; however, they do not provide a strict mandatory obligation to relevant stakeholders. Indonesia may use Europe’s remarkable achievements as lessons learned in initiating a comprehensive legal framework for food waste in the future. This paper, therefore, proposes a Law on Sustainable Food System as an ius constituendum to figure out a comprehensive solution for combining food management and environmental sustainability needs. In terms of legislative drafting, an omnibus law seemed suitable for drafting such a law, which crosses different legal regimes, and the existing provisions are spread in various regulations.

Abstract

This study aims to analyze and examine the President's Veto Rights over draft laws submitted by the Timor Leste Parliament. In the administration of the Democratic Republic of Timor Leste, it is stated in Article 74 of the 2002 Constitution of the Democratic Republic of Timor Leste (RDTL) that the President of the Republic is the Head of State and the symbol of the guarantor of national independence and national unity as well as the smooth functioning of state institutions in a democratic manner. So that the power / authority of the state is held by the President. The research method used in this study is the normative legal research method, which examines and examines based on book reviews / literature reviews and law reviews. The results of the study show that based on Article 85 of the 2002 Constitution of the Democratic Republic of Timor Leste (RDTL) states that one of the authorities of the President of the Democratic Republic of Timor Leste is the veto right over Draft Laws. The veto right is the right to cancel decisions, provisions, draft regulations and laws, or resolutions. In order to improve and make effective the oversight function of the national parliament in fighting for the aspirations of the people of the Democratic Republic of Timor Leste to protect human rights, it is necessary to have limitations and criteria for the use of the President's veto power over draft laws.

Abstract

Indonesia is a country with a high level of disaster vulnerability, which has direct implications for the emergence of health crises. One important instrument in pre-disaster mitigation is the health crisis risk assessment. This study aims to analyze the regulations for health crisis risk assessments in the pre-disaster phase and formulate an ideal regulatory framework that provides legal certainty and protects human rights, particularly the right to health. The research method used is normative juridical, with a statutory and conceptual approach. The results indicate a disharmony between Minister of Health Regulation No. 75 of 2019, which requires annual risk assessments, and Head of the National Disaster Management Agency (BNPB) Regulation No. 02 of 2012, which stipulates a five-year risk assessment validity period. This disharmony has resulted in legal uncertainty and weak implementation of risk assessments at the community health center (Puskesmas) level. From a human rights perspective, this situation has the potential to hinder the fulfillment of the rights to health and the right to life. This study recommends the need for regulatory harmonization and the establishment of a risk assessment period that is adaptive, integrated, and human rights-based.
